VIRGINIA: The Pittsylvania County Planning Cominission met on Thursday, November 7, 2013, in the
General District Courtroom, Chatham, Vixginia. Mr. Stowe, Chairman, called the meeting to order at
approxunately 7:00 p.m. Mr. Stowe called the Yoll.

Case 1, Helen G. Manning, R-13-057 — Mr. Stowe opened the public hearing at 7:01 p.m. MY. Shelton,
Director of Code Compliance, reported that Helen G. Manning had peritioned to rezone a total of 4.48 acres,
four (4) parcels of land, located on State Road 745/Mount View Road, in the Chatham-Blairs Elecrion District
from R-1, Residenrial SubuYban Subdivision District to A-1, Agricultural District to make the zoning consistent
with the adjacent parcel of land zoned A-1. Mrs. Helen Manning was present to represent the petirion. She
stated she had nothing to add. There was no opposition to the perition. Mr. Stowe closed the public hearing at
7:02 p.m. During the discussion, it was stated these parcels of land are completely surrounded by A-1,
Agricultural District zoned properties. A motion was made by Mr. Motley, seconded by Mr. WeatherfoYd, to
recommend the Board of Supervisors rezone the properties from R-1, Residential Suburban Subdivision District
to A-1, Agxicultural District. Motion passed by a 7 to 0 vote (one member was absent).
Case 2, Garv Thompson Shelton & Shelbv Shelton, R-13-058; Case 3, Mount Hermon Volunteer Fire
Dept. Inc., R-13-059 — Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Director of Code
Compliance, xeported that Gary and Shelby Shelton had petitioned to rezone 0.039 acre from R-1, Residential
Suburban Subdivision District to M-1, Industrial District, Light Industry. He also Yeported that Mount Hermon
Volunteer Fire Dept., Inc., had petitioned to rezone 0.174 acre from M-1, Industrial District, Light Industry to
R-1, Residenrial Suburban Subdivision District He stated that both parcels are located on U.S. Highway 41 /
Franklin Turnpike, in the Chatham-Blaixs Election District. Mr. H. F. Haymore, Jr., was present to represent the
petition. He stated he had nothing to add. One of the Board members questioned Mr. Haymore as to whether
the deeds would be swapped, and Mr. Haymore stated the deeds would be swapped. There was no opposition
to the peririon. Mr. Stowe closed the public hearing at 7:05 p.m. A motion was made by Mr. Motley, seconded
by Mr. Weatherford, to recommend the Board of Supervisors rezone 0.039 acre from R-1, Residential Suburban
Subdivision District to M-1, Industrial District, Light Industry and 0.174 acre from M-1, Industrial District, Light
Industry to R-1, Residenrial Suburban Subdivision District Morion passed by a 7 to 0 vote (one member was
absent).
Case 4. Bernie D. Jordan & Tammy L. Jordan, R-13-060 — Mr. Stowe opened the public hearing at 7:06 p.m.
Mr. Shelton, Director of Code Compliance, reported that BeYnie and Tammy Jordan had peritioned to rezone
4.66 acres, located off State Road 722/Oakwood Drive, in the Tunstall Election District from R-1, Residenrial
Suburban Subdivision District to A-1, Agricultural District to allow for placement of two (2) single-wide mobile
homes on the propeYty for their children. Bernie and Tammy Jordan wexe present to represent the petition.
They stated they had nothing to add. There was no opposition to the peririon. Mr. Stowe closed the public
hearing at 7:07 p.m. During the discussion, it was stated there axe mobile homes all around the petitioned parcel
of land. A morion was made by Mr. Motley, seconded by Mr. Weatherford, to Yecommend the Board of
Supervisors rezone the pxoperty fYOm R-1, Residential Suburban Subdivision District to A-1, Agricultural
District. Morion passed by a 7 to 0 vote (one member was absent).
Case 5, Janice H. Doss, R-13-061- Mr. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, DiYector of
Code Compliance, reported that Janice Doss had peritioned to rezone 0.51 acre, located on State Road
676/Taylors Mill Road, in the Callands-Gretna Elecrion District from R-1, Residential Suburban Subdivision
District to A-1, Agricultural District to combine with the adjacent paYCel of land zoned A-1. No one was
present to represent the petition, and Mr. Shelton stated he would answer any questions from the Boaxd
members. There was no opposirion to the peririon. Mr. Stowe closed the public hearing at 7:09 p.m. During
the discussion, it was stated this is consistent with the surrounding propeYries. A morion was made by Ms.

