AMENDMENT PURSUANT TO BASIC SERVICES AGREEMENT
BETWEEN SCS AND PITTSYLVANIA COUNTY FOR SOLID WASTE
MANAGEMENT CONSULTING, ENGINEERING, AND ENVIRONMENTAL
MONITORING SERVICES
DESIGN, ENGINEERING & ADDITIONAL SERVICES FOR ONE REGIONAL COLLECTION CENTER & TWO NEIGHBORHOOD COLLECTION CENTERS
WORK ORDER #5
1. SCOPE OF SERVICES TO BE PERFORMED:
This scope of services outlines the tasks identified by SCS Engineers (SCS) in coordination with the
Pittsylvania County (County) Solid Waste and Recycling Department necessary to implement three
additional Solid Waste and Recycling Compactor Sites/Convenience Centers (Centers). These
Centers are anticipated to consist of one new “Regional” Collection Center and two new
“Neighborhood” Collection Centers.
SCS’s tasks in this Work Order are anticipated to involve the following activities for each of the three
anticipated Centers: assistance during site evaluation and suitability reviews; local permitting and
engineering, design, and development of construction documents; construction bidding and
contractor selection assistance; construction administration; and construction quality assurance
(CQA).
For purposes of conducting this assignment, SCS has structured our proposed scope of services into
five separate tasks. For all tasks, activities will be repeated to develop each of three new Centers.
Since the size, complexity, level-of-effort, and overall scope of the Regional Center development is
anticipated to be greater than that of the two Neighborhood Centers, SCS anticipates incurring
additional costs for this Center. Our budgetary fee estimate calculates these additional costs via
applying a multiplier of 50% of the baseline costs broken down by task and presenting these
separately for the Regional Center. A total budgetary compensation estimate is presented at the end
of this document; in addition, Attachment A presents a budgetary fee estimate broken down by task
and Attachment B presents an anticipated schedule of various activities associated with the
development of the three Centers.
TASK 1 – SITE EVALUATION AND SUITABILITY REVIEW
For each of the Center site areas, SCS will coordinate with our surveying subconsultant to develop
topographic surveys of the sites with delineations of property boundaries, utilities (overhead and
buried), easements, other surface and subsurface features, etc. The surveys will be conducted by a
licensed professional surveyor; it is anticipated at least two of the surveys will be able to be
performed during the same surveyor mobilization. The actual scope of the surveys may depend on
the particular sites selected, but should be sufficient to serve as a basis for local permitting,
engineering, and design. Drawings based on the field surveys conducted will be made available in
electronic CAD format.

