9. HEARING OF THE CITIZENS
Each person addressing the Board under Hearing of the Citizens shall be a resident or
land owner of the County, or the registered agent of such resident or land owner. Each
person shall step up, give his/her name and district in an audible tone of voice for the
record, and unless further time is granted by the Chairman, shall limit his/her address to
three (3) minutes. No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board as a body
and not to any individual member thereof. Hearing of the Citizens shall last for a
maximum of forty-five (45) minutes. Any individual that is signed up to speak during
said section who does not get the opportunity to do so because of the aforementioned
time limit, shall be given speaking priority at the next Board meeting. Absent
Chairman’s approval, no person shall be able to speak who has not signed up.
10. PUBLIC HEARINGS
A. Rezoning Public Hearings
Pursuant to Article V, Division 6, of the Pittsylvania County Zoning Ordinance, the
Board of Supervisors have been empowered to hear and decide specific zoning issues
and zoning map changes in support of said Ordinance. In accomplishing this
important task, the Board is responsible for promoting the health, safety, and general
public welfare of the citizens of Pittsylvania County. The Board must ensure that all
of its decisions and regulations be directed to these goals and that each be consistent
with the environment, the comprehensive plan, and in the best interest of Pittsylvania
County, its citizens, and its posterity.

VIRGINIA: The Legislative Committee of the Pittsylvania County Board of Supervisors
was held on Thursday, March 7, 2019, in the Main Conference Room of the County Administration
Building in Chatham, Virginia 24531. Ben L. Farmer, Chairman, called the Meeting to Order at 4:00
p.m. The following Committee Members were present:

Motion made by Mr. Scearce, seconded by Mr. Barber, to approve Agenda, which was
unanimously approved.
New Business
(a) Discussion of Potential Mandatory Septic Pump-up for Lakefront Property Owners
Ordinance
Mr. Farmer stated that he is a member of TLAC and during their January Meeting, they were
given two (2) very detailed presentations that spoke highly of the lakes in the County. Two (2)
representatives from other localities spoke up about an Ordinance they have. Mr. Hunt researched
and Campbell and Pittsylvania Counties do not have a Pump Out Ordinance. Bedford and Franklin
Counties do have these types of Ordinances. Of the TLAC participants, only one (1) has a full
Ordinance, and one (1) has an Ordinance that only requires septic pump out in short term rental
property. There was consensus of the Legislative Committee to do nothing with this item at this time.

Mr. Slemp stated the Ad-hoc Committee met last month and the majority of the Ordinance is
complete. Mr. Slemp suggested the Committee recommend to the full Board that the Fire and Rescue
Commission be comprised of no more than nine (9) members, by eliminating the EMS-only and Law
Enforcement Members. Mr. Slemp also stated that he has hopes of having the Ordinance completed
and ready for the full Board to review by July. Mr. Scearce mentioned that things have been going
well and everyone seems to be working well together and there are a few things left before the
Ordinance is finalized. There was also discussion about how the citizens are appointed to this
Commission. Motion by Scearce, second by Barber, to recommend to the full Board that the Fire &
Rescue Commission be comprised of no more than nine (9) members, by eliminating the EMS-only
and Law Enforcement Members, and the Board’s decision making on the citizen appointees not be
restricted. The recommendation was unanimously approved by the Committee.
(b) Animal Nuisance Ordinance Update
Mr. Hunt stated there have been some concerns raised from the farm community. The farm
community is primarily concerned that this Ordinance will be used to go after the agricultural
community for smells and things such as that. There is a Public Hearing scheduled for March 12,
2019 for this matter, but the Public Hearing can be removed from the Agenda, or it can still be held to
hear the concerns and take no action after the Public Hearing. Mr. Scearce stated that one concern he
has heard is that usually when a complaint is taken before the Judge, nothing is done, and it has been
a waste of time. He suggested sitting down with Mr. Haskins and trying to come up with some
wording so that this Ordinance has some teeth. Mr. Farmer stated he would still like to hold the
Public Hearing to hear citizen comments.
(c) Inoperable Vehicles Ordinance Revision
There was discussion about why the Ordinance revision came up and if there were more
complaints recently than in the past. Mr. Sides stated there has not been more complaints, but the
idea was brought to the Legislative Committee that maybe there should be more restrictions in
residentially zoned properties, and Staff was asked to bring something back for the Committee to
review. Mr. Warren stated that he has received a lot of phone calls and complaints, but more so in
subdivisions where there are a cluster of homes. Mr. Barber stated that he has not received any
complaints and he feels that the issue is enforcement. There was consensus from the Board on
enforcing the current Ordinance that is in place as is, on a complaint basis, and only take action at a
later date only if necessary.
(d) Grass and Weeds Ordinance
Mr. Sides stated the Legislative Committee requested that Staff look into and draft an
Ordinance, and the Legislative Committee was provided with a standard Grass and Weed Ordinance.
Mr. Barber stated his concern about this issue and recommended it be left alone right now. He stated
there are farmers who cut on residential properties and does not feel that the County has the means to
enforce this issue. Mr. Warren suggested that this issue be tabled and come back to later, but he feels
that something should be done for the citizens who live in subdivisions who have covenants.
(e) “Farming Definition” Expansion/Clarification for Taxation Purposes

Mr. Hunt stated the Legislative Committee directed Staff to mirror the State Code on this
particular item with items 1-10, but since then, Les Adams has inserted language into HB2733 which
is currently sitting on the Governor’s desk. If the Governor signs this, it will become effective July 1,
2019. Staff recommends only addressing this item once, after July 1, 2019, when it is legal, and then
verbatim copy the State Code to include nurseries.
Mr. Ken Moss and his wife Sherry, owners of Windy Acres Nursery, were present at the
Meeting and Mr. Farmer allowed him time to speak on the “farming” definition. Mr. Moss requested
that the Board of Supervisors entertain a Resolution and make this retroactive back to 2014, so that
the current situation that he has been dealing with in the Commissioner of Revenue’s Office will go
away in order to avoid multiple levels of court if necessary.

a. Presentation of FY 2019-2020 County Budget
Mr. Smitherman gave the official presentation of the 2019-2020 Budget. There is no tax increase
proposed in this Budget. The revenue growth is $594,929. The growth may correlate to the higher
tax rates levied last year and the personal property may be due to increased average cost of new
vehicles. The goal of the Fund Balance is twenty percent (20%) of the average annual operating
cost. The outstanding debt obligations are the average annual school debt payment of $5.5 Million,
$51,200,000 outstanding at year-end, and this obligation will be satisfied in FY 2030. The debt

