9. HEARING OF THE CITIZENS
Each person addressing the Board under Hearing of the Citizens shall be a resident or
land owner of the County, or the registered agent of such resident or land owner. Each
person shall step up, give his/her name and district in an audible tone of voice for the
record, and unless further time is granted by the Chairman, shall limit his/her address to
three (3) minutes. No person shall be permitted to address the Board more than once
during Hearing of the Citizens. All remarks shall be addressed to the Board as a body
and not to any individual member thereof. Hearing of the Citizens shall last for a
maximum of forty-five (45) minutes. Any individual that is signed up to speak during
said section who does not get the opportunity to do so because of the aforementioned
time limit, shall be given speaking priority at the next Board meeting. Absent
Chairman’s approval, no person shall be able to speak who has not signed up.
10. PUBLIC HEARINGS
a. Rezoning Public Hearings
Pursuant to Article V, Division 6, of the Pittsylvania County Zoning Ordinance, the
Board of Supervisors have been empowered to hear and decide specific zoning iss ues
and zoning map changes in support of said Ordinance. In accomplishing this
important task, the Board is responsible for promoting the health, safety, and general
public welfare of the citizens of Pittsylvania County. The Board must ensure that all
of its decisions and regulations be directed to these goals and that each be consistent
with the environment, the comprehensive plan, and in the best interest of Pittsylvania
County, its citizens, and its posterity.

held on September 18, 2018, in the Main Conference Room, County Administration Building,

Work Session
a. Ready for Success and STAR Program Presentations (Staff Contact: Richard N. Hicks);
(Presenter: Dr. Mark R. Jones, Robin L. Haymore); (15 minutes)
Robin Haymore with Pittsylvania County Schools updated the Board on their Ready for Success
(“RFS”) Program located at the Victory Academy. The Victory Academy building used to be the
Chatham Armory, which is owned by the County. Currently, they have a maximum of ten (10)
students per class (two (2) classrooms), two (2) teachers, two (2) teacher aides, two (2) child
specific assistants, and one (1) TDT Counselor. The Program is open to both General Education
and Special Education students, but they have to meet a certain criteria. The goal is to return the
student to the Base School in ninety (90) school days. The Outcome Data for SY 2017 -2018 is a
seventy-nine (79) percent return to base school, zero (0) recidivism rate, much higher SOL pass
rates, and all students made gains on Measures of Academic Progress Assessments. The RFS
program saved approximately $1.62 million for private day placement tuition and behavior
support from 2016 to 2018.
Ms. Haymore also provided the Board with information regarding the School’s STAR Program
that is centered around the Autism Spectrum Disorder. This Program is housed at Twin Springs
Elementary and Chatham Middle School. Eight (8) of the thirteen (13) STAR students currently
participate in some type of general education learning environment alongside typical developing
same-aged peers with the support of the STAR Program. The projected cost savings for the
2018-2019 school year for thirteen (13) students is $1,172,047, assuming all students are non-
Medicaid and that each student is receiving both Speech/Language and Occupational Therapy at
an average of two (2) times per week, per related service.
STAFF, COMMITTEE, AND/OR CONSTITUTIONAL OFFICER REPORTS
a. Solid Waste Update (Staff Contact: Richard N. Hicks); (15 minutes)
Mr. Hicks updated the Board on Solid Waste functions throughout the County. Mr. Hicks stated
the biggest changes at the Landfill now is what they are calling “flat dumping,” where the
vehicle is backed right up to the trash to dump it. This will allow the compactor to go over the
trash more times and increase the compaction from one thousand (1,000) pounds per cubic yard
to fifteen hundred (1,500) plus cubic yards. This will extend the life of Cel l B, which is what is
currently being worked in, and the future Cell C by years. The smaller working face reduces the
rain water that goes into the ground, which produces leachate, and this process will cut that cost
in half. Mr. Hicks is looking into adding a small concrete pad driveway for the citizens to back
and dump their trash to increase safety. The Blair Construction Box Site has been increased
from ten (10) to thirteen (13) boxes, the Wyatt Blairs store has been increased from seven (7) to
ten (10) boxes, and they have all been freshly painted. There has been a part-time employee
hired to help maintain the Green Box Sites. The Brosville Site will have controlled hours
beginning September 24, 2018, with the hours being 7:00 AM to 7:00 PM, with a site attendant
present at all times. The 58 West Site will also have controlled hours beginning October 8, 2018,
with the same 7:00 AM - 7:00 PM hours. Mt. Cross, Blairs, and Mt. Hermon will be the next
sites to follow the same controlled hours. These will be the Pilot Sites. The employees who will
be visiting the sites are going to be referred to as the Solid Waste Assistance Team, and their
main objective is to educate the citizens on what is allowed and is not allowed at the sites, along

