05-04-2015 BOS reg meetingRegular Meeting May 4, 2015 Pittsylvania County Board of Supervisors Monday, May 4, 2015 Regular Meeting VIRGINIA: The Regular Meeting of the Pittsylvania County Board of Supervisors was held on Monday, May 4, 2015 in the General District Courtroom of the Edwin R. Shields Addition in Chatham, Virginia. Brenda H. Bowman, Chair, called the meeting to order at 7:03 p.m. The following members were present: Tim R. Barber Tunstall District Coy E. Harville Westover District Jerry A. Hagerman Callands-Gretna District Elton W. Blackstock Staunton River District Jessie L. Barksdale Banister District James H. Snead Dan River District Mr. Clarence C. Monday, County Administrator, Mr. J. Vaden Hunt, County Attorney, Mr. Greg Sides, Assistant County Administrator for Planning and Development and Ms. Rebecca Flippen, Deputy Clerk to the Board were also present. Ms. Bowman led the Pledge of Alliance. Approval of Agenda Motion was made by Mr. Blackstock, seconded by Mr. Barksdale, to approve the agenda with the following changes: Deletion of: (a) Item #16 – Notice of Intent of Motion to Rescind Severance Package portion of County Administrator’s Executed Contract (Reduction of Severance Package from 6 months to 4 months) (b) Item #17 – Closed Session §2.2-3711(A)(1) Mr. Blackstock’s motion was unanimously approved by the Board with the exception of Mr. Snead, who was absent. Hearing of the Citizens Matthew Speck of the Staunton River District offered a word of prayer. Gracie Mays of the Tunstall District invited the Board of Supervisors to attend a candlelight vigil on May 12, 2015 to honor the Fallen Officers of Pittsylvania County during National Police Week. Barbara Hudson of the Callands-Gretna District distributed an open letter addressed to the Pittsylvania County Planning Commission which accused the County’s Director of Agribusiness Development as being an unregistered lobbyist. This concluded the Hearing of the Citizens. Consent Agenda Motion was made by Mr. Snead, seconded by Mr. Barber, to approve the Consent Agenda, which was unanimously approved by the Board. Consent Agenda: (a) Minutes: April 6, 2015 – Regular Meeting April 21, 2015 – Adjourned Meeting Regular Meeting May 4, 2015 (b) Bill List – April 2015 (Online) (c) Proclamation – National Police Week: May 10-16, 2015 (d) Request to Use Fallen Officers’ Memorial Site for a Candlelight Service (e) Resolution – Dan River High School 2015 Boys Basketball Team Pittsylvania County Board of Supervisors PROCLAMATION NATIONAL POLICE WEEK May 10-16, 2015 TO RECOGNIZE NATIONAL POLICE WEEK 2015 AND TO HONOR THE SERVICE AND SACRIFICE OF THOSE LAW ENFORCEMENT OFFICERS KILLED IN THE LINE OF DUTY WHILE PROTECTING OUR COMMUNITIES AND SAFEGUARDING OUR DEMOCRACY. WHEREAS, there are approximately 900,000 law enforcement officers serving in communities across the United States, including the dedicated members of the Virginia State Police and Pittsylvania County Sheriff’s Office; and WHEREAS, nearly 60,000 assaults against law enforcement officers are reported each year, resulting in approximately 16,000 injuries; and WHEREAS, since the first recorded death in 1791, more than 20,000 law enforcement officers in the United States have made the ultimate sacrifice and been killed in the line of duty, including eight members of the Pittsylvania County Sheriff’s Office; and WHEREAS, the names of these dedicated public servants are engraved on the walls of the National Law Enforcement Officers Memorial in Washington, D.C.; and WHEREAS, the service and sacrifice of all officers killed in the line of duty will be honored during the National Law Enforcement Officers Memorial Fund’s 27th Annual Candlelight Vigil, on the evening of May 12, 2015; and WHEREAS, the Candlelight Vigil is part of National Police Week, which takes place this year on May 10-16; and WHEREAS, May 15 is designated as Peace Officers Memorial Day, in honor of all fallen officers and their families and U.S. flags should be flown at half-staff; then THEREFORE, BE IT RESOLVED that the Board of Supervisors formally designates May 10-16, 2015, as Police Week in Pittsylvania County, Virginia, and publicly salutes the service of law enforcement officers in our community and in communities across the nation. Regular Meeting May 4, 2015 Pittsylvania County Board of Supervisors RESOLUTION 2015-05-01 VIRGINIA: At the regular meeting of the Pittsylvania County Board of Supervisors held on Monday, May 4, 2015, the following resolution was presented and adopted congratulating the Dan River Wildcats Boys Varsity Basketball Team on their successful 2015 season, and their capture of the VHSL Conference 37 Boys Varsity Basketball Championship and the VHSL West Region Tournament. WHEREAS, the 2015 Dan River Wildcats Boys Varsity Basketball Team had an highly successful winning season; and WHEREAS, the Dan River Wildcats Boys Varsity Basketball Team went on to capture the Conference 37 Boys Varity Basketball title by defeating Buckingham High School; and WHEREAS, the Wildcats of Dan River High School went on to defeat Glenvar High School in the first round of the 2A