9. HEARING OF THE CITIZENS
Each person addressing the Board under Hearing of the Citizens shall be a resident or
land owner of the County, or the registered agent of such resident or land owner. Each
person shall step up, give his/her name and district in an audible tone of voice for the
record, and unless further time is granted by the Chairman, shall limit his/her address to
three (3) minutes. No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board as a body
and not to any individual member thereof. Hearing of the Citizens shall last for a
maximum of forty-five (45) minutes. Any individual that is signed up to speak during
said section who does not get the opportunity to do so because of the aforementioned
time limit, shall be given speaking priority at the next Board meeting. Absent
Chairman’s approval, no person shall be able to speak who has not signed up.

A. Rezoning Public Hearings
Pursuant to Article V, Division 6, of the Pittsylvania County Zoning Ordinance, the
Board of Supervisors have been empowered to hear and decide specific zoning issues
and zoning map changes in support of said Ordinance. In accomplishing this
important task, the Board is responsible for promoting the health, safety, and general
public welfare of the citizens of Pittsylvania County. The Board must ensure that all
of its decisions and regulations be directed to these goals and that each be consistent
with the environment, the comprehensive plan, and in the best interest of Pittsylvania
County, its citizens, and its posterity.

Adcock stated that recently the County has been approached by commercial entities seeking to
haul and dispose of residential waste at the County’s Landfill. Due to this interest, County Staff
reviewed the County’s existing related Ordinance and discovered it was lacking in detail, clarity,
and proper safety measures to protect the County and the public.
Motion to recommend that the full Board authorize the advertisement of the required Public
Hearing at its May Business Meeting to potentially revise PCC § 17-5 as presented.

Ragsdale stated to ensure that the Pittsylvania County Zoning Ordinance can better regulate
growing trends, specifically camping associated with special events and regulations governing
approved campgrounds, County Community Development Staff has recommended the following
attached amendments to the Pittsylvania County Code (“PCC”):
(1) Create PCC § 35-87 (TEMPORARY CAMPING); and
(2) Amend PCC § 35-138 (CAMPGROUNDS AND RECREATIONAL
VEHICLE/CAMPER AREAS)
Motion to recommend that the full Board authorize the advertisement of the required Public
Hearing at its May Business Meeting to potentially add PCC § 35-87 to the PCC and amend PCC
§ 35-138 as presented.

c. Potential Revisions to PCC Chapter 10 (Music Festivals); (E. Ragsdale)
Ragsdale stated that Pittsylvania County Code (“PCC”), Chapter 10 (Music Festivals) regulates
music or entertainments festivals conducted in open spaces that continue for longer than six (6)
hours. Since this Ordinance has not been revised since 1991, and with large planned future
music festivals in the County there is a need for potential revisions to ensure that the Ordinance
remains relevant and that the interest of the public health, safety, and welfare of the County
residents continue to be protected.
Motion to authorize the advertisement of the Public Hearing for potential changes at the May
meeting.

d. Potential Community Solar Revisions (PCC §§ 35-35; 35-141(C), (D), (E), and (F)); (E.
Ragsdale)
In 2020, the Virginia General Assembly passed legislation allowing Community Solar Projects
within the Dominion Energy service area. Currently, these facilities are considered Utility Scale
Solar Energy Facilities. Based on 2020 Amendments to Pittsylvania County Code (‘PCC”) § 35-
141(C), the locations of these Community Solar Energy Projects would be restricted based on the
requirement that Utility Scale Solar Energy Facilities cannot be located less than five (5) miles
from any other Utility Scale Solar Energy Facility.

a. Staunton River Plastics, LLC Financing Update (Staff Contact: Matthew D. Rowe)
Rowe stated that on April 15, 2021, the Pittsylvania County Industrial Development Authority
(“IDA”) approved a construction contract and package with ARCO Design-Build for the
construction of a 150,000 sq. ft. turn-key manufacturing facility for a price of $9,732,406 or
$65.77/sq. ft. County Economic Development Staff and Staunton River Plastics, LLP
(“Company”), vetted and received estimates from three (3) developers and four (4) builders
(note: ARCO’s per square foot price was more than $5/sq. ft. cheaper than the nearest
competitor). The scope not only includes a move-in ready concrete tilt-up building, but also
improvements to the rail sideline, construction of parking areas, and drainage improvements.
Moreover, due to ARCO’s size and relationship with steel sources, the Project was not impacted
by the rise of steel prices.
During its April 15, 2021, Meeting, the IDA approved “Bank Term Sheet Option #2” with
American National Bank for a construction loan up to $8,592,280, amortized on a twenty-five
(25)-year schedule with a seven (7)-year balloon at 3.55% (a formal solicitation process was
conducted by the County’s financial consultant). Also at the Meeting, the IDA approved a
Facility Lease (already signed by the Company) and Facility Lease Amendment (a one (1)-page

amendment document reflecting final bank terms) that results in the Company paying the IDA a
lease rate equal to or more than the monthly mortgage, plus $1,500 per month financing fee, in
addition to the Company making an up-front rental payment of $1,504,012.65.
All stormwater and land disturbance permits are in hand, and once financial closing occurs,
ground will immediately be broken. The construction period is roughly ten (10) to twelve (12)
months. The Board will need to approve a Moral Obligation at its April 2021 Business Meeting
to stay on the current track of financial closing in early May 2021. American National Bank has
ordered an expedited appraisal and is proactively conducting is title due diligence and work.
b. Danville IDA-Pittsylvania IDA Shell Building Update (Staff Contact: Matthew D.
Rowe)
Rowe stated that at its April 15, 2021, Meeting, the IDA tabled their consideration of the Blairs
Construction (“Contractor”) Contract for a 30,000 square foot shell building in the Cyber Park.
In doing so, the IDA directed County Staff to do the following:
(1) Work with the City IDA and Contractor to develop an itemized budget, more clear
scope of construction, and design-build specifics;
(2) Establish/finalize financing terms/specifics;
(3) Create a Memorandum of Understanding between the County IDA and City IDA
regarding financing and revenue details; and
(4) Finalize the final approved location of the Facility (dependent on RIFA’s final
approval); and
(5) Transmit a letter to City IDA Staff outlining all the above.
Once the information is received, the IDA is willing to have a Special Called Meeting to
expedite the Project.
For reference, the County and City IDAs agreed earlier this year to jointly develop and finance
the 30,000 sq. ft. shell building on a lot in the Cyber Park. County Staff is working with several
potential end tenants and there is a high likelihood that the project will morph into a build-to-suit
facility.