SCS will evaluate the extent that the sites warrant geotechnical testing or a Traffic Impact Analysis
(TIA) prior to design/construction. Additional assessments performed under Task 1 will include
investigating whether any existing entrances and exits to the sites are compliant with VDOT
regulations, and assessing whether it is feasible to develop new access as part of the new Center
project if required. These issues will be discussed with the County during an in-person site
reconnaissance. This reconnaissance should occur after SCS has reviewed the site survey and may
coincide with other initial meetings outlined elsewhere in this Work Order to optimize time spent
performing field and other activities requiring an in-person presence.
Our budgetary fee estimate for Task 1 includes an allocation for a reconnaissance, but does not
include monies for performing geotechnical testing or preparation of a TIA if one or both is deemed
to be necessary. Based on the specific site conditions, SCS and the County will outline the detailed
activities that are warranted to further investigate the sites in order to fully establish its suitability for
the proposed Centers.
If geotechnical testing is required, SCS will develop and submit a separate Work Order outlining our
approach and costs to coordinate recording in-situ measurements and/or obtain soil samples in the
areas that will involve placement of critical infrastructure (pavement, concrete work, equipment,
utilities), as appropriate. If required, samples will be delivered to a geotechnical testing laboratory for
the appropriate tests and methods, which may involve:
Compaction by Standard Proctor (ASTM D-698), Classification (ASTM D-2487), Atterberg
Limits (ASTM D-4318), grain size analysis (ASTM D-422), moisture content (ASTM D 2216
and or 4643) and permeability (ASTM D-5084), if warranted.
In-place field density tests per guidelines from ASTM D-1556 “Test Method for Density and
unit Weight of Soil in-Place by Sand Cone Method” and from ASTM D-4959 “Test method for
Determination of Water (Moisture) Content of Soil by Direct Heating Method.”
Compaction testing per ASTM D-698 “Laboratory Compaction Characteristics Using the
Standard Effort.”
ASTM D-2216 “Laboratory Determination of Water (Moisture) Content of Soil and Rock by
Mass.”
If performed, geotechnical laboratory testing will be in general accordance with the specified
moisture-density relationship and results will be included in a Geotechnical Testing Report
presenting SCS’s findings and recommendations regarding development of the convenience center
improvements.
If a TIA is required, SCS will develop and submit a separate Work Order outlining our approach and
costs to conduct a TIA for the subject new Center. The results of the study will be issued to the
County. Preparation of a TIA may be required to present traffic capacity analysis, turning movement
counts, intersection levels-of-service, turn lane warrant analysis, recommended lane configurations,
and similar assessments. Other activities may need to include assignment of right-of-way, options for
stop control, traffic considerations during construction, etc.
TASK 2 – LOCAL PERMITTING & FINAL DESIGN
This task addresses the engineering efforts required to prepare permitting documentation and final
design documents. Our design engineering activities will involve the following:
Prepare final design drawings for the establishment of three new convenience centers. We
anticipate the drawings will include multiple 24” x 36” layout sheets and detail sheets.

The design documents will include technical specifications for the facilities. The specification
sections will address earthwork, concrete, pavement, electrical supply, fencing, landscaping,
driving surfaces, attendant buildings, and select other site elements. We have assumed the
County will be procuring the containers and compactors directly.
Perform a quantity take-off, contact manufacturers and contractors to obtain current unit
pricing, and develop an engineer’s cost estimate for the project. A complete tabulation shall
be furnished showing the breakdown of Total Project Cost with attached detailed estimates
for major categories, including construction and equipment.
Erosion and Sediment Control (ESC) Plans will be prepared in accordance with Pittsylvania County
Code and any additional requirements outlined by the County. Information required within the Plans
may include, but may not be limited to, a project description, existing site conditions, adjacent areas,
off site areas, soils, potential critical erosion areas, proposed ESC measures, proposed permanent
stabilization, stormwater runoff considerations, ESC calculations. The ESC Plans will include site
drawings that show a vicinity map, north arrow, existing contours, final contours, existing vegetation,
stream buffers (perimeter of parcel buffers), existing drainage patterns, critical erosion areas, off-site
areas, limits of clearing and grading, proposed site development, locations of proposed controls,
maintenance, utilities, and necessary calculations.
The Stormwater Management (SWM) Plans will be prepared in accordance with the Pittsylvania
County Code and Part IIB of the Virginia Stormwater Management Program (VSMP) Regulations.
Information required within the Plans includes, but is not limited to, a narrative that includes a
description of site conditions (current and post development), a general description of the proposed
SWM facilities (type, location, surface waters), hydrologic and hydraulic computations, verification of
compliance with water quality and quantity requirements, site topography maps (showing drainage
area, existing wetlands, floodplains, RPAs, soil types, existing structures, existing roads, parcel
information, proposed structures, and proposed SWM facilities).
SCS will complete the necessary documents in accordance with the requirements of the VSMP and
the Pittsylvania County Code in the event that the disturbed area at the sites are greater than 1 acre,
which is definitely anticipated for the Regional Center but is somewhat uncertain for the two
Neighborhood Centers:

SCS will incorporate the ESC Plans and SWM Plan drawings in the final design plan sets, which will
be utilized for land disturbance, stormwater permitting, and final site plan approval. SCS will submit

the Land Disturbance Permit Package to the local administrator and submit the VSMP General
permit Application to VDEQ as required.
SCS will submit draft design documents to the County for review and comment and meet with the
County to review the draft design documents, if desired. Other actions include revising the draft
documents to incorporate comments as appropriate, submitting final design documents to the
County as required (record and construction copies of drawings and technical specifications) and
developing an AutoCAD drawing file. Final drawings will be sealed by a licensed engineer. A
construction takeoff cost estimate will also be developed. SCS will provide the required final design
plan sets including documents for land disturbance, site plan permitting, and final site plan approval.
Activities will conform to requirements of the County.
TASK 3 – BIDDING/CONTRACTOR SELECTION ASSISTANCE
Depending on the degree of parcel development required at the three selected convenience center
sites, significant construction activities will occur that necessitate solicitation of bids from
contractors in accordance with the County’s procurement practices. It is anticipated that the
development of multiple of the three proposed convenience centers will be performed under a single
construction contract. Upon completion of Task 2 permitting and final design, SCS will assist in
compiling bid forms and supporting documents for public issuance by the County, facilitating a pre-
bid meeting of potential bidders, issuing addenda (if warranted) and reviewing the bids that are
received. Also, we can assist the County with reviewing the contractors' qualifications and checking
references.
SCS will be available to participate in up to two in-person meetings (one of which is assumed to be
the Pre-Bid Meeting with potential bidders) and discussions related to bidding requirements and
process and/or contractor selection assignments. SCS can alternatively arrange teleconference
meetings for remote group discussions or remotely attend meetings when required for internal
project development, conferences with County personnel, meetings involving public participation,
etc. If the County believes it is appropriate, SCS can attend and/or facilitate a public participation
meeting under a separate Work Order.
In addition, SCS will review and provide responses to comments on project documents and designs
prepared during the course of the project. SCS will maintain communication by utilizing telephone
and/or email correspondence to understand comments prior to providing written responses.
TASK 4 – CONSTRUCTION ADMINISTRATION OVERSIGHT
Under Task 4, SCS will assist with construction oversight and serve as the County’s representative
with respect to certain aspects of administration and oversight of the construction contract. Our
activities are intended to be limited to engineering-related duties and our scope and budget assume
that County personnel are intimately engaged in the routine administrative duties necessary to
administer the contract. SCS’ work efforts will likely involve communications with the County and the
Contractor, reviews of shop drawings/submittals, responding to Contractor’s requests for information
or proposed deviations from the design, preparation of work change directives, technical review of
change orders and payment applications, participation at the pre-construction kickoff meeting and
up to two (2) construction progress meetings, development of a punch list after a project walk-
through at the conclusion of the project, discussion with the County and Contractor related to
impacts to the schedule attributed to technical issues, communications regarding adherence to the
conditions in the Contract Documents, and similar duties usually typically performed by the Engineer
during administration of a construction contract on an as-needed basis.

