9. HEARING OF THE CITIZENS
Each person addressing the Board under Hearing of the Citizens shall be a resident or
land owner of the County, or the registered agent of such resident or land owner. Each
person shall step up, give his/her name and district in an audible tone of voice for the
record, and unless further time is granted by the Chairman, shall limit his/her address to
three (3) minutes. No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board as a body
and not to any individual member thereof. Hearing of the Citizens shall last for a
maximum of forty-five (45) minutes. Any individual that is signed up to speak during
said section who does not get the opportunity to do so because of the aforementioned
time limit, shall be given speaking priority at the next Board meeting. Absent
Chairman’s approval, no person shall be able to speak who has not signed up.
10. PUBLIC HEARINGS
A. Rezoning Public Hearings
Pursuant to Article V, Division 6, of the Pittsylvania County Zoning Ordinance, the
Board of Supervisors have been empowered to hear and decide specific zoning issues
and zoning map changes in support of said Ordinance. In accomplishing this
important task, the Board is responsible for promoting the health, safety, and general
public welfare of the citizens of Pittsylvania County. The Board must ensure that all
of its decisions and regulations be directed to these goals and that each be consistent
with the environment, the comprehensive plan, and in the best interest of Pittsylvania
County, its citizens, and its posterity.

VIRGINIA: The Economic Development Committee of the Pittsylvania County Board
of Supervisors was held on Tuesday, September 17, 2019, in the Main Conference Room at 1
Center Street in Chatham, Virginia 24531. Robert W. “Bob” Warren, Chairman, called the
Meeting to Order at 3:30 p.m. The following Committee Members were present:

Deputy Clerk, were also present.
Approval of Agenda
Motion by Mr. Scearce, seconded by Mr. Warren, to approve Agenda, which was
unanimously approved by the Committee Members present.
New Business
(a) Discussion of SVMP Water and Sewer Memorandum of Understanding
Mr. Smitherman provided a draft Memorandum of Understanding (“MOU”) to the
Committee regarding water and sewer services at the Southern Virginia Mega Park at Berry Hill
(“SVMP”). He also provided a Resolution to authorize the County Administrator to execute the
MOU with the County, City, RIFA, and PCSA once finalized. Mr. Smitherman requested this
Resolution be added to the Business Meeting Agenda. Motion by Mr. Scearce, seconded by Mr.
Warren, to recommend to full Board for approval.
Mr. Smitherman also provided to the Committee the revised agreement with Thomas
Loehr, Consultant. The revision more clearly defines roles, responsibilities, and expectations.
The Agreement was effective July 1, 2019, and will expire on December 31, 2019.

Motion was made by Mr. Scearce, seconded by Mr. Warren, to enter Closed Session.

Mr. Aaron briefed the Board on the current restoration of the Old Calland's Post Office. Mr.
Farmer would like for Staff to reach out to the Historic Society and this be a joint effort with
everyone working together.
STAFF, COMMITTEE, AND/OR CONSTITUTIONAL OFFICER REPORTS
a. Welcome Signs Update (Staff Contact: Mark W. Moore); (10 minutes)
Mark Moore briefed the Board on the County’s Welcome Sign Program. There are twelve (12)
welcome signs located throughout the County. Four (4) of those locations are under contract,
with eight (8) signs still available. The landscaping is designed and installed by Health
Landscaping. The current sponsors under contract include Blair Construction, Centra Health,
Farm Bureau, and Mountain View Farms. There are three (3) different tier locations: US 29
Corridor is $5,000 per site annually, other major highways are $4,000 per site annually, and
secondary roads are $2,000 per site annually.
b. Discussion of Board's Recognition Policy (Staff Contact: Kaylyn M. McCluster); (10
minutes)
Mrs. McCluster reviewed the proposed revisions to the Board’s Recognition Policy. These
changes will allow a better definition of which recognition to be provided and still allow students
and others to be recognized at the Board's desire.
c. Cherrystone and Roaring Fork Dams Rehabilitation Update (Staff Contact: Richard
N. Hicks); (10 minutes)
Mr. Hicks stated for the past several months County Staff, the Town of Chatham, and the
Pittsylvania Soil and Water Conservation District have been meeting with Federal and State
Officials on the Supplemental Watershed Plans for the Cherrystone and the Roaring Fork Lake
Dams. Amendments were sought in the Agreements to clarify that approval of the Plans did not
mandate future funding by the Plan Sponsors. Mr. Blackstock stated there needs to be public
access to these lakes.
d. Potential Amendment to PCC § 6-3.1 Update (Staff Contact: J. Vaden Hunt, Esq.);
(10 minutes)
Mr. Hunt stated this item is just an update to the County Code to copy the State Code regarding
Pittsylvania County Code (“PCC”) § 6-3.1, Local County Tax Exemption. This will be on the
Business Meeting Agenda for the Board to authorize County Staff to advertise the proposed
revisions to PCC § 6-3.1, Local County Tax Exemption, for a Public Hearing for potential action
at the October Business Meeting.
e. Economic Development Committee Recommendations (Staff Contact: David M.
Smitherman); (10 minutes)
Mr. Smitherman stated the Economic Development Committee met this afternoon and there was
a Resolution and Memorandum of Understanding (“MOU”) provided to the Committee to
provide water service to the Southern Virginia Mega Park at Berry Hill. The MOU is still in
Draft form, and the requested action at the Business Meeting is approval of the Resolution to

authorize the County Administrator to execute the MOU between the County, City, RIFA, and

f. Discussion of Concealed Weapon Permit Application Fee (Supervisor Blackstock); (10
minutes)
Mr. Blackstock stated he had several citizens express their concerns regarding the concealed
weapon permit application fee. Upon research, it seems that most surrounding localities are in
line with what the County is charging, except for three (3). Mr. Scarce, Clerk of Court, was
present and requested the Board not change the fee associated with the application. He stated the
amount of work that goes into these applications is far more than the fee that is assessed. Mr.
Scearce commended Mr. Scarce and his Office on their hard work and professionalism each time
he has interacted with them. Mr. Blackstock stated upon the research and Mr. Scarce’s
comments, he is fine leaving the fee as is. Mr. Davis agreed with Mr. Blackstock.

worked on a Fire and Rescue Ordinance for approximately eighteen (18) months. Walter Bailey,
Moderator, was also present and stated he led the study team four (4) years ago in the County.
He traveled to the County seventeen (17) times throughout this process for various meetings. He
presented a draft document to the Fire and Rescue Association in February for review and
suggestions. There were no additional comments received and they continued to work through
the Spring to develop the final copy.

SUMMARY:
The County’s School System is currently using the former Armory as the Victory Academy. To
accommodate growth at the Victory Academy, the School System is requesting the authority to
add some additional rooms within the building. The School System is currently leasing the
property from the County and, per the attached Lease Agreement, any modifications to the
building require County approval. A sketch of the proposed modifications is attached for your
review and consideration. Mark W. Moore, Parks and Recreation Director, has reviewed the
proposed sketch and does not believe that it will impact the use of the Victory Academy’s
gymnasium.
FINANCIAL IMPACT AND FUNDING SOURCE:
None for the County. The cost of the modifications will be paid by the School System.
RECOMMENDATION:
County Staff recommends the Board approve the School System’s proposed modifications to the
Victory Academy as presented.

LEASE AGREEMENT
This LEASE AGREEMENT (the “Lease”), is made on ______ __, 2018 (“Date of
Execution”), between the BOARD OF SUPERVISORS OF PITTSYLVANIA COUNTY,
VIRGINIA (“Lessor”), and the SCHOOL BOARD OF PITTSYLVANIA COUNTY,
VIRIGNIA (“Lessee”), (singularly the “Party;” collectively the “Parties”).
WITNESSETH
THAT FOR AND IN CONSIDERATION of the mutual covenants and agreements herein
contained, the Parties do hereby covenant and agree as follows:
1. LEASE OF PROPERTY: Lessor hereby leases and demises, and Lessee hereby rents all
that real property with improvements thereon and appurtenances thereunto belonging, less
the gravel lower parking lot which the Lessor shall have exclusive use/access to, formerly
known as the Chatham Readiness Center/Armory, located on the West side of South Main
Street (U.S. Highway No. 29) near the intersection of Memorial Drive and South Main
Street in the Town of Chatham in Pittsylvania County, Virginia (the “Premises”).
2. COVENANTS OF OWNERSHIP; COORDINATED USE; QUIET ENJOYMENT:
Lessor covenants and agrees that it is the owner of the Premises demised. The Premises is
leased for the sole purpose of being a school. Any other primary use of the Premises by
the Lessee must be approved in writing by Lessor. Following coordination with the Lessee
during non-school hours, the Pittsylvania County Board of Supervisors, the Pittsylvania
County Department of Parks and Recreation, and Pittsylvania County
Administration/Staff, shall have use of the Premises. Except for said coordinated use,
Lessor also covenants that Lessee shall have quiet enjoyment thereof for the Lease’s
duration.
3. TERM OF LEASE; RENEWAL; TERMINATION: The term of this Lease shall be for
five (5) years, commencing as of the Date of Execution above. This Lease may be extended
for an additional four (4), one (1) year terms. Said extension notice shall be given in writing
by Lessee to Lessor at least sixty (60) days prior any Lease termination date. This Lease
may be terminated by either Party with one-hundred and twenty (120) days’ written notice
to other Party.
4. RENT; LATE FEE: Lessee covenants and agrees to pay to Lessor, as rental for the
Premises, the sum on one dollar and no cents ($1.00) per year. All rent payments or late
fees shall be made payable to the Treasurer of Pittsylvania County, Virginia, and sent to
the following address: 21 Main Street, P.O. Box 407, Chatham, Virginia 24531. There
shall be no late rent fee in this Lease.
5. REAL ESTATE AND PERSONAL PROPERTY TAXES: Lessor shall pay all real
estate taxes assesses against the Premises demised (if any) and shall also pay all personal

