03-03-2015PITTSYLVANIA COUNTY PLANNING COMMISSION REGULAR MEETING March 3, 2015 MINUTES VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, March 3, 2015, in the General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00 p.m. Mr. Stowe called the roll. Shelton, Jr. Director of Code Compliance /Zoning Administrator Greg Sides Assistant County Administrator /Director of Planning ABSENT Dr. Charles H. Miller, Jr. Banister District Larry Welborn Dan River District Following the roll call, Mr. Arthur thanked the Board members for the fruit basket he received following the recent death of his brother. Mr. Shelton provided a brief update of Mr. Welborn's health condition, and it was suggested that a get well card be sent to Mr. Welborn, who remains hospitalized at Duke University Medical Center. HEARING OF THE CITIZENS No citizens came forward to speak. APPROVAL OF THE MINUTES A motion was made by Mr. Motley, seconded by Mr. Arthur, and by a 6 to 0 vote (2 members were absent), the February 3, 2015, minutes were approved as presented. CHAIRMAN'S REPORT There was no Chairman's report. THE ZONING PRECEPTS WERE READ by Mr. Stowe TO OPEN THE PUBLIC HEARING at approximately 7:00 p.m. Case 1, Rufus Randolph Duffer, R -15 -004 — Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Director of Code Compliance, reported that Rufus Randolph Duffer had petitioned to rezone a total of 102.89 acres, two (2) parcels of land, located on State Road 685 /Telegraph Road, in the Staunton River Election District from R -1, Residential Suburban Subdivision District to A -1, Agricultural District to combine with the adjacent parcels of land zoned A -1 for agricultural use. Richard Armstrong was present to represent the petition. He stated the petitioned parcels are consistent with the Planning Commission March 3, 2015 Page 2 adjacent parcels of land zoned A -1. There was no opposition to the petition. Doug Rogers spoke in favor of the petition and stated the parcels should be zoned A -1, Agricultural District. Mr. Stowe closed the public hearing at 7:07 p.m. During the discussion, it was stated this has always been an agricultural area. A motion was made by Mr. Arthur, seconded by Mr. Motley, to recommend the Board of Supervisors rezone the properties from R -1, Residential Suburban Subdivision District to A -1, Agricultural District. Motion passed by a 6 to 0 vote (2 members were absent). This concludes the Rezoning case. Case S -1, Arthur D. Cronce, jr., & Ambre M. Crone, S -15- 001 — Mr. Stowe opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance, reported that Arthur and Ambre Cronce had petitioned for a Special Use Permit on 0.57 acre (per plat), located on State Road 703 /Irish Road, in the Tunstall Election District to allow for the addition of a bedroom to their 1994 single -wide mobile home. Arthur Cronce was present to represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:10 p.m. A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals grant this Special Use Permit request. Motion passed by a 6 to 0 vote (2 members were absent). Case S -2, S -15 -002 & Case V -1, V- 15- 001,Jeffrey Scott Crider & Rhonda Barker Crider — Mr. Stowe opened the public hearing at 7:11 p.m. Mr. Shelton, Director of Code Compliance, reported that Jeffrey and Rhonda Crider had petitioned for a Special Use Permit for a kennel for boarding and grooming dogs. He then stated Mr. and Mrs. Crider had also petitioned for a Variance to Section 35.369. Minimum Yard Dimensions.(A.) Front Setback, (B.) Side Setback and (C.) Rear Setback, of the Pittsylvania County Zoning Ordinance for 157 feet Front Setback, 190 feet Right Side Setback, 154 feet Left Side Setback, and 54 feet Rear Setback to allow for a kennel for boarding and grooming dogs. He stated the petitioned parcel is 0.45 acre, located on State Road 685 /Chalk Level Road, in the Banister Election District. Mr. Shelton then stated the Board needed to discuss approval of the Special Use Permit and Variance to approve both cases or deny both cases due to the fact the Special Use Permit could not be issued without the Variance approval. Jeff Crider was present to represent the petition. He stated he had nothing to add. Following questions from a Board member, Mr. Crider stated that a maximum of twenty (20) dogs would be kept in the facility overnight or on weekends and the building would be soundproofed and air - conditioned. There was no opposition to the petition. Tommy Motley and Luther Hammack spoke in favor of the petition. They stated the building had been for sale for a while and they would rather see a business there than to see an empty building. Mr. Stowe closed the public hearing at 7:19 p.m. During the discussion, it was stated a petition had been signed by all the neighbors and the community is very supportive of this petition. A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals grant both the Special Use Permit request and the Variance request as stated. Motion passed by a 6 to 0 vote (2 members were absent). Case S -3. Stacy M. Compton, S -15 -003 — Mr. Stowe opened the public hearing at 7:21 p.m. Mr. Shelton, Director of Code Compliance, reported that Stacy M. Compton had petitioned for a Special Use Permit on 109.87 acre (per plat), located on State Road 633 /Easome Road, in the Staunton River Election District for a campground. Stacy Compton and Proctor Harvey, President of Harvey Design Land Architects, were present to represent the petition. Mr. Compton stated he had nothing to add. Mr. Compton and Mr. Harvey presented maps of the area showing the proposed plans and layout of the campground. He stated there will be three (3) phases of the project, with Phase I to be completed in five (5) years and Phase III being completed in ten (10) years. He then stated there was no room on the property for a stadium; however, there were plans for horse trails on the property and the campground would be family oriented. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:28 p.m. During the discussion, it was stated the neighbors are in favor of the petition. A motion was made by Mr. Arthur, seconded by Ms. Mease, to recommend the Board of Zoning Appeals grant this Special Use Permit request. Motion passed by a 6 to 0 vote (2 members were absent). This concludes the Special Use cases and the Variance case OLD BUSINESS There was no old business. Planning Commission March 3, 2015 Page 3 NEW BUSINESS Mr. Greg Sides, Assistant County Administrator /Director of Planning, reported that at the Board of Supervisors meeting held on Monday night, March 2, 2015, Mr. Elton Blackstock, Vice - Chairman, requested that a joint meeting between the Board of Supervisors and the Planning Commission be scheduled to get the meetings back on track for the agricultural setbacks. He also stated the Comprehensive Plan needed to be reviewed for any updates. He stated the joint meeting would be held in mid - April, and he requested the Board members start thinking of dates they would be available in the month of April for this meeting.