with monitoring tire dumping and scavenging. Mr. Hicks stated there are four (4) cameras up
now at the Grit, Callands, Brosville, and Rockford Sites. There will be a $50 citation if citizens
are caught illegally dumping. The County is currently looking for a new location for the Blair
Construction Green Box Site, along with sites for the Wyatts Blairs, Moons Store, and trying to
find a site in the Banister District. A Regional Compactor Site is being considered, which will
have everything. Accepting tires at the Landfill is being considered due to the cost of disposing
of the tires that are being dumped.
Mr. Barber voiced his concerns about the prospective sites being closed at 7:00 PM, and
suggested that they be open until 8:00 PM or 9:00 PM. Mr. Barber also stated that accepting
tires for a fee would be a great idea. Mr. Davis agreed with Mr. Barber to keep the hours open a
little longer. Mr. Scearce suggested doing an online survey for the public input on the hours of
the sites to be open. Mr. Blackstock stated that it is very important to consider accepting the tires
through businesses and through private citizens to prevent them from being dumped on private
properties and at the sites. Mr. Farmer stated the additional boxes at the Blair Store Site were
great and asked if there was any consideration of adding more boxes at the Climax Store Site.
Mr. Barber stated that he would like for them to pursue the tire disposal and requested the
Chairman to take the consensus of the Board and do 7:00 AM - 8:00 PM, or 9:00 PM, instead of
closing 7:00 PM. Mr. Smitherman stated to use the five (5) Pilot Sites to see how the closure
works. The consensus of the Board was to test the Pilot Sites 7:00 AM - 9:00 PM through the
end of the year to see what the right closing time is.

HEARING OF THE CITIZENS
Mr. Warren opened the Hearing of the Citizens at 7:12 PM. Dan Hayes, Chatham -Blairs
District, represented Averett University and invited everyone to come to Averett’s homecoming
on September 28 - 30. Michael Hughes, Tunstall District, voiced his concerns as he was a
member of the Board of Equalization and felt that they were not given enough instruction as to
what needed to be done throughout the process. He also expressed his thought that Wingate
should be able to present their reasons behind the increases that were imposed. Willie
Fitzgerald, Banister District, spoke on behalf of the Board of Equalization and the NAACP. Mr.
Fitzgerald also stated his concerns about the instructions of the Board of Equalization and the
increase on the current reassessment. Mr. Warren closed the Hearing of the Citizens at 7:24 PM.

Mr. Barber asked that everyone remember all those affected by Hurricane Florence. Mr. Farmer
wanted to make the public aware of the Climax Festival on September 22 and the Callands
Festival on September 6. Mr. Blackstock also asked everyone to remember those affected by the
Hurricane and stated his appreciation for the invitation to NAACP banquet on Saturday,
September 22 at 2:00 PM. Mr. Davis echoed the same sentiments from Mr. Fitzgerald and Mr.
Hughes regarding the Board of Equalization and also thanked Staff, Mr. Bebeau, law
enforcement, and media staff for their support. Dr. Miller voiced his concerns on uranium and
stated the case will go before the Supreme Court on November 5th, and with the County being at
the epicenter of the case, he is in the process of communicating with Governor Northam to have
tickets to be able to attend the case. Mr. Warren gave some facts from the State of the Region
that was recently held. He stated that the County had sixty-six (66) million in investments, the
unemployment rate as of July 2018 was 3.9%, and we have the lowest crime rate in the region
per one hundred thousand (100,000). The County has on-time graduation of 91.9%, which is
higher than the State average, and several medal winners at different County Schools. Mr.
Warren also thanked the Board and the Pittsylvania County School Board for turning the Armory
over to the school system. He stated that Ms. Haymore presented amaz ing statistics of what is
being done at the Victory Academy at the Work Session earlier in the day. He also congratulated
PATHS on their new acquisition in Chatham and stated that there were approximately two

hundred (200) people at the Kyocera ribbon cutting this morning. Mr. Warren congratulated Ben

COUNTY ADMINISTRATOR REPORTS
Mr. Smitherman expressed his appreciation to the Board and citizens for their patience during
the transition of the Solid Waste system. Three (3) new employees have been hired to assist with
enforcement. Two (2) of the three (3) employees are authorized to write citations to those in
non-compliance. There are three (3) things that are non-negotiable. The County cannot and will
not accept tires, brush, and will not allow scavenging. Mr. Smitherman stated he is looking
forward to educating citizens and making the system one to be proud of.

