MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, January 7, 2014, in the General District
Courtroom, Chatham, Virginia. Mr. Shelton, Director of Code Compliance, called the meeting to order at approxirnately
7:00 p.m. Mr. Shelton called the roll.

APPOINTMENT OF CHAIRMAN AND VICE CHAIRMAN FOR THE YEAR 2013 — Upon motion of Mr.
Motley, seconded by Ms. Mease, and by a 6 to 0 vote (2 members were absent), Mr. Stowe was elected Chairman for the
year 2014. By morion of Mr. Arthur, seconded by Mr. Weatherford, and by a 6 to 0 vote (2 members were absent), Mr.
Modey was elected Vice Chairman for the year 2014.
HEARING OF THE CITIZENS
No citizens came forward to speak.
APPROVAL OF THE MINUTES
A morion was made by Mr. Arthur, seconded by Dr. Miller, and by a 6 to 0 vote (2 members were absent), the December
3, 2013, minutes were approved as presented.
CHAIRMAN'S REPORT
There was no Chairman's Report.

Case 1, Roger Edwards & Brenda B. Edwards, R-14-001— NIr. Modey opened the public hearing at 7:05 p.m. Mr.
Shelton, Director of Code Compliance, reported that Roger and Brenda Edwards had petirioned to rezone 2.17 acres,
located on State Road 800/Rigney Circle, in the Callands-Gretna Election District from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District to combine with the adjacent parcel of land zoned A-1. Roger Edwards
was present to represent the petition. He stated he had nothing to add except that his home is located off the highway and
he wanted to have road frontage and access to the highway. There was no opposition to the petition. Mr. Modey closed
the public hearing at 7:07 p.m. A morion was made by Ms. Mease, seconded by Mr. Weatherford, to recommend the
Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District.
Motion passed by a 6 to 0 vote (2 members were absent).
Case 2, Melvin Richard Harlow. Et Als, Roseanne Marie Harlow, Et Als, Joshua T. Harlow, Et Als, R-14-002 —
Mr. Motley opened the public hearing at 7:08 p.m. Mr. Shelton, Director of Code Compliance, reported that Melvin
Richard Harlow and Others had petitioned to rezone a total of 59.48 acres, three (3) parcels of land, located on State Road
863/Moorefield Bridge Road and on State Road 872/Meadowview Drive, in the Westover Elecrion District from R-1,
Residential Suburban Subdivision District and RC-1, Residential Combined Subdivision District to A-1, Agricultural
District for agricultural use — horses. Richard Harlow was present to represent the petition. He stated he had nothing to
add except that he is building a house on one of the petitioned parcels of land and he would like to have one or two horses
and a barn, and he did not desire to offend his neighbors. Brenda Jones spoke in opposition to the petition. Her concerns
included, but were not limited to, the following: She wanted to know what is allowed in A-1, Agricultural District, and she
did not want any mobile homes on the properties. NIr. Harlow then offered a rebuttal and stated there would be no mobile
homes placed on the properties. He also stated he was rezoning to allow for horses only and Ms. Jones would not see the
horses or barn from the main highway. Ms. Jones then stated she had no opposition to the horses being placed on the
properties. Mr. Modey closed the public hearing at 7:18 p.m. During the discussion, it was stated the area is perfect for
horses. A motion was made by Mr. Weatherford, seconded by Mr. Arthur, to recommend the Board of Supervisors rezone
the properties from R-1, Residential Suburban Subdivision District and RC-1, Residential Combined Subdivision District
to A-1, Agricultural District. Motion passed by a 6 to 0 vote (2 members were absent).
Case 3, Maxey Pro�erties, LLC, R-14-003 — Mr. Motley opened the public hearing at 7:19 p.m. Mr. Shelton, Director of
Code Compliance, reported that Maxey Properties, LLC, had petitioned to rezone a total of 1.47 acre, three (3) parcels of
land, located on U.S. Highway 57/Halifax Road, in the Chatham-Blairs and Banister Election Districts from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjacent
parcels of land zoned A-1. No one was present to represent the petition, and Mr. Shelton stated he would answer any
questions from the Board members. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:21
p.m. During the discussion, it was stated these properries have always been used for agricultural purposes. A motion was
made by Dr. Miller, seconded by Ms. Mease, to recommend the Board of Supervisors rezone the properties from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District. Morion passed by a 6 to 0 vote (2 members were
absent).
This concludes the Rezoning cases.
Case S-1, john C. Preston & Sara D. Preston, S-14-001— Mx. Motley opened the public hearing at 7:22 p.m.
MY. Shelton, Director of Code Compliance, reported that John and Sara Preston had peritioned for a Special Use
Permit on 0.55 acre, located on State Road 882/W. Sunrise Drive, in the Tunstall Elecrion District for sale and
placement of a single-wide mobile home on the propeYty. John Preston was present to represent the perition.
He stated he had nothing to add. Copies of a letter written by an adjacent property owner opposed to the
perition weYe distributed to the Board members for their xeview. Mr. Modey closed the public hearing at 7:23
p.m. During the discussion, it was stated there are no mobile homes in the area. A motion was made by Mr.
Weatherford, seconded by Mr. Arthur, to recommend the Board of Zoning Appeals deny this Special Use
Permit request. Motion passed by a 6 to 0 vote (2 members were absent).
This concludes the Special Use Permit case.

OLD BUSINESS
Amend the Pittsvlvania County Zoning Ordinance. Cha�ter 35, for the addition of Adult Uses under Industrial
District �IVI-1i Light Industry, Sec. 35-384, S�ecial Use Permits.
Mr. Shelton reported the Pittsylvania County Board of Supervisors, at their adjourned meeting held on December 17, 2013,
voted unanimously to refer the proposed amendment back to the Planning Commission for their review with the following
revisions:
XX-XX. ADULT USES.
Section XX-XX-3. Kequirement.r and Standard.r.
The original proposed amendment reads as follows:
A. No Adult use shall be permitted:
1. Within two (2) miles of any other e�sting Adult Use; and
2. Within one-thousand (1,000) feet of any e�sting residential use or residentially zoned district...
The revised proposed amendment reads as follows:
A. No Adult Use shall be permitted:
1. Within three (3) miles of any other e�sting Adult Use; and
2. Within two thousand five hundred (2,500) feet of any existing residential use or residentially zoned
district. . .
A motion was made by Dr. Miller, seconded by Mr. Arthur, to advertise for a public hearing to amend the Pitts�lvania
Count� Zoning Ordinance, Cha�ter 35, for the addition of Adult Uses undeY Industrial District (NI-1,LLight
Industr�, Sec. 35-384, S�ecial Use Permits with the proposed revisions. Motion was passed by a 6 to 0 vote (2
members were absent).
NEW BUSINESS
There was no new business.
