Regular Meeting
VIRGINIA: The Regular Meeting of the Pittsylvania County Board of Supervisors was
held on Monday, April 7, 2014 in the General District Courtroom of the Edwin R. Shields
Addition in Chatham, Virginia. Jessie L. Barksdale, Chairman, called the meeting to order at
7:00 p.m. The following members were present:

Mr. Barksdale led the Pledge of Alliance.
Approval of Agenda
Motion was made by Mr. Snead, seconded by Mr. Barber, to approve the agenda with

Mr. Snead's motion was unanimously approved by the Board.
Hearing of the Citizens
Jason Andrews of the Callands /Gretna District offered a word of prayer.
Mary Catherine Plaster of the Chatham/Blairs District made comments concerning
transfer truck traffic traveling Main Street in the Town of Chatham and summarized some of the
damages that have occurred over the years as a result of them, which included compromising the
foundations of homes, damages to cars parked along the sidewalks, sidewalks damaged, street
lights damaged, pedestrians hit, and truck noise interference while Circuit Court was in session.
Ms. Plaster noted that while she sympathized with the problems of citizens on Climax Road,
diverting truck traffic through Chatham was not the answer.
Peter Pilser of the Callands /Gretna District and resident on SR 799 /Climax Road, stated
the Climax Road was not designed for the truck traffic that now occurs there and supported a No
Thru Truck Traffic Restriction for Climax Road.
Arlene Pilser, of the Callands /Gretna District and resident of 1220 Climax Road also
supported a No Thru Truck Traffic Restriction for Climax Road and read a statement from Judy
Pace (who could not attend the meeting) that said the big trucks presenting safety issues as there

are no shoulders or painted lines on the Climax Road and the trucks have downed mailboxes,
frightened parents of children getting on and off the school buses, were damaging and hazardous
on a road like the Climax Road which was too narrow for trucks to meeting each other or another
vehicle without one of the vehicles having to drive off the shoulder of the road, were ruining the
quality of life of the residents of Climax Road by the noise of the trucks, the air quality from the
trucks' exhausts, the fear of what a massive accident would inflict, and it was not an efficient
way of transporting goods. All of which Ms. Pilser agreed with.
Arthur Brunner of the Callands /Gretna District and resident of northern end Climax Road
stated there were more and more tractor trailers using the Climax Road as a thoroughfare
between Hwy 57 and Hwy 40, and that road was not designed for commercial traffic.
Furthermore, he stated they were traveling at excessive speeds that compounded the unsafe
conditions.
Ann Wiegmann of the Callands /Gretna District and resident of the Climax Road
complained about the trucks speeding on that road and her concerns over someone getting hurt or
killed as a result of the heavy truck traffic.
Richard Shumate of the Westover District made comments on the proposed budget that
included dissatisfaction of the increased property assessments, the proposed tax increase, his
opinion of the Board overspending, his opposition to the Board's appropriation of $200,000 to
the Ringgold VFD towards their purchase of a ladder truck and why couldn't Ringgold VFD just
use the City of Danville's ladder truck if one was needed, commenting on how the County had
been purchasing fuel, and lastly not believing the upgrade to the E911 system was necessary.
Karen Maute of the Westover District commented that she had sent letters to Mr. Hawker
and Mr. Hunt but had no knowledge on whether they were reached or not since she'd had no
response from either men, and asked for live streaming of board meetings when the County's
new website when live.
Roy Byrd, Mayor for the Town of Chatham, submitted to the Board of Supervisors a
resolution passed by Town Council opposing routing trucks from the Climax Road through the
Town of Chatham, and he objected to pitting one community against another as routing the
trucks though Chatham from Climax Road was not solving a problem.
Lori Humslon, of the Callands /Gretna District and resident of Climax Road, stated an
alternate route for truck traffic needed to be found instead of using that road or Main Street in
Chatham; she feared for the lives her children as they wait for their school bus; and lastly
commented she felt like Mayor Byrd had a conflict of interest concerning truck routes.
Chad Shelton of the Callands /Gretna District stated he runs a business with 5 road trucks
and he wanted his drivers to come home safe. He questioned if there had been any incidents on
the Climax Road involving trucks, if speed limits were being enforced, commented that every
time a No Thru Truck Traffic Restriction was enforced, you burdening another road somewhere
else, noted that forestry and agriculture were the largest industries in the state -both of which used
trucks to transport their goods, and that the Agriculture Development Board has formed a sub-
committee to study the problem.
This concluded the Hearing of the Citizens.

Mr. Barber's motion was unanimously approved by the Board.
Public Hearin = to receive citizen input of a proposed amendment to the Pittsylvania
County Zoning Ordinance, Chapter 35, for the addition of Adult Uses under Industrial
District, (M -1), Light Industry, §35 -384, Special Use Permits. Mr. Barksdale opened the
public hearing at 7:48pm. Mr. Hunt addressed the changes that included new exemptions for the
health care industry for the proposed ordinance. Karen Maute of the Westover District believed
the wording in the ordinance was pornographic in its detailing and that children could not even
be allowed to read the County's ordinance, felt it was an embarrassment to the County to have an
ordinance written as such, and felt it was not necessary to be luridly descriptive. No one else
signed up to speak and Mr. Barksdale closed the public hearing at 7:52pm. Motion was made by
Mr. Harville, seconded by Mr. Hagerman, to have the County Attorney review the proposed
ordinance and send the proposed ordinance back to the Legislative Committee, asking that the
"garbage Ms. Maute spoke of be removed ". Mr. Harville's motion was unanimously approved
by the Board.
Presentations
E. W. Tibbs, President and CEO for Centra, gave a presentation on the Virginia Medicaid
Expansion issue currently debated in the Virginia General Assembly. Mr. Tibbs submitted
statistics supporting his position that closing the coverage gap by expanding Medicaid coverage
in Virginia would give approximately 3,500 uninsured Pittsylvania County citizens coverage,
and that closing the coverage gap would reduce cost shift, boost the economy, and improve
health care. Mr. Tibbs asked the Board to think carefully before supporting a resolution that
would oppose the Virginia Medicaid Expansion and asked they not take any action at all.
Cigi Moore of Get Fit explained the 50,000 Pound Challenge for the Dan River region
that will run from April 4 to July 4, 2014 and how people could register to participate, and
presented the Board with complimentary totes containing more information on the challenge, a
pedometer, and challenge cards. Motion was made by Mr. Harville, seconded by Mr. Snead, to
approve Resolution 2014 -04 -02 supporting the Get Fit 50,000 Challenge, which was
unanimously approved by the Board.

Get Fit 50,000 Pound Challenge
VIRGINIA: At a regular meeting of the Board of Supervisors of Pittsylvania County, Virginia,
held on Monday, April 7, 2014, the following resolution was presented and adopted:
WHEREAS, the promotion and development of the health of our overall community are
fundamental necessities to the future progress and welfare of the Dan River Region; and
WHEREAS, the conservation and promotion of Pittsylvania County's health and reducing the
high rates of obesity is of paramount importance to the vitality of the community and economy;
and
WHEREAS, it is appropriate that April 4th through July 4h should be set apart and
recognized to direct our thoughts towards the health and well -being of our community; and

WHEREAS, the Get Fit 50,000 Pound Challenge, through its unique community-
driven approach to weight loss and meeting the health needs of the people of the Dan River
Region ensures a healthier workforce, family unit and community; then
BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors do
hereby proclaim April 4`" though July 7`h, 2014 to he the Get Fit 50,000 Pound Challenge time
and urge our citizens and al] agencies and organizations to unite in the observance of such
exercises as will acquaint the people of the Dan River Region with healthy habits for the
development, longevity and wellness of the citizens of Pittsylvania County, Virginia; and
BE IT FURTHER RESOLVED, that a copy of this resolution be distributed to all local
media sources.
Unfinished Business
Proposed amendment to Chapter 1, Article III, §1.8 of the Pittsylvania County Code.
(Tabled from March 18, 2014 meeting)
The proposed amendment would incorporate a Revised Organizational Cooperative Agreement
that would expand the Tri -Lake Administrative Commission's (TLAC) responsibilities to include
Leesville Lake, and incorporate Campbell County into the Agreement and into Chapter 1, Article
III, § 1.8 of the Pittsylvania County Code. Motion was made by Mr. Harville, seconded by Mr.
Hagerman to approve the proposed amendment to Chapter 1, Article III, §1.8 of the Pittsylvania
County Code that would incorporate a Revised Organizational Cooperative Agreement,
expanding TLAC's responsibilities to include Leesville Lake and incorporate Campbell County
into the Agreement, and the following Roll Call Vote was recorded: Mr. Harville -Yes; Mr.
Barber -Yes; Mr. Snead -Yes; Mr. Barksdale -Yes; Ms. Bowman-Yes; Mr. Hagerman-Yes; and
Mr. Barksdale -Yes. Mr. Harville's motion was unanimously approved.
New Business
There were no recommendations from the Personnel Committee.
Motion was made by Mr. Harville, seconded by Mr. Barber, to approve Resolution 2014-
04-01, a resolution of support for an Agricultures and Forestry Industry Development (AFID)
Fund Grant and authorize the Interim County Administrator to provide a letter of support for the
application committing that the required local funds of $10,000.00 ($5000.00 in cashing funding
and $5,000.00 of in -kind services by County staff) will be provided to the project completion,
which was unanimously approved by the Board.
Motion was made by Mr. Snead, seconded by Mr. Barber, to grant permission for Centra
to list the GPS coordinates of Pittsylvania County's Gretna and White Oak Mountain E911
Towers in Center's FCC license application (which does not imply the use of the sites, only to
utilize the coordinates to start the application process and authorize the Interim County
Administrator to send Centra a Letter of Permission granting the Board's approval, which was
unanimously approved by the Board.
A resolution concerning the February 2, 2014 coal ash spill into the Dan River was
postponed until a future meeting.

funds as follows: $199.67 to Clerk of Courts- Copier Lease (100 -4- 021600 - 60051), $234.87 to
Jail - Extradition (100 -4- 033100 - 5550), $35.00 to Animal Control- Donations (100- 4- 035100-
5883), $10,175.28 to E911- Telephone (100 -4- 035500 - 5230), $4,319.52 to Library -Full -Time
Salaries (100 -4- 073100 - 1100), $260.00 to Library - Postage (100 -4- 073100 - 5210), $1,331.60 to
Library- Computer Supplies (100 -4- 073100 - 6021), $1,311.75 to Ag Development - Travel (100 -4-
082500- 5500), $2600.00 to Memorial Gifts Fund -Books (265 -4- 073310 - 6012), $12,893.14 to
WIA -Other Operating (251 -4- 353853 - 6014). Mr. Harville's motion required a 10 -Day Layover.
Motion was made by Mr. Harville, seconded by Mr. Snead, for the appropriation of
$32,500.00 for a J.T. Minnie Maude Grant received for the Pittsylvania County Parks &
Recreation Department and authorize the County Administrator to sign the grant acceptance
from. The following Roll Call Vote was recorded: Mr. Harville -Yes; Mr. Barber -Yes; Mr.
Snead -Yes; Mr. Barksdale -Yes; Ms. Bowman-Yes; Mr. Hagerman-Yes; and Mr. Barksdale -Yes.