capacity is $146,650,270 million according to the three percent (3%) threshold. School debt
retirement accounts for twelve percent (12%) of the presented FY2020 General Fund Budget. The
General Assembly unfunded mandates include $8,711,624 that the County provides to the Comp-
Board, there is a three percent (3%) Comp-Board COLA that equates to $104,866 County expense,
a “State” raise of $871 for C7/L7 Classified Officers and $911 for C8/L8, which equates to $11,801
to the FY 2019 Budget and $28,323 to the FY 2020 Budget. The General Assembly also approved
a five percent (5%) raise for all of the State Funded School Division Teachers that requires a
$650,000 match. For FY19, there was a $1.6 Million additional funding for the School Division.
The School Board requested an additional $3,991,725 of local funding to implement Phase II and
for significant maintenance investments. The FY2020 proposed Budget allocates and additional
$500,000. Mr. Smitherman stated the four (4) year plan; FY2020 highlights are as follows:
Economic Development: $750,000 reserve appropriation; Employee Retention: 2.1% COLA, final
phase of pay study implementation ($539,866); Reassessment Contribution: $0; Capital Reserve
Contribution: $0; and Fire and Rescue Contribution: $498,128 ($1.5 Million more than FY18).
Mr. Smitherman also stated the Economic Development “Wins” which include the following:
Eastern Panel – January 2018; Panacea – March 2018; Amthor – January 2018; QLF – September
2018; PATHS – September 2018; BGF – October 2018; Harlow – November 2018; Intertape –
September 2017; Unison Tube – September 2017. He also stated that the changes at the
convenience centers are working. The plan is to gradually continue the closing of compactor sites
during nighttime hours and looking for out-of-county waste to reduce citizen cost. The FY2020
goal of Pet Center fundraising is $150,000 and there are nine (9) events scheduled before June 30,
2019. For Jail Operations, there is a capacity of thirty-six (36), with an average daily population
of approximately one-hundred ten (110). The average cost is $105 per day per inmate. The Blue
Ridge Regional Jail houses approximately fifty (50) County inmates daily with an average cost of
$26 per day per inmate. There is a new position for medical reimbursement filings anticipated for
the Jail. He also stated the Courthouse Security Fund is rapidly depleting due to the
implementation of controlled access and manned entrance.

a. Health Collaborative Update (Staff Contact: Kaylyn M. McCluster); (Presenter:
Elyse Jardine); (10 minutes)
Elyse Jardine with the Health Collaborative was present to update the Board on the current
initiatives they have in place to assist Pittsylvania County citizens. The Health Collaborative has
223 partners who represent 150 unique organizations, groups, and neighborhoods. Their
approach is to unite organizations and create action to support health for all people in the Dan

River Region. They have five (5) goals which are as follows: active living, health eating, access
to healthcare, healthy spaces, leadership, and capacity building. They are also engaged with
Pittsylvania County Schools to explore the concept of school-based health centers to test
feasibility, identify service needs, and complete a planning process infused with a sustainability
lens. Their community health worker initiative has ten (10) community health workers and one
(1) care coordinator. They act as the link between healthcare, human service organizations, and
community members. They do outreach, community education, social support, and advocacy.
b. AEP Power Line Presentation Regarding Potential Revisions to Pittsylvania County
Code Section 35-50 (Staff Contact: Gregory L. Sides); (15 minutes)
Mr. Sides stated there are potential revisions to Pittsylvania County Code § 35-50, relating to
providing electrical service for the Southern Virginia Mega Site at Berry Hill. Mr. Rowe stated
the Southern Virginia Mega Site at Berry Hill could potentially house $1.6 billion in investment.
The average workforce over 1800-1900 jobs, with an average wage in excess of $50,000. This
would create such an asset to be able to develop such projects. AEP representatives were also
present and David Swisher spoke to the Board. He stated that they had recently entered into an
Agreement with RIFA and their goal is to get the line built by November 2020. Mr. Sides stated
about there are about twenty-four (24) properties that would be affected and they and would have
to make contact with all of those property owners. Mr. Hunt stated that approval would come
back in the form of a Resolution.
STAFF, COMMITTEE, AND/OR CONSTITUTIONAL OFFICER REPORTS
a. Wayside Park Project Update (Staff Contact: Mark W. Moore); (15 minutes)
Mr. Moore gave a brief update on the happenings at Wayside Park in Hurt. He introduced Bryce
Adkins, an Eagle Scout, who will be working at the Wayside Park beginning at the end of the
month, along with several other Eagle Scouts. The Project was initially a $300,000 project. This
has now turned into a $713,000 project, with only a County investment of $150,000. This is
nearly a 500% return on that investment. There will be a playground with pickleball courts and a
shade shelter, a paved trail, restrooms, a stage, and a new entrance design with a trailhead. It is
anticipated that this will be an 18-24 month project beginning at the end of the summer. Mr.
Blackstock stated how vital this park will be for the Northern End of the County, and how much
he appreciates the Board’s support of this Project and Mr. Moore for his hard work and effort put
into this Project.
b. Fire and EMS Improvements Update (Staff Contact: Christopher C. Slemp); (15
minutes)
Mr. Slemp gave a brief update to the Board on recent Fire and EMS improvements in the
County. Animal Control answered 2,600 calls last year, and they have moved their office space
down to the Pet Center. The 911 Center answered almost 30,000 E-911 calls last year. Fire and
Rescue ran approximately 8,000 EMS calls last year. Mr. Slemp is trying to pull as much data as
possible to see the locations where calls responses are originating. They are currently in the
process of making sure each fire-fighter has their own mask. This is a huge health issue and
everyone needs to be able to have their own. He stated they are looking at their fire responses

and making sure they are sending the correct apparatus to each call, and are also looking for
ways to identify the certified and not certified fire fighters, whether it be a different color helmet
or such to prevent someone from going into a building that is not supposed to be. The Special
Operations Team has had a Fire Marshal assigned to work with them. Mr. Slemp also
emphasized the importance of training and plans to really nail that down next year, while looking
at a strategic plan.
c. Cherrystone Creek 1 Revised Plan Update (Staff Contact: Richard N. Hicks); (15
minutes)
The Final Draft of the Cherrystone Creek 1 Revised Watershed Plan and Environmental
Assessment for the Rehabilitation of the Floodwater Retarding Structure No. 1 has been
completed and is being presented to the original sponsors of the Project, the County, the Town of
Chatham, and the Pittsylvania County Soil and Water Conservation District. The Revised Plan
was prepared by the United States Department of Agriculture - Natural Resources Conservation
Service (“NRCS”). To move the Project forward, the Sponsors are being requested to approve
the Revised Plan and execute the Supplemental Watershed Plan Agreement between the
Sponsors and the Natural Resources Conservation Service (formerly Soil Conservation Services)
United States Department of Agriculture. Mr. Hicks stated the recommended action is to approve
Final Cherrystone Creek 1 Revised Watershed Plan and Environmental Assessment for the
Rehabilitation of Floodwater Retarding Structure No. 1 and Authorize the County Administrator
to Execute the Cherrystone Creek Watershed Supplemental Plan Agreement No. 2 as Presented
in the Report. This would be a supplement to the original Watershed Work Plan Agreement
Dated July 22, 1965. The signing of this Plan does not obligate either of the sponsors or NRCS
for the funds named in this Plan. This shows that you have gone through the planning process
and support this Plan as the Preferred Alternative for the dam rehabilitation. As of this week, the
approval of the Plan was moved to June 28, 2019. The Town of Chatham has also agreed to give
their opinion on this matter, and there may be some other options to consider. This item will be
brought back to the Board for consideration at its June Business Meeting.

Petition. Mr. Sam Sari was present and gave a presentation to the Board regarding the Landmark
Group. Dr. Miller asked about the residential portions being mid-upper level and Mr. Sari’s
response was that mid-to-moderate income range is considered $15,000 - $37,000 per year. Mr.
Blackstock stated the County has allowed the building to fall into disrepair and this building has
a special place and is of historical nature. This is a way out for the County and for the building
to be preserved for the betterment of the community. Mr. Farmer asked about parking and if
there is additional parking to support community/public events. Mr. Sari stated parking could be
an issue, but they are attempting to work in additional parking in the future if there seems to be a
big issue. Mr. Davis stated he likes the fact the soccer league can still use the Facility.
Wayne Robertson, Chatham-Blairs District, spoke against the rezoning and sale of this property.
He stated his concerns about the schools being full and when things happen at Berry Hill the
County will need another school. He requested the Board put this item off and reconsider.
Edward Hairston, Tunstall District, stated that the school has a lot of sentimental value to him,
and he would like to keep the building preserved. He thinks it would be a good representation of
our schools and community.

