MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, June 2, 2015, in the General
District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately
7:00 p.m. Mr. Stowe called the roll.

HEARING OF THE CITIZENS
Mr. Richard Motley thanked everyone for the cards, prayers and the fruit basket he received from the
Planning Commission during his recent illness. He also thanked Mrs. Brenda Bowman for her help and
support during his illness.
APPROVAL OF THE MINUTES
A motion was made by Mr. Arthur, seconded by Ms. Mease, and by a unanimous vote, the May 5, 2015,
minutes were approved as presented.
CHAIRMAN ’S REPORT
Mr. Stowe welcomed Mrs. Brenda Bowman, Madam Chair of the Board of Supervisors, to the meeting. He
also welcomed Brian Horne, the Dan River District representative who replaced Mr. Larry Welborn, to the
meeting.
THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at
approximately 7:03 p.m.
Case 1, Mark Winston Stevens , R-15-016 – Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton,
Director of Code Compliance, reported that Mark Winston Stevens had petitioned to rezone 7.07 acres,
located off State Road 360/Old Richmond Road, in the Dan River Election District from R-1, Residential
Suburban Subdivision District to A-1, Agricultural District for agricultural use. Mark Stevens was present to
represent the petition. He stated he wanted to expand his garden to sell produce. John Roberts expressed
his concerns during the meeting and stated he had no opposition to the petition, but he wanted to be
assured there would be no intensive livestock on the property if the rezoning was granted. Mr. Stevens
offered a rebuttal and stated his intentions were strictly for produce and not livestock. There was no
opposition to the petition. Mr. Stowe closed the public hearing at 7:07 p.m. During the discussion, it was
stated the property is surrounded on both sides by parcels of land zoned A-1, Agricultural District. A motion

by Mr. Horne, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone the property from R-
1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously.
Case 2, Billie O. Goodman, Roger L. Goodman, Angela G. Dawso n, Lesley William Goodman, Stef anie
Simpson Goodman , R-15-017 – Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Director of
Code Compliance, reported that Roger L. Goodman and Others had petitioned to rezone a total of 4.98
acres, three (3) parcels of land, located off State Road 900/Glenland Road (on Goodman Lane), in the
Staunton River Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural
District to make the zoning consistent with its current use - farming. Roger Goodman was present to
represent the petition. He stated he raised hay on the 64 acre farm to feed cattle and the property had been
taken out of land use. During questioning from one of the Board members, Mr. Shelton stated the
petitioners wanted to divide their property among their children, and if they rezoned the parcels of land
zoned R-1 to A-1, the property could be subdivided. There was no opposition to the petition. Mr. Stowe
closed the public hearing at 7:16 p.m. A motion was made by Mr. Arthur, seconded by Ms. Mease, to
recommend the Board of Supervisors rezone the properties from R-1, Residential Suburban Subdivision
District to A-1, Agricultural District. Motion passed by a 7 to 1 vote. Those voting to grant the motion were
as follows: Mr. Weatherford, Ms. Mease, Mr. Stowe, Mr. Horne, Mr. Arthur, Dr. Miller and Mr. Hagerman.
The vote to deny the motion was made by Mr. Motley.
Case 3, Renan Fire Department , R-15-018 – Mr. Stowe opened the public hearing at 7:17 p.m. Mr.
Shelton, Director of Code Compliance, reported that Renan Fire Department had petitioned to rezone 0.44
acre, located on State Road 761/Straightstone Road, in the Staunton River Election District from R-1,
Residential Suburban Subdivision District to
M-1, Industrial District, Light Industry to combine with the adjacent parcel of land zoned M-1. Scott
Hutcherson was present to represent the petition. He stated the Renan Fire Department wanted to
construct a 20 x 20 addition to the existing structure for office space, but was unable to obtain a building
permit because of the zoning of the adjacent parcel of land. There was no opposition to the petition. Mr.
Stowe closed the public hearing at 7:18 p.m. A motion was made by Mr. Arthur, seconded by Mr. Motley, to
recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision
District to M-1, Industrial District, Light Industry. Motion passed unanimously.
Case 4, Virginia S. Jacobs , R-15-019 – Mr. Stowe opened the public hearing at 7:19 p.m. Mr. Shelton,
Director of Code Compliance, reported that Virginia S. Jacobs had petitioned to rezone 11.61 acres, located
on State Road 685/Telegraph Road, in the Staunton River Election District from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjacent parcels of
land zoned A-1 and to make the existing single-wide mobile home on the property a permitted use. Mr.
James Kent with Kent & Kent, P.C., was present to represent the petition. He stated the petitioner desired
to rezone the property to allow for more than one (1) residence on the property and be allowed to remodel
the old mobile home located on the property. There was no opposition to the petition. Mr. Stowe closed the
public hearing at 7:20 p.m. A motion was made by Mr. Arthur, seconded by Mr. Motley, to recommend the
Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1,
Agricultural District. Motion passed unanimously.
Case 5, Jerry Fitzgerald , R-15-020 – Mr. Stowe opened the public hearing at 7:21 p.m. Mr. Shelton,
Director of Code Compliance, reported that Jerry Fitzgerald had petitioned to rezone a total of 32.97 acres,
seven (7) parcels of land, located on State Road 686/Elkhorn Road, in the Banister Election District from R-
1, Residential Suburban Subdivision District to A-1, Agricultural District for agricultural use-pastureland.
Jerry Fitzgerald was present to represent the petition. He stated he had nothing to add. There was no
opposition to the petition. Mr. Stowe closed the public hearing at 7:22 p.m. A motion was made by Dr.
Miller, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the properties from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously.
This concludes the Rezoning cases.
Case S-1, Johnnie N. Davis, Jr., & Cynthia B. Davis, S-15-005 – Mr. Stowe opened the public hearing at
7:23 p.m. Mr. Shelton, Director of Code Compliance, reported that Johnnie and Cynthia Davis had
petitioned for a Special Use Permit on 1.52 acres, located on State Road 719/E Witt Road, in the Chatham-
Blairs Election District for non-emergency medical transport. Cynthia and Carla Davis were present to
represent the petition. They stated they had nothing to add. Following questioning from one of the Board
members, Mrs. Davis stated two (2) vehicles would be used for the business,