Jay Craddock, of VDOT. presented the Board an update on VDOT’s Secondary Six-Year Plan
for the County. Authorization to conduct the associated legally required Public Hearing at the
Board’s May Business Meeting is on tonight’s Consent Agenda. Below are the proposed Roads
to be added to the Six Year Plan.
STAFF, COMMITTEE, AND/OR CONSTITUTIONAL OFFICER REPORTS
a. County Summer Youth Work Program Discussion (Staff Contact: Richard N. Hicks);
(15 minutes)
Recently, the City of Danville, Virginia, announced a Youth Summer Work Program
(“Program”) that was created with the partnership of several different agencies. At Supervisor
Miller’s request, County Staff convened a meeting with various agencies to determine if a
similar Program was a possibility for County residents. Representatives from The Institute,
Pittsylvania County Community Action (“PCCA”), The West Piedmont Workforce Development
Board, County Schools, and County met to determine such a Program’s feasibility for County
youth.
Dr. Julie Brown, Director of Advanced Learning at the Institute, was able to develop a Concept
Paper on how a Program might look and what agencies would be participating if approved. Dr.
Brown believes that a case could be easily made to utilize upcoming COVID funds to cover the
County’s cost. PCCA may have additional funds, but most of those are based on income and
have certain restrictions. The Program’s plan proposes to hire twenty (20) County youth for the

Program. The County’s School System will provide summer transportation and identify
potential youth for the Program.
Motion to take a total of students from twenty (20) to twenty-five (25) and to appropriate up to
$75,000 from the County’s future Cares Act funds to fund twenty-five (25) County students to
participate in the County’s 2021 Summer Youth Program.

Ragsdale and Goard were present discuss Solar Taxation. Goard presented the total expected
lifetime revenue for the current solar farms that are in the County when using revenue sharing.
Revenue sharing was not allowed under the State Code originally, but there has been a change
that now allows that going forward.

In Case R-21-005, Mabel Doss (“Petitioner”), has petitioned to rezone 2.01 acres, from A-1,
Agricultural District, to R-1, Residential Suburban Subdivision District, (to consolidate with an
adjacent parcel of land zoned R-1). The subject property is located on State Road 930/Sycamore
Road, in the Staunton River Election District. Once the property is rezoned to R-1, all uses listed
under Pittsylvania County Code § 35-222 are permitted. On March 2, 2021, the Planning
Commission recommended, with no opposition, that the Petitioner’s request be granted.

In Case R-21-006, Frank Martin and Linda Stroud (“Petitioners”), have petitioned to rezone
19.47 acres, from MHP, Residential Manufactured Housing Park District, to A-1, Agricultural
District, (to allow for agricultural use). The subject property is located on State Road 746/Golf
Club Road, in the Westover Election District. Once the property is rezoned to A-1, all uses listed
under Pittsylvania County Code § 35- 178 are permitted. On March 2, 2021, the Planning
Commission recommended, with no opposition, that the Petitioners’ request be granted.
Warren opened the Public Hearing at 7:27 PM. Frank Martin was present to represent the

Other Public Hearings
1. Public Hearing: Disposition of a Portion of County Landfill Property to AC Power,
LLC, for Solar Land Lease Option Agreement (Staff Contact: Richard N. Hicks)
After reviewing several proposals for solar development at the County Landfill, the Board
recently approved a potential lease with AC Power, LLC (“AC Power”), to develop a solar
project thereon. Prior to submitting a proposal to any potential power provider such as
Dominion, AC Power will need to perform its due diligence on the property and gather the
necessary information to submit a competitive proposal. AC Power is proposing a two (2)-year
Land Lease Option (“Option”) for this process. After an initial term of six (6) months after
execution of the Option, AC Power will pay the County $2,500 per quarter during the Option’s
term. If a project is approved and an actual Lease Agreement is executed, AC Power will pay
the County $7,500 per MW-dc installed each year during the term of the Lease with an annual
escalator of one and one-half percent (1.5%). The County has negotiated a one (1) year lease
with the option to renew for a one (1) year term.

2. Public Hearing: Disposition of Old Blairs Middle School/Southside High School to
Mid-Atlantic Foundation, Inc., and Approval of Other Related Easements and

Several months ago, the Board held a Public Hearing and agreed to donate the former Blairs
Middle School/Southside High School property (“Property”) to Landmark Development
(“Landmark”) to renovate the Property into apartments. Landmark has obtained its financing
and is ready to proceed with the Project. Landmark has recently requested that the Property be
donated to Mid-Atlantic Foundation, Inc. (“Mid-Atlantic”), a non-profit, which will provide
them with more flexibility and funding opportunities. The final development will be owned and
operated by Blairs School Apartments, LLC.

to approve the transfer of the Property, the Owner’s Affidavit and Indemnity, a temporary
construction easement for sewer, a Deed of Sewer Easement, an Assignment of Donation
Agreement to Mid-Atlantic, a Deed of Lease for the Auditorium to the County, and an Access
and Parking Easement and Maintenance Agreement. The Public Hearing has been properly
advertised. Sam Sari, with Landmark Development, was in attendance to provide the Board with
an update on the Project.

Authority (“SR RIFA”) announced Staunton River Plastics, LLC (“Company’), a wholly-owned
subsidiary of Rage Corporation (with a plastics facility in the region and another facility and
headquarters in Ohio) would construct a new facility that would result in $34M in investment

and two hundred (200) new jobs over a four (4)-year period from Phase 1 facility construction.
Due to COVID delays and the Company securing additional lucrative contracts, the County’s
Industrial Development Authority (“IDA”) decided that it would be mutually beneficial for it and
the Company for the IDA to finance the construction and entered a guaranteed long-term lease
with the Company. As such, the County IDA requested County Staff to solicit term sheets from
financial institutions. A term sheet option has been selected from this process. As part of the
loan closing, the financial institution selected, American National Bank, is requiring the County
Board to formally approve a Moral Obligation securing the Project’s financing. All construction
permits have been received and groundbreaking will occur immediately after loan closing (note:
Company has already located two (2) large silos on the site and has purchased and
is storing numerous pieces of equipment for the operation).
Motion for the Board to approve the attached Moral Obligation as presented.

At its February 16, 2021, Business Meeting, the Board determined, via a unanimous, affirmative
vote, that no public necessity exists for the continuance of the following County public road: a
portion of SR 1270, Ringgold Industrial Parkway. On February 23, 2021, as required by
Virginia Code, the Board sent a formal notice of its intent to abandon the road to the VDOT
Commissioner. Furthermore, again required by Virginia Code, a notice of intent to abandon was
posted in three (3) locations along the road and a notice was published in two (2) issues of The
Chatham Star Tribune giving the public a chance to request a related Public Hearing. No one
requested a Public Hearing.
Motion to adopt the Resolution # 2021-04-03 as presented and authorize the County
Administrator to execute and submit any related necessary documentation to VDOT.

BOARD MEMBER REPORTS
• Ingram stated it is an honor to support the naming of the bridge in honor of Mr. Pritchett.
He stated that Grace Clark was involved in a horrible accident that resulted in the loss of
her right foot and to continue prayers for her and her family.
• Miller stated that he was served by Ms. Pritchett and she was also a very pleasant and
delightful person. She wished she could be in attendance tonight.
• Davis stated that Ms. Pritchett lives in his District and he spoke highly of her as well. He
thanked the Board and County Staff for their hard work.
• Scearce stated the Friends of NRA banquet is coming on May 6, 2021 at the Olde
Dominion Agricultural Center. The money raised will stay in the community and goes to
help the Boy Scouts.
• Warren thanked County Staff for their work in the communication to the citizens when
one convenience center site had to be closed early. He also thanked the Board and Staff
for the emails, calls, and messages during the loss of his mother-in-law.
COUNTY ADMINISTRATOR REPORTS
Smitherman stated the County is inundated with Spring cleaning which is causing overflow at
the Convenience Centers. The railroad crossing in Dry Fork will be closed next week, Monday-
Thursday. He also congratulated Darrell Dalton and Susan Dillon for their retirement from the
County.