Mr. Barber also stated that he has been on this Board for fifteen (15) years and he could not think
of a better use of the building.

on the future redevelopment of the Old Blairs Middle School Property (also formerly Southside
High School; the “Property”) into apartments (55-units). Following the successful rezoning of
the Property, County Staff recommends the potential donation of the Property to the Landmark
Group.
Motion to authorize the County Administrator, or his designee, to commence the potential
donation of the Property to the Landmark Group by executing, or causing the execution by the
Board, of the following documents as presented: (1) Donation Agreement; (2) Revitalization
Resolution; (3) Zoning Certification Letter; (4) Locality CEO Letter; and (5) An Ordinance to

County Staff was contacted by NRG Curtailment Services, Inc. (“NCS”), about a Demand
Response Program through the PJM Interconnection for the County’s region. PJM
Interconnection is a Regional Transmission Organization (“RTO”) that coordinates the
movement of wholesale electricity in the following states: Delaware, Illinois, Indiana, Kentucky,
Maryland, Michigan, New Jersey, North Carolina, Ohio, Pennsylvania, Tennessee, Virginia,

West Virginia, and the District of Columbia. The RTO is regulated by the Federal Energy
Regulatory Commission.
NCS is offering a Program that would utilize some of the County’s emergency generators in the
event of an emergency within the RTO territory. In the event of an emergency, NCS could call
for the County’s generators to operate for up to ten (10) hours within a given day. The Program
has been in operation for five (5) years, and to date, there have been no calls for the emergency
generators to operate. By enrolling in the Program, the County would be paid once per year,
even if the generators are not called upon. There is a requirement that the generators be tested
once per year at a specific time, to insure their operation.
County Staff would propose enrolling the generators at the Courthouse, Jail, and the 911 Center,
for a total of 333 kilowatts. Based on this load, over a three (3)-year period, the County would
be paid somewhere within the range of $26,520 to $35,360. For your review and consideration,
attached please find a copy of NCS’ Proposal and a revenue estimate.
Mr. Scearce asked about a set rate if it were used more than the one (1) hour and Mr. Farmer
asked if there was an emergency situation and the County were in use of the generator, would it
make a difference. Mr. Hicks stated that the rate would be the same no matter the circumstance.
Motion to authorize the County Administrator to execute the attached agreement with NCS as
presented.

c. Award of Engineering Contracts for Ringgold Trail and Ringgold Railroad Repairs

The County was recently declared a Federal Disaster Area due to damages of the recent tropical
storm. Significant damage was identified at the Ringgold Walking Trail and the Ringgold
Railroad, both owned by the County. Based on the Federal Declaration, the Federal Government
will pay 75% of the recovery costs, the State will pay 20%, leaving the County responsible for
5% of the total cost. County Staff has met with FEMA representatives and the County is ready
to proceed with the development of plans and specifications for the necessary repairs to both
areas.
Dewberry has provided a Proposal for the engineering work on the Ringgold Walking trail at a
cost of $150,336, and a Proposal for similar Ringgold Railroad work at a cost of $13,680. The
Agreements are proposed as additions to an existing On-Call Agreement with the Western
Piedmont Planning District Commission, which allows for local governments within the region
to participate under this Agreement; thereby, satisfying State Procurement law.

they will be engaging in conversation with three (3) broadband providers in the County.

At the March 7, 2019, Legislative Committee (“LC”) Meeting, the LC received a report from
Christopher C. Slemp, Public Safety Director, regarding the Ad Hoc Committee’s work on the
new Public Safety Ordinance. Slemp and Supervisor Scearce updated the LC on many items
proposed and suggested that the final draft would likely be available for Board adoption at its
May Business Meeting. After discussion, Supervisor Scearce, seconded by Supervisor Barber,
moved that the proposed Fire and Rescue Commission be comprised of no more than nine (9)
members, by eliminating the EMS-only and Law Enforcement Members specified in the attached
proposed draft, and that the Board retain authority to appoint any and all citizen appointees to the
proposed Commission. Said recommendation to the full Board was passed by the LC
unanimously.
Motion that the proposed Fire and Rescue Commission be comprised of no more than nine (9)

BOARD MEMBER REPORTS
Mr. Farmer invited everyone to come out to the April 4th Community Meeting regarding SCS
Broadband at Gretna High School at 7:00 PM. Mr. Scearce stated the Friends of NRA Banquet
that was held on February 28th raised over $60,000 and that money stays in our area to help with
the Boy Scouts or the Schools JROTC Program. Dr. Miller voiced his appreciation to all
members of the Board for the positive way everyone is supporting the minority community. He
stated that everyone working together for positive goals is very much appreciated. Mr. Davis
thanked County Staff and everyone for attending the Meeting.
COUNTY ADMINISTRATOR REPORTS
Mr. Smitherman reminded everyone of the four (4) Community Budget Meetings and welcomed
every citizen to come out and hear about the Budget.

New Business
(a) Constitutional Officers and Outside Agency Appointments
Mr. Smitherman stated that he just learned in the afternoon that a Bill passed in the
General Assembly this year that requires the County to allocate funds for two (2) new
Commonwealth’s Attorney positions based upon the number of cameras that are used in law
enforcement. It is required that one position be for every seventy-five (75) cameras that are used,
which would require two (2) new positions at an estimated cost of about $151,000. There was also an
email received from the Comp Board and we are coming up about $92,000 short from the Comp
Board which brings us to $243,000 out of budget.
Mr. Scarce thanked the Committee for the time to come and speak and to remember they are
over there. Ms. Everlena Ross spoke to the Committee and thanked the Board for their past and
continued support. Ms. Tuite thanked the Board for the current funding in the Budget for the Library.
She presented to the Board the Pittsylvania County Public Library Budget Requests (attached).
Sheriff Taylor presented to the Board his requests. He suggested the Legislative Committee taking a
look at assessing a $25 fee for businesses and homes who have security systems where the Sheriff’s
Department has had to respond (after three (3) calls). Sheriff Taylor also stated that due to working
with the County with the recruitment program, they now only have two (2) vacant positions. Sheriff
Taylor also gave an overview of the crimes his Department has dealt with over the past year. Mr.
Haskins spoke in support of the Sheriff’s Office and stated that he is able to do his job, because of the

wonderful work the Sheriff’s Office does. He stated that the language in the new legislature states
one (1) per seventy-five (75), but he understands it to be that he can work something out with the
County, so they are not required to completely fund two (2) new positions. Mr. Haskins stated that
there is 180% turnover in the Commonwealth’s Office, and it is because the pay is not comparable to
other localities and they are constantly losing their employees to other Counties or Cities. He stated
that he is willing to work with the Board and try to make things work with the one (1) additional
employee, and then use additional funding for his employees. He does have to submit a written
Agreement by July 1, 2019.
(b) Budget Discussion and Direction from Committee
Mr. Smitherman stated the Board could consider reducing the money they provide to the
PCSA annually. He also stated they could pull the salary study implementation for the County
employees. Mr. Scearce suggested holding another Finance Committee Meeting on March 26, 2018,
and also on April 2, 2019, to further discuss where cuts can be made for the Budget.