SCS will provide engineering services during the Construction Phase of the project, generally
comprised of activities between the Notice-to-Proceed and issuance of final payment to the
Contractor. SCS’s on-site field engineer will be supported in the office and field by the Project
Engineer/Manager and Project Director, as well as other members of SCS’s project team. Our
construction administration services will likely include the following:
Attend the pre-construction meeting with the County and Contractor’s Project Manager and
Superintendent. Review any technical questions and discuss schedule, material
substitutions, construction sequence, and other relevant issues. Prepare and distribute an
agenda and meeting minutes.
Attend up to two (2) routine construction progress meetings with the County and Contractor
representatives. Prepare and distribute to the County and all others in attendance a report of
the pertinent and salient technical engineering matters considered and conclusions reached
at each of these meetings.
Review shop drawings, material submittals, and Contractor’s requests for substitutions or
information. Evaluate submittals for conformance with Contract Documents such as the
Construction General SWM Permits. Provide details and interpretations, as necessary.
Recommend approval, rejection, or mandate corrections based on technical, contractual,
and functional adequacy. Maintain a Submittal Log to track the status of submittals and
maintain communications with the Contractor and Owner. Distribute approved submittals
and/or review comments to appropriate parties.
Critical documentation to be reviewed includes the selection of various materials and
adherence to VDOT and SWM/ESC measures and specifications.
Review technical engineering-related field modifications and changes to the collection center
configuration as proposed by the Contractor. Evaluate proposed field modifications for
consistency with the design intent and objectives. Prepare sketches or outline approaches
required to address field conditions impacting the site. Recommend approval or rejection
based on technical, contractual, and functional adequacy. Distribute approved submittals
and/or review comments to appropriate parties.
Facilitate communications among SCS, the Contractor, and the County to answer technical
engineering-related questions, resolve issues, and coordinate interpretations of the plans
and specifications.
Prepare technical elements of Change Order documentation and work change directives
complete with narrative description and justification for each item.
If found to be necessary, review Contractor’s Applications for Payment and compare with
Engineer’s quantities and unit prices. Evaluate work performed and installed to verify
quantities. Instruct Contractor regarding changes and recommend approval and forward to
County for processing, as appropriate. Determine the amounts owed to the Contractor based
upon observation of the work and evaluations of the Contractors' Applications for Payment,
and issue Certificates for Payment in such amounts, as provided in the Contract Documents.
The issuance of a Certificate for payment shall constitute a representation by SCS to the
County, based on our observations and inspections at the site and on the data comprising
the Contractor's Application for Payment, that the work has progressed to the point indicated;
that, to the best of SCS's knowledge, information and belief, the quality of the work is in
accordance with the Contract Documents and the Contractor is entitled to payment in the
amount certified.
Conduct a walk-through of the project, document the substantial completion inspection, and
provide a punch-list for completion. Issue a Certificate of Substantial Completion at such

time that the work is determined to be substantially complete as defined in the Contract
Documents. When incomplete, defective or deficient work has been remedied, inspect the
work and advise the County that all work has been satisfactorily completed. Follow-up with
the County and Contractor to resolve any issues regarding punch-list items.
Participate in the final acceptance inspection of the collection center components with
respect to their overall integrity and ability to perform as designed. Review Contractor’s final
payment application. Distribute final close-out meeting minutes.
We assume that the following Construction Administration duties will be the responsibility of County
personnel:
Communicate with County and Contractor regarding Construction Agreement execution and
related issues such as bonds, E-verify Affidavit, sales tax tracking forms, etc.
Schedule and chair the routine construction progress meetings with the County and
Contractor representatives. Prepare and distribute communication of the pertinent and
salient non-engineering matters considered and conclusions reached at each of these
meetings, together with such matters relating to the Project progress.
Review non-engineering field modifications and changes to the collection center
configuration as proposed by the Contractor. Evaluate proposed field modifications for
consistency with the intent and objectives of the project. Distribute approved submittals
and/or review comments to appropriate parties.
Facilitate routine communications among the SCS team, the Contractor, and the County to
answer questions and resolve issues.
Prepare administrative portions of Change Order documentation and work change directives.
Develop documentation necessary to solicit pricing from the Contractor related to additional
work or credit for work to be omitted from the contract.
Maintain files and records for correspondence, reports, photographs, requests for
information or clarification, submittals, meeting minutes, and other construction project
related documentation, and forward to various parties as appropriate.
Participate in the walk-through of the project, attend the substantial completion inspection,
and provide input on the punch-list for completion.
Upon completion of the Project and prior to issuing Final Certificates for Payment (as found
to be necessary), compute the total time for completion as allowed in the Contract, plus any
time extensions granted and identify the number of days, if any, in excess of the Contract
Time for which the Contractor appears liable for liquidated damages. Notify the Contractor of
any proposed assessments of liquidated damages, and allow the Contractor time to respond
thereto. Subsequently, prepare recommendation as to the amount of liquidated damages, if
any, to be assessed and the portion of such assessment attributed to the Contractor.
Participate in the final acceptance inspection of the collection center components.
Assemble, and review for completeness, written guarantees, affidavits, manuals of
instruction for operation, and other required closing papers of the Contractor and forward
them in organized three-ring binders to the County.
Estimated fees and labor efforts in Attachment A assume the Contract Time is 49 consecutive
calendar days. Because the nature of the collection center construction project will likely involve
periods of more intense construction efforts along with periods of relatively low levels of construction
activity, the manpower resources are presented in terms of average weekly labor efforts during the
Contract Time. As with any construction administration project, the level of effort required by SCS is

