11-05-2015 PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING November 5, 2015 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Thursday, November 5, 2015, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Stowe called the roll. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Mr. Arthur, and by a 7 to 0 vote (1 member was absent), the October 6, 2015, minutes were approved as presented. CHAIRMAN’S REPORT There was no Chairman’s Report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:01 p.m. Case 1, William Grabbert & Lori Anderson Grabbert, R-15-032 – Mr. Stowe opened the public hearing at 7:01 p.m. Mr. Shelton, Director of Code Compliance, reported that William and Lori Grabbert had petitioned to rezone a total of 15.25 acres, two (2) parcels of land, located off Cemetery Road, in the Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Lori Grabbert was present to represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:02 p.m. During the discussion, it was stated the properties are located off the road, are in a wooded area, and are adjacent to agricultural lots. A motion was made by Mr. Arthur, seconded by Mr. Motley, to recommend the Board of Supervisors rezone the properties from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed by a 7 to 0 vote (1 member was absent). Planning Commission November 5, 2015 Page 2 Case 2, Wesley Lee Francis, R-15-033 – Mr. Stowe opened the public hearing at 7:04 p.m. Mr. Shelton, Director of Code Compliance, reported that Wesley Lee Francis had petitioned to rezone 2.94 acres, located on U.S. Highway 29, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Wesley Frances and Bill Rogers were present to represent the petition. Mr. Francis stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:06 p.m. During the discussion, it was stated the property on U.S. Highway 29 across from the petitioned parcel is zoned B-1, Business District, Limited. A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Motion passed by a 7 to 0 vote (1 member was absent). Case 3, Mountain Land Company, LLC, R-15-034 – Mr. Stowe opened the public hearing at 7:07 p.m. Mr. Shelton, Director of Code Compliance, reported that Mountain Land Company, LLC, had petitioned to rezone 4.60 acres, located on U.S. Highway 29, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General. William Thomas Rogers was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:09 p.m. During the discussion, it was stated the petitioned parcel is adjacent to properties zoned B-2, Business District, General, and is in line with the Comprehensive Plan. A motion was made by Mr. Motley, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Motion passed by a 7 to 0 vote (1 member was absent). Case 4, William H. Rogers, Jr., & Judith R. Rogers, R-15-035 – Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton, Director of Code Compliance, reported that William and Judith Rogers had petitioned to rezone 0.58 acre, located on U.S. Highway 29, in the Chatham-Blairs Election District from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Bill Rogers was present to represent the petition. He stated the parcel joins a tract that is zoned B-2 and the rezoning would allow for future development. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:12 p.m. During the discussion, it was stated the parcel is adjacent to properties zoned B-2, Business District, General. A motion was made by Mr. Motley, seconded by Dr. Miller, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to B-2, Business District, General. Motion passed by a 7 to 0 vote (1 member was absent). Case 5, William H. Rogers, Jr., & Judith R. Rogers, R-15-036 – Mr. Stowe opened the public hearing at 7:13 p.m. Mr. Shelton, Director of Code Compliance, reported that William and Judith Rogers had petitioned to rezone a total of four (4) parcels of land, one (1) parcel containing 6.16 acres and three (3) parcels with no lot size on file in the Commissioner of Revenue’s Office from B-2, Business District, General and M-1, Industrial District, Light Industry to M-2, Industrial District, Heavy Industry. Mr. Shelton then stated the parcels are located on U.S. Highway 29 and on State Road 719/Lawless Creek Road, in the Banister Election District. Bill Rogers was present to represent the petition. He stated the parcels were presently used as a business, there would be no more entrances than are already at the site, and any changes made would be inside the fenced area. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:15 p.m. A motion was made by Dr. Miller, seconded by Mr. Motley, to recommend the Board of Supervisors rezone the properties from B-2, Business District, General, and M-1, Industrial District, Light Industry to M-2, Industrial District, Heavy Industry. Motion passed by a 7 to 0 vote (1 member was absent). This concludes the Rezoning cases. OLD BUSINESS Mr. Sides stated an update of the Comprehensive Plan and Future Land Use Map, with one change, Route 863 has been changed to Route 311, will be presented to the Board members for their review and consideration at the December meeting. He also stated that a recommendation was made by the Planning Commission at the October meeting that the five-year review had been completed and the Land Use Map be updated to account for changes since 2010.
