District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to ordex at approxixnately 7:00

Mr. Shelton, Director of Code Compliance, reported that David and Ruthann MilleY had petitioned to rezone
3.90 acres, located on U.S. Highway 57/Callands Road, in the Callands-Gretna Election District from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District for agricultural use-fariiung. David
Miller was present to repxesent the peririon. He stated he had nothing to add. There was no opposirion to the
peririon. Mr. Stowe closed the public hearing at 7:03 p.m. During the discussion, it was stated this is consistent
with the parcels of land across the highway and surrounding area that are zoned A-1. A morion was made by
Ms. Mease, seconded by Mr. WeatherfoYd, to recommend the Boaxd of Supervisoxs rezone the property from
R-1, Residenrial Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously.
Case 2, Delbert L. Yoder & Miriam E. Yoder, R-13-064 — MY. Stowe opened the public hearing at 7:04 p.m.
Mr. Shelton, Director of Code Compliance, repoxted that DelbeYt and Miriam Yoder had peririoned to rezone
27.20 acres, located off State Road 802/Hodnetts Mill Road, in the Banister Elecrion District from R-1,
Residenrial Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent and to
combine with the adjacent parcel of land zoned A-1. Delbert Yoder was present to YepYesent the petition. He
stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at
7:05 p.m. A motion was made by Dr. Miller, seconded by Mr. Welborn, to recommend the Board of Supervisors
rezone the property fYOm R-1, Residential Suburban Subdivision District to A-1, AgYicultural District. Morion
passed unanunously.
Case 3, Hvltons Investments, LLC, R-13-065 — Mx. Stowe opened the public hearing at 7:06 p.m. Mr.
Shelton, Director of Code Compliance, reported that Hyltons Investments, LLC, had petitioned to xezone 2.51
acres, located on U.S. Highway 58/Martinsville Highway, in the WestoveY Elecrion District from R-1, Residential
Suburban Subdivision District to B-2, Business District, General for future commercial development. Donald
and Roger Hylton weYe present to represent the petirion. They stated they had nothing to add. Nell Hylton
spoke in opposition to the peririon. Some of her concerns included, but weYe not limited to, the following: She
stated the peririoned parcel is adjacent to residential properties and she desired to keep the area suitable for
Yesidenrial use. She then presented a perition of individuals who were opposed to the rezoning for the Boaxd
members to review. Mr. Stowe closed the public hearing at 7:09 p.m. During the discussion, it was stated this
aYea is favorable for commercial development due to the changes that have taken place in the last ten years. A
motion was made by Mr. Weatherford, seconded by Ms. Mease, to recommend the Board of Supervisors rezone
the property from R-1, Residential Suburban Subdivision District to B-2, Business District, GeneraL Motion
passed unanimously.
Case 4, Joseph R. Burdette & Terri A. Powell, R-13-066 - Mr. Stowe opened the public hearing at 7:15 p.m.
Mr. Shelton, Director of Code Compliance, xeported that Joseph and Terri Burdette had petirioned to rezone
0.763 acre, located off U.S. Highway 58 East/South Boston Highway, in the Dan River Elecrion District from
A-1, Agricultural District to B-2, Business District, General to allow for sales and service of used cars. Joseph
Burdette was present to represent the perition. He stated he had nothing to add. There was no opposirion to the
peririon. Mr. Stowe closed the public hearing at 7:16 p.m. A morion was made by Mr. WelboYn, seconded by
Mr. Arthur, to recommend the Board of Supervisors rezone the property from A-1, Agricultural Disttict to B-2,
Business District, General. Motion passed unanimously.
Case 5, Ronnie M. Hollev & Linda C. Hollev, R-13-067 - Mr. Stowe opened the public hearing at 7:17 p.m.
Mr. Shelton, Director of Code Compliance, reported that Ronnie and Linda Holley had petitioned to rezone 2.01
acres, located on State Road 750/Whitmell School Road, in the Tunstall Elecrion District from A-1, Agricultutal
District to R-1, Residential Suburban Subdivision District to combine with the adjacent parcel of land zoned R-1.

to the peririon. Mr. Stowe closed the public hearing at 7:18 p.m. DuYing the discussion, it was stated
this is consistent with the adjoining land zoned R-1. A motion was made by Mr. Motley, seconded by Mr.
Welborn, to recommend the Board of Supervisors rezone the property fYOm A-1, Agricultural District to R-1,
Residential Suburban Subdivision District. Motion passed unanimously.

Case S-1, Patricia Ann Barksdale, S-13-012 — MY. Stowe opened the public heaxing at 7:19 p.m. Mr. Shelton,
Director of Code Compliance, reported that Patricia Ann Barksdale had petirioned for a Special Use Permit on
0.52 acYe, located on Terry Lane, in the Staunton River Election District fox placement of a single-wide mobile
home for her personal residence. Ms. Barksdale was pYesent to represent the petition. She stated she had
nothing to add. Trent Prater also spoke on behalf of Ms. Barksdale and Yequested this Special Use be granted, as
the single-wide mobile home would be Ms. Barksdale's one chance to own a home due to her financial position.
There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:20 p.m. During the
discussion, it was stated there are other single-wide mobile homes in the genexal area. A morion was made by
MY. ATtIlUY, seconded by Mr. Motley, to recommend the Board of Zoning Appeals grant this Special Use Permit.
Morion passed unanimously.