(a) Budget Discussion and Direction from Committee
Mr. Scearce started the Meeting by stating that he is open to any ideas from the
Committee Members, and if there are areas they want to cut, this would be the Meeting to have that
discussion. There was discussion about reducing the health insurance contingency due to the
projection that our insurance rates are not going to increase this upcoming year, and may even
decrease due to our claims being low. Mrs. VanDerHyde stated that leaving $30,000 in that line
would be reasonable. Mr. Warren suggested reducing the RIFA contribution by $50,000. There was
discussion about reaching out to Franklin County regarding calls that Cool Branch assists with and to
see if there is a possibility they would be willing to help contribute to that cost. It was also mentioned
to look at how the County funds the PCSA and a possibility of reducing that and suggesting that they
pass that cost on to their customers, being that it is such a minimal cost ($2.12 per customer). After
much discussion, there was consensus from the Committee to adjust contingency funds in the
following areas: reduce RIFA contribution from $75,000 to $25,000; reduce Danville-Pittsylvania
County Chamber of Commerce Tourism ($30,000); Health Insurance ($70,000); over-budgeted
Sheriff vehicles ($21,850); delay County Administration Salary Study until January 2020 ($75,000);
Consultants moved to Economic Development budget of $100,000; and Fire truck for Cool Branch

New Business
(a) Consideration of ODAF Request
Mr. Smitherman stated the County was approached by the Olde Dominion Agricultural
Foundation (“ODAF”) regarding a request to purchase land. The request was to provide a
$275,000 Grant and to also provide a $235,000 five-year no interest loan. Mr. John Harris was
present to represent ODAF, and spoke to the Board regarding this request. He stated that one (1)
parcel of land is directly in the middle of what already exists. Another parcel of land is road
frontage, which is very important for them to have that access. Two (2) parcels are known as the
Shorter Brothers Garage, and the other is completely landlocked. Mr. Warren asked if there had
been conversation with the Tobacco Commission to see if they were supportive of this, and Mr.
Harris stated they had talked with DRF and they were supportive, but he had not spoken directly
with the Tobacco Commission. Mr. Blackstock questioned, if there was any reason why they
could not go out and borrow this money, but Mr. Harris stated that he was not sure if they could
show the income to get that loan.

(b) Enterprise Zone Amendment Overview
Ms. McCulloch was present to brief the Board on the proposed Enterprise Zone
Amendment. She stated the General Assembly allows counties and cities in Virginia to designate
a specified acreage of land in a certain geographic area as an Enterprise Zone. The State offers
Enterprise Zone Grants, and the localities also incentivize targeted companies to locate or expand
within said zones. Pittsylvania County has 2 Enterprise Zones, the first, Zone 57, is a joint EZ
with Danville and includes Cane Creek and Gretna. The second Zone, Zone 24, is newer and
predominantly includes SVMS at Berry Hill and SVMP in Hurt. After examining the County’s
incentives and boundary for the purpose of updating them, Pittsylvania County is currently going
through a revision process, which is very common and even encouraged with the Enterprise
Zones. Ms. McCulloch stated that the week prior, the Department of Housing and Community
Development (“DHCD”) approved the County’s proposed boundary line and amendment
changes. DHCD oversees the Program, and they allow amendments to the Zones with an
application and public process. They are submitting four (4) amendment applications, one (1)
boundary and one (1) incentive for Zone 24 and one (1) boundary and one (1) incentive for Zone
57. There are sixty-seven (67) removal letters combined and sixteen (16) addition letters that
have to be sent out. She stated they want to stress that changes to the boundary are being done
based on real business activity. They are revising the boundary to allow incentives exactly
where industries are stating they want to be on a daily, weekly, and monthly basis. The
incentives are being revised to give companies the value they are looking for and helps to be
competitive. They are paid based on performance (retroactive), which protects the company and
the County.

Mr. Smitherman stated this was a follow up to last week’s Finance Committee Meeting and he
had made the suggested adjustments to the proposed Budget. There was discussion about starting the
process of not providing the PCSA with funding. Mr. Warren stated that if they were to send that
cost to their customers, it would be a very small amount; a little over $2 per month additional for their
customers. Mr. Warren also suggested compromising on the ERIP program. The adjustment would
be $8,000 per year. This saves money and allows that to be within the Budget.
Motion by Mr. Warren, seconded by Mr. Farmer, to recommend proceeding with the ERIP
plan with the edits, subject to approval by the County Attorney and Human Resources Director,
which was unanimously approved by the Finance Committee.
Motion by Mr. Farmer, seconded by Mr. Warren, to use PCSA $78,800 contribution to
fund the Gretna Library over two (2) years, subject to County Code changes.
Mr. Smitherman stated, for Thursday’s Meeting, they will add $78,800 to contingency for the
Gretna Library capital contribution, and in non-departmental expenses, they will remove $78,800.

Called Meeting
It is a statutory requirement that the Pittsylvania County Board of Supervisors (the “Board”) hold
a Public Hearing for citizen input on the proposed School’s Budget. Said Public Hearing was
held on Thursday, March 28, 2019, allowing citizen comment on the proposed FY2020
Pittsylvania County School Budget, totaling $96,031,927. Said Public Hearing was also
advertised in the Chatham Star Tribune on March 13, 2019; thereby, satisfying the requirements
of Virginia Code § 15.2-2506 concerning publication and notice. County Staff recommends the
Board approve the FY2020 County School Budget in the amount of $96,031,927, which includes
a local appropriation of $18,836,709, as presented. Since more than seven (7) days has passed
from the aforementioned Budget Public Hearing, the statutory requirement has been satisfied to
approve the FY2020 County School Budget.
Motion to approve the FY2020 Pittsylvania County School’s Budget in the amount of
$96,031,927, which includes a local appropriation of $18,836,709.

b. Discussion of the County's Payment to the Pittsylvania County Service Authority
Mr. Blackstock questioned using the Pittsylvania County Service Authority (“PCSA”) money for
the Gretna Library. Mr. Blackstock also requested that Mr. Adcock speak on how this will affect
the PCSA, and commended the Service Authority for how they have handled their money over
the years. Mr. Barber stated that the main project is getting Henry County to Route 29 and to be
able to service Chatham. Mr. Adcock stated they do they have a large project in the works of a
little less than $12 million from Mt. Hermon to Route 29 and incorporating Mt. Cross. Mr.
Warren thanked Mr. Adcock for his service and hard work. Mr. Blackstock stated the PCSA is
in a healthy financial situation and they deserve to have conversation about this matter before
making a decision. Mr. Scearce asked Mr. Adcock if cost were passed on to residents how much
would it cost per bill, and stated that it was around $2 per month per customer. Mr. Scearce also
stated that his goals were for the Board to have cost savings, but he was also okay if the Board
wanted to spend the money. He also suggested that, if the money was going to be spent, he
would like the money put back in for the employee raises. He also questioned a sewer leak, and
Mr. Adcock stated that they have been working to find the problem and get it solved. Mr.
Warren stated the Board should do all they can do to help with the sewer problem and he echoed
Mr. Scearce’s suggestion to put the employee salary implementation back in. Mr. Blackstock
thanked Mr. Adcock and Members of the PCSA for showing up.
c. Approval of County Budget/Budget Resolution (Staff Contact: Kimberly G. Van Der

Mrs. VanDerHyde stated that the County Budget was also advertised in the Star Tribune on
March 13, 2019. The advertised Budget was $180,086,993. Since then there have been several
Finance Committee Meetings and changes to the Budget which brings the total to $179,904,353,
and this does incorporate the School Budget.