directly dependent on the Contractor’s performance, schedule, and field conditions encountered
during construction.
TASK 5 – CONSTRUCTION QUALITY ASSURANCE
Under Task 5, SCS will perform periodic, part-time construction quality assurance (CQA) inspection
services necessary to observe the Contractor’s performance of the Work. This is often termed
resident engineering, or CQA, and involves observation of the construction activities related to the
major features associated with the collection centers and associated features, comparison of the
installed product with the Drawings and Technical Specifications included in the Contract
Documents, observation and documentation of testing, discussions and communication with the
Contractor and County related to the Work. Our on-site field activities are intended to be limited to
engineering-related duties and our scope and budget assume that County personnel are intimately
engaged in routine observations of contractor performance and progress necessary to administer
the contract.
SCS will provide a qualified field engineer to perform on-site construction engineering and CQA
activities during the installation of the collection center during the Construction Phase of the project.
SCS efforts will involve observation of the construction activities and documentation as to the
conformance of the work product to the Contract Documents. Our CQA inspection services will likely
include the following:
Conduct periodic observation of the work activities during the project on a part-time basis as
may be necessary to monitor the progress and observe in detail the quality of work and to
observe the extent to which the work is proceeding in accordance with the Contract
Documents and in accordance with applicable laws, statutes, ordinance, codes, regulations,
orders and decrees applicable to the project.
Critical activities to be observed include grading, asphalt paving, concrete pours, compactor
pad construction, entrance/exit transition onto public roadways, and electrical power
installation. SCS will maintain a presence at the site during these activities in order to
observe and document, monitor construction materials and methods, and verify general
compliance with the construction documents.
Observe equipment start-up and demonstration. SCS will participate with the manufacturer’s
representatives and Contractor to observe demonstration and functional testing of the
equipment installed under this project, such as compactor units, attendant shed/light pole
electrical components, and proper gate operation.
Observe site restoration efforts and repairs to erosion and sediment control features.
Prepare and submit written reports for each site visit in the form of daily field reports.
Conduct observations and site visits as may be required to fulfill obligations as the County’s
Representative.
Report to the County unsatisfactory, faulty, or defective work that has not been corrected. As
its representative, SCS will identify defects and deficiencies in the Work, verify conformance
with the Contract Documents, communicate problems to the County and Contractor, and
follow-up with all parties to confirm that such issues are resolved in a manner acceptable to
the County.
Our CQA inspection services do not anticipate that SCS will perform any construction surveying or
soils or other materials testing during the construction period (which is expected to be the
responsibility of the Contractor).

Estimated fees and labor efforts in Attachment A assume the Contract Time is 49 consecutive
calendar days. Because the nature of the project will likely involve periods of more intense
construction efforts along with periods of relatively low levels of construction activity, the manpower
resources are presented assuming approximately 10 hours of average weekly on-site CQA labor
efforts during the Contract Time. As with any CQA project, the level of effort required by SCS is
directly dependent on the Contractor’s performance, schedule, and field conditions encountered
during construction.
2. WORK ORDER SCHEDULE:
SCS is prepared to commence the work efforts as described above upon receiving authorization from
the County to proceed. The durations of these tasks are for individual centers and are summarized
below:

3. COMPENSATION: Compensation for each Convenience Center shall be as indicated
below.
SCS will be compensated for time and expenses in accordance with SCS's standard
rates in effect at the time of performance, provided that total compensation will not
exceed $64,700 for each of the two Neighborhood Centers and $96,900 for the
Regional Center (for a total of $226,300) without the Client’s authorization.

