2011-05-05 EnerSol Resolution of SupportRESOLUTION 2011-OS-OS A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF PITTSYLVANIA, VIRGINIA VIRGINIA TOBACCO INDEMNIFICATION AND COMMUNITY REVITALIZATION COMMISSION APPLICATION ENDORSEMENT RESOLUTION WHEREAS, the Virginia Tobacco Indemnification and Community Revitalization Commission (the "Tobacco Commission") was created to help foster economic development in the tobacco dependent communities of Southside and Southeast Virginia; and WHEREAS, Pittsylvania County, Virginia (the "County"), is an independent political subdivision of the Commonwealth of Virginia (the "Commonwealth"), and is located wholly within the Tobacco Commission's footprint; WHEREAS, EnerSol Technologies, Inc. ("EnerSol"), a Springfield, Virginia corporation, has developed the Plasma-Enhanced Gasification System ("PEGS") that converts waste into fuel; thereby, potentially enhancing the Commonwealth's energy security, reducing greenhouse gas emissions, and prolonging the lifespan of its waste facilities; and WHEREAS, EnerSol has proposed the construction of anext-generation waste to energy demonstration unit (the "Demonstration Unit") in the Tobacco Commission's footprint to demonstrate the viability of PEGS in the municipal waste arena, specifically to build a fifty (50) ton per day demonstration unit to convert municipal solid waste into electrical power; and WHEREAS, EnerSol, on September 9, 2010, submitted an application for FY11 research and development funds to the Tobacco Commission to construct and operate said Demonstration Unit; and WHEREAS, EnerSol's application for research and development funds was sponsored/supported by Mr. Peter Su, Director, Virginia Department of Business Assistance and Assistant Secretary of Commerce and Trade; and WHEREAS, EnerSol has approached the County, and has proposed construction of the Demonstration Unit at/in the Pittsylvania County Landfill; and WHEREAS, upon information and belief, the Demonstration Unit project offers near and long term benefits into the Tobacco Commission's footprint including, but not limited to, the following: creating fifty (50) to one-hundred (100) jobs during the construction phase of twelve (12) to eighteen (18) months; employing twenty-five (25) to thirty (30) skilled and semi- skilled workers annually at the Demonstration Unit; creation of a supply chain footprint for the proposed project of over seven million dollars ($7,000,000); opening of an engineering office by EnerSol upon grant award in the Tobacco Commission's footprint to create long-term green jobs; Page 1 of 2 potential to develop up to nineteen (19) five-hundred (500) ton per day commercial waste gasification projects in the Tobacco Commission's footprint; a minimum of an additional five million dollars ($5,000,000) benefit to the supply chain base over the first ten (IO) years of the commercialization of the technology in Virginia and worldwide; more than $4.6 billion economic activity over the next twenty (20) years from construction with one-thousand (1,000) jobs in the Tobacco Commission's footprint; and over two-hundred eighty-seven million dollars ($287,000,000) from economic activity annually from operations and two-thousand (2,000) jobs; and NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Pittsylvania, Virginia (the "BOS"), as evidenced by a majority affirmative vote at its Monday, May 2, 2011, lawfully advertised and convened public meeting, does hereby support EnerSol's application to the Tobacco Commission for the potential construction of the Demonstration Unit at/in the Pittsylvania County Landfill, recognizing, inter alia, the following: that this resolution is an expression of interest only; said resolution does not bind or obligate the County, the BOS, or the Industrial Development Authority of Pittsylvania County, Virginia (the "IDA"), to the reimbursement for or payment of any local match money, fees, or any and all other costs associated or related to EnerSol's application or the Demonstration Unit's construction, maintenance, or operation; said resolution does not hinder any party's ability to seek current or future Tobacco Commission funds; any potential future construction, placement, and operation at/of the Demonstration Unit at/in the Pittsylvania County Landfill will be subject to comprehensive legal review, and must comply with any all federal, state, and local laws and regulations; and the County, BOS, and/or the IDA can withdraw its support of the Demonstration Unit project and application thereof at any time, without penalty, recourse, or civil, criminal, or equitable legal recourse or redress from/by EnerSol. BE IT FURTHER RESOLVED, that the BOS, does hereby authorize the Board Chairman and/or County Administrator to sign apd execute this resolution endorsing/supporting EnerSol's application. / ~, William D.