Mr. Blackstock questioned what needs to be changed in the Motion to reflect adding money back
for the PCSA, the employee salary money, and for the library. Mr. Barber asked how much
funding was in the Budget for the Pet Center and Mrs. VanDerHyde stated there is $866,027 in
this Budget for the Pet Center. Mr. Barber also stated that he has had questions regarding our Pet
Center taking dogs in from Texas earlier in the day, but Mr. Smitherman stated that our Pet
Center was a weigh station where they brought their dogs, fed them, and then actually took some
of the County’s dogs with them.
Mr. Davis asked how much money have we received since the cameras have been put up at the
convenience centers and Mr. Shorter stated that the County has received around $1,400 for fines
that have been sent out.
Motion to approve FY2020 County Budget as presented with $75,000 of general Contingency
earmarked for July 1 implementation of Phase III of the County Employee pay and classification
study implementation, and amend Section 36 accordingly, appropriate $78,800 from General
contingency to Gretna library renovations capital account, restore funding for PCSA hydrant fees
and eliminate Section 26 from the Budget Resolution.

WHEREAS, Law Day is a “day of national dedication to the principles of government
under law,” as stated by President Dwight Eisenhower, who established the first nationwide
commemoration in 1958; and
WHEREAS, the First Amendment to the U.S. Constitution states: “Congress shall make
no law respecting an establishment of religion, or prohibiting the free exercise thereof; or
abridging the freedom of speech, or of the press; or the right of the people peaceably to
assemble, and to petition the Government for a redress of grievances;” and
WHEREAS, the Fourteenth Amendment incorporates the rights established in the First
Amendment to apply to state governments; and
WHEREAS, the Universal Declaration of Human Rights states: “Everyone has the right
to freedom of opinion and expression: this right includes freedom to hold opinions without
interference and to seek, receive and impart information and ideas through any media and
regardless of frontiers;” and
WHEREAS, the 2019 Law Day theme enables us to reflect on the way that freedom of
speech and freedom of the press provide the foundation for our free society.

To recognize National Police Week 2019, and May 15th as Peace Officers Memorial Day, by
honoring the service and sacrifice of those law enforcement officers killed in the line of
duty while protecting our communities and safeguarding our democracy.

WHEREAS, the Congress and the President of the United States have declared law
enforcement officer safety and wellness a top priority, and the International Association of
Chiefs of Police’s Center for Officer Safety and Wellness promotes the importance of individual,
agency, family, and community safety and wellness awareness; and
WHEREAS, the members of the Pittsylvania County Sheriff’s Department play an
essential role in safeguarding the rights and freedom of the citizens of Pittsylvania County,
Virginia (the “County”); and
WHEREAS, it is important that all citizens know and understand the problems, duties,
and responsibilities of their sheriff’s department, and that members of the County’s Sheriff’s
Department recognize their duty to serve the people by safeguarding life and property, by
protecting them against violence or disorder, and by protecting the innocent against deception
and the weak against oppression or intimidation; and
WHEREAS, the County’s Sheriff’s Department has grown to be a modern and scientific
law enforcement agency which unceasingly provides a vital public service; then
NOW, THEREFORE, the Board of Supervisors of Pittsylvania County, Virginia, calls
upon all County citizens, and upon all patriotic, civil, and educational organizations to observe
the week of May 6-16, 2019 as Police Week with appropriate recognition and thanks for the
police officers, past and present, who by their faithful and loyal devotion to their responsibilities
have rendered a dedicated service to their communities and, in doing so, have established for
themselves an enviable and enduring reputation for preserving the rights and security for all
citizens; and
THE BOARD OF SUPERVISORS FURTHER calls upon all County citizens to

WHEREAS, emergencies can occur at any time that require police, fire, or emergency
medical services; and,
WHEREAS, when an emergency occurs the prompt response of police officers,
firefighters, and paramedics is critical to the protection of life and preservation of property; and,
WHEREAS, the safety of our police officers and firefighters is dependent upon the
quality and accuracy of information obtained from Pittsylvania County, Virginia (the “County”)
citizens who telephone the Pittsylvania County Emergency Communications Center; and,
WHEREAS, Public Safety Telecommunicators are the first and most critical contact
with County citizens have with emergency services; and,
WHEREAS, Public Safety Telecommunicators are the single vital link for the County’s
police officers and firefighters by monitoring their activities by radio, providing them
information and insuring their safety; and,
WHEREAS, County Public Safety Telecommunicators have contributed substantially to
the apprehension of criminals, suppression of fires, and treatment of patients; and,
WHEREAS, each dispatcher has exhibited compassion, understanding, and
professionalism during the performance of their job in the past year.
NOW, THEREFORE, the Pittsylvania County Board of Supervisors, does hereby

NATIONAL TRAVEL & TOURISM WEEK
May 5-11, 2019

WHEREAS, travel has a positive effect on Virginia and the nation’s economic prosperity and image
abroad, it also impacts business productivity and to individual travelers’ well-being; and
WHEREAS, travel to and within the United States provides significant economic benefits for the
nation, generating more than $2.5 trillion in economic output in 2018, with $1.1 trillion spent directly by
travelers; and
WHEREAS, travel is among the largest private-sector employers in the United States, supporting 15.7
million jobs in 2018, including 8.9 million directly in the travel industry and 6.8 million in other industries; and
WHEREAS, travelers’ spending directly generated tax revenues of $170.9 billion for federal, state, and
local governments, funds used to support essential services and programs.
WHEREAS, tourism continues to have a positive impact on Pittsylvania County, Virginia (the
“County”) with over $76 million in travel related expenditures, 670 people employed in local tourism positions,
over $2 million in local tax receipts, and $14 million in local payroll in 2018.
WHEREAS, international travel to the United States is the nation’s No. 1 services export. In 2018,
travel generated $256 billion in exports, creating a $69 billion trade surplus for the United States.
WHEREAS, meetings, events, and incentive travel are core business functions that help companies
strengthen business performance, educate employees and customers and reward business accomplishments—
which in turn boosts the U.S. economy. In 2018, domestic and international business travelers spent $327.3
billion.
WHEREAS, leisure travel, which accounts for more than three-quarters of all trips taken in the United
States, spurs countless benefits to travelers’ health and wellness, creativity, cultural awareness, education,
happiness, productivity, and relationships.
WHEREAS, travel is a pillar of economic growth, creating jobs at a faster rate than other sectors.
NOW, THEREFORE, the Pittsylvania County Board of Supervisors does hereby proclaim May 5-11,
2019 as National Travel and Tourism Week in the County, and urge County citizens to join me in this special
observance with appropriate events and commemorations.

SUMMARY:
The Virginia Tobacco Region Revitalization Commission (“TRRC”) has created a Grant
Funding Program to assist in constructing “last-mile” broadband telecommunications
infrastructure in unserved areas of the Tobacco Region. Local units of government are eligible
to apply for these Grants and a qualified and experienced private sector provider is required as a
co-applicant. For the FY19 Grant Cycle, Pittsylvania County, Virginia (the “County”), is
partnering with Mecklenburg Electric Cooperative (“MEC”) in an application for $375,549 to
install 9.2 miles of fiber optic cable in the north-eastern area of the County. This fiber extension
will connect MEC facilities and provide broadband internet services to homes along the route
through EMPOWER Broadband, Inc.
FINANCIAL IMPACT AND FUNDING SOURCE:
The “last-mile” Broadband Grant Program requires that a fifty percent (50%) match be provided
by an applicant. The total estimated project cost is $762,321, and the matching funds of
$382,512 will be provided by MEC. There will be no County funds required for this Project.
RECOMMENDATION:
As a part of this Grant Application, a Resolution from the local governing body supporting the
Project and authorizing the submittal of the Application is required. County Staff recommends
that the Board approve Resolution #2019-04-01 as presented.