Added Items
Ms. Bowman discussed with the Board her wish to begin a dialogue with the Pittsylvania
County Schools, the Chamber of Commerce and other agencies, in forming a Youth
Commission.
Motion came from the Legislative Committee to move forward with a newsletter in the
Chatham Star Tribune, who would deliver it to every household in Pittsylvania County sometime
after July 1 for a cost of $7,800.00 that was budgeted for, which was unanimously approved by
the Board.
Board Announcements
Mr. Snead stated that a ladder truck had been purchased by the Ringgold VFD.
Ms. Bowman reminded everyone April was Spring Clean Up Month in Pittsylvania
County.
Mr. Harville asked that an Amnesty Day be arranged for the landfill for unused drugs, as
well as paint/oil /chemicals.
Mr. Barksdale reminded everyone there would be a full board meeting April 10, 2014 at
5:00pm in the conference room of the Captain Martin Building, and that the public hearing on
the FY 2014/15 School and County Budget would be held at 7pm at the Pittsylvania County
Cultural Center that same evening.

VIRGINIA: The Adjourned Meeting of the Pittsylvania County Board of Supervisors
was held on Thursday, April 10, 2014 in the Pittsylvania County School Educational and
Cultural auditorium located at 39 Banks Street in Chatham, Virginia. Jessie L. Barksdale,
Chairman, called the meeting to order at 7:00p.m. The following members were present:

Ms. Kimberly Van Der Hyde, Director of Finance, and Ms. Rebecca Flippen, Deputy Clerk to
the Board, were also present.
Also present were the members of the Pittsylvania County School Board.
Mr. Barksdale led the Pledge of Allegiance.
APPROVAL OF AGENDA
Motion was made by Mr. Harville, seconded by Mr. Snead, to approve the agenda,
which was unanimously approved by the Board.
PUBLIC HEARINGS
(1) FY2014/15 PROPOSED REAL PROPERTY TAX INCREASE
The Board of Supervisors of Pittsylvania County, Virginia, will hold a public hearing in the
Pittsylvania County School Educational and Cultural auditorium located at 39 Bank Street in
Chatham, Virginia Thursday, April 10, 2014 at 7:00 p.m. to hear citizen input on the proposed
real property tax increase for fiscal year 2015. The proposed real property tax increase is part of
the overall County budget which proposes a 5¢ increase making an effective tax rate of 59¢ per
$100 of assessed value. Separate public hearings will be held for the proposed County budget
and the proposed School budget.
The Board of Supervisors of Pittsylvania County, Virginia, proposes to increase property tax
levies.
a) Assessment Increase: Total assessed value of real property, excluding additional
assessments due to new construction or improvements to property, exceeds last year's
total assessed value of real property by 3.66 %.

b) Lowered Rate Necessary to Offset Increased Assessment: The tax rate which would levy
the same amount of real estate tax as last year, when multiplied by the new total assessed
value of real estate with the exclusions mentioned above, would be $0.54 per $100 of
assessed value. This rate will be known as the "lowered tax rate ".
c) Effective Rate Increase: The Board of Supervisors of Pittsylvania County, Virginia,
proposes to adopt a tax rate of $0.59 per $100 of assessed value. The difference between
the lowered tax rate and the proposed rate would be $0.05 per $100, or 9 %. This
difference will be known as the "effective tax rate increase ". Individual property taxes
may, however, increase at a percentage greater than or less than the above percentage.
d) Proposed Total General Fund Budget Increase: Based on the proposed real property tax
rate and changes in other revenues, the total General Fund budget of Pittsylvania County,
Virginia, will exceed last year's by 2.7 %.
Mary Lou Baldwin of the Westover District opposed a reassessment proposed real
property tax increase due to the economic slump and cost of living increases.
Marvin Hylton of the Westover District opposed the reassessment rates and
commented that his property value had increased 23% from this last reassessment.
Ben Krause of North Carolina, but owns property in Pittsylvania County, opposed
the advertised budgets and made comments on management practices of the County.
Eugene Carter of the Chatham - Blairs District opposed any tax increases.
Reverend Joan Tarpley- Robinson of the Banister District was in favor of the
advertised budget and stated she realized in order for the County to provide services the
citizens had to pay taxes, so she supported the increases.
Steve Matherly of the Chatham - Blairs District opposed the increases and stated
the County needs to become more accountable and spend smarter. He did support an
increase to the school budget, but not a property tax increase, and suggested that the real
estate tax only be increased by 1¢ for each of the next four consecutive years. Mr.
Matherly also stated the County needed a Capital Improvements Plan.
Joe Spence of the Dan River District opposed an increase on real property and did
not agree with the recent property reassessments.
Henry Booth of the Tunstall District commented he'd never seen a reassessment
increase as large as this most recent one and was opposed to it.
Tom Morris of the Chatham - Blairs District suggested the County consider
outsourcing some of its functions to save money.
Martin Fisher (no election district given) asked if there had been any assessment
done of whether or not households can even afford to pay higher taxes; asked if a zero
sum budget was offered during the budget process; stated the Board had no moral
authority to raise taxes on anyone; believed there should be an ordinance requiring a zero
sum budget offered long with any other budget offered; and opposed a 3- minute
limitation for speaking at a public hearing.
This concluded citizen input and Mr. Barksdale closed the hearing at 7:44pm.
(2) FY2014/15 PROPOSED PITTSYLVANIA COUNTY SCHOOL BUDGET
The Board of Supervisors of Pittsylvania County, Virginia, will hold a public hearing in the
Pittsylvania County School Educational and Cultural auditorium located at 39 Bank Street in
Chatham, Virginia Thursday, April 10, 2014 at 7:00 p.m. to hear citizen input on the proposed
school budget for fiscal year 2015. The School budget is part of the overall County budget which
proposes a 5¢ increase making an effective tax rate of 59¢ per $100 of assessed value. Separate

Mr. Barksdale opened the public hearing at 7:45pm.
Reverend Joan Tarpley- Robinson of the Banister supported the advertised school budget,
stating it is a must that children of Pittsylvania County excel in education and all aspects of life
in order to compete globally.
Joe Spence of the Dan River District opposed the school budget and felt like the school
system overspent.
Willie Fitzgerald of the Banister District and President of the local chapter of the NAACP
supported the advertised school budget stating that children of Pittsylvania County need a good
education and every educational advantage the County can give them in order for the children to
grow up and be competitive for jobs.
Mary Lou Baldwin of the Westover District stated the schools did not deserve any more
funding that the state required since children were graduating that needed remedial classes at
Danville Community College before they could take classes towards a degree.
This concluded citizen input and Mr. Barksdale closed the hearing at 7:57pm.
(3) FY2014/15 PROPOSED PITTYSLVANIA COUNTY BUDGET
The Board of Supervisors of Pittsylvania County, Virginia, will hold a public hearing in the
Pittsylvania County School Educational and Cultural auditorium located at 39 Bank Street in
Chatham, Virginia Thursday April 10, 2014 at 7:00 p.m. to hear citizen input on the proposed

2014 -2015 County Budget. This budget will not be considered for adoption until seven (7) days
after the public hearing. This notice is published pursuant to Sections 15.2 -2503, 15.2 -2506, and
22.1 -93 of the Code of Virginia, 1950, as amended. This budget proposes a 5¢ increase making
an effective tax rate of 59¢ per $100 of assessed value. Separate public hearings will be held to
hear citizen input on the proposed school budget and the proposed real property tax increase.

Reverend Joan Tarpley- Robinson of the Banister District supported the advertised
County budget; commented that she works with the Sheriffs school imitative program and
encouraged the Board to vote "Yes" for the advertised budget.
Joe Spence of the Dan River District was opposed to the advertised budget, opposed to
tax increases, commented on the unnecessary purchase of Woodlawn Academy by the
Pittsylvania County Public Schools and did not feel the schools needed a STEM academy,
commented on the lack of discipline currently in school systems, and felt the Board could to a
better job of handling the County's finances.

Willie Fitzgerald of the Banister District and President of the Pittsylvania County Chapter
of the NAACP supported the advertised budget, but felt Land Use should be done away with and
all property owners taxed equally.
Tom Morris of the Chatham- Blairs District made comments on wanting better County
government transparency and that expenditures should be regularly published by line item.
Mary Lou Baldwin opposed the amount of money advertised for the school budget and
claimed the County schools have one of the highest dropout rates in the state.
This concluded citizen input and Mr. Barksdale closed the hearing at 8:17pm.

Motion was made by Mr. Snead, seconded by Mr. Blackstock, to adjourn, which was
unanimously approved by the Board. The meeting adjourned at 8:18pm.

held on Monday, April 14, 2014 in the Danville Regional Airport Conference Room, Danville,
Virginia. Jessie L. Barksdale, Chairman, called the meeting to order at 1:34 p.m. The following

Closed Session
Motion was made by Mr. Harville, seconded by Mr. Snead, to enter into Closed Session
as follows:
Discussion concerning a prospective business or industry or the expansion of an
existing business or industry where no previous announcement has been made of the
business' or industry's interest in locating or expanding its facilities in the
community.
Authority: §2.2- 3711(A)(5) of the Code of Virginia, 1950, as amended
Subject Matter: Unannounced Industry
Purpose: Discussion concerning a prospective business or industry or the
expansion of an existing business or industry where no previous
announcement has been made of the business' or industry's
interest in locating or expanding its facilities in the community.
Mr. Harville's motion was unanimously approved by the Board with the exception of Mr.
Blackstock who was absent. The Board entered into Closed Session at 1:36pm.