property taxes assesses against any of the personal property and fixtures hereby demised
(if any).
6. UTILITIES: Lessee shall pay for all its telephone, cable, internet or satellite television,
used on or upon the Premises. Lessor and Lessee shall equally split the costs of all other
utilities used on, in, and upon the Premises.
7. INSURANCE; INDEMNIFICATION:
A. INSURANCE: Lessor shall maintain all appropriate insurance on the Premises and its
contents.
B. INDEMNIFICATION OF LESSOR: Lessor shall not be liable for any damage to
property or injury arising from Lessee's occupation or use of the Premises, except as
may be caused by Lessor's failure to perform under the Lease. Lessee shall protect,
indemnify, defend, and save harmless the Lessor, his agents, or servants from and
against any and all claims, actions, damages, liabilities, and expenses (including
reasonable attorneys’ fees) resulting from the negligent, unlawful, or willful acts or
omissions of Lessee, Lessee’s employees, representative, agents, customers, invitees,
or visitors, or from Lessee's failure to perform any obligation imposed upon it by law
or the provisions of this Lease, notwithstanding any possible negligence (whether sole,
concurrent, or otherwise) on the part of Lessor, its agents, contractors, or servants.
8. MAINTENANCE OF THE PREMISES:
A. GENERAL MAINTENANCE OF PREMISES: Lessee shall maintain the Premises
always in a neat and orderly condition. All exterior signage shall be approved in writing
by Lessor.
B. EXTERNAL REPAIRS TO PREMISES; GRASS CUTTING; LANDSCAPING:
Lessor shall be responsible for maintaining the roof and exterior of the Premises,
cutting the grass, maintaining upper and lower parking lots, and landscaping.
C. INTERNAL MAINTENANCE OF PREMISES; MAINTENANCE/REPAIRS TO
HVAC, PLUMBING, WIRING, AND OTHER FIXTURES: Lessee shall maintain
all aspects of the interior of the Premises and be responsible for the maintenance of and
repairs to the HVAC (heating and air conditioning system(s)), plumbing equipment,
wiring, and any and all other fixtures in, on, or upon the Premises.
9. DESTRUCTION OF PREMISES: If Premises is totally destroyed by casualty or
becomes so extensively damaged, without fault of Lessee, so as to render the demised
Premises unusable by Lessee, Lessor or Lessee may elect to terminate this Lease, and the
proceeds of any insurance on the Premises or personal property leased hereunder shall be
the Lessor’s property.

10. ALTERATIONS OR IMPROVEMENTS: No alterations or improvements shall be
made to the demised Premises by the Lessee without prior written consent of Lessor. All
alterations or improvements made to the Premises shall be the property of Lessor at the
termination of the Lease.
11. ASSIGNMENTS AND SUBLEASE: No assignment or sublease of the rights of the
Lessee under this Lease shall be made without prior written consent of Lessor.
12. LESSOR’S RIGHT OF ENTRY: Lessor may, at reasonable times, enter upon the
demises Premises for inspecting the same.
13. BREACH OF COVENANTS: In the event Lessee fails to perform any of the other
covenants of this Lease to be performed by Lessee under this Lease, then Lessor shall have
the right, in addition to all other rights or remedies provided by law or equity, to: (i) without
demand or notice to re-enter, by force or otherwise, and take possession of the Premises
without being liable by doing said; and (ii) setoff against rents paid in advance for any
damages caused by such breach, with the Lessee being liable for any deficiency. In the
event Lessor fails to perform any of the covenants of this Lease to be performed by Lessor,
Lessee shall have all rights and remedies provided by law and equity. If an action is
brought to enforce any of the rights or remedies available to either party in the event a
breach of any term of this Lease, the prevailing party shall be entitled to all costs expended,
including reasonable attorneys’ fees, court costs, and litigation costs.
14. IMMEDIATE TERMINATION OF LEASE: In the event that Lessee should execute
any Deed of Assignment for the benefit of creditors, file a petition in bankruptcy, or should
the property of the Lessee be levied upon by any creditors, the Lessor, at its discretion,
shall have the option, if allowed by law or equity, to declare this Lease terminated.
15. WAIVER OF BREACH: The failure of Lessor to enforce one (1) or more of the terms
or conditions of the Lease, from time-to-time, shall not constitute a waiver of such terms
or conditions upon subsequent or continuing breach.
16. APPLICABLE LAW: This Lease shall be construed according to the laws of the
Commonwealth of Virginia.
17. VENUE: The legal venue for any litigation arising out of this Lease shall be the
appropriate court of Pittsylvania County, Virginia.
18. ENTIRE AGREEMENT: This Lease constitutes the entire agreement between the
Parties. This Lease may not be changed orally, but only by an agreement in writing, signed
by both Parties.

David M. Smitherman, County Administrator, received a letter from the Virginia Cooperative
Extension regarding the extreme dry conditions in Pittsylvania County, Virginia (the “County”),
since June. In the past, the Board has approved similar Resolutions to the attached to declare a
Drought Disaster in the County.

RECOMMENDATION:
County Staff recommends the Board approve Resolution # 2019-10-01 declaring a Drought
Disaster in the County.

Dear Mr. Smitherman:
I am writing to inform you of the adverse environmental conditions in Pittsylvania County
and the detrimental effect those conditions have had on the agricultural community.
Though spring rains were plentiful and widely received, drought conditions have been
forming since June. The frequency of rainfall and the amount received have rapidly
diminished with many areas of the County having been 30-45 days since the last
effective rainfall event. The coupling of inadequate rainfall and high heat conditions
have created a detrimental drought condition.
Due to these continually deteriorating conditions, staff members of Virginia Cooperative
Extension, Farm Service Agency and Natural Resources Conservation Service met
Thursday, September 19th to conduct an initial estimate of crop losses due to the
environmental condition currently being experienced by producers in the County. This
body, also known as the Pittsylvania Food and Agriculture Committee, feel that adverse
weather conditions warrant a Drought Disaster Declaration.
On behalf of Virginia Cooperative Extension – Pittsylvania County and the Pittsylvania
Food and Agriculture Committee, I request that you present this information to the
Pittsylvania Board of Supervisors and request that they consider a resolution to petition
the Governor to have Pittsylvania County declared a drought disaster for the current
growing season. If you should have questions or require additional information, please

Event Summary
Drought Intensity has worsened to Severe Drought Conditions (D2) for
a large portion of southeast WV and portions of northwest NC and
southwest VA. Moderate Drought Conditions (D1) cover the rest of the
NWS Blacksburg forecast area.
Over the next 7-8 days, wetting rains will be possible Sunday
afternoon/Monday, and next Friday (10/11). Otherwise, confidence is
moderate to high that dry conditions will occur between these systems.
Temperatures will be closer to normal.
Despite these opportunities for precipitation, weeks of historically
below normal precipitation will continue to bring an increased fire risk
and damage to crops and pastures.

VIRGINIA: At the Business Meeting of the Pittsylvania County Board of Supervisors on October
15, 2019, in the General District Courtroom of the Edwin R. Shields Courthouse Addition, the following
Resolution was presented and adopted:
WHEREAS, though Spring rains were plentiful and widely received, drought conditions have been

WHEREAS, the frequency of rainfall and the amount received have rapidly diminished with many areas

WHEREAS, additionally, data from the National Weather Service indicates that the County is in drought
conditions; and
WHEREAS, due to these continually deteriorating conditions, Virginia Cooperative Extension, Farm
Service Agency and Natural Resources Conservation Service Staff Members met Thursday, September 19, 2019,
to conduct an initial estimate of crop losses due to the environmental condition currently being experienced by
County producers. This body, also known as the Pittsylvania Food and Agriculture Committee, feels that adverse
weather conditions warrant a Drought Disaster Declaration, then
NOW, THEREFORE, BE IT RESOLVED, that the Pittsylvania County Board of Supervisors declare
a disaster area in the County due to the extreme drought, and petition the Honorable Ralph S. Northam, Governor
of the Commonwealth of Virginia, to declare the County a disaster area due to the extreme drought conditions to
provide the means for those affected to qualify for any available relief assistance; and
BE IT FURTHER RESOLVED, that a copy of this Resolution be forwarded to Governor Northam
respectfully requesting that he forward this Resolution to the U.S. Department of Agriculture on the County’s
behalf.

