REGULAR MEETING
December 9, 2014
MINUTES
VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, December 9, 2014, in the General
District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to
order at approximately 7:00 p.m. The Board observed a few moments of silence. Mr. Shelton called the roll.

APPROVAL OF THE MINUTES
By motion of Mr. Merricks, seconded by Ms. Glass, and by a unanimous vote, the Minutes of the November 13,
2014, meeting were approved as presented.
Old Business
There was no old business.
New Business
Mr. Shelton reported there were no cases for the January 2015 Cycle. He further stated all the members had been
given a memo regarding the dates for the 2015 meetings.
CHAIRMAN'S REPORT
There was no Chairman's report.
THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at
approximately 7:01 p. m.
Case S -1, John and Maria Hawk, S -14 -015 — Mr. Talbott opened the public hearing at approximately 7:02 p. m.
Mr. Shelton, Director of Code Compliance /Zoning Administrator, reported John and Maria Hawk had petitioned for
a Special Use Permit on 20.80 acres, located on State Road 672 /Pittsville Road, in the Staunton River Election
District for a recreational facility to allow for weddings, receptions, and family reunions. He further reported the
Planning Commission, with no opposition, recommended granting the petitioners' request. Mr. Hawk was present to
represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Talbott
closed the public hearing at approximately 7:03 p.m. The Board discussed the petition as the Committee of the

Whole and determined there were no adverse effects. During the discussion it was stated there was already a bed and
breakfast on the property. Upon motion of Mr. Easley, seconded by Mr. Craddock, the following motion was
adopted: Whereas, John and Maria Hawk have petitioned the Board of Zoning Appeals for a Special Use Permit for
a recreational facility and, Whereas, we find no substantial detriment to adjacent property, that the character of the
zoning district will not be changed thereby, and, that such use will be in harmony with the purpose and intent of the
Ordinance, I move the Special Use Permit be granted. The vote was six (6) to zero (0), with one (1) member absent,
Mr. Estes.
Case S -2, Timothy and Kimberly Barber, S -14 -016 — Mr. Talbott opened the public hearing at approximately 7:05
p. m. Mr. Shelton, Director of Code Compliance /Zoning Administrator, reported Timothy and Kimberly Barber had
petitioned for a Special Use Permit on 95.60 acres, located on State Road 862 /Oak Hill Road, in the Tunstall Election
District for a 60 foot x 80 foot commercial garage for service and repair of automobiles. He further reported the
Planning Commission, with no opposition, recommended granting the petitioners' request. Mr. Barber, was present
to represent the petition. He stated his family had run this type of business, in this community, for over 60 years and
he had run the business for twenty years. Mr. Barber stated this was an expansion of his current business. He further
stated the area would be kept nice and clean and that Mr. Craddock, with VDOT, had given his approval for this
project. There was no opposition to the petition. Mr. Talbott closed the public hearing at approximately 7:06 p.m.
The Board discussed the petition as the Committee of the Whole and determined there were no adverse effects.
During the discussion it was stated this business had been in the community for some years and would stay in the
community. It was further stated that there were no junk vehicles at Mr. Barber's current location and the Board was
sure neighbors would notify the staff if there was a problem at this location. Upon motion of Mr. Merricks, seconded
by Mr. Yeaman, the following motion was adopted: Whereas, Timothy and Kimberly Barber have petitioned the
Board of Zoning Appeals for a Special Use Permit for a commercial garage for service and repair of automobiles and,
Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be
changed thereby, and, that such use will be in harmony with the purpose and intent of the Ordinance, I move the
Special Use Permit be granted. The vote was six (6) to zero (0), with one (1) member absent, Mr. Estes.
This concludes the Special Use Permit cases.
The meeting adjourned at approximately 7:10 p.m.