Monday, April 14, 2014, the Board hereby certifies by a recorded vote that to the best of each committee
member's knowledge only public business matters lawfully exempted from the open meeting
requirements of the Virginia Freedom of Information Act and identified in the motion authorizing the
closed meeting were heard, discussed or considered in the closed meeting. If any member believes that
there was a departure from the requirements of the Code, he shall so state prior to the vote indicating the

during National Police Officers Week (to be moved and approved under the
Consent Agenda)
(d) Recommendations for Joint Setback Study Subcommittee
Mr. Blackstock's motion was unanimously approved by the Board.
Hearing of the Citizens
Arlene Pilser of the Callands /Gretna District and resident of Climax Road, made comments
concerning the community meeting held on April 16, 2014 and quotes attendees' remarks on safety
concerns, road damage, and impaired quality of life due to the heavy truck traffic on SR
799 /Climax Road and requested consideration for a No Thru Truck Traffic Restriction for that
Road.
Sammy Thompson of the Tunstall District made comments opposing the high reassessment
values, questioned whether cemeteries were supposed to be taxed, comments that Christianity
should be allowed in public schools and for public prayer at meetings, and closed with asking the
Board to look into the recent reassessment values.
Ellen Mayhew of the Callands /Gretna District and teacher at Mt. Airy Elementary School
thanked the Board of Supervisors for giving money above state requirements last year, and to
please pass the advertised FY 2014/15 School Budget, and closed by challenging the Board of
Supervisors to give to the schools the amount of money the Board would invest in the Mega Park.

Adjourned Meeting
April 22, 2014
Richard Shumate of the Westover District offered a word of prayer, then commented
opposing the budget, felt the schools overspent as well as the County, and opposed the increased
reassessments.
Jordan Dalton of the Callands /Gretna District and a 101' grader at Faith Christian Academy
offered a word of prayer.
William Wiegking, Councilman for the Town of Chatham, commented on a need to
continue looking for an alternate route for truck diversion besides through Chatham, noting very
serious wrecks have already occurred at the traffic light where Hwy 57W and Main Street (Bus 29)
intersect, and there was a need for a VDOT Safety Study on the matter.
This concluded the Hearing of the Citizens.
Consent Agenda
Motion was made by Mr. Snead, seconded by Mr. Barber, to approve the Consent Agenda,
which was unanimously approved by the Board.
(a) Resolution — Dan River Wildcats VHSL Group 2A Boys Basketball State
Championship
The Board of Supervisors presented the 2014 Dan River Wildcats Boys Basketball Team/Coaches
with the following resolution, congratulating them on their recent state championship.

RESOLUTION
2014 -04 -05
VIRGINIA: At the adjourned meeting of the Pittsylvania County Board of Supervisors held on Tuesday,
April 22, 2014, the following resolution was presented and adopted congratulating the Dan River Wildcats
Boys Varsity Basketball Team on their successful 2014 Season, and their capture of the VHSL Group 2A
Boys Basketball State Championship.
WHEREAS, the 2014 Dan River Wildcats Boys Varsity Basketball Team had an undefeated winning
season; and
WHEREAS, the Dan River Wildcats Boys Varsity
Region title by defeating Floyd County High School,
consecutively in that title tournament; and
Basketball Team went on to capture the 2A West
Virginia High School, and Martinsville High School
WHEREAS, the Wildcats of Dan River High School went on to defeat Brunswick High School in the
Group 2A semifinals and continued on to defeat the Bruton Panthers and captured Dan River High School's
first VHSL Group 2A Boys Basketball State Championship; and
WHEREAS, the Dan River High School Wildcats ended their 2013/14 season as the only undefeated team
in public or private high school boys' basketball in Virginia with a record of 25 -0; and
WHEREAS, the Dan River Wildcats Boys Varsity
and talent as they defeated their opponents in the 2A
Boys Basketball State Championship games; and
Basketball Team exhibited exemplary sportsmanship
West Region tournament and in the VHSL Group 2A
WHEREAS, the Dan River Wildcats Boys Varsity Basketball Team has performed admirably throughout
their winning season of 2014, bringing recognition not only to themselves but to their school, their County,
and its citizens; then

BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors, on the behalf of all the
citizens of Pittsylvania County, express their sincere appreciation, admiration and congratulations to the
2014 Dan River Wildcats Boys Varsity Basketball Team for their winning season and bringing the VHSL
Group 2A Boys Basketball State Championship to Pittsylvania County; and
BE IT FURTHER RESOLVED that a copy of this Resolution be presented to the Coach and the Members
of the 2014 Dan River Wildcats Boys Varsity Basketball Team.
Public Hearings
Rezoning Cases
Case 1: Duane and Eva Blevinc —Dan River Election District. R- 14-016
Mr. Barksdale opened the public hearing at 7:35pm. Mr. Shelton explained that Duane and Eva Blevins had
petitioned to rezone 1.44 acres, located on SR 726/Ringgold Depot Road, in the Dan River Election District,
from R -1, Residential Suburban Subdivision District to M -1, Industrial District, Light Industry (for metal
fabrication and welding operations). The Planning Commission, with no opposition, recommended granting the
petitioners' request. No one signed up to speak and Dwayne Dickens was present to represent the petition. Mr.
Barksdale closed the public hearing at 7:37pm. Motion was made by Mr. Snead, seconded by Mr. Barber, to
approve rezoning Case R -14-016 from R -1 to M -1 and the following Roll Call Vote was recorded: Mr.
Harville -Yes; Mr. Barber -Yes; Mr. Snead -Yes; Mr. Blackstock -Yes; Ms. Bowman-Yes; Mr. Hagerman -Yes;
and Mr. Barksdale -Yes. Mr. Snead's motion to rezone Case R -14-016 from R -1 to M -1 was unanimously
approved by the Board.
This concluded the Rezoning Cases.
Presentation
Eric Deaton, CEO for Danville Regional Medical Center (DRMC) and Marketing President
for Lifepoint, updated the Board of Supervisors on programs ongoing with DRMC, including
DRMC's residency program that in 2010 had 6 interns and now has a maximum number of 50
intems which has a $6.6 million economic impact on the area. Mr. Deaton discussed ways DRMC
and Martinsville Memorial Hospital (a Lifepoint partner) are working together to serve the people
of the Southside region. Plans for finalizing the Chatham Imaging Center were discussed as well
as the opening of the Gretna facility, and the various services both facilities will offer the public
were discussed. Mr. Deaton informed the Board that DRMC was in the process of opening a
facility in Yanceyville, that the Danville lab was being updated, and that the Brosville facility was
doing well. Mr. Deaton also commented on the importance of Virginia Medicaid Expansion being

VIRGINIA: At an adjourned meeting of the Pittsylvania County Board of Supervisors on
Monday, April 22, 2014 in the General District Courtroom in the Edwin R. Shields Courthouse
Addition in Chatham, Virginia, the following resolution on the annual budget for Fiscal Year 2015
was presented and adopted.
WHEREAS, the laws of the Commonwealth of Virginia require the governing body to
prepare and approve a budget for fiscal and planning purposes, not withstanding additional
requirements for the schools, including revenues and expenditures for the ensuing year by May 1,
2014; and
WHEREAS, the laws of the Commonwealth of Virginia control the distribution of funds
by appropriations giving the Board of Supervisors authority to set such appropriations at such
periodic basis as outlined in Section 15.2 -2506 of the Code of Virginia, being further identified in
this Resolution with Exhibit A and Exhibit B; and
WHEREAS, a public hearing has been properly advertised and held on April 10, 2014, in
accordance with state statute as shown by the affidavit of the publisher; then,
BE IT HEREBY RESOLVED, by the Board of Supervisors of the County of Pittsylvania,
that there be hereby adopted and appropriated a budget for Fiscal Year 2015, the full and complete
budget is contained in the document entitled:
"PITTSYLVANIA COUNTY ADOPTED BUDGET"

BE IT FURTHER RESOLVED, that the estimated budget total of $175,554,277 includes
$16,482,595 total local effort for the Pittsylvania County Schools, and $1,885,747 in reallocated
carryovers for Industrial Development Local. Included in this budget is an approval of
supplements for employees of the Sheriff s Department including the jail. In addition, it includes a
continued supplement of $10,000 each for the Treasurer, Commissioner of Revenue and Clerk of
Courts and $5,000 for the Commonwealth's Attorney for salary supplements.
BE IT STILL FURTHER RESOLVED, that the funds of the School Budget, the Library
Board, and the Welfare Board shall be expended only by order and approval of those respective
boards and that no money shall be paid out for such contemplated expenditures unless and until
there has first been made an appropriation for such contemplated expenditures by the Board of
Supervisors; and,

BE IT STILL FURTHER RESOLVED that the School Budget estimate for FY 2014-
2015 be set at $92,143,378 with the local funds provided by the Board of Supervisors set at

and the school board to report back in amounts requested to be funded in each classification if
different than shown in the approved budget.

• All other vehicles which do not meet the definition of "qualifying" (business use vehicles,
farm use vehicles, motor home, etc.) will not be eligible for any of tax relief under this
program.

AND BE IT FURTHER RESOLVED by the Pittsylvania County Board of Supervisors
that, for the fiscal year beginning on July 1, 2014, and ending on June 30, 2015, the following
sections are hereby adopted.
Section 1. The cost center shown on the attached table labeled Appropriations
Resolution, Exhibit A, are hereby appropriated from the designated
estimated revenues as shown on the attached table labeled Appropriations
Resolution, Exhibit A. This appropriation does include the unappropriated
surplus. Funds may be appropriated by the Board of Supervisors as needed
during FY 2015 subject to the Board's by -laws for appropriations.
Section 2. Appropriations, in addition to those contained in this general Appropriations
Resolution, may be made by the Board of Supervisors only if there is
available in the fund unencumbered or unappropriated sums sufficient to
meet such appropriations.
Section 3. All appropriations herein authorized shall be on the basis of cost centers for
all departments and agencies excluding schools. The regular school fund is
specifically appropriated by category as listed on Exhibit A.
Section 4. The School Board and the Social Services Board are separately
granted authority for implementation of the appropriated funds for their
respective operations. By this resolution the School Board and the Social
Services Board are authorized to approve the transfer of any unencumbered
balance or portion thereof from one line item of expenditure to another
within the same classification in their respective funds in any amount.
Transfers between classification or funds require approval of the Board of
Supervisors.
Section 5. The County Administrator is expressly authorized to transfer any
unencumbered balance or portion thereof from one line item of expenditure
to another within the same cost center for the efficient operation of
government.

