Route 58 Waterline - Grant Farm Acquisition by CondemnationRESOLUTION
PITTSYLVANIA COUNTY BOARD OF SUPERVISORS

WHEREAS, pursuant to authority as set forth in Title 15, Chapter
19, the Code of Virginia, 1950, as amended, the Pittsylvania County
Board of Supervisors is authorized to enter and acquire by
condemnation title to or easements in property for public use and
purposes, including water supply and related pipes and lines;
WHEREAS, the Route 58 Waterline Project constitutes a public use
for which condemnation is authorized;
WHEREAS, pursuant to Virginia Code § 15.2-1905(C), the
Pittsylvania County Board. of Supervisors has provided opportunity for
comment at public hearing, following duly published notice thereof,
concerning the possible entry onto or acquisition by condemnation of
title to or easements in property as set forth herein and related to
the Route 58 Waterline Project;
WHEREAS, time constraints associated with funding for the Route
58 Waterline Project necessitate resort to entry upon and taking of
property; and
WHEREAS, the County of Pittsylvania has not been successful in
securing 0.5997245 acre for that portion of a twenty (20) foot
construction & maintenance easement and 0.429086 acre for that portion
of a five (5) foot temporary construction easement fronting on the
northern boundary of the U.S. Highway 58 (westbound lane) right-of-
way, on and over property owned by Helen Lawson Grant, Rorer James
Grant, and Elizabeth Grant Peters, consisting of approximately 313.721
acres, more or less, parcel I.D. no. 14500-OA-00-0043-B, located in
the County of Pittsylvania, Virginia, despite having made bona fide
but ineffectual effort to purchase and acquire the same from the
owners at the price of $964.00, the amount determined to be the just
compensation for said easements, then
BE IT HEREBY RESOLVED that the Pittsylvania County Board of
Supervisors do hereby:
1. Find that the: Route 58 Waterline Project represents a
public use and there is a necessity for work and improvements
associated with the project;
2. Find that there exists a necessity for entry upon and
taking of said 0.5997245 acre for a_ construction & maintenance
easement and said 0.429086 acre for a temporary construction easement,
fronting on the northern boundary of the U.S. Highway 58 right-of-way,
on and over property owned by Helen Lawson Grant, Rorer James Grant,
and Elizabeth Grant Peters, consisting of approximately 313.721 acres,
more or less, designated as parcel I.D. No. 14500-OA-00-0043-B,
located in Pittsylvania County, Virginia, for such use and purposes as
necessary prior to or during condemnation proceedings;
3. Authorize condemnation and other means for purposes of
acquiring said easements for the Route 58 Waterline Project from Helen
Lawson Grant, Rorer James Grant, and Elizabeth Grant Peters; and
4. Authorize its employees, designees, and counsel, Clement &
Wheatley, to file, institute, and conduct such actions or those
proceedings as necessary to enter upon and take possession of and
pursue condemnation proceedings with respect to the property and
related interests or easements described herein.