SUMMARY:
Due to the passage of the County’s New Public Safety Ordinance (Pittsylvania County Code
(“PCC”) Chapter 11) at the Board’s September Business Meeting, PCC Chapters 27 (Open
Burning) and 31 (Fire Prevention/Emergency Ambulance Service) can now be repealed. All
issues addressed therein are now covered by PCC Chapter 11. Accordingly, County Staff
requests the Board authorize a Public Hearing for the Board’s November Business Meeting to
allow for the potential repeal of PCC Chapters 27 and 31.
FINANCIAL IMPACT AND FUNDING SOURCE:
None.
RECOMMENDATION:
County Staff recommends the Board authorize the advertisement of a Public Hearing at the

The County’s Public Safety Department is required to check driver’s licenses of County Staff
who provide EMS care. This is a requirement of the State EMS rules and regulations. County
Staff is requesting permission to enter into a written agreement with the Virginia Department of
Motor Vehicles (“DMV”) that allows us to conduct said checks.

USER
Information Use Agreement
PURPOSE: To establish an agreement between the USER and the Department of Motor Vehicles (DMV) for access
to DMV records.
This Agreement made and entered into on this date: October 4, 2019, between Pittsylvania County Board of Supervisors,
hereinafter referred to as the USER, and the Commonwealth of Virginia, Department of Motor Vehicles, hereinafter referred to as DMV.
Witnesseth:
The term of this Agreement shall be for the period beginning on October 4, 2019 and shall continue for a period of two years,
ending on October 3, 2021 unless otherwise terminated by the USER upon thirty (30) days written notice to DMV, or terminated by DMV at
any time by written or verbal notice to the USER. DMV reserves the right to terminate this Agreement in part or in whole for any reason, at any
time, without prior notice at the sole discretion of DMV. Notice shall be deemed given on the date delivered to the other party, or, if sent by
mail, five (5) days from the date of mailing as indicated by the postal mark on the envelope.
This Agreement may be renewed for an infinite number of successive two-year periods. This Agreement shall not automatically renew.
Written notice of DMV’s intention to renew shall be given approximately sixty days prior to expiration of each contract period.
All modifications to this Agreement must be authorized in advance, in writing, by DMV. Under no circumstances shall the USER
proceed with changes to any aspect of this Agreement without express, prior written consent of DMV.
According to § 46.2-208 of the Code of Virginia, the Commissioner may enter into an agreement with any governmental authority
or business to exchange information specified in this section by electronic or other means.
Whereas, the USER requests the following:
Driver Information which relates to a driver’s license status and driver activity
Now, therefore, the USER hereby agrees without reservation or qualification to comply with all statutes and regulations, whether
Federal or State, and all DMV policies pertaining to personal information disseminated by DMV, which statutes and regulations include
but may not be limited to: Virginia Code §§ 46.2-208, 46.2-209 and 46.2-210, the Federal Driver’s Privacy Protection Act (DPPA), 18
U.S.C. §§ 2721 through 2725 and DMV’s Information Security Policy. The USER further agrees and hereby certifies that the information
furnished from said record(s) shall be used for no purpose other than the purpose for which it was furnished.
The use of the seal of the Commonwealth of Virginia or any copyrighted material owned by the Commonwealth of Virginia is
prohibited.
AUTOMATED INTERFACE RESTRICTION: The USER and/or its agents will not develop or utilize any automated interfaces or
other methodologies for the extraction or manipulation of data or information (commonly referred to as screen-scraping or web-enabled
access) received from DMV pursuant to this Information Use Agreement without explicit review and written permission of DMV. DMV has
established this requirement because federal and state laws impose stringent requirements providing for the protection and presentation
of all data processed, stored, and transmitted via DMV’s systems, whether internet, extranet or intranet. DMV reserves the right to revoke
this Information Use Agreement if this provision is violated in any way.
The USER will keep on file and make available for inspection by DMV adequate written authorization by the subject for each
such personal information request to cover any requested dissemination when required by law. The USER further agrees and hereby
certifies that in the event the disclosure of such information leads to any claim or litigation, the USER will indemnify and hold DMV
harmless from any resulting liability.
The laws of the Commonwealth of Virginia shall govern this Agreement. Any litigation arising under or concerning this
Agreement shall be brought in a court of competent jurisdiction of the Commonwealth of Virginia. Should a court of competent
jurisdiction find any clause or provision of this Agreement unenforceable, that clause or provision shall be struck from the Agreement or
may be modified as the court sees fit in a manner that allows other clauses or provisions in the Agreement to remain in full force and
effect.
Security Requirements: All automated systems access users shall, at their own expense, comply with and maintain compliance
with all Commonwealth of Virginia IT security policies, standards, and guidelines, including any revisions, amendments, and/or
successors thereto. All automated systems access users shall make all necessary modifications to comply with and maintain
compliance with all revisions, updates, modifications, and/or successors to such policies, standards, and guidelines at its own costs.
All automated systems access users also shall, at their own expense, comply with and maintain compliance with the DMV IT
Architecture and Security Documents, as may be amended from time to time.
Copies of the current Commonwealth of Virginia IT security policies, standards, and guidelines are available on the VITA
Website at https://www.vita.virginia.gov/it-governance/itrm-policies-standards/.
Copies of the most recent DMV IT Architecture and Security Documents are available on the DMV Website at
https://www.dmv.virginia.gov/general/pdf/security_policy.pdf.
All automated systems access users will be responsible for reviewing these websites for revisions, updates and/or modifications
at least once every six months.
Audit Requirements: DMV reserves the right to audit USER to confirm compliance with all requirements in this agreement.
USER shall provide DMV with full access to and the opportunity to examine any records, electronic devices, and/or other materials
necessary to perform such audits.

USER certifies that the information obtained by Extranet access, is to be used for the sole purpose (stated in the USER's
application) of: pre-employment screening and participation in DMV’s Driver Alert Program plus risk management on current employees.
The USER covenants that the information shared, as contemplated by this Agreement, is personal to the USER and that the USER will
not permit the information to be utilized by any other person, firm, corporation or government agency unless expressly specified and
authorized in an addendum to this agreement. Further, USER covenants that the information obtained will be used solely to assist in the
delivery of services in the USER’s normal course of business, which expressly shall not include use in transactions in which the USER
has a personal interest or transactions in which there is a personal benefit accruing to the USER.
a) Misuse: DMV may immediately terminate this Agreement and/or deny USER’s access to DMV’s records, at the discretion of DMV,
upon suspected or actual misuse of information provided to USER pursuant to this Agreement or derived therefrom by USER or
any customer or third party supplied with information directly or indirectly by USER.
b) Unauthorized Access: If USER discovers that any of its employees or agents viewed a DMV customer record pursuant to
the access granted in this Agreement for any reason other than the stated purposes defined above, USER must
immediately notify DMV of the unauthorized access incident, and then report to DMV the results of any internal
investigation.
c) Changes in the Law: This Agreement is subject to immediate termination by DMV or the USER upon passage or interpretation by
a court of competent jurisdiction of any state or federal law or regulation that makes this Agreement or any provision contained
herein unlawful, or any law or regulation that would require DMV, as a result of uses authorized by this Agreement, to obtain
express written consent of the person to whom such information pertains.
d) Non-Compliance with the Terms of this Agreement: DMV may immediately terminate this Agreement and/or deny USER’s access to
DMV’s records, at the discretion of DMV, upon suspected or actual non-compliance with the terms of this Agreement.
Should the USER misuse the information obtained from DMV or otherwise fail to comply with the terms of this Agreement, then, in addition to
immediately terminating this Agreement and/or denying USER’s access to DMV’s records, DMV may:
1) recover all files and media suspected of containing information obtained from DMV;
2) Hold the USER responsible for any damages caused by the misuse of personal information obtained from DMV; and
3) make public any available evidence of such misuse of information and/or non-compliance with the terms of this
Agreement in order to allow victimized persons the opportunity to bring charges against the USER, either individually or
in concert.
In accordance with the provisions of Section 607 of the Federal Fair Credit Reporting Act (Pub. L. 91-508, as amended), the Federal
Driver's Privacy Protection Act, the Consumer Credit Protection Act (Pub. L. 90-321, as amended), the Virginia Government Data
Collection and Dissemination Practices Act (Virginia Code § 2.2-3800 et seq.), and § 46.2-208 et seq. of the Code of Virginia USER
hereby certifies that it is entitled to the use of the above requested information recorded in the files of DMV.
USER further certifies that I t has caused this Agreement to be signed by a duly authorized representative or agent, thereby binding
its authorized personnel and representatives to the conditions stated in this Information Use Agreement.
The USER, unless exempt from fees based on Virginia Code § 46.2-214, will be billed monthly for services outlined in this
Information Use Agreement. If payment for these services is not received within 30 days of billing, DMV will consider the payment
overdue and may take action to discontinue the services. USERS will be subject to DMV’s usual procedures for collection of past due
accounts.