Section 6. All outstanding encumbrances, both operating and capital, at June 30, 2014
shall be reappropriated to the FY 2015 fiscal year to the same cost center
and account for which they are encumbered in the previous year. A report of
which shall be submitted to the Board.
Section 7. At the close of the fiscal year, all unencumbered appropriations lapse for
budget items other than the School Cafeteria Receipts Fund 209, the State
Restricted Seizure Fund - Sheriff 241, the Federal Restricted Seizure Fund

Federal Restricted Seizure Fund — Commonwealth's Attorney 244, the

Reserve Fund 425, the Bond Fund- Schools 435, the Landfill Enterprise
Fund 520, the Rescue Billing Fund 530, the Special Welfare Fund 733 and
the Pittsylvania County Employees Health Plan 734. Thus, all cancelled
cash balances shall revert back to the General Fund.
Section 8. Appropriations designated for capital projects will not lapse at the end of the
fiscal year but shall remain appropriated until the completion of the project
or until the Board of Supervisors, by appropriate ordinance or resolution,
changes or eliminates the appropriation. Upon completion of a capital
project, the County Administrator is hereby authorized to close out the
project and transfer to the funding source any remaining balances. This
section applies to all existing appropriations for capital projects at June 30,
2014 and appropriations in the FY 2015 Budget. The County Administrator
is hereby authorized to approve construction change orders to contracts up
to an increase of $10,000.00 and approve all change order for reduction of
contracts.
Section 9. The approval of the Board of Supervisors of any grant of funds to the
County shall constitute the appropriation of both the revenue to be received
from the grant and the County's expenditure required by the terms of the
grant, if any. The appropriation of grant funds will not lapse at the end of
the fiscal year but shall remain appropriated until completion of the project
or until the Board of Supervisors, by appropriate resolution, changes or
eliminates the appropriation. The County Administrator may increase or
reduce any grant appropriation to the level approved by the granting agency
during the fiscal year. The County Administrator may approve necessary
accounting transfers between cost centers and funds to enable the grant to be
accounted for the in correct manner.
Upon completion of a grant project, the County Administrator is authorized
to close out the grant and transfer back to the funding source any remaining

balance. This section applies to appropriations for grants outstanding at
June 30, 2014 and appropriations in the FY 2015 Budget.
Section 10. The County Administrator may reduce revenue and expenditure
appropriations related to programs funded all or in part by the
Commonwealth of Virginia and/or the Federal Government to the level
approved by the responsible state or federal agency.
Section 11. The County Administrator is authorized to make transfers to the various
funds for which there are transfers budgeted. The County Administrator
shall transfer funds only as needed up to amounts budgeted or in accordance
with any existing bond resolutions that specify the matter in which transfers
are to be made.
Section 12. The Treasurer may advance monies to and from the various funds of the
County to allow maximum cash flow efficiency. The advances must not
violate County bond covenants or other legal restrictions that would prohibit
an advance.
Section 13. All purchases with funds appropriated herein shall be made in accordance
with the County purchasing ordinance and applicable state statutes.
Section 14. It is the intent of this resolution that funds be expended for the purposes
indicated in the budget; therefore, budgeted funds may not be transferred
from operating expenditures to capital projects or from capital projects to
operating expenses without the prior approval from the Board of
Supervisors. Also, funds may not be transferred from one capital project to
another without the prior approval of the Board of Supervisors.
Section 15. The County Administrator is authorized, pursuant to state statute, to issue
orders and warrants for payments where funds have been budgeted,
appropriated, and where sufficient funds are available. A warrant register
shall be presented to the Board of Supervisors not less frequently than
monthly.
Section 16. Subject to the qualifications in this resolution contained, all appropriations
are declared to be maximum, conditional and proportionate appropriations —
the purpose being to make the appropriations payable in full in the amount
named herein if necessary and then only in the event the aggregate revenues
collected and available during the fiscal year for which the appropriations
are made are sufficient to pay all the appropriations in full. Otherwise, the
said appropriations shall be deemed to be payable in such proportion as the
total sum of all realized revenue of the respective funds is to the total
amount of revenue estimated to be available in the said fiscal year by the
Board of Supervisors.
Section 17. All revenue received by any agency under the control of the Board of
Supervisors or by the School Board or by the Social Services Board not
included in its estimate of revenue for the financing of the fund budget as
submitted to the Board of Supervisors may not be expended by said agency
under the control of the Board of Supervisors or by the School Board or by

the Social Services Board without the consent of the Board of Supervisors
being first obtained. Nor may any of these agencies or boards make
expenditures, which will exceed a specific item of an appropriation.
Section 18. Allowances out of any of the appropriations made in this resolution by any
or all county departments, bureaus or agencies under the control of the
Board of Supervisors to any of their officers and employees for expense on
account of the use of such officers and employees of their personal
automobiles in the discharge of their official duties shall be paid at the same
rate as that established by the Internal Revenue Service and shall be subject
to change from time to time to maintain like rates.
Section 19. The County Administrator is directed to establish eight (8) petty -cash
accounts under non - departmental from funds in this budget for central
purchasing, the landfill, building inspections, zoning and recreation in
accordance with Section 15.2 -1229 of the Code of Virginia as amended,
1950 with management plans as directed by the County Auditor.
Section 20. All previous appropriation ordinances or resolutions to the extent that they
are inconsistent with the provisions of this resolution shall be and the same
are hereby repealed.
Section 21. This resolution shall be effective on July 1, 2014.

BE IT RESOLVED, that Pittsylvania County 55171 does hereby acknowledge that its
contribution rates effective July 1, 2014 shall be based on the higher of a) the contribution rate in
effect for FY 2014, or b) eighty percent of the results of the June 30, 2013 actuarial valuation of
assets and liabilities as approved by the Virginia Retirement System Board of Trustees for the
2014 -16 biennium (the "Alternate Rate ") provided that, at its option, the contribution rate may be
based on the employer contribution rates certified by the Virginia Retirement System Board of
Trustees pursuant to Virginia Code § 51.1- 145(I) resulting from the June 30, 2013 actuarial value
of assets and liabilities (the Certified Rate "); and
BE IT ALSO RESOLVED, that Pittsylvania County 55171 does hereby certify to the
Virginia Retirement System Board of Trustees that it elects to pay the following contribution rate
effective July 1, 2014:

officers of Pittsylvania County are authorized and directed to pay over to the Treasurer of Virginia
from time to time such sums as are due to be paid by Pittsylvania County for this purpose.

Adjourned Meeting
April 22, 2014
Motion was made by Mr. Harville, seconded by Mr. Barber, to set a public hearing for
citizen input on proposed changes to the County's Procurement Policy, amending Chapter 25-
Centralized Purchasing, of the Pittsylvania County Code, which was unanimously approved by the
Board.
Motion was made by Ms. Bowman, seconded by Mr. Snead, to amend the FY 2014 budget
and approve an appropriation of $965 for the Byrne Justice Assistance Grant (JAG) and approve
the transfer of $107 from the Sheriffs Grant Local Match line item (100 -4- 031200 -8108) to line
time 250 -4- 031744 -8107. The following Roll Call Vote was recorded: Mr. Harville -Yes; Mr.
Barber -Yes; Mr. Snead -Yes; Mr. Blackstock -Yes; Ms. Bowman-Yes; Mr. Hagerman -Yes; and Mr. Barksdale -
Yes. Ms. Bowman's motion was unanimously approved by the Board.
Motion was made by Mr. Barber, seconded by Mr. Snead, to award the Brosville Industrial
Park Grading Project for Lots 7 & 9 to Haymes Brothers, Inc. in the amount of $1,150,000.00 and
authorize the Interim County Administrator to sign all necessary documentation, noting the funds
were already budgeted for this project. Mr. Barber's motion was unanimously approved by the
Board.
Motion was made by Ms. Bowman, seconded by Mr. Snead, to ratify the sale of 13 voting
units at a cost of $100 each to the City of Danville and authorize the Finance Department to bill the
City of Danville $1300 for this equipment, which was unanimously approved by the Board.
Motion was made by Mr. Harville, seconded by Mr. Blackstock, to: 1) Authorize the
establishment of the Pittsylvania County Youth Commission; (2) Authorize Mrs. Bowman to apply
for a "Make It Happen" grant through the Danville Regional Foundation, which exists to engage
more people and organizations in the transformation of the Dan River Region, by becoming
involved in making this a community of "bright spots and success stories" ; and (3) Authorize the
Interim County Administrator to sign any documentation necessary concerning the "Make It
Happen" grant. Mr. Harville's motion was unanimously approved by the Board.

Motion was made by Ms. Bowman, seconded by Mr. Harville, to submit the Barn
Preservation Program as an entry for the VACo Achievement Awards competition in the
"Environmental" category, with Ms. Sonja Ingram of Preservation Virginia helping with the
submission, which was unanimously approved by the Board.
Motion was made by Mr. Blackstock, seconded by Ms. Bowman, to appoint Mr. Hagerman
as Pittsylvania County's Alternate member to the Regional Industrial Facilities Authority (RIFA)
to serve out the seat left vacant by Ms. Bowman's resignation. Mr. Hagerman's term would from
April 22, 2014 through January 5, 2018.
Motion was made by Mr. Harville, seconded by Mr. Barber, to send the recommendations
submitted by the Joint Setback Study Subcommittee to the Planning Commission for their review.
Mr. Hagerman stated the Board had just received the recommendations right before the Board
meeting started and made a Substitute Motion, seconded by Mr. Blackstock, to table the issue until
the May 5, 2014 Board of Supervisors meeting in order for the Board members to have time to
review the recommendations. The Board voted 6 -0 to approve Mr. Hagerman's Substitute Motion,
with Mr. Harville abstaining from voting.

Board Announcements
Mr. Harville reminded the Board to submit any additions they may have for the Rural
Rustic Roads Program to Mr. Hawker for the May 5, 2014 Board of Supervisors meeting, noting
that if nothing is added at that meeting, noting the VDOT public hearing in Lynchburg is May 15,
2014 at 6:OOpm for additions to the VDOT FY 2015/2020 Six -Year Plan. Mr. Harville also asked
that a Letter of Appreciation be sent to the J.T. Minnie Maude thanking them for their recreation
grants.
Mr. Snead reminded the Board of the Danville - Pittsylvania Chamber of Commerce's
Annual Awards Dinner at 5:45pm on May 12, 2014 and to let the Chamber know by May 6, 2014
if they plan to attend in order to receive their tickets. Mr. Snead also requested that the
Pittsylvania County Registrar attend the Board's next meeting on May 5, 2014 at 7:OOpm to
answer questions the Board has concerning surplus voting equipment.
Mr. Blackstock announced that he would be running for election as the Staunton River
District Board of Supervisors representative in the November 2014 Special Election to fulfill the
remainder of the January 1, 2012 — December 31, 2015 term seat.
Mr. Barksdale said he has recently been appointed to a newly formed Advisory Council at
Danville Community College. He also reminded everyone of the 2014 Dixie Junior Livestock
Show coming up at the Olde Dominion Agricultural Complex on April 24 -27, 2014, and of
Sheriffs Night Out on Tuesday, April 29. 2014.