WHEREAS, Pittsylvania County, Virginia (the “County”) has been impacted by
the decline of the tobacco industry causing a negative impact on economic development
and growth throughout the County, and
WHEREAS, the Tobacco Region Revitalization Commission (the “Tobacco
Commission”) has developed a Last Mile Broadband Grant Program to assist in
constructing last-mile broadband telecommunication infrastructure in unserved areas of
the Tobacco Region to help tobacco-related localities to change and revitalize their
economies, and
WHEREAS, grants from the Tobacco Commission will assist the County in
transforming its economy to replace the decline in the tobacco agri-business community
through the expansion of broadband internet access; then
BE IT HEREBY RESOLVED, that the Board of Supervisors of Pittsylvania
County, Virginia (the “Board”), fully supports the Grant Application to the FY2019
Research and Development Last Mile Broadband Grant Program for a partnership with
Mecklenburg Electric Cooperative/Empower to extend its fiber optic system in the
County and provide broadband internet service in the County and authorizes the County
Administrator to execute the Application on behalf of the Board and meet the
requirements of the Grant and its administration.

SUMMARY:
Shenandoah Cable Television, LLC (“Shentel”) currently owns, operates, and maintains a cable
television system serving Pittsylvania County, Virginia (the “County”), pursuant to a Franchise
Agreement which expired on March 25, 2018. The County and Shentel have continued to be
bound by the Franchise Agreement. Shentel has requested the County’s consent to renew the
Franchise Agreement. Shentel and County Staff believe it is in the County’s best interest to
approve Resolution #2019-04-02, attached, renewing the Franchise Agreement.

Shentel has been pleased to provide cable service to Pittsylvania County and would be
delighted to continue serving Pittsylvania County and its residents. Our cable franchise with Pittsylvania
County expired on March 25, 2018 and has continued to be honored by both parties on a month-to-
month basis since the expiration date. We previously sent a renewal package on September 22, 2017.
For your reference, we include the cover page of that package.
Shentel respectfully requests that Pittsylvania County review and sign the enclosed resolution
to extend the term of the existing franchise agreement fifteen (15) years, commencing on the
execution date of the resolution. If this resolution is acceptable, please sign and return to us in the
enclosed prepaid envelope or email a scanned copy of the executed resolution to

RESOLUTION OF PITTSYLVANIA COUNTY
APPROVING THE RENEWAL OF THE CABLE TELEVISION FRANCHISE
WHEREAS, Shenandoah Cable Television, LLC ("Franchisee") owns, operates and
maintains a cable television system ("System") serving Pittsylvania County pursuant to
a franchise agreement which expired on March 25, 2018 (the "Franchise") issued by
Pittsylvania County (the "Franchise Authority"), and Franchisee is the duly authorized
holder of the Franchise; and
WHEREAS, Franchisee and Pittsylvania County have continued to follow and be
bound by the Franchise; and
WHEREAS, Franchisee has requested the consent of the Franchise Authority for the
renewal of the Franchise in accordance with the requirements of the Franchise and
applicable law; and
WHEREAS, Franchisee has represented that it will comply with the terms and
conditions of the Franchise; and
WHEREAS, the Franchise Authority believes that it is in the best interest of the
communiTy to approve the renewal ofthe Franchise granted to Franchisee.
NOW, THEREFORE, BE IT RESOLVED BY THE FRANCHISE AUTHORITY
AS FOLLOWS:
SECTION 1. The Franchise Authority hereby approves and consents to the renewal
for a term of fifteen (15) years ofthe Franchise, all in accordance with the terms of the
Franchise and applicable law and Franchisee shall comply with the terms and conditions
of the Franchise.
SECTION 2. The Franchise Authority confirms that the renewal term of the Franchise

WHEREAS, Karen Johnston has always been a strong supporter of charities that help those afflicted with
various diseases and disorders; and
WHEREAS, after losing multiple friends and even loved ones to cancer, Karen Johnston decided to make
contributions to various cancer research groups and charities, and even grew her hair longer in order to donate an
eleven (11)-inch ponytail it to the Locks of Love Organization in 2009; and
WHEREAS, despite her efforts to take care of herself and stay healthy, in 2008, Karen was diagnosed
with cancer. Throughout her battle, she was inspired by the kindness of those who took excellent care of her.
Due to this, she felt led to step up and do something to help those going through the same battle, but who may be
less fortunate; and
WHEREAS, Karen became a member of the Danville-Pittsylvania Cancer Board in January 2010; and
WHEREAS, ten (10) years ago Karen followed her dream of organizing a healthy and fun event called
Bridge 2 Bridge to raise funds for Danville-Pittsylvania Cancer; and
WHEREAS, since its inception, her efforts have raised over $400,000 for Danville-Pittsylvania Cancer
Association; and
WHEREAS, since over 1.7 million new cancer cases will be diagnosed in the United States this year,
increased access to quality cancer care, screening, and prevention – especially among minorities and the medically
underserved – must be a top priority in our community; and
WHEREAS, Karen is a cancer survivor and has shown extreme perseverance through her battle and
continues to pursue her desire to help other cancer survivors; then
BE IT RESOLVED, that the Pittsylvania County Board of Supervisors expresses its sincere admiration
and appreciation to Karen Johnston for her outstanding efforts in the Danville-Pittsylvania County area.

Pittsylvania County, Virginia (the “County”), has agreed to accept certain electronic solid waste
from Henry County, Virginia. Henry County will certify that there are no Cathode Ray Tubes in
the waste provided to the County for disposal. Per Pittsylvania County §17-19, the Board is
asked to ratify the negotiated and attached Agreement.
FINANCIAL IMPACT AND FUNDING SOURCE:
It is anticipated this relationship will contribute approximately $45,000 of revenue to the Solid
Waste Enterprise Fund annually.
RECOMMENDATION:

SUMMARY:
For the sum of $600 per month, the Town of Chatham has agreed to provide housing (consisting
of sleeping quarters and space for the parking of one (1) ambulance), twenty-four (24) hours per
day, seven (7) days per week, at the Chatham Volunteer Fire Department, 35 Depot Street,
Chatham, Virginia 24531, for Delta Response Team (“DRT”) employees providing backup E-
911 EMS call coverage in the County’s legal boundaries and property. For the Board’s reference
and review, a Rental Agreement evincing the same is attached.
FINANCIAL IMPACT AND FUNDING SOURCE:
$7,200 annually (or $600 per month); money is budgeted in the Public Safety Budget.

RENTAL AGREEMENT
This Rental Agreement (the “Contract”) is made effective as of____________2019, by and
between the Pittsylvania County, Virginia (the “County”), a political subdivision of the
Commonwealth of Virginia, whose address is 1 Center Street, P.O. Box 426, Chatham, Virginia
24531, and the Town of Chatham (the “Town”), a Virginia Municipal Corporation, whose address
is 16 Court Place, P.O. Box 370, Chatham Virginia 24531 (individually a “Party;” collectively the
“Parties”).
I. AGREEMENT
A. The Town of Chatham shall provide housing (consisting of sleeping quarters and
space for (1) ambulance parking), twenty-four (24) hours per day, seven (7) days
per week, at the Chatham Volunteer Fire Department, 35 Depot Street, Chatham
Virginia 24531 “Property”), for the Delta Response Team (“DRT”) employees
providing backup 911 EMS call coverage in the County’s legal boundaries and
property.
B. The County shall pay, monthly, the sum of six hundred dollars and no cents
($600.00) per month for rental of said Property retroactive to September 1, 2018,
when DRT occupancy began. Payment shall be required to be submitted to the
Town of Chatham by the fifth (5th) day of each month.
II. TERMS
A. The initial term of this Contract shall commence upon its signing and shall
terminate on August 31, 2019, unless the Contract automatically renews as
provided for herein below for subsequent annual terms of twelve (12) months.
B. Unless terminated, this Contract shall automatically renew on the first (1st) day of
September, annually.
C. This Contract may be cancelled, in writing, by either Party with at least sixty (60)
written notice to the other Party.
D. The County shall be responsible to make repairs to the Property, if it is proven by
a court of competent jurisdiction that damage to the Property was the result of
misconduct or negligence of DRT or County employees.
E. The Town shall be responsible to maintain the Property in a state of operational
readiness, and bear the cost, solely, for any repair associated with normal
operation(s) of the Property.