Violation of the terms contained herein is punishable under state law as a Class 4 misdemeanor. Violation of Federal Public Law 91-508,

EXTRANET USER
MEMORANDUM OF UNDERSTANDING AND AGREEMENT
This Memorandum of Understanding and Agreement ("Agreement") is made and entered into by
and between Pittsylvania County Board of Supervisor, party of the first part, hereinafter referred
to as the Extranet User and the Commonwealth of Virginia, Department of Motor Vehicles, party
in the second part hereinafter referred to as DMV.
WHEREAS, DMV has developed an internet-based system by which transactions, information
and requests for information may be submitted to, and information received from, DMV
electronically (the "Extranet System"); and
WHEREAS, the electronic submission of transactions and information is of economic benefit to
Extranet User and DMV;
NOW THEREFORE, Extranet User and DMV agree to the following terms and conditions:
I. Purpose and Scope:
The purpose of this Agreement is to establish parameters, terms and conditions under
which Extranet User is authorized to submit transactions, information and requests for
information to, and receive information from, DMV via the Internet (the "Extranet System").
Descriptions of the transactions and information that Extranet User is authorized to submit and
information that Extranet User is authorized to receive via the Extranet System are set forth in an
attachment to this Agreement (Attachment A), which is incorporated herein by reference.
II. Access to Extranet System:
Access to Internet service is granted to Extranet User by DMV as a privilege, in order to
provide Extranet User a convenient method to perform an authorized function. Access to the
DMV system is made available to Extranet User for the sole purpose of performing those
functions authorized by DMV. Extranet User agrees that the DMV system will be used only to
perform the functions authorized by DMV and agrees that any other use by Extranet User, its
directors, officers, employees or agents constitutes the unauthorized use and misuse of the
Extranet System.
III. Responsibilities of Extranet User:
A. Information--Filing Requirements and Privacy/Confidentiality: (1) Filing: Extranet
User understands and accepts the ethical and legal responsibilities of filing information with
and/or obtaining information from DMV, recognizes that unauthorized access to information or
unauthorized filing or filing of false information is illegal and/or unethical and agrees to refrain
from any illegal and/or unethical action as a user of the Extranet System. Extranet User
understands and agrees that it is responsible for all information obtained or submitted via the
Extranet System by Extranet User and/or by means of Extranet User's access mechanisms and
that the unauthorized access to information and/or the unauthorized submission of information or
submission of any false or inaccurate information shall be deemed a misuse of the system.

(2) Confidentiality/Privacy: Extranet User understands and agrees that any information obtained
by Extranet User, its individual user(s), directors, officers, agents, or employees pursuant to this
Agreement and/or use of the Extranet System may be of a personal or confidential nature and
subject to and governed by restrictions upon access, use and/or dissemination of information set
forth in state and/or federal laws and/or regulations. Accordingly, Extranet User agrees without
reservation or qualification, that it shall comply with, and be subject to the penalties for violation
of, all laws and regulations, whether Federal or State, pertaining to the access, use and/or
dissemination of information, including, but not limited to, the Federal Driver's Privacy
Protection Act (18 U.S.C. § 2721 et. seq.), the Federal Fair Credit Reporting Act (Pub. L. 91-
508, as amended), the Consumer Credit Protection Act (Pub. L. 90-321, as amended), the
Virginia Government Data Collection and Dissemination Practices Act (Virginia Code § 2.2-3800
et seq.), the Virginia Computer Crimes Act (Virginia Code § 18.2-152.1 et seq.), and Virginia
Code §§ 46.2-208 and 58.1-3. Extranet User agrees that any information obtained by Extranet
User, its individual user(s), directors, officers, agents, or employees pursuant to this Agreement
and/or use of the Extranet System shall be used for no purpose other than the purpose for which it
was furnished.
B. Access Mechanisms, Procedures and Requirements: Extranet User shall not be permitted
access to the Extranet unless and until (i) DMV and Extranet User have executed this Agreement;
(ii) Extranet User has submitted and DMV has approved a completed and signed Application for
Extranet Transaction Access; and (iii) Extranet User has complied with all requirements of this
Section (B).
Upon execution of this Agreement, Extranet User must obtain one or more tokens from
DMV, which will be necessary for Extranet User to access Extranet and perform the functions
authorized herein. DMV shall bear sole discretion in determining the number of individual users
that will be authorized for, and tokens that will be issued to, Extranet User. DMV will charge
Extranet User a non-refundable fee for each token issued to Extranet User, as set forth on the
Application for Extranet Transaction Access (“US 531E/ER”) signed by Extranet User,
incorporated herein by reference. DMV shall notify Extranet User in writing of any change to the
fee and such new fee shall apply only to tokens issued thereafter.
Individual users of Extranet User will be assigned separate logon identifiers ("logon-ids")
and Personal Identification Numbers (“PINs”). In order to obtain logon ids and PINs for its
individual users, Extranet User must provide DMV with such individual users' personal/
identifying information as required by DMV.
Extranet User understands and agrees that all access mechanisms, including logon-ids, PINs,
passwords, user identifiers and tokens, are issued for specific, pre-identified individual users and
that neither Extranet User nor its individual users, officers, agents or employees will share logon-
id, PIN, password or user identifier information, or tokens, nor permit their use by, any individual
other than the individual user to whom such information or token is assigned. Extranet User
further agrees that logon ids, PINs, and/or tokens will not be reassigned to different individuals
without prior written approval of DMV.
Extranet User understands and agrees that the token has an expiration date and will not
function after the specified expiration date. Once Extranet User has been issued a token, it shall
be the sole responsibility of Extranet User to track the expiration dates of the tokens and to order
new replacement tokens sufficiently in advance of expiration in order to avoid a lapse in access to
the Extranet System. DMV will only ship replacements for expiring tokens upon receiving an

order from Extranet User. DMV will deactivate an expiring token 5 days after its replacement
has been shipped by DMV.
Extranet User agrees to maintain, in a secure manner, a log reflecting token numbers, the
date each token was received, the individual to whom the token was assigned, the expiration date
of the token and the final disposition of such token. Extranet User shall make the original log
available to DMV upon demand.
Extranet User hereby agrees that by entering into this Agreement, it assumes and bears the
entire risk of loss and/or damage to the token(s) provided by DMV, regardless of the cause of loss
or damage. In the event of any loss or damage to the token(s), regardless of the extent, nature or
cause of the loss or damage, Extranet User shall pay the applicable token fee, as set forth above,
to replace the token.
Extranet User agrees that DMV may also monitor use of tokens and if DMV detects non-use
or determines, solely within its discretion, misuse of a token, Extranet User shall return, or
provide DMV with written explanation of Extranet User's inability to return the token, within 5
days of written notice by DMV that the token must be returned. In the event that Extranet User is
unable to return the token, Extranet User shall submit to DMV within 5 days of written demand
by DMV the applicable token fee, as set forth above, to be used to replace the token.
Extranet User shall, within 15 days of expiration or earlier termination of this Agreement,
return, to DMV, in good repair, condition, and working order, any and all tokens issued to
Extranet User, by delivering the token(s), in a secure manner and at Extranet User's sole expense,
to a location specified by DMV. In the event Extranet User will be returning damaged tokens or
fewer tokens than were assigned or issued to Extranet User by DMV, then Extranet User shall,
within 15 days of expiration or earlier termination of this Agreement, pay to DMV the applicable
token fee, as set forth above, for each damaged or lost token.
Extranet User agrees that it will not disclose information concerning any access mechanism
of which Extranet User has knowledge, unless properly authorized by DMV to disclose such
information and that it will not use any access mechanism that has not been expressly assigned to
Extranet User by DMV.
Extranet User understands and agrees that Extranet User, its directors, officers, individual
users, agents and employees are prohibited from using or knowingly permitting the use of any
assigned or entrusted access mechanism (such as logon identifiers, PINs, passwords, user
identifiers, tokens, etc.) for any purpose other than the performance of authorized functions.
C. Monitoring Use: Extranet User agrees to monitor all use of the Extranet System in which
Extranet User's access mechanisms or equipment are used to gain access, whether authorized or
unauthorized, to the Extranet System and agrees to report any incidents of non-compliance with
the terms of this Agreement, immediately upon suspicion or detection thereof, to the DMV
contact specified in this Agreement.
Extranet User agrees that it shall establish and maintain procedures and record keeping
which will enable Extranet User to track use of, and Extranet access via, Extranet User's access
mechanisms. Extranet User shall, at a minimum, track, record, and when requested by DMV,
provide DMV with, the name of a particular individual who, by means of Extranet User’s access
to the Extranet, conducted a specified transaction or accessed specific information on a particular
date.