VIRGINIA: At the regular meeting of the Pittsylvania County Board of Supervisors held on Monday, May 5, 2014,
the following resolution was presented and adopted congratulating the Chatham Rotary Club on their 750' Anniversary.
WHEREAS, 2014 marks the 75th anniversary of the Chatham Rotary Club of Chatham, Virginia; and
WHEREAS, the Chatham Rotary Club was established on March 15, 1939 and became a member of Rotary
International when it was presented with its charter on June 23, 1939; and
WHEREAS, the Chatham Rotary Club has operated under the guiding principles to encourage and foster the
ideal service as a basis of worthy enterprise, including the development of acquaintance as an opportunity for
service; the promotion of high ethical standards in business and professions; the application of the ideal
service in each Rotarian's personal, business and community life; and the advancement of international
understanding, goodwill and peace; and
WHEREAS, during the last 75 years, the Chatham Rotary Club has supported many projects and fundraising
programs to benefit Chatham and Pittsylvania County that include beauty pageants, park festivals, Brunswick Stew
sales and silent auctions, scholarship awards, purchases of school equipment, Boy Scouts of America, God's Pit Crew
disaster response team, the Boys & Girls Club of the Danville area, the Pittsylvania County Literacy Project, the
Pittsylvania County 4 -H Program, Big Brothers Big Sisters of the Danville area, Cross Roads Reconciliation Services
and the sponsorship of the Chatham High School robotics team and Interact Club service organization; and
WHEREAS, the Chatham Rotary Club's outreach efforts include the support of the Rotary District 7570 Water
Project, Youth Leadership Awards, and international efforts to eradicate polio and provide clean water wells; then
BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors, on the behalf of all the citizens of

Each year the Board of Supervisors, in cooperation with the Pittsylvania County Sheriffs Department and
Virginia State Police, prepare a Proclamation to provide awareness for the National Police Week.
DISCUSSION:
Attached hereto, you will find a proclamation for Pittsylvania County concerning National Police Week for
May 11, 2014 through May 17, 2014. The Sheriff and/or members of the Pittsylvania County Sheriffs
Office will be present at the Board meeting to accept the proclamation.
The Board of Supervisors encourages citizens to attend the memorials and provide support for Fallen
Officers that have been killed in the line of duty protecting the citizens of Pittsylvania County. The Sheriff
will hold the annual memorial, as well as citizens holding a candlelight vigil, on Tuesday, May 13, 2014 at
7:30 pm at The Chatham Baptist Church.
Staff recommends that the Board of Supervisors approve the attached Proclamation and direct it to be
distributed to the required news media.

NATIONAL POLICE WEEK
May 11-17,2014
VIRGINIA: At a regular meeting of the Board of Supervisors of Pittsylvania County,
Virginia, held on Monday, May 5, 2014, the following proclamation was presented and
adopted to recognize National Police Week 2014 and to honor the service and sacrifice of those
law enforcement officers killed in the line of duty while protecting our communities and
safeguarding our democracy.
WHEREAS, there are approximately 900,000 law enforcement officers serving in
communities across the United States, including the dedicated members of the Pittsylvania
County Sheriff's Office; and
WHEREAS, nearly 60,000 assaults against law enforcement officers are reported each
year, resulting in approximately 16,000 injuries;
WHEREAS, since the first recorded death in 1791, almost 20,000 law enforcement
officers in the United States have made the ultimate sacrifice and been killed in the line of
duty, including 8 members of the Pittsylvania County Sheriff's Office; and
WHEREAS, the names of these dedicated public servants are engraved on the walls of
the National Law Enforcement Officers Memorial in Washington, D.C.; and
WHEREAS, the Candlelight Vigil is part of National Police Week, which takes place
this year on May 11 -17;
WHEREAS, May 15 is designated as Peace Officers Memorial Day, in honor of all
fallen officers and their families and U.S. flags should be flown at half - staff;
THEREFORE, BE IT RESOLVED that Pittsylvania County Board of Supervisors
designates May 11 -17, 2014, as Police Week in Pittsylvania County and publicly salutes the
service of law enforcement officers in our community and in communities across the nation.
FURTHERMORE, the Board of Supervisors calls upon all citizens of Pittsylvania
County to observe Tuesday, May 13, 2014 as Peace Officers Memorial Day in Pittsylvania
County in honor of those peace officers who, through their courageous deeds, have lost their
lives or have become disabled in the performance of duty.

Rural Residential — Agriculture (RR -A)
Proposed Wording
A. Statement of intent. This district is intended to allow rural residences in areas where agricultural and
other low- intensity uses predominate, but where low- density residential lots can be created. Uses
not consistent with the existing character of this district are not permitted. As rural residential
housing is not permitted in A -1 and C -1, this zoning classification has been established to allow
those landowners who desire to live in a rural setting the right to do so. Any land severed from an
A -1 parcel or adjoining an A -1 parcel that is to be re -zoned for residential use, shall abide by the
code established herein for residential buildings and shall be re -zoned to RR -A.
a) Furthermore, "It is advised that these residential building lots are located in an agricultural area.
Agriculture is the primary economic activity surrounding this zoning district. Owners, residents,
and other users of property may be subjected to inconvenience or discomfort arising from
agricultural operations even though conducted in accordance with best management practices
and /or in accordance with existing laws and regulations of the Commonwealth and the County.
Such agricultural operations may generate noise, odors, and dust; may involve the operation of
machinery, including aircraft, during any portion of a 24 hour day; and may involve the storage
and disposal of manure or biosolids, and the application of fertilizer, soil amendments, and
pesticides /herbicides. Owners, occupants, and users of land should be prepared to accept such
inconveniences or discomfort as a normal and necessary aspect of living in an agricultural zoning
district in a county with a strong rural character and an active agriculture sector."
b) The wording in Sub - section A. a) shall be printed on all preliminary and recorded plats,
presented to property owners who request a zoning classification change from A -1 to RR -A for
the expressed purpose of building a rural residential dwelling, and /or provided to mortgagees in
loan closing packets.
B. Uses. In this district, structures to be erected or land to be used shall be for one or more of the
following uses:
a) Uses permitted by right:
i) Single- family detached dwellings.
ii) Manufactured houses on permanent foundations.
iii) Neighborhood parks and playgrounds.
iv) Lines, poles and pipes to provide electric, gas, telephone, water or sewer service to
structures located on properties adjacent to said facilities.
v) Recreational vehicle, provided that the recreational vehicle is on the property no more than
30 consecutive days and is removed from the property for at least 14 consecutive days each
time it is removed.
vi) Open space developments.
b) Permitted accessory uses:
(a) Off - street parking.
(b) Customary accessory uses and structures.
(c) Home occupation.
(d) Home business.
C. Area regulations. The minimum lot area shall be 2.5 acres.

D. Yard regulations.
a) Front yard. Structures shall be located 100 feet or more from the front lot line. This shall be
known as the "setback line."
b) Side yard. Each side yard for each main structure shall be a minimum of 150 feet. No accessory
building shall be located closer than 150 feet to any side property boundary line.
c) Rear yard. Each main structure shall have a rear yard of 150 feet or more. Accessory buildings
may be built to within 30 feet of the rear property line.
d) Lots adjoining an A -1 zoning district. No residential structure shall be constructed closer than
150 feet to any A -1 adjacent zoned property line. Wells shall be located 100 feet from any A -1
adjacent zoned property lines unless the adjacent landowner agrees to such through their
signature on a recordable waiver.
e) Lots adjoining an industrial zoned district. No residential structure shall be constructed closer
than 150 feet to an adjacent property line if that property is an industrialized zoned district or
contains an industrial use.
E. Clustering of Residences. A landowner who properly rezones their A -1 property to RR -A may
develop their property for multiple residences as long as the lots adjoining A -1 property maintain
the following criteria:
a) Minimum lot size of 1.75 acres
b) Residential setback of 150 feet on whichever side(s) touch A -1 zoned property and 100 feet on
the front from a public road; interior residential yardage setbacks, not adjoining A -1, may be
reduced to a 50 feet setback
c) Any residences located to the interior of a residential cluster may reduce the minimum lot size
to .75 acres and maintain a minimum of 50 feet for the front, rear, and side yardage setbacks
F. Building Coverage. The maximum building coverage on a lot shall be 30 %.

We have a number of surplus laptops that are obsolete and we have used a program to remove all data
from them. Rather than their take up space and gather dust, I would like to give to Goodwill. They
probably won't sell them but have their clients dismantle and recycle parts.
I would like to give these and the computer system that we used with ORE voting system which Is also
taking up space we could use for other things. The IT department has wiped this clean to ensure no
Information about the ballots can be obtained from the system.
Goodwill will come and pick these up from my office at no expense to the County. I hope you will give
me permission to dispose of these items in this manner.

At their adjourned meeting on April 22, 2014, by a 5 -2 majority vote, the Board of Supervisors approved a
motion made by the Honorable Elton Blackstock, seconded by the Honorable James Snead, to adopt the
budget and Resolution 2014 -04 -03 with the following amendment: Mr. Blackstock proposed to cut line item
100-4-033100-317400, Boarding of Prisoners External, from $500,000.00 to $250,000.00, amending the total
County budget to $175,554,277.00.

VIRGINIA: At an adjourned meeting of the Board of Supervisors of Pittsylvania County,
Virginia, held on Tuesday, March 18, 2014, the following resolution was presented and adopted:
WHEREAS, each year the foremost duty of the Virginia General Assembly to pass a
budget or budget amendments that serve as Virginia's financial blueprint for each fiscal year;
and
WHEREAS, Virginia is constantly recognized for its sound fiscal management and
budgetary practices as illustrated by its AAA bond rating and the strong bond ratings of many
local government divisions throughout the Commonwealth; and
WHEREAS, Pittsylvania County is currently in the process of developing and adopting
its budget for the upcoming fiscal year•, and
WHEREAS, the Pittsylvania County Board of Supervisors relies on the timely passage
of a budget to allocate funding to local government services and make policy and hiring
decisions for the upcoming fiscal year; and
WHEREAS, 62,807 residents of Pittsylvania County depend on county government to
provide critical services such as education and public safety; and
WHEREAS, failure to pass a timely budget will result in uncertainty for the County of
Pittsylvania, which receives 45% of its funding as direct aid from the Commonwealth; and
WHEREAS, the Pittsylvania County School Board relies on the timely passage of the
state budget in order to see its budget and make staffing decisions, which includes teacher
contracts; and
WHEREAS, interruption of the provision of educational services to Pittsylvania County
students will have a significant negative impact on students and families; and
WHEREAS, the interruption of public safety services would likely result in the loss of
property, serious injury or loss of life for Pittsylvania County citizens; and
WHEREAS, critical mental health services to Pittsylvania County residents are provided
via funds that flow from the state budget through county budgets; and
WHEREAS, the Virginia General Assembly adjourned sine die on Saturday, March 8,
2014 without adopting a budget for the two year biennium beginning July 1, 2014; then
BE IT RESOLVED by the Pittsylvania County Board of Supervisors that the Governor
of Virginia and the Virginia General Assembly are urged to pass a budget as soon as practicable
to ensure the continued functioning of state and local governments; and

BE IT FURTHER RESOLVED that the issue of Medicaid Expansion under the
Affordable Care Act should be decoupled from budget negotiations and considered a separate
legislative session to facilitate prompt passage of a state budget; and
BE IT FURTHER RESOLVED that the Pittsylvania County Board of Supervisors shall
transmit copies of this resolution to the Honorable Terence R. McAuliffe, Governor of the
Commonwealth of Virginia and members of the Virginia General Assembly so they may be
apprised of the sense of the Pittsylvania County Board of Supervisors in this matter.