F. It shall be the sole responsibility of DRT Staff to notify, as soon as possible, The
Town as to any issues arise with the Property, so that a reasonable solution can be
reached in a timely manner to minimize the effects on DRT’s EMS call response
times.
G. Notwithstanding any other provision in this Contract to the contrary, if the County
fails during any fiscal year to appropriate or allocate sufficient funds to pay the
amounts to be paid by the County pursuant to the provisions of this Contract which
become due or payable during such fiscal year, then this Contract and all the
obligations of the County hereunder shall automatically terminate at the end of the
fiscal year in which such non-appropriation occurs. The County agrees to use its
reasonable efforts to obtain any necessary funding contemplated by this Contract,
on an annual basis.
H. In addition to any and all other rights a Party may have available according to law,
if a Party defaults by failing to substantially perform any provision, term, or
condition of this Contract (including without limitation the failure to make a
monetary payment when due), the other Party may terminate the Contract by
providing written notice to the defaulting Party. This notice shall describe with
sufficient detail the nature of the default. The Party receiving such notice shall have
thirty (30) days from the effective date of such notice to cure the default(s). Unless
waived in writing by a arty providing notice, the failure to cure the default(s) within
such time period shall result in the automatic termination of this Contract.
I. If performance of this Contract or any obligation under this Contract is prevented,
restricted, or interfered with by causes beyond either Party's reasonable control
("Force Majeure"), and if the Party unable to carry out its obligations gives the other
Party prompt written notice of such event, then the obligations of the Party invoking
this provision shall be suspended to the extent necessary by such event. The term
Force Majeure shall include, without limitation, acts of God, fire, explosion,
vandalism, storm, or other similar occurrence, orders, or acts of military or civil
authority, or by national emergencies, insurrections, riots, or wars, or strikes, lock-
outs, or work stoppages. The excused Party shall use reasonable efforts under the
circumstances to avoid or remove such causes of non-performance and shall
proceed to perform with reasonable dispatch whenever such causes are removed or
ceased. An act or omission shall be deemed within the reasonable control of a Party
if committed, omitted, or caused by such Party, or its employees, officers, agents,
or affiliates.
J. The legal venue for any litigation arising out of this Contract shall be the
appropriate Court in the County of Pittsylvania, Virginia.
K. This Contract contains the entire agreement of the Parties, and there are no other
promises or conditions in any other agreement, whether oral or written, concerning

the subject matter of this Contract. This Contract supersedes any prior written or
oral agreements between the Parties.
L. If any provision of this Contract is held to be invalid or unenforceable for any
reason, the remaining provisions will continue to be valid and enforceable. If a
Court finds that any provision of this Contract is invalid or unenforceable, but that
by limiting such provision it would become valid and enforceable, then such
provision will be deemed to be written, construed, and enforced as so limited.
M. This Contract may be modified or amended in writing by mutual agreement of the
Parties, if the writing is signed by the Party obligated under the amendment.
N. This Contract shall be construed in accordance with the laws of the Commonwealth
of Virginia.
O. Any notice or communication required or permitted under this Contract shall be
sufficiently given if delivered in person or by certified mail, return receipt
requested, to the address set forth in the Contract’s opening paragraph, or to such
other address as one (1) Party may have furnished to the other in writing.
P. The failure of either Party to enforce any provision of this Contract shall not be
construed as a waiver or limitation of that Party's right to subsequently enforce and
compel strict compliance with every provision of this Contract.
Q. In any action arising hereunder, or any separate action pertaining to the validity of
this Contract, each Party shall pay its own attorneys’ fees, litigation fees, or other
legal expenses.
R. The rule requiring construction or interpretation against the drafter is waived. The
Contract shall be deemed as if it were drafted by both Parties in a mutual effort.
S. This Contract shall inure to the benefit of, and shall bind the heirs, successors, and
assigns of the Parties.
T. No assignment of the Town’s or County’s rights under this Contract shall be made
without the other Party’s prior written consent.
U. The Town shall have appropriate property and casualty insurance, at appropriate
levels, on the Property at all times during this Contract. The County and DRT shall
have appropriate property and casualty insurance, at appropriate levels, on its
property and employees at all times during this Contract.

III. LIABILITIES
A. The Parties, subject to the Terms of this agreement, agree to indemnify and save
harmless each other, their officers, agents, employees, and volunteers from any
and all losses, expenses, costs and claims, including but not limited to costs of
investigation, all reasonable attorneys’ fees (whether or not litigation results), and
the cost of any appeal, occurring or arising in connection with the Parties’, their
agents’, subcontractors’, employees’, vendors’, or volunteers’ negligence or
wrongful acts or omissions in connection with its performance of this Contract.
Nothing contained in this Contract shall be deemed to be a waiver of the Town’s or
the County’s sovereign immunity.

SUMMARY:
In Case R-10-012, Randy Thomas Owen and Nikki Robertson Owen, Petitioners, have petitioned
to rezone 15.590 acres from R-1, Residential Suburban Subdivision District, to A-1, Agricultural
District (for agricultural purposes – plant pine trees for harvesting). The parcel is located on

SUMMARY:
Pittsylvania County, Virginia (the “County”) is working with Appalachian Power (“AEP”) to
provide an industrial level electrical power supply for the Southern Virginia Megasite at Berry
Hill. The activity of providing a new transmission line to Megasite currently requires obtaining a
Special Use Permit (“SUP”) for all parcels crossed by the line. AEP has not been required to
follow this process in industrial parks in other localities, such as Commonwealth Crossing in
Henry County. AEP has an option to go to the State Corporation Commission to obtain approval,
instead of the locality, but this is typically a long and arduous process.
The County’s Economic Development Department proposed that the County consider amending
its Zoning Ordinance to exempt industrial park transmission lines from the SUP process (see
attached proposed Amendment to Pittsylvania County Code (“PCC”) § 35-50). The process for
amending the County’s Zoning Ordinance requires that the Planning Commission (“PC”) first
conduct a Public Hearing on the proposed Amendment and then make a recommendation to the
Board of Supervisors (the “Board”). The PC held their Public Hearing on April 2, 2019, and
voted unanimously to recommend the Amendment to the Board. The Board is now required to
hold its own Public Hearing before voting on the Amendment.
FINANCIAL IMPACT AND FUNDING SOURCE:
There is no financial impact from this proposed Zoning Ordinance Amendment, other than the
potential loss of a SUP fee.
RECOMMENDATION:
County Staff recommends that the Board conduct the required Public Hearing for the proposed
Zoning Ordinance Amendment. Assuming no currently unforeseen issues arise from the Public
Hearing, County Staff recommends that the proposed Amendment to PCC § 35-50 for industrial
park transmission lines be approved.

