June 6, 2017
MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, June 6, 2017, in the General District Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Motley
called the roll.

No citizens came forward to speak.
APPROVAL OF THE MINUTES
A motion was made by Mr. Stowe, seconded by Mr. Horne, and by a unanimous vote, the May 2, 2017, minutes were approved as presented.
CHAIRMAN’S REPORT
There was no Chairman’s report. THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately
7:03 p.m. Case 1, Lester A. Strode, R-17-018 – Mr. Motley opened the public hearing at 7:03 p.m. Mr. Shelton, Director of Code
Compliance, reported that Lester A. Strode had petitioned to rezone 14.84 acres, located on State Road 719/Lawless Creek Road in the Westover Election District from R-1, Residential Suburban Subdivision District to B-2, Business District,
General. Mr. Shelton also stated once the property is rezoned to B-2, all uses listed under Section 35-365 are a permitted use. Lester Strode was present to represent the petition. He stated he had no plans for construction of a plant on his property; he just wanted a place to park his equipment used in his paving company. He also stated he would like to place a
shed on the property in the future to serve as a cover for his equipment and place a power pole on this property for a security light. Annie Lee Osborne and Elmer Logan spoke in opposition to the petition. Their concerns included, but
were not limited to, the following: the road is too narrow and safety and noise issues. Mrs. Osborne presented the Board
members with a petition with 28 individuals opposed to the petition (eleven (11) of the individuals that signed the petition reside on Lawless Creek Road). Mr. Strode offered a rebuttal and stated he would be willing to leave 50–75 feet on the
residential side of his property with the original trees to serve as a sound barrier. He also stated the entrance and the exit to his property is clear. Mr. Motley closed the public hearing at 7:20 p.m. During the discussion, it was stated nothing has

changed, the Comprehensive Plan indicates this area is for future commercial development but it is currently residential, and there are safety concerns regarding the property. A motion was made by Mr. Haymore, seconded by Ms. Mease, to
recommend the Board of Supervisors deny the rezoning request. Motion passed by a 5 to 3 vote (Mr. Davis, Dr. Miller,
Mr. Arthur, Mr. Haymore and Ms. Mease voted for the motion; Mr. Stowe, Mr. Motley and Mr. Horne voted against the motion.).
Case 2, Otha Kermit Gibson & Lois P. Gibson, R-17-019 – Mr. Motley opened the public hearing at 7:31 p.m. Mr. Shelton, Director of Code Compliance, reported that Kermit and Lois Gibson had petitioned to rezone 1.28 acres, located
on State Road 41/Franklin Turnpike, in the Tunstall Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Mr. Shelton also stated once the property is rezoned to A-1, all uses listed under Section 35-
178 are a permitted use. Richard Armstrong with Armstrong Land Surveying was present to represent the petition. He
stated he had nothing to add except this is an odd-shaped parcel of land and Mr. Gibson wanted to square up the lot to make it more usable. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:32 p.m. During
the discussion it was stated this is consistent with the surrounding properties zoned A-1, Agricultural District. A motion was made by Mr. Stowe, seconded by Mr. Arthur, to recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously.
Case 3, Cable Holdco Exchange, III, LLC, R-17-020 – Mr. Motley opened the public hearing at 7:34 p.m. Mr. Shelton,
Director of Code Compliance, reported that Cable Holdco Exchange, III, LLC, had petitioned to rezone 2.08 acres,
located on State Road 634/Blue Ridge Drive, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Mr. Shelton also stated once the property is rezoned to B-2, all
uses listed under Section 35-365 are a permitted use. Keith Jones and James Jendrzejewski with Comcast were present to represent the petition. They stated all work will be done inside the fenced area. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:40 p.m. A motion was made by Mr. Arthur, seconded by Mr. Horne, to
recommend the Board of Supervisors grant the rezoning request. Motion passed unanimously.
This concludes the Rezoning cases.
Public Hearing – Proposed Revision to Pittsylvania County Code, Chapter 35, SEC. 35-179.SPECIAL USE
PERMITS of the Pittsylvania County Zoning Ordinance – Mr. Motley opened the public hearing at 7:41 p.m. Mr. Shelton, Director of Code Compliance, reported the proposed revision to Pittsylvania County Code, Chapter 35, SEC. 35-179.SPECIAL USE PERMITS of the Pittsylvania County Zoning Ordinance was discussed at the May 2, 2017,
meeting and was advertised in the Star Tribune on May 24 & 31, 2017. The proposed revision would include the addition of Temporary Uses – Rodeos. Mr. Shelton stated this use is not listed anywhere in the ordinance. Mr. Greg Sides,
Assistant County Administrator/Director of Planning, stated he and Mr. J. Vaden Hunt, County Attorney, felt this revision
was best. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:42 p.m. A motion was made by Mr. Arthur, seconded by Mr. Stowe, to recommend the Board of Supervisors approve the proposed revision to SEC.
35-179. SPECIAL USE PERMITS as advertised. Motion passed unanimously. OLD BUSINESS
There was no old business.
NEW BUSINESS
There was no new business. The meeting was adjourned at approximately 7:45 p.m.
