MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, August 4, 2015, in the General
District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately
7:00 p.m. Mr. Stowe called the roll.

No citizens came forward to speak.
APPROVAL OF THE MINUTES
A motion was made by Mr. Motley, seconded by Mr. Arthur, and by a unanimous vote, the July 7, 2015,
minutes were approved as presented.
CHAIRMAN ’S REPORT
There was no Chairman’s Report.
THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at
approximately 7:01 p.m.
Case 1, Steven Grant Epps , R-15-023 – Mr. Stowe opened the public hearing at 7:01 p.m. Mr. Shelton,
Director of Code Compliance, reported that Steven Epps had petitioned to rezone 14.71 acres, located on
State Road 665/Rockford School Road, in the Staunton River Election District from R-1, Residential
Suburban Subdivision District to A-1, Agricultural District for agricultural use - farming. Steve Epps was
present to represent the petition. He stated he had nothing to add. There was no opposition to the petition.
Mr. Stowe closed the public hearing at 7:02 p.m. During the discussion, it was stated this is consistent with
the adjacent parcels of land zoned A-1, Agricultural District. A motion was made by Mr. Arthur, seconded by
Mr. Horne, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District. Motion passed unanimously.

Case 2, English Holding Company, Inc., R-15-024 – Mr. Stowe opened the public hearing at 7:03 p.m. Mr.
Shelton, Director of Code Compliance, reported that English Holding Company, Inc., had petitioned to
rezone 1.50 acres, located on State Road 609/Brights Road, in the Staunton River Election District from R-
1, Residential Suburban Subdivision District to A-1, Agricultural District to combine with the adjacent parcels
of land zoned A-1. Mr. James Kent with Kent & Kent, P.C., was present to represent the petition. He stated
he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:05
p.m. During the discussion, it was stated this parcel zoned R-1 is a case of spot zoning. A motion was made
by Mr. Arthur, seconded by Mr. Motley, to recommend the Board of Supervisors rezone the property from R-
1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously.
Case 3, Robert Allen Shrewsberry , R-15-025 – Mr. Stowe opened the public hearing at 7:06 p.m. Mr.
Shelton, Director of Code Compliance, reported that Robert Allen Shrewsberry had petitioned to rezone
3.59 acres, located on State Road 1016/Neal Davis Road, in the Dan River Election District from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District for subdivision of the property to allow
for placement of a second home. Lena Crihfield was present to represent the petition. She stated she had
nothing to add except the second home would be for her sister’s residence. There was no opposition to the
petition. Mr. Stowe closed the public hearing at 7:07 p.m. During the discussion, it was stated there are
single-wide and double-wide mobile homes in the area and the property located behind the petitioned parcel
is zoned A-1, Agricultural District. A motion was made by Mr. Horne, seconded by Mr. Arthur, to recommend
the
Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1,
Agricultural District. Motion passed unanimously.
Case 4, Tony L. Lundy , R-15-026 – Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director
of Code Compliance, reported that Tony Lundy had petitioned to rezone approximately 1.00 acre, located on
State Road 750/Mount Cross Road, in the Westover Election District from A-1, Agricultural District to M-1,
Industrial District, Light Industry to combine with the adjacent parcel of land zoned M-1. Tony Lundy was
present to represent the petition. He stated he had nothing to add except he wanted to add to his existing
business and expand the parking lot. John Ludeman spoke during the hearing and stated he wanted to be
sure the Board members were aware that the petitioned parcel fronted Mount Cross Road and Moorefield
Bridge Road; however, he was not opposed to the petition. There was no opposition to the petition. Mr.
Stowe closed the public hearing at 7:09 p.m. During the discussion, it was stated Mr. Lundy’s business
employs local people and it is a growing business. A motion was made by Mr. Weatherford, seconded by
Dr. Miller, to recommend the Board of Supervisors rezone the property from A-1, Agricultural District to M-1,
Industrial District, Light Industry. Motion passed unanimously.
Case 5, Brandon Scott Cassidy , R-15-027 – Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton,
Director of Code Compliance, reported that Brandon Scott Cassidy had petitioned to rezone 9.56 acres,
located on State Road 693/Chaneys Store Road, in the Dan River Election District from B-2, Business
District, General to RC-1, Residential Combined Subdivision District to allow for a second dwelling, a 2014
single-wide mobile home, on the property. Joann Moser, Mr. Cassidy’s grandmother, was present to
represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr.
Stowe closed the public hearing at 7:11 p.m. During the discussion, it was stated this is not spot zoning and
the zoning is consistent with the adjacent parcels of land zoned RC-1, Residential Combined Subdivision
District. A motion was made by Mr. Horne, seconded by Mr. Motley, to recommend the Board of
Supervisors rezone the property from B-2, Business District, General to RC-1, Residential Combined
Subdivision District. Motion passed unanimously.
This concludes the Rezoning cases.
Case S-1, The ARC of Southside , S-15-0 11 – Mr. Stowe opened the public hearing at 7:12 p.m. Mr.
Shelton, Director of Code Compliance, reported that The ARC of Southside had petitioned for a Special Use
Permit on 1.14 acres, located on State Road 685/Chalk Level Road, in the Banister Election District for a
private day school for developmentally disabled children. Tonya Fowler, Executive Director of The ARC of
Southside, was present to represent the petition. She stated she had nothing to add. There was no
opposition to the petition. Mr. Stowe closed the public hearing at 7:13 p.m. A motion was made by Dr.
Miller, seconded by Mr. Horne, to recommend the Board of Zoning Appeals grant this Special Use Permit
request. Motion passed unanimously.

This concludes the Special Use Permit case.
Case V-1, Roy P. Custer & Patricia C. Custer , V-15-00 5 – Mr. Stowe opened the public hearing at 7:14
p.m. Mr. Shelton, Director of Code Compliance, reported that Roy and Patricia Custer had petitioned for a
Variance on 6.30 acres, located on U.S. Highway 29 North, in the Callands-Gretna Election District to
Section 35.369. Minimum Yard Dimensions. (C.) Rear Setback, of the Pittsylvania County Zoning
Ordinance, requesting a variance of thirty (30) feet to allow for construction of a storage building. Roy
Custer was present to represent the petition. He stated he would like to rent the storage building out for
future business use once he no longer used it for his personal use. There was no opposition to the petition.
Mr. Stowe closed the public hearing at 7:15 p.m. A motion was made by Ms. Mease, seconded by Mr.
Hagerman, to recommend the Board of Zoning Appeals grant this Variance request. Motion passed
unanimously.
This concludes the Variance case.
OLD BUSINESS
There was no old business.
NEW BUSINESS
Mr. Sides presented a proposed Conservation Easement Summary for the Board’s review from the Virginia
Outdoors Foundation for a total of 76.83 acres, two (2) parcels of land, located on State Road 845/Hinesville
Road. He also stated the property is a working farm, is rural in atmosphere, and is outside of the area of
concentrated growth. He also stated the property is consistent with the Future Land Use Plan and the
Comprehensive Plan. A motion was made by Mr. Motley, seconded by Mr. Weatherford, that this property is
consistent with the Comprehensive Plan. Motion passed unanimously.
The meeting was adjourned at approximately 7:23 p.m.