PUBLIC HEARING NOTICE
The Board of Supervisors of Pittsylvania County, Virginia, will hold a Public Hearing on
Tuesday, April 16, 2019, at 7:00 p.m., in the General District Courtroom of the Edwin R. Shields
Courtroom Addition, Chatham, Virginia, 24531, to receive citizen input for a potential amendment
to Pittsylvania County Code (“PCC”), Chapter 35, Section 35-35, Exemptions. The proposed
amendment would add a new item to the existing exemptions, specifically: Electrical transmission
lines sized 138kv or less, constructed to serve a properly zoned industrial park shall be exempt

SEC. 35-50. EXEMPTIONS.
The following structures and uses shall be exempt from the regulations of this Ordinance.
1. Wires, cables, conduits, vaults, laterals, pipes, mains, valves or other similar equipment for
the distribution to consumers of telephone or other communications, electricity, gas, water or
the collection of sewage or surface water operated or maintained by a governmental entity or
a public utility or public service corporation including customer, meter pedestals, telephone
pedestals, distribution transformers and temporary utility facilities required during building
construction, whether any such facility is located underground or above ground, but only
when such facilities are located in a street right-of-way or in an easement less that forty (40)
feet in width. The exemption shall not include any substation located on or above the surface
of the ground or any such distribution facility located in an easement of forty (40) feet or
more in width.
2. Railroad tracks, signals, bridges and similar facilities and equipment located on a railroad
right-of-way, and maintenance and repair work on such facilities and equipment.
3. Property owned by Pittsylvania County or any designated agent of Pittsylvania County which
is devoted to or intended for government uses is exempt from this Zoning Ordinance.
4. Electrical transmission lines sized 138kv or less, constructed to serve a properly zoned
industrial park shall be exempt from this Zoning Ordinance, with approval subject to a public
hearing and vote by the Board of Supervisors.
The following structures shall be exempt from the minimum yard requirements set forth in this
Ordinance: telephone booth and pedestals, underground utility equipment, mail boxes, or any similar
structure or equipment which in the opinion of the Zoning Administrator is obviously intended to be
otherwise located in the public interest, and are not incongruent with the aesthetic standards of the
surrounding area.

County Staff received a Petition from by Carol Cooper, resident of Museville Road in the
County, requesting the Board consider amending Pittsylvania County Code (“PCC”) § 2.2-22;
Running At Large Restrictions in Designated Areas, to include sections of Museville Road and
Anderson Mill Road. Ms. Cooper has developed a Petition supporting a dog controlled area
defined as 1128 Museville Road to 1348 Museville Road, and from 12620 Anderson Mill Road
to Burton Lake Road. County Staff has verified there are twenty-six (26) property owners within
this area. Ms. Cooper’s Petition has sixteen (16) signatures, representing 61.5% of property
owners in the proposed dog controlled area, requesting a Public Hearing for citizen input on
amending PCC § 2.2-22 to include the aforementioned sections of Museville Road and Anderson
Mill Road.
FINANCIAL IMPACT AND FUNDING SOURCE:

RECOMMENDATION:
County Staff recommends setting a Public Hearing for citizen’s input to be held at the Board’s
Business Meeting on Tuesday, May 14, 2019.

SEC. 2-22. RUNNING AT LARGE RESTRICTIONS IN DESIGNATED AREAS.
(a) Notwithstanding the provisions of Section 2-13, it shall be unlawful for any dogs, licensed or
unlicensed to run at large within certain designated subdivisions, towns, villages, or other
defined areas. (B.S.M. 4/19/05)
(b) A majority of the property owners in any subdivision, town, village, or other defined area
within Pittsylvania County may petition the Board of Supervisors to be included among those
areas within which it is unlawful for dogs to run at large. Upon receipt of such petition, the
Board shall consider (1) whether the petition is signed by a majority of the property owners
within the area, and (2) whether the area is well enough defined to permit adequate enforcement
by the Animal Control Officer. Thereafter, the Board shall vote upon the petition. If a majority
of the members of the Board vote in favor of the petition, the area designated therein shall be
added to those on file in the County Administrator’s Office.
(c) The following areas shall be designated areas restricting dogs running at large.

SUMMARY:
The Honorable Michael Taylor, Pittsylvania County Sheriff, requests Board approval to accept a
reimbursable Grant from the Virginia Attorney General’s (“AG”) Office in the amount of $5,000
for the purpose of the 2019 VARules Summer Camp. VARules Camp is a week-long summer
experience for rising eighth (8th) graders in the County held at Camp Selah in the Sutherlin area
of the County. Kids and Cops is the focus of the Camp that leads toward building positive
relations between youth and law enforcement in a non-traditional atmosphere, while also
learning anti-social behaviors that increase the youth’s ability to not become involved in illegal
and or immoral behaviors. To date, over one-hundred (100) twelve (12) and thirteen (13)-year
olds have attended the Camp and only one (1) of them has deviated from normal expected social
behavior.
FINANCIAL IMPACT AND FUNDING SOURCE:
There is little to no financial impact to the County. Costs and expenditures are reimbursed by the
AG’s Office after the completion of the Camp. Other products are procured through business
donations. Finally, any shortfalls will be facilitated by asset forfeiture educational funds.
RECOMMENDATION:
The Sheriff requests the Board’s approval for the Grant funded Camp.

SUMMARY:
The City of Martinsville, Virginia (“Martinsville”), recently received funds in the amount of
$271,203.83 from the Virginia Department of Social Services for a TANF Employment Grant.
Martinsville will be utilizing the help of the West Piedmont Workforce Investment Board
(“WIB”) and the United Way to effectively administer this Grant. Since Pittsylvania County,
Virginia (the “County”), is the WIB’s Fiscal Agent, the County needs to appropriate a portion of
these funds to cover the expenditures incurred by this Grant.
FINANCIAL IMPACT AND FUNDING SOURCE:
The total portion of the Grant that has been allocated to the WIB is $241,363.31 as shown in the
attached Budget. These funds will come to the County via a check issued by Martinsville. This
grant requires no local match.
RECOMMENDATION:
County Staff recommends that the Board appropriate a total of $241,363.31 to the WIB’s 2019
Budget (Fund 251) as referenced in the attached Budget document.

SUMMARY:
Last Spring, the new Riceville Voting location was approved by the Board and moved to
Riceville Missionary Baptist Church Family Life Center. However, after the June 2018 Primary
Election, the Church’s Trustee Committee sent a formal notice that it was no long available due
to an internal divide. After several attempts with Church Staff to come to a mutual agreement,
the County’s Registrar was forced to relocate the precinct to Riceville Java Volunteer Fire
Department located at 3105 Java Rd, Java, Virginia 24565. However, because of the November
2018 Election quickly approaching, it had to be submitted to the State Board of Election as an
Emergency Relocation.
In addition to moving Riceville, the County’s Registrar is also in a position that requires her to
find and approve a new facility for the Mt. Hermon Precinct. The owner of the Mt. Hermon
Courtyard notified the County’s Registrar that they had a new tenant with a Lease Agreement
that no longer allows it to offer the space for rent to anyone else. The County’s Registrar has
since toured and met with several local facilities within the Mt. Hermon Precinct boundaries and
has determined that New Life Community Church located at 3837 U.S. Highway 29, Danville,
Virginia 24540 has the space needed, and satisfies all of the state requirements for handicap
parking and accessibility.
FINANCIAL IMPACT AND FUNDING SOURCE:
The County’s Registrar will no longer have a rental fee of $300 per Election for use of Mt.
Hermon Courtyard. Voter Public Notice posted in Star Tribune is estimated at $89. Printing and
postage of 3,300 voter cards is estimated at $2,000.
RECOMMENDATION:
The County Registrar recommends the Board relocate Riceville Precinct from Riceville
Missionary Baptist Church Family Life Center to Riceville Java Volunteer Fire Department and
to relocate the Mt. Hermon Precinct from Mt. Hermon Courtyard to the New Life Community
Church.