VIRGINIA: At its Business Meeting on Tuesday, May 18, 2021, the Pittsylvania
County Board of Supervisors (“Board”) adopted the following Proclamation:
WHEREAS, Community Action has made essential contributions to individuals and
families across this Nation by creating economic opportunities and strengthening Communities;
and
WHEREAS, Community Action is a robust state and local force connecting people to
life-changing services and creating pathways to prosperity in ninety-nine percent (99%) of all
American Counties; and

SUMMARY:
On March 12, 2019, the Board approved a partial tax exemption for the proposed Southside Loft
Apartments Project (“Project”). A copy of the adopted Ordinance is attached for the Board’s
review and information. Construction on the Project was to start within eighteen (18) months
after the adoption of the Ordinance. Due to the COVID Pandemic and the complexity of the
Project, the Project has taken longer to develop. At the April Board Meeting, the Board
approved all the necessary documents to transfer ownership of the property to the developer.
The developer anticipates starting construction within the next sixty (60) to ninety (90) days and
is requesting that the partial tax exemption deadline be extended until the end of 2021. A letter
from the developer requesting the extension is attached for the Board’s review and information.
Per the original Ordinance, the estimated cost was close to $5 million dollars and now the
estimated cost is closer to $12 million dollars, so projected tax revenues have increased.
FINANCIAL IMPACT AND FUNDING SOURCE:
After construction is complete, the developer will pay taxes on fifty percent (50%) of the
appraised value for a period of three (3) years.
RECOMMENDATION:
County Staff recommends the Board amend section 5(b) of the Partial Tax Exemption Ordinance
adopted on March 12, 2019, for the Southside Loft Apartments complex to December 31, 2021.

Re: Southside Lofts Partial Exemption from Taxation Ordinance Extension
Mr. Chairman,
I hope this letter finds you well. I am writing to inform you that the partial exemption from real
estate taxation for the Southside Lofts development has expired, and to respectfully request that the Board
of Supervisors consider extending the ordinance. I have attached that ordinance here for reference.
As you may remember, an ordinance was originally passed by the Board unanimously on March
12th, 2019 in an effort to support the approximately $11,800,000 development, and to make the
development’s funding application more competitive. The ordinance gave the Southside Lofts
development a three-year partial real estate tax exemption. The amount of the partial exemption is the
value of increase in property value, or 50% of the cost of the improvements, whichever is greater.
Unfortunately, due to various delays resulting from the COVID-19 pandemic, the development
has missed the original 18-month deadline to qualify for the Ordinance, which originally expired on
9/12/2020.
However, I am pleased to share that Southside Lofts is now thirty to sixty days from the start of
construction. Since the partial real estate tax exemption helped us qualify for funding, we need to keep it
in place.
Therefore, I respectfully request that the Board of Supervisors consent to extending the
rehabilitation deadline in the ordinance to 12/31/2021. All other terms of the ordinance will remain the
same.
We greatly appreciate the Board’s continued support and partnership. Please do not hesitate to
reach out to me if you have any questions, or would like to discuss the development.

(GPIN # 2410-34-8278) adjoining the Mt. Hermon Convenience Center from the owner, Gary C.
Oakes (“Oakes”), in the amount of $150,000. Oakes is ready to prepare the Deed for the sale of
the property and his attorney has requested documentation that the Board approves of said land
purchase.

Virginia Code § 24.2-307 mandates that "[e]ach precinct shall be wholly contained within a
single congressional district, Senate district, House of Delegates district, and election district
used for the election of one or more members of the governing body or school board for the
county or city." The County currently has fourteen (14) Split Precincts. Given the delay in
redistricting activities due to deferred Census data, the Commonwealth will be granting waivers
for curing of the split Precincts via a Waiver Application. The purpose of said Wavier
Application is to allow the use of Split Precincts, which reflect the County’s current 2021
boundaries. For the Board’s consideration, attached is Resolution # 2021-05-0, authorizing the
Split Precincts Waiver Application submission.

Split Precinct Wavier Submission Authorization

VIRGINIA: At its Business Meeting on Tuesday, May 18, 2021, the Pittsylvania County
Board of Supervisors (“Board”) adopted the following Resolution:
WHEREAS, § 24.2-307 of the Code of Virginia, 1950, as amended ("Virginia Code"),
mandates that "[e]ach precinct shall be wholly contained within a single congressional district,
Senate district, House of Delegates district, and election district used for the election of one or
more members of the governing body or school board for the county or city;" and
WHEREAS, the Pittsylvania County, Virginia ("County") currently has the following
fourteen (14) split Precincts: Chatham (105), Climax (206), Gretna (207), Central (301), Riceville
(305), East Blairs (307), Mt. Airy (308), East Gretna (309), Keeling (402), Kentuck (404),
Ringgold (405), Hurt (501), Bachelor’s Hall (702), and Mount Hermon (704); (together, "Split
Precincts"); and
WHEREAS, the Virginia Code requires that the Board establish Precinct boundaries to be
consistent with any Congressional district, Senate district, House of Delegates district, and local
election district by June 15, 2021; and
WHEREAS, due to the COVID-19 Pandemic, the 2020 Census ("Census") data has not
been received by the County; and
WHEREAS, without updated Census data, the County is unable to establish Precinct
boundaries that eliminate the Split Precincts by June 15, 2021; and
WHEREAS, the Virginia Code requires the Board apply for a Waiver from the State Board
of Elections to continue to administer the Split Precincts for any election held in 2021.
NOW, THEREFORE, BE IT RESOLVED that the Board does hereby authorize the
County Director of Elections and General Registrar to submit a request for a Waiver from the State
Board of Elections pursuant to the Virginia Code to use the aforementioned fourteen Split
Precincts any election held in 2021.

