MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, December 2, 2014, in the General District
Courtroom, Chatham, Virginia. Mr. Motley, Chairman, called the meeting to order at approximately 7:14 p.m. Mr. Motley
called the roll.

HEARING OF THE CITIZENS
No citizens came forward to speak.
APPROVAL OF THE MINUTES
A motion was made by Mr. Arthur, seconded by Mr. Welborn, and by a 5 to 3 vote (3 members were absent), the
November 6, 2014, minutes were approved as presented.
CHAIRMAN’S REPORT
Mr. Motley welcomed Mr. Jesse Barksdale, Chairman of the Pittsylvania County Board of Supervisors, Mrs. Brenda
Bowman, Board of Supervisors Representative for the Chatham-Blairs District, Mr. Tim Barber, Board of Supervisors
Representative for the Tunstall District, and Mr. Jerry Hagerman, Board of Supervisors Representative for the Callands-
Gretna District to the meeting.
THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approximately
7:16 p.m.
Case 1, Jerry T. Shelton & Vickie C. Shelton, R-14-045 – Mr. Motley opened the public hearing at 7:16 p.m. Mr.
Shelton, Director of Code Compliance, reported that Jerry and Vickie Shelton had petitioned to rezone a total of 2.678
acres, three (3) parcels of land, located on State Road 904/Burke Road and State Road 634/Blue Ridge Drive, in the
Banister Election District. He stated they would like to rezone 0.97 acre from A-1, Agricultural District to R-1, Residential
Suburban Subdivision District. He then stated they would like to rezone 0.718 acre from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District. He also stated they would like to rezone 0.99 acre from B-2, Business
District, General to A-1, Agricultural District to combine with the adjacent parcels of land. Jerry Shelton was present to

represent the petition. He stated he had nothing to add and he just wanted to get the properties rezoned into one complete
package. There was no opposition to the petition. Tommy Nicholson spoke in favor of the petition and stated the
properties needed to be rezoned to be in compliance with the surrounding area. Mr. Motley closed the public hearing at
7:19 p.m. A motion was made by Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Supervisors rezone
0.97 acre from A-1, Agricultural District to R-1, Residential Suburban Subdivision District, 0.718 acre from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District, and 0.99 acre from B-2, Business District, General
to A-1, Agricultural District. Motion passed by a 5 to 0 vote (3 members were absent).
Case 2, Michael R. Jones & Kristy E. Jones, R-14-046 – Mr. Motley opened the public hearing at 7:20 p.m. Mr.
Shelton, Director of Code Compliance, reported that Michael and Kristy Jones had petitioned to rezone a total of 24.77
acres, two (2) parcels of land, located on State Road 717/Hunters Lane, in the Dan River Election District from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District to allow for construction of a garage for storage of
their personal vehicles on a vacant parcel of land. Michael Jones was present to represent the petition. He stated he had
nothing to add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:21 p.m. During the
discussion, it was stated this is consistent with the surrounding parcels in the area. A motion was made by Mr. Welborn,
seconded by Ms. Mease, to recommend the Board of Supervisors rezone the properties from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District. Motion passed by a 5 to 0 vote (3 members were absent).
Case 3, Shirley Adams Daniel, R-14-047 – Mr. Motley opened the public hearing at 7:21 p.m. Mr. Shelton, Director of
Code Compliance, reported that Shirley Adams Daniel had petitioned to rezone a total of 3.33 acres, four (4) parcels of
land, located on U.S. Highway 29 and on State Road 946/Georges Lane, in the Chatham-Blairs Election District from
R-1, Residential Suburban Subdivision District to B-2, Business District, General for future sale of the properties. Jeff
Davis was present to represent the petition. Mr. Davis distributed a map with an aerial view of the properties to each
Board member for their review. He then stated the parcels are surrounded by residential area; however, there are
numerous properties across the highway zoned for business. He then stated the best use for the petitioned parcels would
be a business district. Willie Bullington, Eddie Giles and Jack Noble spoke in opposition to the petition. Their concerns
included, but were not limited to, the following: a desire for the neighborhood to remain peaceful; a desire for no
businesses in their front door; traffic concerns; and not taking the safety of the citizens into consideration. Mr. Bullington
presented a petition with a total of 104 signatures in opposition to the petition to the Board members for their review. Mr.
Davis offered a rebuttal and stated the properties are presently on the market, but are not under contract. He also stated a
privacy fence would be placed to protect the residents in the area should the rezoning be granted. Mr. Motley closed the
public hearing at 7:39 p.m. During the discussion, it was stated Highway 29 separates the surrounding properties between
residential and business, and should the petitioned parcels of land be rezoned, this would create spot zoning. A motion
was made by Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Supervisors deny this rezoning request.
Motion passed by a 5 to 0 vote (3 members were absent).
This concludes the Rezoning cases.
Case S-1, John L. Hawk & Maria K. Hawk, S-14-015 – Mr. Motley opened the public hearing at 7:41 p.m. Mr. Shelton,
Director of Code Compliance, reported that John and Maria Hawk had petitioned for a Special Use Permit on 20.80 acres,
located on State Road 672/Pittsville Road, in the Staunton River Election District for a recreational facility to allow for
weddings, receptions, and family reunions. John Hawk was present to represent the petition. He stated he had nothing to
add. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:42 p.m. A motion was made by
Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Zoning Appeals grant this Special Use Permit request.
Motion passed by a 5 to 0 vote (3 members were absent).
Case S-2, Timothy R. Barber & Kimberly R. Barber, S-14-016 – Mr. Motley opened the public hearing at 7:44 p.m.
Mr. Shelton, Director of Code Compliance, reported that Timothy and Kimberly Barber had petitioned for a Special Use
Permit on 95.60 acres, located on State Road 862/Oak Hill Road, in the Tunstall Election District for a 60 ft. x 80 ft.
commercial garage for service and repair of automobiles. Tim Barber was present to represent the petition. He stated this
business has been in his family for over sixty (60) years, this is his third (3rd) expansion, this is a nice building, and the
neighbors had no opposition. No one spoke in opposition to the petition. Mr. Motley closed the public hearing at 7:45

p.m. A motion was made by Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Zoning Appeals grant
this Special Use Permit request. Motion passed by a 5 to 0 vote (3 members were absent).
This concludes the Special Use Permit cases.
OLD BUSINESS
There was no old business.
NEW BUSINESS
Mr. Shelton reminded the Board members that new officers will be elected at the January meeting. He also stated a
memorandum with the 2015 meeting dates for the Planning Commission and Board of Zoning Appeals would be mailed
to them (a copy was also distributed to each Board member in attendance).
The meeting was adjourned at approximately 7:47 p.m.