Climbing Cables: Our climbing cables are flexible enough to provide movement, yet strong
enough to last. Our ropes are made from 6 polyester cords with steel reinforcement wrapped around
a synthetic fiber core. Each cord contains 8 galvanized steel strands tightly covered with polyester
multi-fibers. Our RopeVenture® cables consist of 6 strands, each containing 24 stainless steel reinforcing
strands within a nylon sleeve, wrapped around a solid nylon core.
Aluminum Connectors: Swivel connectors at the end of our ropes allow assembly at any
angle with no unwanted twists in the net. The aluminum fittings used to secure the joints are swaged in place
to prevent any movement between the rope and fittings that could cause wear.

BCI Burke Company, LLC (“Burke”) warrants that all standard products are warranted to be free from defects in materials and workmanship, under normal use and service,
for a period of one (1) year from the date of invoice.

In addition, the following products are warranted, under normal use and service from the date of invoice as follows:
• One Hundred (100) Year Limited Warranty on aluminum and steel upright posts (including Intensity®, Voltage®, Nucleus®, Little Buddies® and ELEVATE®/ACTIVATE®)
against structural failure due to corrosion, deterioration or workmanship.
• One Hundred (100) Year Limited Warranty on KoreKonnect® clamps against structural failure due to corrosion, deterioration or workmanship.
• One Hundred (100) Year Limited Warranty on Hardware (nuts, bolts, washers)

• Ten (10) Year Limited Warranty on NaturePlay® Boulders and GFRC products against structural failure due to natural deterioration or workmanship. Natural wear, which
may occur with any concrete product with age, is excluded from this warranty
• Ten (10) Year Limited Warranty on Full Color Custom Signage against manufacturing defects that cause delamination or degradation of the sign. Full Color Custom Signs
also carry a two (2) year warranty against premature fading of the print and graphics on the signs.
• Five (5) Year Limited Warranty on Intensity® and RopeVenture® cables and LEVEL X® flex bridge against premature wear due to natural deterioration or manufacturing
defects. Determination of premature wear will be at the manufacturer’s discretion.
• Five (5) Year Limited Warranty on swing seats and hangers; Kid Koaster® Trolleys and other moving parts against structural failure due to materials or workmanship.
• Five (5) Year Limited Warranty on PlayEnsemble™ cables and mallets against defects in materials an d workmanship.
• Three (3) Year Limited Warranty on electronic panel speakers, sound chips and circuit boards against electronic failure caused by manufacturing defects.
The warranty stated above is valid only if the equipment is erected in conformity with the layout plan and/or installation instructions furnished by BCI Burke Company,
LLC using approved parts; have been maintained and inspected in accordance with BCI Burke Company, LLC instructions. Burke’s liability and your exclusive remedy
hereunder will be limited to repair or replacement of those parts found in Burke’s reasonable judgment to be defective. Any claim made within the above stated
warranty periods must be made promptly after discovery of the defect. A part is covered only for the original warranty period of the applicable part. Replacement
parts carry the applicable warranty from the date of shipment of the replacement from Burke. After the expiration of the warranty period, you must pay for all parts,
transportation and service charges.
Burke reserves the right to accept or reject any claim in whole or in part. Burke will not accept the return of any product without its prior written approval. Burke will
assume transportation charges for shipment of the returned product if it is returned in strict compliance with Burke’s written instructions.
THE FOREGOING WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED

abnormal use, lack of maintenance, or other cause not within Burke’s control; and
Limitation of Remedies: Burke is not liable for consequential or incidental damages, including but not limited to labor costs or lost profits resulting from the use of or
inability to use the products or from the products being incorporated in or becoming a component of any other product. If, after a reasonable number of repeated
efforts, Burke is unable to repair or replace a defective or nonconforming product, Burke shall have the option to accept return of the product, or part thereof, if such
does not substantially impair its value, and return the purchase price as the buyer’s entire and exclusive remedy. Without limiting the generality of the foregoing, Burke will
not be responsible for labor costs involved in the removal of products or the installation of replacement products. Some states do not allow the exclusion of incidental