RESOLUTION HONORING SHERIFF G. HAROLD PLASTER
VIRGINIA: At the Pittsylvania County Board of Supervisors’ (“Board”) Business Meeting on Tuesday, May 18,
2021, the Board adopted the following Resolution:
WHEREAS, Grover Harold Plaster (“Sheriff Plaster”) the son of Clarence Woodrow Plaster and Dessa Turner
Plaster, was born in Patrick County, Virginia, on August 6, 1946; and
WHEREAS, he married Mary Ann Quesinberry on September 18, 1965, and was married to her for fifty-five (55),
and they had a daughter, Cara Plaster Orange; and
WHEREAS, Sheriff Plaster joined the Virginia State Police (“VSP”) in 1967, and was stationed in Prince William
County, Virginia, and then Pittsylvania County, Virginia (“County”), as a State Trooper; and
WHEREAS, he left the VSP and became the Safety Director with the Virginia Department of Transportation
(“VDOT”), followed by a position as Director with the Virginia Alcohol Safety Action Program; and
WHEREAS, Sheriff Plaster then became the Manager at the Martinsville and Danville VDOT Offices; and
WHEREAS, he ran for the Office of Sheriff of Pittsylvania County in 1984 and 1988, but was unsuccessful; he
then ran a third (3rd) time and was elected as Sheriff in 1992; and
WHEREAS, Sheriff served as County Sheriff for sixteen (16) years from 1992, until his retirement in 2008; and
WHEREAS, Sheriff Plaster was the Henry County Jaycees Young Man of the Year and was also an active member
of Brosville United Methodist Church; and
WHEREAS, he was a former member of the Board of Directors of the Brosville Fire Department, Chairman of the
Sandy River Medical Center, member of the Brosville Ruritan Club, a 32nd Degree Blue Lodge Mason, a past member of
the VSP Association, the National Sheriff’s Association, and was also the Past-President of the Virginia Sheriff’s
Association; and
WHEREAS, Sheriff Plaster was a faithful and loyal supporter of the Brosville Community and the County; and
WHEREAS, he died on July 23, 2020, in Danville after a long and courageous battle to overcome multiple health
issues.
NOW, THEREFORE, BE IT RESOLVED, that the Board expresses its sincere regret and grief over the loss of
such a faithful and loyal member of the County’s community; and
BE IT FURTHER RESOLVED, the Board expresses its gratitude for the life and service of Sheriff Plaster and
expresses its condolences to Mrs. Plaster and their entire family; and
BE IT FINALLY RESOLVED that the Board directs that a copy of this Resolution be given to Sheriff Plaster’s
family.

RESOLUTION HONORING FLOURNEY A. KEATTS
VIRGINIA: At its Business Meeting on Tuesday, May 18, 2021, the Pittsylvania County Board of Supervisors
(“Board”) adopted the following Resolution:
WHEREAS, Flournoy A. Keatts (“Keatts”), son of Flournoy Edward and Emma Keatts of the Axton Community,
was born on April 15, 1924, in Pittsylvania County, Virginia (“County”); and
WHEREAS, Keatts was a graduate of Brosville High School; and
WHEREAS, he married the late Nina Yeatts Keatts and was married for sixty-two (62) years, and during their
marriage, they had three (3) children, Pam, Sherry, and Barry; and
WHEREAS, Keatts worked for Dan River Mills for ten (10) years before becoming a dairy farmer and he owned
and operated Keatts Dairy for sixty-five (65) years; and
WHEREAS, he was a lifelong member of Sugartree Primitive Baptist Church; and
WHEREAS, Keatts was an active hunter and fisherman and passionate about wildlife conservation; he once built
a pond just for ducks; and
WHEREAS, Keatts served on the Soil and Conservation Board, the Piedmont Planning Commission, was a
member of the Young Farmers Association, and was a lifetime member of the Farm Bureau; and
WHEREAS, he ran for the Board and won the Tunstall District Seat in 1971, where he served for thirty-two (32)
years and Chaired many Committees; and
WHEREAS, Keatts was affectionately known as the “Watchdog of the Treasury;” and
WHEREAS, he died in Danville, Virginia, at the age of ninety-six (96).
NOW, THEREFORE, BE IT RESOLVED, that the Board expresses its sincere regret and grief over the loss of
such a faithful and loyal member of the County and a devoted former member of the Board; and
BE IT FURTHER RESOLVED, the Board expresses its gratitude for Keatts’ life and service and expresses its
condolences to his family; and
BE IT FINALLY RESOLVED that the Board directs that a copy of this Resolution be given to Keatts’ family.

RESOLUTION HONORING H. DARREL SHELTON
VIRGINIA: At its Business Meeting on Tuesday, May 18, 2021, the Pittsylvania County Board of
Supervisors (“Board”) adopted the following Resolution:
WHEREAS, the Pittsylvania County Public Library was established in 1939, by the Board with the
assistance of the County School Board, local Federation of Women’s Clubs, the Rotary Club, the Chatham Library
Association, and the donation of a building and books by Mr. and Mrs. David K. Bruce; and
WHEREAS, the PPL Foundation were established in 1983, and received IRS 501(C)3 status effective
June 1, 1984, for the purpose of supporting and raising funds for the Library; and
WHEREAS, in the Spring of 1988, the Friends of the Library formally organized under the auspices of
the PPL Foundation for the purpose of promoting the Library and its services; and
WHEREAS, the County Public Library and the County have since 1983 been greatly supported by the
PPL Foundation in Library expansion by adding, renovating, or replacing the Brosville/Cascade, Gretna, and Mt.
Hermon Library branches; in purchasing, maintaining, and replacing Bookmobiles to extend Library services to
County Schools and remote County communities; and in making other major renovations and repairs; and
WHEREAS, H. Darrel Shelton (“Shelton”) has served as PPL Foundation Treasurer since July 2, 1991,

In Case R-21-012, Gentry Farms, LLC (“Petitioners”), have petitioned to rezone a total of 56.13
acres, from R-1, Residential Suburban Subdivision District, to A-1, Agricultural District (to
allow for agricultural use (livestock) and recreational use (event venue)). The subject property
is located of State Road 734/Clarks Mill Road, in the Dan River Election District and shown on
the Tax Maps as GPIN #s 2346-89-0267 and 2346-99-5750. Once the property is rezoned to A-
1, all uses listed under Pittsylvania County Code § 35-178 are permitted. On April 6, 2021, the
Planning Commission recommended, with no opposition, that the Petitioner’s request be granted.

RECOMMENDATION:
County Staff recommends approval of Case R-21-012 as presented. The subject property is
adjacent to properties currently zoned A-1, Agricultural District, and the rezoning would be

SUMMARY:
Recently, the County has been approached by commercial entities seeking to haul and dispose of
residential waste at the County’s Landfill. Due to this interest, County Staff reviewed the
County’s existing related Ordinance and discovered it was lacking in detail, clarity, and proper
safety measures to protect the County and the public. The revised § 17-5 was presented to the
Legislative Committee at their April 20, 2021, Meeting, and the LC recommended that the Board
authorize the same for a Public Hearing tonight for potential adoption. For the Board’s review
and consideration, attached are proposed revisions to Pittsylvania County Code (“PCC”) § 17-5
to remedy the above issues and a copy of the related Public Hearing advertisement.