West Region Championship, and then defeated Martinsville High School to their fourth straight Group 2A West Region Title; and WHEREAS, the Dan River High School Wildcats defeated Prince Edward County High School, winning the State Championship semi-finals; and WHEREAS, the Dan River High School Wildcats ended 2015 with a 24-4 winning season; and WHEREAS, the Dan River Wildcats Boys Varsity Basketball Team exhibited exemplary sportsmanship and talent as they defeated their opponents for the Conference 37 and Group 2A West Region Tournament Titles; and WHEREAS, the Dan River Wildcats Boys Varsity Basketball Team has performed admirably throughout their winning season of 2015, bringing recognition not only to themselves but to their school, their County, and its citizens; then BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors, on the behalf of all the citizens of Pittsylvania County, express their sincere appreciation, admiration and congratulations to the 2015 Dan River Wildcats Boys Varsity Basketball Team for their winning season and their fourth consecutive Group 2A West Region Title; and BE IT FURTHER RESOLVED that a copy of this Resolution be presented to the Coach and the Members of the 2015 Dan River Wildcats Boys Varsity Basketball Team. Presentations The Pittsylvania County Youth Commission updated the Board of Supervisors on their activities which included: a briefing on their trip to Richmond to visit the General Assembly while it was in session; their work on compiling the high school surveys that had been received; the Youth Commission’s participation in Shadow Day on April 13, 2015; and that applications are now being accepted for the 2015/2016 Youth Commission. Amy Childress gave a briefing to the Board of Supervisors on the 2014 Comprehensive Services Act (CSA) Audit by the Office of Comprehensive Services (OCS), which was completed on March 24, 2015. Ms. Childress stated the audit report noted significant improvements on the local program. Ms. Childress also informed the Board this would be her last presentation to the Board as she was resigning from her position, but would continue to work Regular Meeting May 4, 2015 through the hiring process for her replacement. The Board thanked Ms. Childress for her work on helping to improve the County’s CSA program and wished her well. Diane Arnold, Director of the Longwood Small Business Development Center (SBDC), presented the SBDC’s 2014 highlights, which included many workshops, research requests and resource developments. Ms. Arnold stated the SBDC had 119 clients with 48 of those located in the County. Ms. Arnold stated this would be her last presentation to the Board as she was retiring. The Board thanked Ms. Arnold for her many years of hard work and dedication and wished her well in her retirement. Unfinished Business At their adjourned meeting on April 21, 2015, a motion was made by Mr. Snead, seconded by Mr. Blackstock, to approved Library Transfer Funds from the Memorial Gifts Fund to the Library Local Budget in the amount of $2,481.71. This motion required a 10-Day Layover that had now been met and the following Roll Call Vote was recorded: Mr. Harville-Yes; Mr. Barber-Yes; Mr. Snead-Yes; Mr. Blackstock-Yes; Mr. Barksdale-Yes; Mr. Hagerman-Yes; and Ms. Bowman-Yes. Mr. Snead’s motion was unanimously approved by the Board. At their adjourned meeting on April 21, 2015, a motion was made by Mr. Harville, seconded by Mr. Blackstock, to appropriate funds as follows totaling $296,131.64: 1.) Clerk of Circuit Court-The Honorable H.F. Haymore has requested the use of Technology Trust Funds (TTF) (100-3-000000-2307) from the state in the amount of $10,631.64 be used for part-time salaries and service contracts as outlined in the attached memo. 2.) Jail-Captain James Crews has requested the use of $25,000 of jail telephone commission revenue (100-3-000000-160501). A total of $28,200.33 has currently been received for telephone commissions in the jail that has not been previously appropriated. The amounts requested and reason for each request is attached. 3.) Community Policy and Management Team (CPMT)-The CPMT recently changed the procedure for agencies to pay Comprehensive Services Act (CSA) related invoices. In the past, the School Board was responsible for paying 100% of CSA expenditures and then was required to request a reimbursement back from the County. Since the schools were responsible for paying the State back for ineligible expenses totaling $250,000 per year for 10 years, the County would withhold the $250,000 from reimbursements to the Schools. With the recent CPMT change for the County to start paying vendors direct, the schools will now have to pay the County the $250,000. This amount will now be accounted for as revenue to the County and not as a reduction in expense. This revenue line item (100-3-000000-240411) needs to be appropriated to the CSA-Pool Program line item in order to have sufficient funds to cover CSA expenditures (100-4-053500-7003) until year-end. The schools made this payment to the County on March 19, 2015. 