Extranet User agrees to appoint one officer or employee of Extranet User as “Security
Officer” for Extranet User and to provide DMV with the name and contact information of the
Security Officer, which shall be set forth in Extranet User's Application for Extranet Transaction
Access. The Security Officer shall serve as Extranet User's designated officer whose duty it shall
be to receive notices from DMV concerning Extranet User’s access to the Extranet, to receive and
maintain tokens and token information, and to provide DMV with information requested by DMV
from time to time during the term of this Agreement or any renewal thereof, which information
shall include but not be limited to, the status of all tokens issued to Extranet user, the names of
individuals to whom tokens have been issued, and the name of an individual who conducted a
particular transaction or used a token on a particular date. Notwithstanding the foregoing,
Extranet User shall bear responsibility and liability for any and all duties and informational
requirements pursuant to this Agreement, including those described hereunder as duties and
requirements of the Security Officer.
D. Remedies: Notwithstanding any other remedies available under applicable law, DMV
reserves the right to terminate Extranet User’s access to the Extranet System and to terminate or
suspend any certification or other agreement(s) between Extranet User and DMV, in the event of
any suspected or actual submission of any false or inaccurate information or unauthorized use by
Extranet User, its individual user(s), directors, officers, agents, or employees or by means of
Extranet User's access mechanism, as well as any suspected or actual non-compliance by Extranet
User, its individual users, directors, officers, agents or employees with the terms of this
Agreement or Extranet User's Application for Extranet Transaction Access.
E. Compliance with Law: In addition to the requirements set forth in Section III.A. (2) of this
Agreement, Extranet User agrees to comply with all applicable laws, rules, regulations, and
guidelines, whether Federal or State, related to this Agreement, its subject matter, or Extranet
User's performance hereunder, including but not limited to, the Virginia Computer Crimes Act
(§§ 18.2-152.1 through 18.2-152.15 of the Code of Virginia.)
F. Security Requirements: All extranet users shall, at their own expense, comply with and
maintain compliance with all Commonwealth of Virginia IT security policies, standards, and
guidelines, including and revisions, amendments, and/or successors thereto. All extranet users
shall make all necessary modifications to comply with and maintain compliance with all
revisions, updates, modifications, and/or successors to such policies, standards, and guidelines at
its own costs. All extranet users also shall, at their own expense, comply with and maintain
compliance with the DMV IT Architecture and Security Documents, as may be amended from
time to time.

Copies of the most recent DMV IT Architecture and Security Documents are available on the
DMV Website at http://www.dmv.virginia.gov/webdoc/general/security_docs.asp.
All extranet users will be responsible for reviewing these websites for revisions, updates and/or
modifications at least once every six months.
G. Antivirus Requirements: Extranet User understands and agrees that each and every
electronic device used to access data stored on DMV Systems must have commercially available

Antivirus software installed and actively running on the device, and that the Antivirus software
must be maintained with up-to-date virus definitions.
H. Audit Requirements: DMV reserves the right to audit Extranet User to confirm compliance
with all requirements in this agreement. Extranet User shall provide DMV with full access to and
the opportunity to examine any records, electronic devices, and/or other materials necessary to
perform such audits.
IV. Term of Agreement; Termination:
The term of this Agreement shall be for the period beginning on October 4, 2019 and shall
continue for a period of two years, ending on October 3, 2021 unless otherwise terminated by the
Extranet User upon thirty (30) days written notice to DMV, or terminated by DMV at any time by
written or verbal notice to the Extranet User. DMV reserves the right to terminate this
Agreement in part or in whole for any reason, at any time, without prior notice at the sole
discretion of DMV. Notice shall be deemed given on the date delivered to the other party, or, if
sent by mail, five (5) days from the date of mailing as indicated by the postal mark on the
envelope.
This Agreement may be renewed for an infinite number of successive two-year periods.
This Agreement shall not automatically renew. Written notice of DMV’s intention to renew shall
be given approximately sixty days prior to expiration of each contract period.
V. Miscellaneous:
This Agreement shall be governed by and interpreted in accord with the laws of the
Commonwealth of Virginia. Any disputes which arise out of this Agreement shall be tried by a
court of competent jurisdiction located in the Commonwealth of Virginia.
Titles and headings are inserted for convenience only and shall not be used to interpret the
Agreement.

SUMMARY:
Earlier this Summer, County Parks and Recreation Staff met onsite at Wayside Park with two (2)
national playground manufacturers to solicit design and quotes on a large, handicap accessible
playground for Wayside Park. Both playground manufacturers are considered Tier 1
Manufacturers in the playground industry, and both participate in nationally recognized
Cooperative Purchasing Agreements. After consideration of creativity of design, price, and
references, the playground design and bid that was selected by County Staff was from All
Recreation of Virginia, Inc., distributors of Burke Commercial Playgrounds. Design elements
include earth tone colors to fit into a rural park, a train to emulate the nearby train trestle,
handicap accessible ramps to allow for inclusive play, three (3) bays of swings, four (4) shade
structures, and a one hundred-foot (100’) zip line, to name a few. Playground amenities and size
will make this a “destination” playground, and one (1) of the centerpieces of the newly renovated
Wayside Park. County Staff anticipates that County residents will make the drive to this
Wayside Park just to experience this playground. If awarded, estimated installation is early
Spring of 2020.
FINANCIAL IMPACT AND FUNDING SOURCE:
This playground will be completely paid for with Grant Funding that has previously been
appropriated into the County Budget. This playground is procured through the BCI Burke
National IPA Contract #R170301-VA-303904 as assigned to All Recreation of Virginia, Inc.
Connie Gibson, Purchasing Manager, has reviewed and approved all related documentation.
RECOMMENDATION:
County Staff recommends the Board award the contract to All Recreation of Virginia, Inc., using
the National IPA Contract #R170301-VA-303904 for the purchase of a playground for Wayside
Park in the amount of $192,000.00.

Climbing Cables: Our climbing cables are flexible enough to provide movement, yet strong
enough to last. Our ropes are made from 6 polyester cords with steel reinforcement wrapped around
a synthetic fiber core. Each cord contains 8 galvanized steel strands tightly covered with polyester
multi-fibers. Our RopeVenture® cables consist of 6 strands, each containing 24 stainless steel reinforcing
strands within a nylon sleeve, wrapped around a solid nylon core.
Aluminum Connectors: Swivel connectors at the end of our ropes allow assembly at any
angle with no unwanted twists in the net. The aluminum fittings used to secure the joints are swaged in place
to prevent any movement between the rope and fittings that could cause wear.

for a period of one (1) year from the date of invoice.

also carry a two (2) year warranty against premature fading of the print and graphics on the signs.
• Five (5) Year Limited Warranty on Intensity® and RopeVenture® cables and LEVEL X® flex bridge against premature wear due to natural deterioration or manufacturing
defects. Determination of premature wear will be at the manufacturer’s discretion.
• Five (5) Year Limited Warranty on swing seats and hangers; Kid Koaster® Trolleys and other moving parts against structural failure due to materials or workmanship.
• Five (5) Year Limited Warranty on PlayEnsemble™ cables and mallets against defects in materials an d workmanship.
• Three (3) Year Limited Warranty on electronic panel speakers, sound chips and circuit boards against electronic failure caused by manufacturing defects.
The warranty stated above is valid only if the equipment is erected in conformity with the layout plan and/or installation instructions furnished by BCI Burke Company,
LLC using approved parts; have been maintained and inspected in accordance with BCI Burke Company, LLC instructions. Burke’s liability and your exclusive remedy
hereunder will be limited to repair or replacement of those parts found in Burke’s reasonable judgment to be defective. Any claim made within the above stated
warranty periods must be made promptly after discovery of the defect. A part is covered only for the original warranty period of the applicable part. Replacement
parts carry the applicable warranty from the date of shipment of the replacement from Burke. After the expiration of the warranty period, you must pay for all parts,
transportation and service charges.
Burke reserves the right to accept or reject any claim in whole or in part. Burke will not accept the return of any product without its prior written approval. Burke will
assume transportation charges for shipment of the returned product if it is returned in strict compliance with Burke’s written instructions.

abnormal use, lack of maintenance, or other cause not within Burke’s control; and
Limitation of Remedies: Burke is not liable for consequential or incidental damages, including but not limited to labor costs or lost profits resulting from the use of or
inability to use the products or from the products being incorporated in or becoming a component of any other product. If, after a reasonable number of repeated
efforts, Burke is unable to repair or replace a defective or nonconforming product, Burke shall have the option to accept return of the product, or part thereof, if such

SUMMARY:
At recent Legislative Committee Meetings, County Staff presented the attached proposed
revisions to Pittsylvania County Code (“PCC”) § 6-3.1, Local County Tax Exemption, for
consideration and potential adoption. Said revisions are supported by recent changes to Virginia
Code § 58.1- 3505 made by the General Assembly effective July 1, 2019. At the September
Business Meeting, the Board unanimously voted to advertise the same for a Public Hearing for
potential adoption at the October Business Meeting. Said Public Hearing has been duly
advertised in the Chatham Star Tribune.