BACKGROUND:
The Board of Supervisors held a public hearing on July 17, 2012 for citizen input on a proposed No Thru
Truck Traffic Restriction on SR 799 /Climax Road. (See Attachment A).
In recent months, there has been much discussion about tractor trailer traffic on SR 799 /Climax Road and
whether an engineering study concerning No Thru Truck Traffic Restrictions could be performed by the
Virginia Department of Transportation (VDOT). (See Attachment B- !/DOT's response on steps necessary for
such an engineering study).
DISCUSSION:
The Honorable Jerry Hagerman has requested consideration for a public hearing for citizen input on No Thru
Truck Traffic Restrictions for the roads listed above, and has offered alternate routes. (See Attachment Q.
RECOMMENDATION:
Staff submits this to the Board of Supervisors for their review and consideration.

No one signed up to speak and Mr. Barber closed the public hearing at 7:25pm. Motion was
made by Mr. Ecker, seconded by Ms. Bowman, to approve rezoning Case R -12 -030 from R -1 to
MHP with the submitted proffer. The following Roll Call Vote was recorded: Mr. Harville -Yes;
Mr. Snead -Yes; Mr. Barksdale -Yes; Mr. Hagerman -Yes; Ms. Bowman; Mr. Ecker; and Mr.
Barber -Yes. Mr. Ecker's motion to rezone Case R -12 -030 from R -1 to MHP was unanimously
approved by the Board.
This concluded the Rezoning Cases.
Public Hearing
No Thru Trucks- Callands- Gretna District: Public Hearing to receive citizen input on the
proposal to restrict truck traffic from SR 750 /Green Pond Road (off RT 57 West) to SR
800 /Anderson Mill Road; to SR 799 /Climax Road; to RT 40 West. The Alternate Route
would be for trucks on RT 57 West to continue east to the Town of Chatham; then follow
U.S. RT 29 North until reaching RT 40; thence taking RT 40 West. The proposed
restriction will be on any truck, truck and trailer, or semi - trailer combination except a
pickup truck or panel truck.
Mr. Barber opened the public hearing at 7:27pm. Mr. Sleeper explained that there had
been concern on the narrowness of the road and the amount of commercial truck traffic on the
advertised route from VA RT 57 to VA RT 40 and that the Honorable Jerry Hagerman has
requested a "No Thru Trucks" resolution be considered for public hearing and if approved, be
forwarded on to the Virginia Department of Transportation. The following persons signed up to
speak:
Mr. Jim Wagner of the Callands -Gretna District, whose career field is Forestry,
questioned if there had been a study of the amount of truck traffic on the currently used route for
VA RT 57 to VA RT 40 and that to use the suggested alternate route would put an undue burden
of additional miles and gas expense on the drivers, in addition to how important this route was
for the forestry industry. Mr. Wagoner suggested the Board look at all aspects of this issue and
to consider getting direct input from the Department of Forestry and landowners alike.
Ms. Tammy Whitt, of the Callands- Gretna District, lives on Climax Road / SR799, and
voiced concerned about vehicles using excessive speed; of trucks using the road as a shortcut to
VA RT 40 and that because of the narrowness of the road, meeting such trucks has become
highly dangerous and supported the resolution.
Ms. Annegret Wiegmann of Chatham voiced safety concerns concerning the roads not
being designed for commercial traffic and believed that lowering the speed limit would improve
what currently was a dangerous situation.
Mr. Arthur Brunner of 3211 Climax Road /SR799 also stated the traffic appeared to be
going too fast (approximately 55- 60mph) and felt speed limits should be restricted to 40mph, and
that the road was too narrow for commercial truck traffic.
Mr. Ken Scruggs of the Tunstall District, and a professional forester and local timber
buyer, stated the forest industry needed the current route being used and the forest industry
couldn't afford to absorb the cost that would incur from using the proposed alternate route, and
the landowners selling timber would also lose profit from their timbers sales since these
additional costs for a more lengthy route would have to be passed onto the customers. Mr.
Scruggs further voiced his concerns on the ability of some trucks to pass beneath the low train
trestle, which presents a potential safety hazard.
Mr. Max Kendall, of Kendall Lumber, stated the Board to consider instead requesting
that VDOT widen the existing truck routes (SR 750, 800, and 799) by 18 inches to 2 feet on each
side of the road, and this would greatly benefit both sides of the issue. Furthermore, Mr. Kendall
pointed out that if you divert that amount of commercial truck traffic into the Town of Chatham,
the Town's residents would be the next group of people in front of the Board complaining.

prohibit thru traffic north or to realign the 57 / B -29 intersection at the Exxon Station for traffic
turning south off Hwy 57 have been rejected. The proposed restriction will simply make worse a
problem that already exists in town and one which we have had no success in addressing with
VDOT. This restriction would take what appears to be a relatively minor rural road problem and
turn it into a much larger issue in the town.
I respectfully request the county reconsider this proposal or look at alternatives which would
avoid putting this traffic into town. If adopted, any plan put forward by the county must include
asking VDOT for prohibitions on thru truck traffic on Main Street (Business 29) north of
Highway 57 and also for a realignment of the intersections at Hwy 57 and 29 Business both
coming off 57 west and entering 57 east at the Exxon Station.

Mr. Rodgers commented that Dominion Power alone had over 10,000 trucks per year that used the
current route from VA RT 57 to VA RT 40 and it created numerous difficulties for the trucks to
come through the Town of Chatham as opposed to their current route.
Mr. Roy Byrd, Council Member for the Town of Chatham, and Fuel Procurement
Manager for the Dominion Power Plant, stated the current truck route was critical for Dominion
Power, and that as a Town Councilman, the issue becomes where are you going to spend money to
accommodate the truck traffic -the current route or the proposed route, as each has issues. As a 10-
year veteran of the Virginia Transportation Board, Mr. Byrd stated that the one thing he learned is
that the propose of highways was to distribute traffic and if the Board restricts truck traffic from
RT 750, you will concentrate all this truck traffic through the Town of Chatham. Dominion Power
is the largest taxpayer in Pittsylvania County and saves over 2 million barrels of oil a year for fuel
consumption and furthermore, has extended $163 million to the timberers of this County. His
suggest would be to start with lowering the speeds on the roads in question and then petition
VDOT to widen those same roads.
Mr. Roger Jefferson, of the Callands- Gretna District, is a dairy farmer on the Climax
Road who markets 88% of the milk in Pittsylvania County, and the largest dairy farmer in the
Commonwealth of Virginia, and stated his business can't operate if the trucks can't come in and
out of his business. He was not in support of restricting the truck traffic and suggested the more
reasonable solution would be to lower speeds and have them enforced.
Mr. Chad Shelton of the Callands- Gretna District runs a lumber business with his father
and stated the current truck route was the primary corridor for moving their products and agreed
with earlier suggestions of enforced lowered speed limits and widening the roads.
Mr. Bill Black of the Banister District worried about the quality of life in Chatham if an
excess of 10,000 trucks were added to the Town traffic. Furthermore, long carriers cannot make
the turn going north onto Main Street if cars are parked at the post office and trucks making a turn
onto VA RT 57 E can't make that turn either, making this alternate route an impossible route for
truckers to use.
Mr. David Falson of Dominion Power stated that SR 750 is crucial to the operation of
Dominion Power and that in 7 years and over 10,000 loads, none of their trucks had been involved
in an incident.

Ms. Audrey Fox of 2813 Greenpond Road stated that road was very curvy, had a high
traffic county, and was not built to accommodate the amount of traffic currently traveling it. Ms.
Fox stated the major problem was speeding by all vehicles and suggested VDOT lower the speed
limit to 45mph.
Mr. Bobby Trucker of the Callands- Gretna District and the Museville community was
opposed to the truck restriction, mostly because he did not believe in imposing restrictions on
certain types of traffic. Mr. Tucker stated that only l truck has been involved with traffic
incidents on that road, and questioned if the No Thru Trucks restriction was imposed, would that
also prohibit utility trucks, farm trucks pulling trailers, and etc. from using the current route.
Mr. Joe Rodgers, of Chatham and the current Mayor for the Town of Chatham, presented
a written statement for record on the behalf of the Town of Chatham.
Comments for: Pittsylvania County Board of Supervisors — Public Meeting of July 17, 2012 -
Truck Restrictions from Route 57 to Route 40 west of Gretna
On behalf of the town of Chatham, I must voice opposition to the proposal to restrict truck traffic
beginning at the route 57 / 750 intersection; then along Green Pond, Anderson Mill, Climax, and
Piney Road to route 40 just west of Gretna. This opposition is based on the negative effects that
this change would have on the town and its citizens.
Before preparing this statement, I drove the route of the proposed restriction from Rondo to
Gretna and back_ I found the traffic to be light and encountered an average of only 12 cars
(counting both directions going and coming from Route 57 to Route 40. 1 did not see any road
conditions which appeared unsafe when traveled at legal speed limits.
I am advised that truck traffic from western Pittsylvania County and from Martinsville and
Henry County is using this route as a short cut from Hwy 57 to Hwy 40 and then to US 29 north.
They are also apparently using it to avoid having to go through the Town of Chatham. I
measured a 5 mile savings from Hwy 57 to US 29 north at the Gretna by -pass using this route vs,
going down Hwy 57 to Chatham and then north on US 29 to Gretna.
I understand that the Board of Supervisors is reacting to recent accidents on Green Pond Road. In
each case, it is not clear that the road itself was a primary factor. Based on what I've read, the
tragic accident which took the life of the young mother of two would not have been influenced in
any manner had trucks been restricted on this section of road.
If the proposed restrictions are put in place, the only route for this northbound traffic will be
through the Town of Chatham. It is my contention that this may create more problems than a
restriction in the county will solve. The intersection at Hwy 57 and Business 29 in town presents
difficulty in maneuvering trailer trucks whether turning on to or off of Main Street. Southbound
traffic on Main Street occasionally has to stop and back up to provide turning radius space for
trailer trucks going north on Main Street off of 57 and vehicles turning left off Business 29 onto
Hwy 57 often require trucks trying to turn right to maneuver onto the sidewalks, as tire marks
readily attest.
Truck traffic along Main Street, especially northbound traffic, has to contend with vehicles on
both sides of the street as well as pedestrian traffic. The town has received routine complaints
about the noise, pollution and safety issues associated with through truck traffic north of Hwy 57
on Business 29, it is noteworthy that northbound traffic through town passes through much area
which is residential. Herein lay many of the citizens concerns. Efforts and overtures to VDOT to