NATIONAL DOMESTIC VIOLENCE AWARENESS MONTH (OCTOBER 2018)
WHEREAS, one (1) in every four (4) women will experience domestic violence
during her lifetime, and approximately 15.5 million children are exposed to domestic
violence every year; and
WHEREAS, an average of three (3) women in the United States lose their lives
every day and domestic violence is the leading cause of injury to women; and
WHEREAS, children exposed to violence can experience serious long-term
consequences creating difficulties in school, post-traumatic disorders, alcohol and drug
abuse, and criminal behavior; and
WHEREAS, the crime of domestic violence violates an individual’s privacy, dignity,
security, and humanity due to the systematic use of physical, emotional, sexual,
psychological, and economic control and/or abuse; and
WHEREAS, it is our obligation as citizens, leaders, and governmental officials to
take a strong and united stance against violence; and
WHEREAS, victims of the violence should have help to find the compassion,
comfort, and healing they need, and domestic abusers should be punished to the
fullest extent of the law; and
WHEREAS, we encourage domestic violence victims and their families to seek
assistance from appropriate victims’ services organizations and the National Domestic
Violence Hotline (1-800-799-SAFE); and
WHEREAS, it is important to recognize the compassion and dedication of the
individuals who provide services to victims of domestic violence and work to increase
public understanding of this significant problem; and
WHEREAS, as a community, we must dedicate ourselves to protecting vulnerable
members of our society, we have a moral obligation to work to prevent domestic
violence, and to address its brutal and destructive effects;
THEREFORE, in recognition of the important work done by domestic violence
programs and victims’ service providers, the Pittsylvania County Board of Supervisors do
hereby proclaim the month of October as Domestic Violence Awareness Month, and
urge all citizens to work towards the elimination of domestic violence.

WHEREAS, the Task Force Officer of the Year award was established last year; and
WHEREAS, this award recognizes a state or local task force officer who made
significant contributions to the FBI’s mission during the past fiscal year; and

Recently, the Board requested an RFQ to be issued for investigative services for DSS HR issues.
The Purchasing Department emailed seven (7) copies of the RFQ to local law firms, advertised it
in the Chatham Star Tribune, and posted it on the County’s Public Notice Board and on the
County’s website. The County received three (3) responses. The Board agreed to interview two
(2) firms, Gentry Locke and Byrnes Gould Law. Both firms were highly qualified. Following
the interviews, the Board directed County Staff to commence negotiations with Byrnes Gould
Law to come to an acceptable financial arrangement to conduct the above-referenced services.
As a result of said negotiations, attached please find an Engagement Letter executed between the
two (2) on September 25, 2018.

SUMMARY OF POSITION: Under the general supervision of the Director of Public Safety, the

CERTIFICATIONS AND LICENSES: Must possess VA EMT certification or be able to obtain
VA certification within 6 months of hire; must possess VA or equivalent Firefighter II,
Hazardous Materials Operations, and EVOC certifications. Must have completed training in
Incident Command Systems 100, 200, 300 and 400. Prefer completion of courses related to
emergency management. Possession of an appropriate valid driver’s license issued by the
Commonwealth of Virginia.

SUMMARY:
Several local businesses have expressed an interest in sponsoring the landscaping around the
“Welcome to Pittsylvania County” signs. The County currently has twelve (12) of these signs
dispersed throughout the County along Virginia Department of Transportation (“VDOT”)
highways. The County has already received funds for the first three (3) locations. In order to
move forward, the County must develop a Comprehensive Roadside Management Plan for these
locations, hold a Public Hearing on the Plan, and submit a Land Use Permit Application to
VDOT. At the September 18, 2018 Meeting, the Board of Supervisors (the “Board”) voted to
hold a Public Hearing on Tuesday, October 16, 2018. The Public Hearing has been duly
advertised. A copy of the proposed Comprehensive Roadside Management Plan is attached for
your review and consideration. A sketch of the initial sites is included in the Plan. A copy of the
Plan has also been posted on the County’s website.
FINANCIAL IMPACT AND FUNDING SOURCE:
This project will be funded through the annual sponsorship fees being paid by the businesses and
will not require any County funds. County Staff time will be devoted to carrying out the Project.
RECOMMENDATION:
County Staff recommends the Board to approve the Pittsylvania County Comprehensive
Roadside Management Plan and Authorize Staff to Submit Land Use Permit Application to
VDOT.

Plan as presented and authorize County Staff to submit a Land User Permit Application to

SUMMARY:
Laurel, Inc. currently has an Open Space Use Agreement for a golf course expiring on December
31, 2018. The County’s Land Use Ordinance requires a renewal application be submitted to the
Commissioner of the Revenue’s office every six (6) years, if the land owner wishes to remain in
the Land Use Program.
FINANCIAL IMPACT AND FUNDING SOURCE:
If the Agreement is granted, the Honorable Shirley Hammock has submitted the deferred tax
revenue will be $3,231.44 annually.
RECOMMENDATION:
County Staff recommends the Board approve the Open Space Land Use Renewal Contract
submitted by Laurel, Inc., and authorize the County Administrator to sign any necessary
documentation.