PITTSYLVANIA COUNTY CODE
SEC. 6-3.1. LOCAL COUNTY TAX EXEMPTION.
A. Effective December 1, 1981 and thereafter, artificial or propane gas, firewood, coal, or heating
oil used for domestic consumption is hereby exempt from the one percent (1 %) local sales and
use tax pursuant to Sections 58-441.6 (g, l) and 58-441-49.3, Code of Virginia, 1950, as amended.
For the purpose of this ordinance domestic consumption shall mean the use of artificial or propane
gas, firewood, coal, or heating oil by an individual purchaser for other than business, commercial,
or industrial use as defined by the State Office of Taxation. This amendment is to take effect
December 1, 1981, and thereafter until changed by a duly authorized Ordinance.
B. The below list of items be exempt from local personal property taxation:
(1) Hhorses, mules, and other kindred animals.
(2) Ccattle.
(3) Ssheep and goats.
(4) Hhogs.
(5) Ppoultry.
(6) all farm machinery and farm implements. Grains and other feeds used for the nurture
of farm animals.
(7) Grain; tobacco; wine produced by farm wineries as defined in § 4.1-100, Code of
Virginia, 1950, as amended, and other agricultural products, as defined in § 3.2-6400, Code of
Virginia, 1950 as amended, in the hands of a producer.
(8) Farm machinery other than the farm machinery described in subdivision 10, and farm
implements, which shall include (i) equipment and machinery used by farm wineries as defined in
§ 4.1-100, Code of Virginia, 1950, as amended, in the production of wine; (ii) equipment and
machinery used by a nursery as defined in § 3.2-3800, Code of Virginia, 1950, as amended, for
the production of horticultural products; and (iii) any farm tractor as defined in § 46.2-100, Code
of Virginia, 1950, as amended, regardless of whether such farm tractor is used exclusively for
agricultural purposes.
(9) Equipment used by farmers or farm cooperatives qualifying under § 521 of the Internal
Revenue Code to manufacture industrial ethanol, provided that the materials from which the
ethanol is derived consist primarily of farm products.
(10) Farm machinery designed solely for the planting, production, or harvesting of a single
product or commodity.

The provisions of this Ordinance shall apply to the tax years beginning on and after January 1,
1977.
C. Household Goods Exempt from Taxation
All household goods and personal effects as defined in § 58.1-3504, Code of Virginia, 1950, as
amended, are hereby exempt from taxation, beginning on and after January 1, 2014.
1. Notwithstanding any provision of § 58.1-3503, Code of Virginia, 1950, as amended,
household goods and personal effects are hereby defined as separate items of taxation and
classified as follows:
A. Bicycles.
B. Household and kitchen furniture, including gold and silver plates, plated ware,
watches and clocks, sewing machines, refrigerators, automatic refrigerating machinery of any type,
vacuum cleaners and all other household machinery, books, firearms, and weapons of all kinds.
C. Pianos, organs, and all other musical instruments; phonographs, record players,
and records to be used therewith; and radio and television instruments and equipment.
D. Oil paintings, pictures, statuary, curios, articles of virtue, and works of art.
E. Diamonds, cameos or other precious stones and all precious metals used as
ornaments or jewelry.
F. Sporting and photographic equipment.
G. Clothing and objects of apparel.
H. Antique motor vehicles as defined in § 46.2-100, Code of Virginia, 1950, as
amended, which may not be used for general transportation purposes.
I. All-terrain vehicles, mopeds, and off-road motorcycles as defined in § 46.2-100,
Code of Virginia, 1950, as amended.
J. Electronic communications and processing devices and equipment, including but
not limited to cell phones and tablet and personal computers, including peripheral equipment such
as printers.
K. All other tangible personal property used by an individual or a family or
household incident to maintaining an abode. The classification above set forth shall apply only to
such property owned and used by an individual or by a family or household primarily incident to
maintaining an abode.
2. Notwithstanding any provision set forth above, household appliances in residential rental
property used by an individual or by a family or household incident to maintaining an abode shall
be deemed to be fixtures and shall be assessed as part of the real property in which they are located.

For purposes of this subsection, "household appliances" shall mean all major appliances

SUMMARY:
Currently, in the Pittsylvania County Code (“PCC”) § 35-122 Commercial Kennel, Veterinary,
Animal Hospital, there are specific setback and housing requirements that do not consider
varying site and area characteristics. This may prevent new or expansion projects that cannot
meet said requirements. On September 3, 2019, the County’s Planning Commission (“PC”) held
a Public Hearing and unanimously voted to remove PCC § 35-122 and add Commercial Kennels,
Veterinary and Animal Hospitals as a Special Use Permit (“SUP”) in the following Zoning
Districts: A-1, Agricultural District, and B-1, Business District, Limited. Provisions already
exist in B-2, Business District, General, M-1, Industrial District, Light Industry, and M-2,
Industrial District, Heavy Industry. The next step in the process is for the Board to hold a Public
Hearing to potentially adopt the above-amendments.

RECOMMENDATION:
County Staff supports the proposed Zoning Amendment as this approach will allow for
flexibility and for specific site characteristics to be considered in individual cases. Obtaining a
SUP for a Commercial Kennel, Veterinary and Animal Hospital will require two (2) Public

SUMMARY:
The County’s Juvenile & Domestic (“J&D”) Court Services has an Outreach Program that
provides supervision and intervention of youth before the Court. The goals of the Outreach and
Electronic Monitoring Programs are to reduce the number of new law violations while awaiting
trial, reduce the need for secure detention or other out of home placements, and to ensure Court
appearances for juveniles in the Program by providing close monitoring, crisis intervention, and
referral for services. The County’s Purchasing Department issued a Request for Proposals
(“RFP”) for said services. Said RFP was advertised on the County’s website, Virginia Business
Opportunity’s website, and the State’s Public Procurement Board. The County received two (2)
responses to the related RFP. The County’s Evaluation Committee ranked Youth Connect of
Virginia as the top scoring vendor and recommend the award of the contract to the same.
FINANCIAL IMPACT AND FUNDING SOURCE:
Funds have already been appropriated for FY2020 from the VJCCCA (Grant Funds).

Convenience Centers Capital Projections

At a prior meeting, the Board requested that County Staff develop a timetable for the design and
construction of the three (3) new proposed Convenience Centers, as well as develop an action
plan for several of the existing Convenience Centers that present the most problems to the
County citizens. County Staff is proposing to move forward with the design of the three (3)
Convenience Centers. Costs for the design and permitting would be covered in the existing FY
19/20 County Budget. A construction timetable would be determined with the adoption of the
FY 20/21 County Budget. Attached for your review and information is a copy of an amendment
to the current contract with SCS Engineers for said work. Also attached is a Power Point
presentation that details that cost by fiscal year. County Staff has also provided a list of
improvements needed for some of the existing Convenience Centers, and an estimate for all the
associated FY 19/20 capital costs. County Staff wishes to proceed with the design and
permitting of the three (3) proposed Convenience Centers, as well as make the necessary
improvements to the Convenience Centers listed in the presentation.
FINANCIAL IMPACT AND FUNDING SOURCE:
The cost for the projects will be paid from existing Capital Funds within the Solid Waste Fund.
RECOMMENDATION:
County Staff recommends proceeding with the design and permitting of the three (3) proposed

1. SCOPE OF SERVICES TO BE PERFORMED:
This scope of services outlines the tasks identified by SCS Engineers (SCS) in coordination with the
Pittsylvania County (County) Solid Waste and Recycling Department necessary to implement three
additional Solid Waste and Recycling Compactor Sites/Convenience Centers (Centers). These
Centers are anticipated to consist of one new “Regional” Collection Center and two new
“Neighborhood” Collection Centers.
SCS’s tasks in this Work Order are anticipated to involve the following activities for each of the three
anticipated Centers: assistance during site evaluation and suitability reviews; local permitting and
engineering, design, and development of construction documents; construction bidding and
contractor selection assistance; construction administration; and construction quality assurance
(CQA).
For purposes of conducting this assignment, SCS has structured our proposed scope of services into
five separate tasks. For all tasks, activities will be repeated to develop each of three new Centers.
Since the size, complexity, level-of-effort, and overall scope of the Regional Center development is
anticipated to be greater than that of the two Neighborhood Centers, SCS anticipates incurring
additional costs for this Center. Our budgetary fee estimate calculates these additional costs via
applying a multiplier of 50% of the baseline costs broken down by task and presenting these
separately for the Regional Center. A total budgetary compensation estimate is presented at the end
of this document; in addition, Attachment A presents a budgetary fee estimate broken down by task
and Attachment B presents an anticipated schedule of various activities associated with the
development of the three Centers.
TASK 1 – SITE EVALUATION AND SUITABILITY REVIEW
For each of the Center site areas, SCS will coordinate with our surveying subconsultant to develop
topographic surveys of the sites with delineations of property boundaries, utilities (overhead and
buried), easements, other surface and subsurface features, etc. The surveys will be conducted by a
licensed professional surveyor; it is anticipated at least two of the surveys will be able to be
performed during the same surveyor mobilization. The actual scope of the surveys may depend on
the particular sites selected, but should be sufficient to serve as a basis for local permitting,
engineering, and design. Drawings based on the field surveys conducted will be made available in
electronic CAD format.