4.) J&D Court Services Unit-The County pays a set dollar figure each year for 6 guaranteed beds at W.W. Moore Detention Center. This amount is paid monthly. At year-end, the City of Danville evaluates the usage and compares it with the amount that has been paid. The County received a refund in the amount of $70,524.33 on October 1, 2014 from the City of Danville (100-3- 000000-190102) since we did not use our allotment for FY 2014. The Court Service Unit (CSU) has recently experienced some changes that require more Regular Meeting May 4, 2015 funds be spent on the Electronic Monitoring Program (EMP). They would like to have $10,500 of this refund be appropriated to the EMP line item 100- 4-033300-3182. This motion required a 10-Day Layover that had now been met and the following Roll Call Vote was recorded: Mr. Harville-Yes; Mr. Barber-Yes; Mr. Snead-Yes; Mr. Blackstock-Yes; Mr. Barksdale-Yes; Mr. Hagerman-Yes; and Ms. Bowman-Yes. Mr. Harville’s motion was unanimously approved by the Board. New Business Motion was made by Mr. Harville, seconded by Mr. Barber, for the reappropriation of $18,548.70 as follows: $89.05 to County Attorney-Office Supplies (100-4-012210-6001), $9.00 to Purchasing-Travel (100-4-012530-5500), $199.67 to Clerk of Courts-Copier Lease (100-4- 021600-60051), $548.20 to Sheriff-Parts (100-4-031200-6030), $602.60 to Sheriff-Labor (100-4- 031200-6031), $26.00 to VFD-United Way Contribution (100-4-032200-5667), $2,207.26 to VFD-Communication Equipment (100-4-032200-6004), $423.49 to Extradition (100-4-033100- 5550), $67.85 to Jail-Food Supplies (100-4-033100-6002), $300.00 to B&G-Building Supplies (100-4-043100-6007), $653.00 to CPMT-CSA Pool Program (100-4-053500-7003), $1,875.00 to Recreation-Field Maintenance (100-4-071100-6006), $11,107.79 to WIA-Other Operating (251- 4-353853-6014), $439.79 to WIA-Unobligated (251-4-353868-6014). Mr. Harville’s motion required a 10-Day Layover. Motion was made by Mr. Harville, seconded by Mr. Blackstock, to appropriate $7,548.76 from unappropriated General Funds to pay Virginia Logos, LLC for the design and installation of four (4) Scenic River Designation signs for the Dan and Banister Rivers. This motion required a 10-Day Layover. Motion was made by Mr. Barber, seconded by Mr. Harville, to amend the FY 2015 budget and approve an appropriation of $997 for the Byrne Justice Assistance Grant, and approve the transfer of $111 from the Sheriff’s Grant Local Match line item (100-4-031200- 8109) to line item 250-4-031744-8107. The following Roll Call Vote was recorded: Mr. Harville-Yes; Mr. Barber-Yes; Mr. Snead-Yes; Mr. Blackstock-Yes; Mr. Barksdale-Yes; Mr. Hagerman-Yes; and Ms. Bowman-Yes. Mr. Barber’s motion was unanimously approved by the Board. Motion was made by Mr. Harville, seconded by Mr. Blackstock, to approve a request by M. Kate Berger, Treasurer for Pittsylvania County, to hold a public hearing for citizen input on a proposed amendment to Chapter 6 of the Pittsylvania County Code that would allow the Treasurer the option to sign a Trust Joinder Agreement with the Virginia Investment Pool and authorized the staff to advertise the public hearing for May 19, 2015, which was unanimously approved by the Board. Mr. Greg Sides, Assistant County Administrator for Planning & Development, briefed the Board of Supervisors on the Feasibility Study of the American Armored Tank Museum completed and submitted by The Launch Place. Mr. Sides noted the study recommended the Tank Museum should rely less on the revenue from patrons and become more donations and fundraising-centered. The study did not recommend the Tank Museum relocate as relocation was certain to require a large upfront expenditure for an uncertain and incremental increase in attendance. The study concluded that the Tank Museum’s survival and financial sustainability lied in the combination of a greater fundraising effort, enhanced marketing, and change of operating hours. The Board took no action. Regular Meeting May 4, 2015 Captain Donald Motley of the Pittsylvania County Sheriff’s Department appeared before the Board to present a draft Solid Waste Enforcement Plan and its estimated cost, as had been requested by the Board at a previous meeting. Captain Motley stated the draft plan required hiring two (2) part time employees for 29 hour work weeks each with a combined salary of $52,000; plus uniforms, firearms and required certification. The positions would have to be advertised as well. The Board took no action. Motion was made by Mr. Snead, seconded by Mr. Harville, to advertise a joint public hearing with the Virginia Department of Transportation that would be held at 7:00pm on May 19, 2015 for citizen input on the VDOT Secondary Six -year Plan for FY2016-2021, which was unanimously approved by the Board. County Attorney Announcement Mr. Hunt stated there would be Freedom of Information Act (FOIA) training on May 18, 2015 from 6pm – 8pm at the Olde Dominion Agricultural Complex. Anyone interested in attending was to contact Ms. Flippen to assure enough seating was provided. Adjournment Motion was made by Mr. Snead seconded by Mr. Harville, to adjourn, which was unanimously approved by the Board.