SEC. 17-5. COLLECTION LICENSES.
A. No commercial hauler shall collect, remove, haul, or convey any solid waste through or upon
any of the streets or alleys of the County of Pittsylvania or dispose of the same in any manner or
place without obtaining approval from the governing body and a license from the Commissioner
of Revenue of the County.
B. The license fee for such vehicle shall be annually set by the Board of Supervisors. All licenses
shall be issued for the calendar year, or such portion thereof as shall remain after the issuance
thereof. There shall be no reduction in the fee for a license issued after the beginning of any
calendar year.
C. Every person or firm who shall apply for a license under this Section shall state the type or
types of refuse to be collected, the manner of collections, and the place and method of disposal,
and shall maintain minimum liability coverage on each vehicle used for such collection as
mandated by the Commonwealth of Virginia.
D. No license shall be granted if the place and method of disposal shall not conform to the
requirements of this Ordinance, or to the ordinance of any municipal or quasi-municipal
corporation, wherein disposal of refuse is to be made.
E. No licensed collector or commercial hauler shall make any change in the arrangements for
disposal or refuse collection by him without first receiving the approval of the governing body.
F. It shall be unlawful to permit an unlicensed collector or unlicensed commercial hauler to collect
or remove refuse from a household, institution, or commercial enterprise located in Pittsylvania
County, Virginia.
SEC. 17-5. COLLECTION LICENSES.
A. License Required
It shall be unlawful for any commercial hauler to collect, transport, or dispose of any solid waste
or recyclable material generated in the County, without first obtaining a solid waste collection
license from the Pittsylvania County Board of Supervisors.
B. Application
The applicant shall apply to the Commissioner of Revenue upon such forms as required by the
Commissioner. Each application shall contain the name, address, and telephone number of the
place where the applicant proposes to maintain his equipment and vehicles and the number and
description of vehicles to be used. Each application shall state the number and type of vehicles,
include their year, make, model, gross weight, tare weight, capacity, vehicle identification number,
and Virginia Department of Motor Vehicles (“DMV”) license number. Each application shall state
the type or types of solid waste to be collected, the manner of collections, and the place and method
of disposal.
10.B.2.b

C. Fee
The fee for a license required by this Section shall be fifty dollars ($50.00) per vehicle, up to a
maximum of two hundred fifty dollars ($250.00) per company. The fee shall be for all vehicles
operating within and registered with Virginia DMV to that company, as certified in the license
application. This fee may be modified from time-to-time by Board of Supervisor’s action. All
licenses shall be issued for the calendar year, or such portion thereof as shall remain after the
issuance thereof. There shall be no proration of the fee for a license issued after the beginning of
any calendar year.
D. Inspection of Vehicles and Premises
The County Administrator, or his/her duly authorized representative, shall have the authority to
inspect or cause an inspection of the premises and vehicles named and described in the license
application for the purpose of determining whether the premises and vehicles comply with the
provisions of this Article or any other Ordinance, Resolution, and/or County regulation. If the
permit has been issued, the permittee shall correct any deficiencies immediately upon notification
by the County, or its duly authorized representative, and said vehicle shall not be used for refuse
collection until the deficiencies have been corrected.
E. Display/Possession of Permit
Each refuse collection vehicle must always have in its possession a signed and validated copy of
the approved permit. Failure to present this approved license at the weight scale building upon
entering the County Landfill will result in that vehicle being turned away and dumping of its
contents will not be allowed.
F. Annual Renewal
Each licensee see shall annually submit a renewal application of his/her permit no later than the
1st of December by paying the current annual license fee. The annual renewal application must
indicate any changes from the original license application and must be signed by a business owner.
G. Violation/Revocation/Penalties
If a licensed commercial hauler fails to follow these regulations, the County reserves the right to
impose reasonable fines and/or revoke the license to operate within the County, subject to any
appeal provisions described herein.
Penalties shall be as outlined in Sec. 17-21. Each day of failure to comply with the regulations
shall constitute a separate violation.
F. Minimum Standards
Any licensee as described herein who does not comply with the following minimum standards
shall be subject to suspension of the license issued under this Section:
1. Haulers transporting solid waste within the County shall prevent or remedy any
spillage from vehicles or containers used in the transport of such solid waste. The vehicles shall
be securely covered, watertight, strongly built, and kept thoroughly cleaned and well maintained.
Except for roll-offs, open trucks, or trucks covered with tarps will not be used for the collection of
solid waste.

2. Solid waste shall be collected in vehicles which are suitable and dedicated for use
in performance of such collection, which bear prominent legible marking, signs, or decals
identifying them as being solid waste collection vehicles and bearing the name, address, and
telephone number of the licensed hauler.
3. Haulers shall maintain minimum liability coverage on each vehicle used for such
collection as mandated by the Commonwealth of Virginia.
4. The premises wherein vehicles, equipment, and offices are maintained shall be kept
in a clean and sanitary condition. An accumulation of solid waste or recyclable material which
tends to create a health problem or nuisance shall not be permitted on such premises.
5. All vehicles shall be emptied before being placed on the licensee's premises for
overnight parking (except for Sunday nights only, where the vehicle will be emptied first thing
Monday morning).

specifically camping associated with special events and regulations governing approved
campgrounds, County Community Development Staff has recommended the following attached
redlined amendments to the Pittsylvania County Code (“PCC”):
(1) Create PCC § 35-87 (TEMPORARY CAMPING); and
(2) Amend PCC § 35-138 (CAMPGROUNDS AND RECREATIONAL

SEC. 35-86. PARKING AND STORAGE OF CERTAIN VEHICLES
Major recreational equipment as defined for purposes of these regulations includes travel trailers,
pickup campers, motorized dwellings, tent trailers, beats and boat trailers, house boats and the like,
and cases or boxes used for transposing such recreational equipment, whether occupied by such
equipment or not.
No major recreational equipment shall be used for living, sleeping or other occupancy when parked
or stored on a residential lot or in any other location not approved for such use.
No buses or renovated buses shall be used for living, sleeping or other occupancy when parked or
stored on a residential lot or in any other location not approved for such use.
SEC. 35-87. TEMPORARY CAMPING
Major recreational equipment as defined by Sec. 35-86 may be used for living, sleeping or other
occupancy when such a use is in conjunction with an event held on property zoned for such an
event and a Temporary Camping Permit has been issued by the Zoning Administrator. Fees for
Temporary Camping Permits shall be set by the Board of Supervisors. Major recreational
equipment shall be located on the same property as the event and may be permitted for a period
that shall not exceed 24 hours prior to the start of the event and 24 hours after the conclusion of
the event. A Temporary Camping Permit shall be issued by the Zoning Administrator prior to any
event for a period not to exceed twenty-one (21) consecutive days or one hundred-eighty (180)
days per calendar year. Prior to the issuance of a Temporary Camping Permit, the following shall
be reviewed and approved by the Zoning Administrator:
1) Site plans shall be submitted to the Zoning Administrator identifying major recreational
equipment parking locations, utility hookups and/or dump stations, bathhouses, and any
other amenities that will be offered as an incidental use.
2) A plan for adequate sanitation facilities and garbage, trash, and sewage disposals shall be
approved by the Zoning Administrator prior to a permit being issued. This plan shall
meet the requirements of all state and local statutes, ordinances, and regulations.
3) A plan for adequate fire protection shall be reviewed and approved by the Director of
Public Safety. This plan shall meet the requirements of all state and local statutes,
ordinances, and regulations.
No such permit shall be issued for events held within residential zoning districts.
SEC. 35-138. CAMPGROUNDS AND RECREATIONAL VEHICLE/CAMPER AREAS
1. Definitions

parks which shall be used only by travel trailers, pick-up coaches, motor homes, recreational vans,