SCS will evaluate the extent that the sites warrant geotechnical testing or a Traffic Impact Analysis
(TIA) prior to design/construction. Additional assessments performed under Task 1 will include
investigating whether any existing entrances and exits to the sites are compliant with VDOT
regulations, and assessing whether it is feasible to develop new access as part of the new Center
project if required. These issues will be discussed with the County during an in-person site
reconnaissance. This reconnaissance should occur after SCS has reviewed the site survey and may
coincide with other initial meetings outlined elsewhere in this Work Order to optimize time spent
performing field and other activities requiring an in-person presence.
Our budgetary fee estimate for Task 1 includes an allocation for a reconnaissance, but does not
include monies for performing geotechnical testing or preparation of a TIA if one or both is deemed
to be necessary. Based on the specific site conditions, SCS and the County will outline the detailed
activities that are warranted to further investigate the sites in order to fully establish its suitability for
the proposed Centers.
If geotechnical testing is required, SCS will develop and submit a separate Work Order outlining our
approach and costs to coordinate recording in-situ measurements and/or obtain soil samples in the
areas that will involve placement of critical infrastructure (pavement, concrete work, equipment,
utilities), as appropriate. If required, samples will be delivered to a geotechnical testing laboratory for
the appropriate tests and methods, which may involve:
Compaction by Standard Proctor (ASTM D-698), Classification (ASTM D-2487), Atterberg
Limits (ASTM D-4318), grain size analysis (ASTM D-422), moisture content (ASTM D 2216
and or 4643) and permeability (ASTM D-5084), if warranted.
In-place field density tests per guidelines from ASTM D-1556 “Test Method for Density and
unit Weight of Soil in-Place by Sand Cone Method” and from ASTM D-4959 “Test method for
Determination of Water (Moisture) Content of Soil by Direct Heating Method.”
Compaction testing per ASTM D-698 “Laboratory Compaction Characteristics Using the
Standard Effort.”
ASTM D-2216 “Laboratory Determination of Water (Moisture) Content of Soil and Rock by
Mass.”
If performed, geotechnical laboratory testing will be in general accordance with the specified
moisture-density relationship and results will be included in a Geotechnical Testing Report
presenting SCS’s findings and recommendations regarding development of the convenience center
improvements.
If a TIA is required, SCS will develop and submit a separate Work Order outlining our approach and
costs to conduct a TIA for the subject new Center. The results of the study will be issued to the
County. Preparation of a TIA may be required to present traffic capacity analysis, turning movement
counts, intersection levels-of-service, turn lane warrant analysis, recommended lane configurations,
and similar assessments. Other activities may need to include assignment of right-of-way, options for
stop control, traffic considerations during construction, etc.
TASK 2 – LOCAL PERMITTING & FINAL DESIGN
This task addresses the engineering efforts required to prepare permitting documentation and final
design documents. Our design engineering activities will involve the following:
Prepare final design drawings for the establishment of three new convenience centers. We
anticipate the drawings will include multiple 24” x 36” layout sheets and detail sheets.

The design documents will include technical specifications for the facilities. The specification
sections will address earthwork, concrete, pavement, electrical supply, fencing, landscaping,
driving surfaces, attendant buildings, and select other site elements. We have assumed the
County will be procuring the containers and compactors directly.
Perform a quantity take-off, contact manufacturers and contractors to obtain current unit
pricing, and develop an engineer’s cost estimate for the project. A complete tabulation shall
be furnished showing the breakdown of Total Project Cost with attached detailed estimates
for major categories, including construction and equipment.
Erosion and Sediment Control (ESC) Plans will be prepared in accordance with Pittsylvania County
Code and any additional requirements outlined by the County. Information required within the Plans
may include, but may not be limited to, a project description, existing site conditions, adjacent areas,
off site areas, soils, potential critical erosion areas, proposed ESC measures, proposed permanent
stabilization, stormwater runoff considerations, ESC calculations. The ESC Plans will include site
drawings that show a vicinity map, north arrow, existing contours, final contours, existing vegetation,
stream buffers (perimeter of parcel buffers), existing drainage patterns, critical erosion areas, off-site
areas, limits of clearing and grading, proposed site development, locations of proposed controls,
maintenance, utilities, and necessary calculations.
The Stormwater Management (SWM) Plans will be prepared in accordance with the Pittsylvania
County Code and Part IIB of the Virginia Stormwater Management Program (VSMP) Regulations.
Information required within the Plans includes, but is not limited to, a narrative that includes a
description of site conditions (current and post development), a general description of the proposed
SWM facilities (type, location, surface waters), hydrologic and hydraulic computations, verification of
compliance with water quality and quantity requirements, site topography maps (showing drainage
area, existing wetlands, floodplains, RPAs, soil types, existing structures, existing roads, parcel
information, proposed structures, and proposed SWM facilities).
SCS will complete the necessary documents in accordance with the requirements of the VSMP and
the Pittsylvania County Code in the event that the disturbed area at the sites are greater than 1 acre,
which is definitely anticipated for the Regional Center but is somewhat uncertain for the two
Neighborhood Centers:

SCS will incorporate the ESC Plans and SWM Plan drawings in the final design plan sets, which will
be utilized for land disturbance, stormwater permitting, and final site plan approval. SCS will submit

the Land Disturbance Permit Package to the local administrator and submit the VSMP General
permit Application to VDEQ as required.
SCS will submit draft design documents to the County for review and comment and meet with the
County to review the draft design documents, if desired. Other actions include revising the draft
documents to incorporate comments as appropriate, submitting final design documents to the
County as required (record and construction copies of drawings and technical specifications) and
developing an AutoCAD drawing file. Final drawings will be sealed by a licensed engineer. A
construction takeoff cost estimate will also be developed. SCS will provide the required final design
plan sets including documents for land disturbance, site plan permitting, and final site plan approval.
Activities will conform to requirements of the County.
TASK 3 – BIDDING/CONTRACTOR SELECTION ASSISTANCE
Depending on the degree of parcel development required at the three selected convenience center
sites, significant construction activities will occur that necessitate solicitation of bids from
contractors in accordance with the County’s procurement practices. It is anticipated that the
development of multiple of the three proposed convenience centers will be performed under a single
construction contract. Upon completion of Task 2 permitting and final design, SCS will assist in
compiling bid forms and supporting documents for public issuance by the County, facilitating a pre-
bid meeting of potential bidders, issuing addenda (if warranted) and reviewing the bids that are
received. Also, we can assist the County with reviewing the contractors' qualifications and checking
references.
SCS will be available to participate in up to two in-person meetings (one of which is assumed to be
the Pre-Bid Meeting with potential bidders) and discussions related to bidding requirements and
process and/or contractor selection assignments. SCS can alternatively arrange teleconference
meetings for remote group discussions or remotely attend meetings when required for internal
project development, conferences with County personnel, meetings involving public participation,
etc. If the County believes it is appropriate, SCS can attend and/or facilitate a public participation
meeting under a separate Work Order.
In addition, SCS will review and provide responses to comments on project documents and designs
prepared during the course of the project. SCS will maintain communication by utilizing telephone
and/or email correspondence to understand comments prior to providing written responses.
TASK 4 – CONSTRUCTION ADMINISTRATION OVERSIGHT
Under Task 4, SCS will assist with construction oversight and serve as the County’s representative
with respect to certain aspects of administration and oversight of the construction contract. Our
activities are intended to be limited to engineering-related duties and our scope and budget assume
that County personnel are intimately engaged in the routine administrative duties necessary to
administer the contract. SCS’ work efforts will likely involve communications with the County and the
Contractor, reviews of shop drawings/submittals, responding to Contractor’s requests for information
or proposed deviations from the design, preparation of work change directives, technical review of
change orders and payment applications, participation at the pre-construction kickoff meeting and
up to two (2) construction progress meetings, development of a punch list after a project walk-
through at the conclusion of the project, discussion with the County and Contractor related to
impacts to the schedule attributed to technical issues, communications regarding adherence to the
conditions in the Contract Documents, and similar duties usually typically performed by the Engineer
during administration of a construction contract on an as-needed basis.