Public Hearing — Amendment to the Pittsylvania County Zoning Ordinance as Advertised to amend the
Pittsylvania County Zoning Ordinance, Chapter 35, for the addition of Adult Uses under Industrial
District (M-1�ght Industry, Sec. 35-384, Special Use Permits. - Mr. Stowe opened the public hearing at
7:21 p.m. There was no opposirion to the pxoposed amendment, and Mx. Stowe closed the public hearing at
7:22 p.m. During the discussion, it was stated this informarion had been compiled by Pittsylvania County
Attoxney, Mr. J. Vaden Hunt. It was also stated this informarion is very strong, and the Board of Supervisors
needs help and guidance with this. In addition, it was stated this will help Pittsylvania County. A motion was
made by Mr. Modey, seconded by Mr. WeatheYford, to recommend to the Board of Supervisors that this
amendment be placed in the Pittsylvania County Zoning Ordinance, Chaptex 35, under Industrial District (M-1)
Light Industry, Section 35-382, with a Special Use Permit. Morion passed unanimously.
OLD BUSINESS
Mr. Shelton stated the name of the AgYicultural Comxnittee had been changed to the Setback Committee. Mr.
Stowe appointed Mr. Motley and MY. Arthur to repYesent the Planning Coinmission on this conimittee.
NEW BUSINESS
A site plan review for a proposed telecommunications tower to be located off U.S. Highway 58 East/South
Boston Highway, Sutherlin, Virginia, was presented to the Board members for their approval. Mr. Shelton stated
a cell tower is a permitted use in property zoned M-1, Industrial District, Light Industry, and if the Board had no
quesrions and the site plan was approved as presented, then a builcling permit would be issued. A motion was
made by Mr. Welborn, seconded by Mr. AYthur, that the site plan be approved and accepted. Motion passed
unanimously.

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the comprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the
board regarding zoning cases will be limited to (3) three minutes.

RMF, Residential Multi-Famil� District — Residential locarions for apartments, townhouses,

B-1, Business District. Limited — A district for general business oriented toward
neighborhood focus, in which the public requires direct and frequent access to, limited to

limited to commercial, retail and wholesale type establishments, oriented to service the enti�e

M-1, Industrial District, Light Industrv — A district for small-scale manufacturing and

this petition pursuant to Sections 35-806 and 35-807 of the Pittsylvania County Zoning
Ordinance and in accordance with the Code of Vir�inia, 1950, as amended, and would
respectfully show the following:

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Coininission's public hearing on a zoning map amendment, there shall be
erected on the property pxoposed to be rezoned, a sign or signs provided by the Zoning Aduiiiustrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whateveY boundary line of
such land abuts a public road and shall be so placed as to be cleaxly visible fxom the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be exected in the same manner as above for each such abutting road. If no public road abuts
theYeon, then signs shall be erected in the same manneY as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of SupervisoYS for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Administrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign eYected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Administrator or an authorized agent of either,
to Yemove or tamper with any sign furnished duxing the period it is required to be maintained under this Section. All
signs erected under this Section shall be removed by the applicant with fouxteen (14) days following the public
hearing for which it was erected.

Melvin Richard Harlow, Et Als, Roseanne Marie Harlow, Et Als, and Joshua T. Harlow, Et Als, petitioned the
Planning Coininission/Board of Supervisors on November 21, 2013, to rezone from R-1, Residential Suburban
Subdivision District and RC-1, Residenrial Combined Subdivision District to A-1, Agricultural District on a total
of 59.48 acres, three (3) parcels of land. The parcels are shown on our records as GPIN #s 1388-43-4611/161-
A-17E (37.74 acres), 1388-24-4565 (21.32 acres) and 1388-53-6878/161-13-1 (0.42 acre).
The applicants would like to xezone the properries for agricultural use (horses). They also stated they may have a
few chickens and may start a tree farm on the properries in the future.
There are several parcels of land adjacent to the peririoned parcels that are zoned A-1, Agricultural District. One
adjacent parcel was rezoned in 2001 (Case R-01-029) from R-1 to A-1, granted with proffer.

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Coininission's public hearing on a zoning map amendment, there shall be
erected on the propeYty proposed to be rezoned, a sign ox signs pxovided by the Zoning Adininistrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public Yoad and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Administrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Secrion 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the dury of the applicant at the hearings to pYOVe by affidavit that he has fully complied with
the requixements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning AdininistratoY or an authoYized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Section. All
signs erected under this Section shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Ordinance. I
undeYStand it is my responsibility to post, maintain and remove this/these sign or signs, according to Secrion 35-817,

WHEREAS, your Petitioner, Maxev Properties, LLC, respectfully files this petition
pursuant to Sections 35-806 and 35-807 of the Pittsylvania County Zoning Ordinance and
in accordance with the Code of Virginia, 1950, as amended, and would respectfully show
the following:
(1) The Petitioner is the owner of the above-referenced parcels of
land, or is filing with the owner's consent.
(2) The properties are presently zoned under the provisions of the Pittsylvania

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Commission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign or signs pxovided by the Zoning Administrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days prececling such hearing, a sign or signs provided by the Zoning
Adininistxator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this section and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Administrator or an authorized agent of either,
to remove or tamper with any sign fuxnished during the period it is required to be maintained under this Secrion. All
signs erected under this Section shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Coinmission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign or signs provided by the Zoning Administrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the properry,
then a sign shall be eYected in the same mannex as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manneY as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be exected, at least fouxteen (14) days preceding such hearing, a sign ar signs provided by tl�e Zoning
Admuustrator indicating the date, time and place of the public hearing. Such sign oY signs shall be erected in the
same manner as prescribed in Secrion 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this secrion shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this section and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful foY any person, except the applicant or the Zoning Adinuzistrator or an authorized agent of eithex,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Secrion. All
signs erected under this Secrion shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Ordinance. I
understand it is my responsibility to post, maintain and remove this/these sign or signs, according to Secrion 35-817,
Section 35-818, and 35-819. If this sign is removed or destroyed, I understand it is my responsibility to obtain
another sign from the Zoning office, post the property and maintain the sign(s), according to the above Sections of