the drivers of the vehicles were not required to have special permits, the hours of operation would be from
9:00 a.m. to 5:00 p.m., and the business would be operated at the site address. There was no opposition to
the petition. Mr. Stowe closed the public hearing at 7:25 p.m. During the discussion, it was stated the site is
well groomed and is a very nice area. A motion was made by Mr. Motley, seconded by Dr. Miller, to
recommend the Board of Zoning Appeals grant this Special Use Permit request. Motion passed
unanimously.
Case S-2, Tommy D. Mathena & Joyce S. Mathena , S-15-00 6 – Mr. Stowe opened the public hearing at
7:26 p.m. Mr. Shelton, Director of Code Compliance, reported that Tommy and Joyce Mathena had
petitioned for a Special Use Permit on 26.12 acres, located on U.S. Highway 41/Franklin Turnpike, in the
Tunstall Election District for a private recreational facility for paintball gun games. Richard Reynolds was
present to represent the petition. He stated the facility would benefit the local youth, it would be open after
school until dark, and the facility would not be seen from the highway. Following questioning from one of
the Board members regarding safety issues, Mr. Reynolds discussed safety measures implemented prior to
distribution of the paintball guns, as well as protective gear that is distributed to the players. Mr. Reynolds
also stated the closest recreational facility for paintball is located in Greensboro, North Carolina. There was
no opposition to the petition. Mr. Stowe closed the public hearing at 7:32 p.m. During the discussion, it was
stated this facility would be great for the youth of Pittsylvania County. A motion was made by Mr. Motley,
seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals grant this Special Use Permit
request. Motion passed by a 7 to 1 vote. Those voting to grant the motion were as follows: Mr.
Weatherford, Ms. Mease, Mr. Motley, Mr. Stowe, Mr. Horne, Mr. Arthur, and Dr. Miller. The vote to deny the
motion was made by Mr. Hagerman.
This concludes the Special Use Permit cases.
OLD BUSINESS
Mr. Shelton stated he would like to commend Mr. Motley and to recognize him for his dedication to the
Planning Commission, especially following his recent illness.
Mr. Shelton welcomed Brian Horne, the Dan River District representative, to the meeting.
Mr. Shelton also reminded the Board members to make their donations to the Flower Fund.
NEW BUSINESS
There was no new business.
The meeting was adjourned at approximately 7:42 p.m.