2. Standards for Campgrounds and Recreational Vehicle/Camper Areas
a. Lot/Space Sizes
Lots or spaces of this district shall be no less than three thousand (3,000) one thousand six
hundred (1,600) square feet. Each lot or space in this district shall not be less than (50) twenty-
five (25) feet in width at the narrowest point.
b. Maximum Percentage of Lot or Space Coverage
Lots or spaces in this district shall have allowances so that no more than forty (40) percent of
the lot or space is covered. Units placed on lot or space shall not be placed closer than ten (10)
feet from the adjacent space.
c. Minimum Size for Campground
The area for the total campground shall be no less than three (3) acres.
d. Density Requirements
Density shall be no more than ten (10) twenty (20) sites per acre.
e. Minimum Yard Dimensions
A separation distance often (10) feet is required between units set on lots and adjacent lot lines.
Front yards, that portion of the lot between the unit and a public or private street in the
campground, shall be no less than twenty (20) feet in depth which shall include the distance
from the unit to the right-of-way line for the street.
f. Open Space/Recreation Space Requirements
Not less than five (5) percent of the gross areas of the facility shall be reserved as common
open space and recreation facilities exclusive of required exterior boundary setback areas,
pedestrian ways, parking bays, public or private streets and community storage facilities.
g. Minimum Off-Street Parking Spaces
At least two (2) one (1) off-street parking spaces on ten (10) feet by twenty (20) feet shall be
provided for each lot or space, on or adjacent to the lot or space, and/or a total of two hundred
(200) square feet. A consolidated parking area within sixty (60) feet of the lots or spaces may
be used to provide required space.
h. Maximum Height of Buildings
Buildings in this district shall be limited to thirty-five (35) feet in height.

i. Signs
Each campground shall, at all times, have a sign at its entrance designating
the name of the campground, the owner(s), and the telephone number of the owner or renting
agent. The sign and its contents shall be visible from a distance of forty (40) feet in either
direction; minimum letter size shall be six (6) inches.
j. Occupancy
Campgrounds are designed for transient occupancy, requiring that units remain movable at all
times. Permanent structures shall not be constructed on or attached to units in a manner that
would inhibit the ability of the unit to be moved.
3. Plat Requirements
a. Any owner or developer of a tract of land in Pittsylvania County, Virginia, proposing to
develop a "campground and recreational vehicle/camper area" shall submit plats to the Zoning
Administrator that have been prepared by a Professional Engineer or Licensed Land Surveyor
in the Commonwealth of Virginia whichever is applicable in a scale of one (1) inch equal one
hundred feet (10 ft) or greater setting forth the following information:
1. Name and address of owner and developer.
2. Location and map inset showing nearest highway and intersection of highways.
3. Boundary survey of entire tract of and owned on which proposed camp to be located.
4. If less than whole tract is to be used for camp, show proposed use of remaining land
with boundary of campsite shown.
5. Size, location, and number of lots.
6. Entrances, exits, streets and walks.
7. Size and location of vehicle storage.
8. Location and size of proposed service buildings, including floor plan and elevations and
any other structures i.e., including pools, cabanas, and accessory buildings to be located
in a camp.
9. Location and size of recreation area, showing development plans, landscaping and
drainage.
4. Permits Required
a. Water Supply. An adequate supply of water, approved by the Health Department, shall be
furnished from a public water supply: system, or from a private water system conforming to all
applicable laws, regulations and Ordinances, with supply faucets or hookups located on each lot or
space. No drinking water comers or fountains shall be located in any room or building housing toilet
facilities. All water lines shall be made frost-free.

b. Sewerage Facilities. In each campground, all waste or wastewater (including such waste from
units or vehicles, main buildings on the site, or accessory buildings on the site, or any other shelters or
enclosures that might house equipment) from a faucet, toilet, tub, shower, sink, slop sink, drain,
washing machine, garbage disposal unit or laundry shall empty into a sewer system approved by the
Health Department and shall be installed ill accordance with the Health Department regulations.

SUMMARY:
Pittsylvania County Code (“PCC”), Chapter 10 (Music Festivals), regulates music or
entertainments festivals conducted in open spaces that continue for longer than six (6) hours.
Since this Ordinance has not been revised since 1991, and with large planned future music
festivals in the County, County Staff are proposing the attached revisions to ensure that the
Ordinance remains relevant and that the interest of the public health, safety, and welfare of
County residents continue to be protected. In addition to the proposed revisions shown in the
attached document, County Staff is proposing the following addition:
H. Documentation from a Sound Engineer shall be submitted and approved by the
Director of Community Development showing that adequate measures have been
taken to reduce the sound and/or music, either by mechanical device or live
performance, to a decibel level at or below the acceptable level specified in the
Pittsylvania County Noise Ordinance. The event shall remain in compliance with
the Pittsylvania County Noise Ordinance.

CHAPTER 10
MUSIC FESTIVALS
SEC. 10-1. PURPOSE.
This Ordinance is enacted pursuant to Section 15.2-1200, of the Code of Virginia, 1950, as
amended, for the purpose of providing necessary regulation for the conditioning of musical or
entertainment festivals conducted in open spaces not within an enclosed structure and/or of any
gathering or groups of individuals for the purpose of listening to or participating in entertainment
which consists of primarily musical renditions conducted in open spaces not within an enclosed
structure in the interest of the public health, safety, and welfare of the citizens and inhabitants of
Pittsylvania County, Virginia (“County”).
SEC. 10-2. DEFINITIONS.
When used in this Ordinance, the following words shall mean:
A. Board of Supervisors or Board shall mean the Board of Supervisors of Pittsylvania County,
Virginia.
B. Musicals or entertainment festival shall mean any gathering of groups or individuals for the
purpose of listening to or participating in entertainment which consists primarily of musical
renditions conducted in open spaces not within an enclosed structure, and/or those entertainments
where the listeners are not within an enclosed structure and which has a continued existence on
the premises for a period of time exceeding six (6) hours.
SEC. 10-3. PERMIT.
1. No person, firm, corporation, or partnership shall stage, promote, or conduct any musical or
entertainment festival in the Pittsylvania County, unless there shall have been first obtained from
the Board of Supervisors a Sspecial Eentertainment Ppermit (“Permit”) for said festival.
2. An application for such a Permit special entertainment permits shall be in writing or forms
provided for the purpose and filed in duplicate withbe filed with the County Administrator at least
twenty-one (21)ninety (90) days before the date of such festival. Such application shall have
attached hereto and made a part thereof the plans, statements, approvals and other documents
required by this Oordinance. A copy of such applications shall be sent by certified mail by the
County Administrator to each member of the board of Supervisors the day such applications are
filed.
3. The Board of Supervisors shall act on such applications at their next regularly scheduled
Meeting from the filing of the same or within sixty (60) days of receipt of Permit application. If
granted, the Ppermit shall be issued in writing on a form for the purpose and mailed by the County
Administrator to the Aapplicant at the address indicated. If denied, the refusal shall be in writing
and the reasons for such denial stated therein and mailed by the Ccounty Administrator to the
Aapplicant at the address indicated. Permit fees shall be set by the Board annually in the Budget
Resolution or at any other appropriate time as determined by County Staff or the Boardof

