BZA Minutes 06122018PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING Tuesday, June 12, 2018 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, June 12, 2018, in the General District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at approximately 7:00 p.m. The Board observed a moment of silence. Mrs. Hayes called the roll. PRESENT Kenneth Talbott R. Allan Easley Leon Griffith Helen Glass Joseph “Jay” Craddock Carroll Yeaman Karen N. Hayes Greg Sides ABSENT Ronald Merricks APPROVAL OF THE AGENDA Upon motion of Mr. Easley, seconded by Mrs. Glass, and by a 6 to 0 vote (one member, Mr. Merricks, was absent), the agenda was approved as presented. APPROVAL OF THE MINUTES Upon motion of Mr. Easley, seconded by Mrs. Glass, and by a 6 to 0 vote (one member, Mr. Merricks, was absent), the minutes of the May 8, 2018, meeting were approved as presented. OLD BUSINESS There was no old business. NEW BUSINESS Mrs. Hayes reported there is one (1) Sign Permit case for the July 2018 cycle for Faith Memorial Baptist Church for an on-site 4 x 10 (40 square feet), double-sided, digital LED marquee sign to be incorporated into the existing structure which contains a 2 x 12 (24 square feet) sign. Board of Zoning Appeals June 12, 2018 Page 2 Mr. Greg Sides, Assistant County Administrator, introduced Mr. Christopher Dadak, Attorney At Law with Guynn & Waddell, P.C., in Salem, Virginia, to the Board members. Mr. Sides then stated this law firm had been chosen to serve as legal counsel for the Board of Zoning Appeals. An Engagement Letter from Guynn & Waddell, P.C., stating the terms of service was presented to the Board for their review and acceptance. A discussion among the Board members followed, and no action was taken. THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at approximately 7:17 p.m. Case S-18-006, Charika Carter Barksdale – Mr. Talbott opened the public hearing at approximately 7:17 p.m. Mrs. Hayes, Deputy Director of Community Development, reported that Charika Barksdale had petitioned for a Special Use Permit on 0.44 acre, located on State Road 1664/Bonny Avenue, in the Tunstall Election District to allow for placement of a single-wide mobile home to be used for rental purposes. Mrs. Hayes further reported the Planning Commission, with no opposition, recommended granting the petitioner’s request. Ms. Charika Barksdale was present to represent the petition. She stated the mobile home was not brand new, but it was in good condition. She then stated she owns another mobile home located two (2) lots up from the petitioned parcel of land. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:19 p.m. The Board discussed the petition as the Committee of the Whole. During the discussion, it was stated all the homes in the area are well kept. Upon motion of Mr. Griffith, seconded by Mr. Yeaman, the following motion was adopted: Whereas, Charika Carter Barksdale has petitioned the Board of Zoning Appeals for a Special Use Permit to allow for placement of a single-wide mobile home on the property for rental purposes and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted. Motion passed by a 6 to 0 vote (one member, Mr. Merricks, was absent). This concludes the Special Use Permit case.