Ms. Carolyn Moon of the Westover District and forestry consultant that assists private
owners in the sale of their timber stated this proposed restriction is a form of restricting commerce
and agrees with the earlier proposed solutions of reduced speed limits and widening of the roads
currently being used.
Mr. Nelson Giles, Jr. of Chatham stated that the roads /shoulders of the current routes are
not adequate for trucks, but it is the shortest and most economical route to use. Speed limit
enforcement, Mr. Giles stated, is a necessity no matter how the Board votes.
Mr. Peter Pilser of the Climax Road complained about the noise the truck traffic created
and that slowing the traffic down via enforced speed limits would certainly help.
Mr. Richard Shields of the Callands- Gretna District sympathized with both sides of the
issue, and that the most important thing to be done would be enforcing reduced speed limits.
Mr. Roy Van Der Hyde of the Chatham - Blairs District and Van Der Hyde Dairy Farms,
agreed with Mr. Jefferson's comments.
Mr. Tommy Motley of the Callands- Gretna District also agreed with Mr. Jefferson and
that if truck traffic was diverted to the Town, and a truck got hung up at the train trestle, not only
would it stop vehicle traffic, it could stop train traffic as well.
Mr. Kevin Owns of the Callands- Gretna District, who lives on the Climax Road, stated
some of the craziest driving was from car drivers, not truck drivers, and restricting truck traffic
would not answer the safety issues currently experienced on that road; that speed limits need to be
lowered for all road traffic and enforced.
Mr. Jay Calhoun of the Gretna - Callands District stated the truck restriction was a way of
restricting commerce that's harvested in this County and that route is a thorough faire route on the
VDOT maps; it is important to identify and solve the road problems, not restrict traffic.
Ms. Lori Berries of the Climax area, spoke in favor of the restrictions.
Mr. Donnie Moore of the Callands- Gretna agreed with previous comments on speed
reduction and road widening.
Mr. Steven Veal, who lives on Anderson Road and is a truck driver, stated that a tractor
trailer can't make the turns in the Town of Chatham and agreed with previous comments
concerning the limitations and road widening.
Mr. Frank Fox of the Chatham - Blairs District felt this proposal alternate route was an
example of unintended consequences and that the problem would being moved instead of fixed.
No one else spoke and Mr. Barber closed the public hearing at 8:21pm. Motion was then made by
Mr. Hagerman, seconded by Mr. Ecker, to forward the resolution onto VDOT for consideration.
Mr. Harville made a substitute motion, seconded by Mr. Snead, to ask VDOT to extend the roads
by 18 inches on each side, and to immediately post 45mph speed limit signs. Furthermore, Mr.
Harville stated that he would be willing to forfeit his 6 -year funds to fix this road problem, and that
the County needed to send a strong message to the Commonwealth of Virginia concerning this
matter. The Board then approved Mr. Harville's substitute motion by a 6 -1 majority vote, with
Mr. Hagerman opposing.
This concluded the Public Hearings.
Unfinished Business
At the July 2, 2012 meeting of the Board, a motion was made by Mr. Snead,
seconded by Mr. Ecker, for the reappropriation of funds as follows: $175,00 to Sheriff - Wrecker
Service (100 -4- 031200 - 3170), $2,312.09 to Sheriff - Subsistence & Lodging, $10,620.04 to
Sheriff -Parts (100 -4- 031200- 6030), $7,742.35 to Sheriff -Svc Costs -Labor (100-4-031200-0631),
$70.38 to Jail- Extradition (100 -4- 033100 - 5550), $37,351.07 to WIA -Rent (251-4-353160-5420),

Yes, this is a big deal, so it does need a resolution. In fact, prior to doing a resolution, a public hearing must be held. I've
attached a pdf of the CTB guidelines, but here's a summary of the rules that would have to be followed just to submit
the request.
A. The public notices for the hearing must include a description of the proposed through truck restriction and the
alternate route with the same termini. A copy of the notices must be provided to VDOT.
B. A public hearing must be held by the local governing body and a transcript of the hearing must be provided with
the resolution.
C. The resolution must describe the proposed through truck restriction and a description of the alternate, including
termini.
D. The governing body must include in the resolution that it will use its good offices for enforcement of the
proposed restriction by the appropriate local law enforcement agency.
Note that the termini for the restricted route and the alternate route have to be the same.

GUIDELINES FOR CONSIDERING REQUESTS TO
RESTRICT THROUGH TRUCKS ON PRIMARY AND SECONDARY HIGHWAYS
Section 46.2- 809 of the Code of Virginia provides:
The Commonwealth Transportation Board, or its designee, in response to a formal
request by a local governing body, after such body has held public hearings, may, after
due notice and a proper hearing, prohibit or restrict the use by through traffic of any
part of a primary or secondary highway if a reasonable alternate route is provided.
The Board, or its designee, shall act upon any such formal request within nine
months of its receipt, unless good cause is shown. Such restriction may apply to any
truck or truck and trailer or semitrailer combination, except a pickup or panel truck,
as may be necessary to promote the health, safety, and welfare of the citizens of the
Commonwealth. Nothing in this section shall affect the validity of any city charter
provision or city ordinance heretofore adopted.
Background
It is the philosophy of the Commonwealth Transportation Board that all vehicles should have access
to the roads on which they are legally entitled to travel. Travel by any class of vehicle on any class of
highway should be restricted only upon demonstration that it will promote the health, safety and
welfare of the citizens of the Commonwealth without creating an undue hardship on any of the users
of the transportation system. The Board recognizes that there may be a limited number of instances
when restricting through trucks from using a segment ofa primary or secondary roadway will reduce
potential conflicts, creating a safer environment and one that is in accord with the current use of the
roadway. The Board has adopted these guidelines to govern and regulate requests for through truck
restrictions on primary and secondary highways.
Process
The Commonwealth Transportation Board delegates the authority to restrict through truck traffic on
secondary highways to the Commissioner of the Virginia Department of Transportation. Such

restrictions can apply to any truck, truck and trailer or semi trailer combination, or any combination of
those classifications. Consideration of all such restrictions by the Commissioner is subject to these
guidelines as adopted by the Board. The Commonwealth Transportation Board retains the authority
to restrict through truck traffic on primary highways.
In order to conform to the requirements of the Code of Virginia and to insure that all concerned
parties have an opportunity to provide input, the local governing body must hold a public hearing and
make a formal request of the Department. The following must be adhered to:
(A) The public notices for the hearing must include a description ofthe proposed through
truck restriction and the alternate route with the same termini. A copy of the notices
must be provided.
(B) A public hearing must be held by the local governing body and a transcript of the
hearing must be provided with the resolution.
(C) The resolution must describe the proposed through truck restriction and a description
of the alternate, including termini.
(D) The governing body must include in the resolution that it will use its good offices for
enforcement of the proposed restriction by the appropriate local law enforcement
agency.
Failure to comply with (A), (B), (C) and (D) will result in the request being returned. The
Commonwealth Transportation Board and the Commissioner shall act upon any such formal request
within nine months of its receipt, unless good cause is shown.
Criteria
Travel by any class of vehicle should be restricted only upon demonstration that it will promote
the health, safety and welfare of the citizens of the Commonwealth without creating an undue
hardship on any users of the transportation net work. The Virginia Department of Transportation
will consider criteria 1 through 4 in reviewing a requested through truck restriction. The proposed
restriction must meet both the first and second criteria in order to be approved:
1. Reasonable alternate routing is provided. The alternate route will be evaluated for traffic and

safety related impacts. To be considered "reasonable ", the alternate route(s) must be
engineered to a standard sufficient for truck travel, and must be judged at least as appropriate
for truck traffic as the requested truck restriction route. If an alternate route must be
upgraded, the improvement shall be completed before the truck restriction can be
implemented. The termini of the proposed restriction must be identical to the alternate routing
to allow a time and distance comparison to be conducted between the two routings. Also, the
alternate routing must not create an undue hardship for trucks in reaching their destination.
2. The character and /or frequency of the truck traffic on the route proposed for restriction is not
compatible with the affected area. Evaluation will include safety issues, accident history,
engineering of the roadway, vehicle composition, and other traffic engineering related issues.
In addition to meeting the first two criteria, the proposed restriction must meet either the third or the
fourth criteria in order to be approved.
3. The roadway is residential in nature. T a the roadway will be judged to be residential if
there are at least 12 dwellings combined on both sides within 150' of the existing or proposed
roadway center line per 1,000 feet of roadway.
4. The roadway must be functionally classified as either a local or collector.
Failure to satisfy criteria 1 and 2, and either criteria 3 or 4 will normally result in rejection of
the requested restriction.
The Commonwealth Transportation Board when deemed necessary may modify or revise any
provisions or criteria contained in these guidelines.

from using the following state highways ":
a. Rt. 790 (from Rt. 40 to Rt. 790)
b. Rt. 799 (entire length from Rt. 40 to Rt. 57)
c. Rt. 750 (from Rt. 57 to Rt. 649)
d. Rt. 649 (from Rt. 750 to Rt. 799)
The alternate route is as follows:
Traveling east on Rt. 57 from Martinsville, va continue thru Chatham to Rt. 29
North /South . When coming from Rt. 40 travel to Rt. 29 North toward
Altavista or South towards Danville. Vehicles toward Martinsville would exit
Rt. 29 on Rt 57 going thru Chatham for app. One block on main street. This
would allow all trucks to be restricted from going North on Main St. Chatham.
This would allow two turns with corners being adjusted slightly and stop lines
moved further south on main St. The rail road underpass on Rt. 57 passes
Federal and State regulations by being over 14 feet in height when truck
height is restricted to app. 13 feet 6 inches. This would alleviate Tractor
Trailers from traveling 8 miles on a 17 ft. wide rural road with no shoulders
and allow all tractor trailers to travel on a 4 lane highway designed for large
trucks which would conserve fuel have safer conditions for drivers and the
public.