SCS will provide engineering services during the Construction Phase of the project, generally
comprised of activities between the Notice-to-Proceed and issuance of final payment to the
Contractor. SCS’s on-site field engineer will be supported in the office and field by the Project
Engineer/Manager and Project Director, as well as other members of SCS’s project team. Our
construction administration services will likely include the following:
Attend the pre-construction meeting with the County and Contractor’s Project Manager and
Superintendent. Review any technical questions and discuss schedule, material
substitutions, construction sequence, and other relevant issues. Prepare and distribute an
agenda and meeting minutes.
Attend up to two (2) routine construction progress meetings with the County and Contractor
representatives. Prepare and distribute to the County and all others in attendance a report of
the pertinent and salient technical engineering matters considered and conclusions reached
at each of these meetings.
Review shop drawings, material submittals, and Contractor’s requests for substitutions or
information. Evaluate submittals for conformance with Contract Documents such as the
Construction General SWM Permits. Provide details and interpretations, as necessary.
Recommend approval, rejection, or mandate corrections based on technical, contractual,
and functional adequacy. Maintain a Submittal Log to track the status of submittals and
maintain communications with the Contractor and Owner. Distribute approved submittals
and/or review comments to appropriate parties.
Critical documentation to be reviewed includes the selection of various materials and
adherence to VDOT and SWM/ESC measures and specifications.
Review technical engineering-related field modifications and changes to the collection center
configuration as proposed by the Contractor. Evaluate proposed field modifications for
consistency with the design intent and objectives. Prepare sketches or outline approaches
required to address field conditions impacting the site. Recommend approval or rejection
based on technical, contractual, and functional adequacy. Distribute approved submittals
and/or review comments to appropriate parties.
Facilitate communications among SCS, the Contractor, and the County to answer technical
engineering-related questions, resolve issues, and coordinate interpretations of the plans
and specifications.
Prepare technical elements of Change Order documentation and work change directives
complete with narrative description and justification for each item.
If found to be necessary, review Contractor’s Applications for Payment and compare with
Engineer’s quantities and unit prices. Evaluate work performed and installed to verify
quantities. Instruct Contractor regarding changes and recommend approval and forward to
County for processing, as appropriate. Determine the amounts owed to the Contractor based
upon observation of the work and evaluations of the Contractors' Applications for Payment,
and issue Certificates for Payment in such amounts, as provided in the Contract Documents.
The issuance of a Certificate for payment shall constitute a representation by SCS to the
County, based on our observations and inspections at the site and on the data comprising
the Contractor's Application for Payment, that the work has progressed to the point indicated;
that, to the best of SCS's knowledge, information and belief, the quality of the work is in
accordance with the Contract Documents and the Contractor is entitled to payment in the
amount certified.
Conduct a walk-through of the project, document the substantial completion inspection, and
provide a punch-list for completion. Issue a Certificate of Substantial Completion at such

time that the work is determined to be substantially complete as defined in the Contract
Documents. When incomplete, defective or deficient work has been remedied, inspect the
work and advise the County that all work has been satisfactorily completed. Follow-up with
the County and Contractor to resolve any issues regarding punch-list items.
Participate in the final acceptance inspection of the collection center components with
respect to their overall integrity and ability to perform as designed. Review Contractor’s final
payment application. Distribute final close-out meeting minutes.
We assume that the following Construction Administration duties will be the responsibility of County
personnel:
Communicate with County and Contractor regarding Construction Agreement execution and
related issues such as bonds, E-verify Affidavit, sales tax tracking forms, etc.
Schedule and chair the routine construction progress meetings with the County and
Contractor representatives. Prepare and distribute communication of the pertinent and
salient non-engineering matters considered and conclusions reached at each of these
meetings, together with such matters relating to the Project progress.
Review non-engineering field modifications and changes to the collection center
configuration as proposed by the Contractor. Evaluate proposed field modifications for
consistency with the intent and objectives of the project. Distribute approved submittals
and/or review comments to appropriate parties.
Facilitate routine communications among the SCS team, the Contractor, and the County to
answer questions and resolve issues.
Prepare administrative portions of Change Order documentation and work change directives.
Develop documentation necessary to solicit pricing from the Contractor related to additional
work or credit for work to be omitted from the contract.
Maintain files and records for correspondence, reports, photographs, requests for
information or clarification, submittals, meeting minutes, and other construction project
related documentation, and forward to various parties as appropriate.
Participate in the walk-through of the project, attend the substantial completion inspection,
and provide input on the punch-list for completion.
Upon completion of the Project and prior to issuing Final Certificates for Payment (as found
to be necessary), compute the total time for completion as allowed in the Contract, plus any
time extensions granted and identify the number of days, if any, in excess of the Contract
Time for which the Contractor appears liable for liquidated damages. Notify the Contractor of
any proposed assessments of liquidated damages, and allow the Contractor time to respond
thereto. Subsequently, prepare recommendation as to the amount of liquidated damages, if
any, to be assessed and the portion of such assessment attributed to the Contractor.
Participate in the final acceptance inspection of the collection center components.

instruction for operation, and other required closing papers of the Contractor and forward
them in organized three-ring binders to the County.
Estimated fees and labor efforts in Attachment A assume the Contract Time is 49 consecutive
calendar days. Because the nature of the collection center construction project will likely involve
periods of more intense construction efforts along with periods of relatively low levels of construction
activity, the manpower resources are presented in terms of average weekly labor efforts during the
Contract Time. As with any construction administration project, the level of effort required by SCS is

directly dependent on the Contractor’s performance, schedule, and field conditions encountered
during construction.
TASK 5 – CONSTRUCTION QUALITY ASSURANCE
Under Task 5, SCS will perform periodic, part-time construction quality assurance (CQA) inspection
services necessary to observe the Contractor’s performance of the Work. This is often termed
resident engineering, or CQA, and involves observation of the construction activities related to the
major features associated with the collection centers and associated features, comparison of the
installed product with the Drawings and Technical Specifications included in the Contract
Documents, observation and documentation of testing, discussions and communication with the
Contractor and County related to the Work. Our on-site field activities are intended to be limited to
engineering-related duties and our scope and budget assume that County personnel are intimately
engaged in routine observations of contractor performance and progress necessary to administer
the contract.
SCS will provide a qualified field engineer to perform on-site construction engineering and CQA
activities during the installation of the collection center during the Construction Phase of the project.
SCS efforts will involve observation of the construction activities and documentation as to the
conformance of the work product to the Contract Documents. Our CQA inspection services will likely
include the following:
Conduct periodic observation of the work activities during the project on a part-time basis as
may be necessary to monitor the progress and observe in detail the quality of work and to
observe the extent to which the work is proceeding in accordance with the Contract
Documents and in accordance with applicable laws, statutes, ordinance, codes, regulations,
orders and decrees applicable to the project.
Critical activities to be observed include grading, asphalt paving, concrete pours, compactor
pad construction, entrance/exit transition onto public roadways, and electrical power
installation. SCS will maintain a presence at the site during these activities in order to
observe and document, monitor construction materials and methods, and verify general
compliance with the construction documents.
Observe equipment start-up and demonstration. SCS will participate with the manufacturer’s
representatives and Contractor to observe demonstration and functional testing of the
equipment installed under this project, such as compactor units, attendant shed/light pole
electrical components, and proper gate operation.
Observe site restoration efforts and repairs to erosion and sediment control features.
Prepare and submit written reports for each site visit in the form of daily field reports.
Conduct observations and site visits as may be required to fulfill obligations as the County’s
Representative.
Report to the County unsatisfactory, faulty, or defective work that has not been corrected. As
its representative, SCS will identify defects and deficiencies in the Work, verify conformance
with the Contract Documents, communicate problems to the County and Contractor, and
follow-up with all parties to confirm that such issues are resolved in a manner acceptable to
the County.
Our CQA inspection services do not anticipate that SCS will perform any construction surveying or
soils or other materials testing during the construction period (which is expected to be the
responsibility of the Contractor).

3. COMPENSATION: Compensation for each Convenience Center shall be as indicated
below.
SCS will be compensated for time and expenses in accordance with SCS's standard
rates in effect at the time of performance, provided that total compensation will not
exceed $64,700 for each of the two Neighborhood Centers and $96,900 for the
Regional Center (for a total of $226,300) without the Client’s authorization.
