REGULAR MEETING

MINUTES
VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, October 14, 2014, in the General
District Courtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to
order at approximately 7:00 p.m. The Board observed a few moments of silence. Mr. Shelton called the roll.

APPROVAL OF THE MINUTES
By motion of Mr. Estes, seconded by Mr. Yeaman, and by a unanimous vote, the Minutes of the September 9, 2014,
meeting were approved as presented.
Old Business
There was no old business.
New Business
Mr. Shelton reported on the cases for the November 2014 Cycle.
CHAIRMAN’S REPORT
There was no Chairman’s report.
THE ZONING PRECEPTS WERE READ BY Mr. Talbott to OPEN THE PUBLIC HEARING at
approximately 7:01 p.m.
Case S-1, Steven & Lillian Cassada, S-14-012 – Mr. Talbott opened the public hearing at approximately 7:03 p.m.
Mr. Shelton, Director of Code Compliance/Zoning Administrator, reported Steven & Lillian Cassada had petitioned
for a Special Use Permit on 100 x 100 feet (10,000 square feet), located off State Road 1063/Ridge Road, in the
Westover Election District for construction of a 250 foot self-supporting, lighted, lattice design telecommunications
tower with a five (5) foot lightning rod, within a 100 x 100 feet (10,000 square feet) compound for Try-MAC
Construction/Try-MAC Towers. He further reported the Planning Commission, with no opposition, recommended
granting the petitioners’ request. Mr. Fred Papa, with Try-MAC Construction/Try-MAC Towers, was present to
represent the petition. Mr. Papa explained this tower had come about due to AT & T needing a tower in this

location. He further stated the tower was needed to handle the increased communications needs in the area. Mr.
Papa stated Try-MAC Towers would lease space on the tower to Ntelos and other carriers and the tower could
accommodate approximately 10 to 12 carriers. He further stated they would work with the County for 911
emergency services if they wished to locate on the tower. There was no opposition to the petition. Mr. Talbott
closed the public hearing at approximately 7:09 p.m. The Board discussed the petition as the Committee of the
Whole and determined there were no adverse effects. During the discussion, the Board discussed the height of the
tower. Upon motion of Mr. Estes, seconded by Mr. Craddock, the following motion was adopted: Whereas, Steven
and Lillian Cassada have petitioned the Board of Zoning Appeals for a Special Use Permit for construction of a 250
foot self-supporting, lighted, lattice design telecommunications tower with a five (5) foot lightning rod, within a 100 x
100 feet (10,000 square feet) compound for Try-MAC Construction/Try-MAC Towers and, Whereas, we find no
substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby, and,
that such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be
granted. The vote was six (6) to zero (0), with one (1) member absent, Mr. Merricks.
This concludes the Special Use Permit case.
The meeting adjourned at approximately 7:10 p.m.