VIRGINIA: At the regular meeting of the Pittsylvania County Board of Supervisors held on Monday, May 05, 2014,
the following resolution was presented and adopted.
WHEREAS, Duke Energy operated a power generating facility referred to as the Dan River Steam Station, located in
Rockingham County, North Carolina, for 63 years; and
WHEREAS, the three units of the Dan River Steam Station were retired in 2012, leaving in place two coal ash ponds
located adjacent to the Dan River; and
WHEREAS, on February 2, 2014 approximately 39,000 tons of coal ash and 35 million gallons of contaminated
wastewater were released into the Dan River from a broken stormwater pipe located beneath an unlined coal ash pond
at this Dan River Steam Station ; and
WHEREAS, this coal ash spill resulted in coal ash deposits in the Dan River and still undetermined potential impacts
to the river's natural ecosystem; and
WHEREAS, the Dan River flows from the coal ash spill site through Pittsylvania County, Virginia and is an important
natural resource to the people of Pittsylvania County both for recreational and economic development reasons; and
WHEREAS, Pittsylvania County has recognized the importance of the Dan River by supporting its addition to the
Virginia Scenic Rivers program; and
WHEREAS, the President of Duke Energy has stated, "We apologize and will use all available resources to take care
of the river." and "We will do the right thing for the river and surrounding communities. We are accountable. ", then
BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors accepts Duke Energy's
responsibility and accountability for the Dan River coal ash spill and requests that the interests and concerns of the
residents of Pittsylvania County be considered and addressed throughout the process of clean up and remediation of all
impacts associated with the spill, both environmental and economic; and
BE IT FURTHER RESOLVED that Pittsylvania County government and elected officials should be fully informed
and involved in any and all decisions about how Duke Energy addresses both real and perceived damages to the Dan
River and the region's image.

§33.1 -70.1 of the Code of Virginia, 1950, as amended, permits the hard surfacing of certain unpaved roads deemed
to qualify for designation as a Rural Rustic Road.
(1) Attached hereto, you will find four (4) resolutions (see attached) that were submitted to the Virginia
Department of Transportation (VDOT) on August, 6, 2013 for the following roads in Pittsylvania County that
qualified as Rural Rustic Roads: Resolution 2013- 08 -02: SR 758 /Rose Street; Resolution 2013- 08 -03: SR
755 /Mercury Road, Resolution 2013- 08 -04: SR 644 1CooksburgRoad; and Resolution 2013- 08 -05: SR 749 /Cedar
Road. VDOT recently sent a notification that there was some required language missing from those resolutions
and that these roads had not yet been added to be added to Rural Rustic Road Program. Attached are new
resolutions that include the required language so these 4 roads can be added to the Rural Rustic Road Program.

Here are the resolutions that have already been passed regarding Rural Rustics. These were for Rose Street, Mercury
Road, and Cooksburg Road. There was also another one passed at the same meeting for Cedar Road, but it is already
paved, so I did not include it.
However, in reading the wording of these resolutions, they state that the roads are in the Board's six year plan, and they
were not, so I'm not sure they're valid. It would probably be prudent to pass another resolution for the roads that do
make it into the six year plan. Also, there is a paragraph missing from the resolution.
I have attached a sample resolution as a guide.
Also, Jacobs Rd. (Route 637) is on the current six year plan, but we do not have a resolution declaring it as a Rural Rustic.
Of course, this is subject to change, but a rough estimate of what it takes to do a Rural Rustic project is $175,000 per
mile. Over the next 6 years, the County will be getting about 3.3 million for unpaved roads, which is about 18.9 miles
worth.
The resolutions so far, plus Jacobs Road total 5.1 miles, so there's room for another 13.8 miles. Also, please note that
the 1.26 miles mentioned in the resolution for Cooksburg Road will not take care of all of the unpaved section of this
road, but will only go from Rt. 750 to Rt. 783. If the intent was to pave all of it, the distance should be 2.3 miles.

A Change Order request has been generated due the County's responsibility to decommission two transmitting
locations. Currently, the County has two leases that will require us to remove our old microwaves and antenna lines
and shelters. With the new Harris Radio System we are no longer using the Crown Castle Tower Site on State Rd 863.
That location has two microwaves and three antennas with associated cabling to the shelter at the base of the tower. Our
lease requires us to decommission and vacate this property by June 30, 2014.
The second lease is with Verizon Wireless on Brushy Mountain in Gretna. This site also has two microwaves, three
antennas with associated cabling to the shelter at the base of the tower.
Per our lease we must remove all equipment and restore the sites back to the original condition prior to our installation.
The removal of the communications shelters will require a crane to relocate both shelters to the landfill for future
auction.
The County is requesting to issue a Change Order to Harris Radio for them to decommission and remove all equipment
and shelters. This equipment and shelters will be relocated and stored at the Landfill pending auction at a later date.
The Contract Amendment is for $35,188.00.
The Capital Outlay E911 Radio Project has a balance of $20,417.30. The remaining funding will be transferred from
the E -911 budget to the Capital Outlay E -911 Radio Project to cover these costs.
Staff recommends the Board of Supervisors to authorize the transfer from the E -911 budget in the amount of
$14,771.00 from the Account # 100 -4- 035500 - 523000 to 416 -4- 094416- 810200 and authorize the Interim County
Administrator to sign the Contract Amendment in the amount of $35,188.00.

THIS AMENDMENT (hereinafter "Amendment ") is made and entered into this _
day of May 2014 by and between The County of Pittsylvania County, Virginia (hereinafter
referred to as "Buyer ") and Harris Corporation through its RF Communications Division
(hereinafter referred to as "Seller ").
WHEREAS, the parties entered into a System Purchase Agreement ( "Agreement ")
dated December 20, 2011, for a P25 Radio Communications System; and
WHEREAS, the parties entered into Amendment 1 on March 07, 2012; and

BACKGROUND:
Chapter 822 of the 2012 Acts of Assembly (SB497) discusses the member contribution requirements
necessary for employees to begin paying the employee portion of the Virginia Retirement Rate, which
equates to 5 %. We started the VRS employee contribution phase -in process on July 1, 2012.
DISCUSSION:
During the budget process for FY 2015, a 1% increase was included in VRS covered salaries in order to
enable employees to pay the additional I% employee contribution required. Employees will be responsible
for paying 3% of the employee contribution beginning July 1, 2014. This method will continue for the next 2
years until Pittsylvania County employees pay the entire 5% member contribution. All employees hired by
Pittsylvania County after July 1, 2012 automatically pay the 5% member contribution upon commencement
of employment. It is not an option to phase these individuals in.
RECOMMENDATION:
Staff recommends that the Board approve the attached resolution (Resolution 2014- 05 -03) to elect the

RESOLUTION

Member Contributions by Salary Reduction for Counties, Cities, Towns, and Other
Political Subdivisions
WHEREAS, the Board of Supervisors of Pittsylvania County 55171 employees who are
Virginia Retirement System members who commence or recommence employment on or after
July 1, 2012, shall be required to contribute five percent of their creditable compensation by
salary reduction pursuant to Internal Revenue Code § 414(h) on a pre -tax basis upon
commencing or recommencing employment; and
WHEREAS, the Board of Supervisors of Pittsylvania County employees who are
Virginia Retirement System members and in service on June 30, 2012, shall be required to
contribute five percent of their creditable compensation by salary reduction pursuant to Internal
Revenue Code § 414(h) on a pre -tax basis no later than July 1, 2016; and
WHEREAS, such employees in service on June 30, 2012, shall contribute a minimum of
an additional one percent of their creditable compensation beginning on each July I of 2012,
2013, 2014, 2015, and 2016, or until the employees' contributions equal five percent of
creditable compensation; and
WHEREAS, the Board of Supervisors may elect to require such employees in service on
June 30, 2012, to contribute more than an additional one percent each year, in whole
percentages, until the employees' contributions equal five percent of creditable compensation;
and
WHEREAS, the second enactment clause of Chapter 822 of the 2012 Acts of Assembly
(SB497) requires an increase in total creditable compensation, effective July 1, 2014, to each
such employee in service on June 30, 2014, to offset the cost of the member contributions, such
increase in total creditable compensation to be equal to the percentage increase of the member

contribution paid by such pursuant to this resolution (For example, if the member contribution
paid by the employee increases from two to three percent pursuant to this resolution, the
employee must receive a one percent increase in creditable compensation.)
BE IT THEREFORE RESOLVED, that the Board of Supervisors of Pittsylvania
County does hereby certify to the Virginia Retirement System Board of Trustees that it shall
effect the implementation of the member contribution requirements of Chapter 822 of the 2012
Acts of Assembly (SB49) according to the following schedule for the fiscal year beginning July
1, 2014:

BE IT FURTHER RESOLVED, that such contributions, although designated as
member contributions, are to be made by the Board of Supervisors of Pittsylvania County in lieu
of member contributions; and
BE IT FURTHER RESOLVED, that pick up member contributions shall be paid from
the same source of funds as used in paying the wages to affected employees; and
BE IT FURTHER RESOLVED, that member contributions made by the Board of
Supervisors of Pittsylvania County under the pick up arrangement shall be treated for all
purposes other than income taxation, including but not limited to VRS benefits, in the same
manner and to the same extent as member contributions made prior to the pick up arrangement;
and
BE IT FUTHER RESOLVED, that nothing herein shall be construed so as to permit or
extend an option to VRS members to receive the pick up contributions made by the Board of
Supervisors of Pittsylvania County directly instead of having them paid to VRS; and

BE IT FURTHER RESOLVED, that notwithstanding any contractual or other
provisions, the wages of each member of VRS who is an employee of the Board of Supervisors
of Pittsylvania County shall be reduced by the amount of member contributions picked up by the
Board of Supervisors of Pittsylvania County on behalf of such employee pursuant to the
foregoing resolutions; and
BE IT FURTHER RESOLVED, that in accordance with the Appropriation Act, no
salary increases that were provided solely to offset the cost of required member contributions to
the Virginia Retirement System under § 51.1 -144 of the Code of Virginia will be used to certify
that the salary increases required by the Appropriations Act have been provided.
NOW, THEREFORE, the officers are hereby authorized and directed in the name of the
Board of Supervisors of Pittsylvania County to carry out the provisions of this resolution, and
said officers are authorized and directed to pay over to the Treasurer of Virginia from time to
time such sums as are due to be paid by the Board of Supervisors for this purpose.