Supervisors. The Applicant promotor shall be required to carry a $500,000 bond to ensure
compliance with the regulations set forth in this Ordinance.
SEC. 10-4 CONDITIONS.
Such A Permit special entertainment permit shall not be issued unless the following conditions are
met and all required the following plans, statements, and approvals are submitted to the Bboard
of Supervisors with the application:
A. An overall description of the proposed festival shall be provided with the Aapplication.
This description shall include the location of the proposed festival, the name and address
of the property owner(s) of said property, the nature and interest of the Aapplicant, the
date(s) and time(s) of said festival, the total number of tickets that will be offered for sale,
a full list of all persons or groups who will perform, the name and address of all promotors
of the festival, and the financial backing for the event. Proof of insurance must also be
provided showing a minimum of $1,000,000 general liability coverage. This amount can
be increased at the discretion of the County Administrator based on the intensity of the
event. An updated ticket sale count shall be provided to the County Administrator no less
than one (1) week prior to the event. Said application for special entertainment permit shall
have attached to it a copy of the ticket or badge of admission to said festival, containing
the date or dates and time or times of said festival, together with a statement by the
applicant of the total number of tickets to be offered for sale and the best reasonable
estimate by the applicant of the number of persons expected to be in attendance.
B. A statement of the name and address of the promoters of the festival, the financial backing of
the festival, and the names of all persons or groups who will perform at said festival.
B. A statement of the location of the proposed festival, the name and address of the owner of
the property on which said festival is to be held, and the nature and interest of the applicant
therein.
A site plan shall be approved by the Director of Community Development identifying the
placement of permeant and/or temporary stages, the location of any concessions, parking if
offered onsite, major recreational equipment parking locations and any associated utility
hookups and/or dump stations, bathhouses, and any other amenities that will be offered as an
incidental use.
C. A plan for adequate sanitation facilities and garbage, trash, and sewage disposals for the
persons at the festival shall be approved by the County Director of Public Works. This plan
shall meet the requirements of all state and local statutes, ordinances, and regulations., and
shall be approved by the County Director of Public Health.
B.
D.C. A plan for providing food, water, and lodging for the persons at the festival shall
be submitted. This plan shall meet the requirements of all state and local statutes,
ordinances, and regulations, and shall be approved by the County Director of Public
Health. Director of Community Development and the Virginia Department of Health. All
applicable permits required will be subject to separate permit fees.

E.D. A plan for adequate medical facilities and EMS coverage for persons at the festival
shall be, approved by the County Director of Public SafetyHealth. The Aapplicant shall
be responsible for any and all associated costs of EMS coverage as required under the
County’s Public Safety Ordinance. See Section 11-91 of the County Code.
F.E. A plan for adequate parking facilities and traffic control in and around the festival area
shall be approved by the County, Virginia Department of Transportation (“VDOT”), and
the Virginia State Police. If traffic impacts are expected on public roads leading to the
proposed venue, a VDOT land use permit for special events must be obtained and said
permit may be subject to separate permit fees. A traffic control plan will be required. The
Aapplicant must comply with all requirements set forth in the VDOT land use permit.
G.F. A plan for adequate fire protection shall be approved by the Director of Public
Safety. This plan shall meet the requirements of all state and local statutes, ordinances,
and regulations. , and shall be approved by the County’s representative of the Virginia
Division of Forestry. The Aapplicant shall be responsible for any and all associated cost
of fire department services as required under the County’s Public Safety Ordinance
Section 11-91 of the County Code.
H.G. A statement specifying whether any outdoor lights or lighting is to be utilized, and
if so,If any outdoor lighting will be utilized, a plan showing the location of such lights and
shielding devices or other equipment to prevent unreasonable glow beyond the property
on which the festival is locatedvenue shall be submitted and approved by the Director of
Community Development.
H. A statement that no music shall be played, either by mechanical device or live
performance, in such a manner that the sound emanating therefrom shall be unreasonably
audible beyond the property on which the festival is located.
I. Any pyrotechnics or fireworks displays that will be utilized must be permitted and
approved by the Pittsylvania County Fire Marshal and will be subject to separate permit
fees.
J. A security and crowd control plan shall be submitted and approved by the Pittsylvania
Countythe County Sherriff. The Aapplicant shall be responsible for any associated costs
of required coverage by the Pittsylvania County Sherriff’s Department or the Virginia
State Police.
SEC. 10-5. TWELVE HOUR LIMITATIONS.
Music shall not be rendered, nor entertainment provided for more than twelve (12) hours in any
twenty-four (24) hour periods, to be measured form the beginning of the first performance at said
festival. However, all music performance shall start no earlier than 9:00 a.m. and end prior to
11:45 00 p.m. on the night of the performance. (B.S.M. 10-15-91)

SEC. 10-6. PARENT OF GUARDIAN.
No person under the age of eighteen (18) years of age shall be admitted to any festival, unless
accompanied by parent of guardian, the parent or guardian to remain with the said person at all
times.
SEC. 10-7. PERMISSION.
No Ppermit shall be issued under this Oordinance unless the Aapplicant shall furnishsfurnishes to
the Board Board of Supervisors written permission for the Board of Supervisors, its lawful agents,
or duly constituted law enforcement officers to go upon the property at any time for the purpose
of determining compliance with the provisions of this Oordinance. The Board of Supervisors shall
have the right to revoke any Ppermit issued under this Oordinance upon non-compliance with any
of its provisions and conditions.
SEC. 10-8. VIOLATION.
Any person, firm or corporation who violates any provisions of this ordinance shall be guilty of a
Class 2 Mmisdemeanor, punishable by confinement in jail for not more than six (6) months and a
fine of not more than $1,000, either or both. Each violation shall constitute a separate offense. An
additional violation within a twelve (12)-month period shall be punishable asby a Cclass 1
Mmisdemeanor. SEC. 10-8. VIOLATION.
Any person, firm or corporation who violates any provisions of this ordinance shall be guilty of a
misdemeanor, and upon conviction thereof, shall be punished by a fine not exceeding three
hundred ($300.00) dollars or by confinement in jail not exceeding thirty (30) days, or by both such
fine and imprisonment. Each violation shall constitute a separate offense. The Board may bring
suit in the Circuit Court of Pittsylvania County to restrain, enjoin, or otherwise prevent violation

SUMMARY:
On May 18, 2016, a Complaint was filed in the Pittsylvania County Circuit by Sands Anderson,
the Treasurer’s outside delinquent tax law firm, for delinquent taxes on Parcel ID# 2366-37-
9913, owned by Mary J. Walters and Howard E. Terry (as all of the known heirs had deeded
their interests to Mr. Terry). Taxes on the property had been delinquent for 2012, 2014, and
2015, in the approximate amount of $5,955.19. Mr. Terry was notified by letter from Sands
Anderson on March 25, 2016, that he had thirty (30) days to come current on the delinquent
taxes, or a delinquent tax suit would be filed and ultimately a delinquent tax sale would be held.
As no delinquent taxes were paid on the property, Mr. Terry was served with the Delinquent Tax
Complaint and, June 1, 2016, and wrote the attached letter to Judge Moreau stating that he was
not contesting the sale of the property. In that same letter, Mr. Terry acknowledged that after
many years and a lot of money and time spent, the family could not come to an agreement about
the property and going forward they would not be able to manage the property if they held on to
it.
In September of 2016, the property was sold for $232,000 to an outside bidder and, on December
5, 2016, a Final Order was presented to the Court and the funds were disbursed accordingly, with
the balance being held by the Circuit Court Clerk.
On December 12, 2016, a week following the disbursement of proceeds, Mr. Terry hired Aubrey
Rosser, Esq., an attorney from Altavista, Virginia, to file a Motion to Reopen the Matter to make
a claim that the excess funds should be paid to Mr. Terry. In said Motion, Mr. Terry claimed
that he was entitled to certain expenses incurred related to the property, such as reimbursement
for having paid the taxes on the property prior to it becoming delinquent in the amount of
$9,070.52, paying a genealogist for researching his family tree, family reunion expenses for all
known relatives for airfare and hotel accommodations, and legal fees in an amount of
$39,193.01.

On January 26, 2017, a Hearing on the above-Motion was held in the County Circuit Court
before Judge Perdue, in which he awarded Mr. Terry a total of $119,993.28 ($48,263.53 for
reimbursement of expenses and taxes, and $71,729.75, representing his share of the proceeds for
his 45.22% interest in the Property), with the balance remaining to be held with Clerk of the
Circuit Court. On May 11, 2018, Attorney Rosser filed and had an Order entered dismissing the
matter entered by the Court.
On September 18, 2018, the County’s Clerk’s Office requested the remaining funds of
$86,998.34 from ANB, and, pursuant to the Court Order, remitted the funds to the County
Treasurer as required. According to Mr. Shorter, once the funds were received, they go into the
General Fund and are immediately disbursed at that time.
Pursuant to Virginia Code § 58.1-3967, attached, Mr. Terry is now requesting that the Board
award him the remaining surplus funds in the amount of $86,998.34. Per said Virginia Code
Section, the Board, “[u]pon request of the former owner, his heirs or assigns, or unknown
beneficiary of any real estate sold under this article, and after a showing of a prior entitlement
thereto, the governing body of any county or city which has received such surplus funds may, in
its discretion, grant relief, by ordinance, to such former owner, heir, or assign, or unknown
beneficiary and pay over such amount as the governing body may deem appropriate to such
former owner, heir, assign, or unknown beneficiary” (emphasis added).
Mr. Terry has hired several attorneys since Attorney Rosser to represent him in this matter. To
date, none of these attorneys have formally appeared to represent Mr. Terry’s related interests
before the Board.
FINANCIAL SOURCE AND FISCAL IMPACT:
The $86,998.34 in excess funds would have to come from the County’s Unobligated General
Fund and require a County Budget Amendment.
RECOMMENDATION:
As authorized by Virginia Code § 58.1-3967, County Staff recommends the Board exercise its
discretion to deny Mr. Terry’s request for $86,998.34 in excess funds in this matter.

Virginia Code § 58.1-3967. How proceedings instituted; parties; procedure generally; title
acquired; disposition of surplus proceeds of sale.
Proceedings under this article for the appointment of a special commissioner under § 58.1-
3970.1 or the sale of real estate on which county, city, or town taxes are delinquent shall be by bill
in equity, filed in the circuit court of the county or city in which such real estate is located, to
subject the real estate to the lien for such delinquent taxes.
Any party with an interest in such real estate, including a lienor or person with a claim of title, but
not including a person whose interest in the real estate is secured by a deed of trust properly
recorded, shall file his claim within 90 days after notice of such proceedings. Failure to timely file
shall bar any such claims.
Any party who is not otherwise served shall be served by publication pursuant to § 8.01-316. Any
person served by publication may petition to have the case reheard, but, notwithstanding § 8.01-
322, only for good cause shown, and only within 90 days of entry of the confirmation of sale.
All necessary parties shall be made parties defendant. A guardian ad litem shall be appointed for
persons under a disability as defined in § 8.01-2, and for all persons proceeded against by an order
of publication as parties unknown. The beneficiary or beneficiaries under any deed of trust,
security interest or mortgage shall not be deemed necessary parties, provided any trustee under the
deed of trust, any mortgagee under the mortgage, and any lien creditor are given notice as
prescribed in § 58.1-3965, except that either the beneficiary or beneficiaries, or the trustee or
trustees, under any deed of trust, security interest or mortgage securing a financial institution, or
any lien creditor that is a financial institution, shall be necessary parties defendant. After filing of
suit and a lis pendens, any party who thereafter acquires an interest in the delinquent real estate,
including a lienor or party with a claim of title, shall not be deemed a necessary party, but shall be
permitted to intervene in the proceedings to file his claim. Failure to file such a claim shall bar any
such claim. The title conveyed to the purchaser at the judicial sale shall be held to bar any
disabilities of parties defendant, and shall be free of all claims of any creditor, person, or entity,
including those claims of beneficiaries under any deed of trust or mortgage, provided that notice
was given or the creditor, person, or entity was made a party defendant.
Such proceedings shall be held in accordance with the requirements, statutory or arising at
common law, relative to effecting the sale of real estate by a creditor's bill in equity to subject real
estate to the lien of a judgment creditor, provided that publication, if necessary, shall be as provided
by § 8.01-321.
In proceedings under this article, the character of the title acquired by the purchaser of such real
estate at such sale shall be governed by the principles and rules applicable to the titles of purchases
at judicial sales of real estate generally; however nothing herein shall be construed to affect any
easements recorded prior to the date of sale.
The former owner, his heirs or assigns of any real estate sold under this article shall be entitled to
the surplus received from such sale in excess of the taxes, penalties, interest, reasonable attorneys'
fees, costs and any liens chargeable thereon. If no claim for payment of the indebtedness secured

by any lien chargeable thereon is made by an unknown beneficiary of such lien, or if no claim for
such surplus is made by such former owner, his heirs or assigns, within two years after the date of
confirmation of such sale, then such amount secured by the lien of the unknown beneficiary,
surplus, or both, as applicable, shall be paid by the clerk of the court in which such suit was
instituted to the county, city, or town that received proceeds from the sale of the real estate. If a
county and a town receive proceeds from the same sale, then such surplus shall be divided between
the county and town pro rata based on the relative amount of proceeds received by each. Upon
request of the former owner, his heirs or assigns, or unknown beneficiary of any real estate sold
under this article, and after a showing of a prior entitlement thereto, the governing body of any
county or city which has received such surplus funds may, in its discretion, grant relief, by
ordinance, to such former owner, heir, or assign, or unknown beneficiary and pay over such
amount as the governing body may deem appropriate to such former owner, heir, assign, or
unknown beneficiary.

SUMMARY:
The Danville Redevelopment and Housing Authority (“DRHA”) has recently purchased fourteen
(14) acres in the County with the intent of constructing ten (10) homes for workforce housing
(“Project”). DRHA desires to request a $50,000 Community Development Block Grant
(“CDBG”) Planning Grant from the Virginia Department of Housing and Community
Development (“DHCD”) to fund a feasibility study, environmental assessment, and the
development of construction plans for the Project. Based on CDBG guidelines, the County is
required to be the applicant and act as Fiscal Agent for the Project. The West Piedmont Planning
District Commission has agreed to serve as the Grant writer and administrator. DRHA
representatives will be present to answer any of the Board’s related questions.
FINANCIAL IMPACT AND FUNDING SOURCE:
None.
RECOMMENDATION:
County Staff recommends the Board authorize County Staff to apply on behalf of DRHA
requesting $50,000 from the CDBG Planning Grant Program for the Project.