Case 6, Ethelvne R. Hardv, R-13-062 - Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton,
Director of Code Compliance, reported that Ethelyne Hardy had petirioned to rezone 0.15 acre, located on State
Road 676/Taylors Mill Road, in the Callands-Grema Election District from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District to combine with the adjacent parcel of land zoned A-1. No one
was present to represent the peririon, and Mr. Shelton stated he would answer any questions from the Board
members. There was no opposition to the perition. Mr. Stowe closed the public heaxing at 7:11 p.m. During
the discussion, it was stated this is consistent with the surrounding properties. A morion was made by Ms.
Mease, seconded by Mr. Welborn, to recommend the Board of Supervisors rezone the propexty from R-1,
Residenrial Suburban Subdivision District to A-1, Agricultural District. Morion passed by a 7 to 0 vote (one
member was absent).

NEW BUSINESS
Mr. Shelton stated on November 6, 2013, Mr. J. Vaden Hunt, Pittsylvania County Attorney, submitted a
proposed constitutional zoning regularion of Adult Uses in Pittsylvania County with a xecommendation to
amend the zoning ordinance to allow Adult Uses in M-1, Industrial Disttict, Light Industry with a Special Use
Permit (Sec. 35-384) or in M-2, Industrial District, Heavy Industry with a Special Use Permit (Sec. 35-403). Mr.
Shelton then stated following a vote from the Planning Cominission, a public hearing norice would be advertised
in The Star Tribune on NovembeY 20 and 27, 2013, and the hearing would be held on Tuesday, December 3,
2013. Each Board member was presented a copy of the infoYmarion submitted by Mr. Hunt for their review.
Mr. Shelton instructed the Board members to review the information and should they have any quesrions, to call
Mr. J. Vaden Hunt, Pittsylvania County Attorney. A motion was made by Mx. Motley, seconded by Mr. Arthur,
to adverrise for a public hearing to amend the Pittsylvania Countv Zoning Ordinance, Cha�teY 35, for the
addirion of Adult Uses under Industrial District (NI-1� Light Industrv Sec 35-384, S�ecial Use Permits Motion
passed by a 7 to 0 vote (one member was absent).

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the comprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the
board regarding zoning cases will be limited to (3) three minutes.
PUBLIC HEARING PROCEDURE
A. Prior to opening Hearing, Chairman reviews zoning law precepts for all present.

WHEREAS, your Petitioners, David Rav Miller and Ruthann Miller, respectfully file this
petition pursuant to Sections 35-806 and 35-807 of the Pittsylvania County Zoning
Ordinance and in accordance with the Code of Vir�inia, 1950, as amended, and would
respectfully show the following:
(1) The Petitioners are the owners of the above-referenced parcel of
land, or are filing with the owner's consent.
(2) The property is presently zoned under the provisions of the Pittsylvania
County Zoning Ordinance as R-1, Residential Suburban Subdivision
District.
(3) Your petitioners now desire to have the property rezoned to A-1,

SIGN AFFIDAVIT
Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Coinmission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign or signs provided by the Zoning Adininistrator indicating the
date, time, and place of the public heaxing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible fxom the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Boaxd of SupervisoYS for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Administrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Secrion 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requiYements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Adnunistrator or an authorized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Secrion. All
signs erected under this Secrion shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Ordinance. I
understand it is my Yesponsibility to post, maintain and remove this/these sign ox signs, according to Secrion 35-817,
Secrion 35-818, and 35-819. If this sign is removed or destroyed, I understand it is my Yesponsibility to obtain
another sign from the Zoning office, post the pYOperty and maintain the sign(s), according to the above Sections of
the Pittsylvania County Zoning Ordinance.

WHEREAS, your Petitioners, Delbert L. Yoder and Miriam E. Yoder, respectfully file
this petition pursuant to Sections 35-806 and 35-807 of the Pittsylvania County Zoning
Ordinance and in accordance with the Code of Virginia, 1950, as amended, and would
respectfully show the following:

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Commission's public hearing on a zoning map amendment, there shall be
erected on the property pxoposed to be rezoned, a sign or signs provided by the Zoning Administrator indicating the
date, time, and place of the public hearing. The sign shall be eYected within ten (10) feet of whatevex boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the xoad with the bottom of the sign
not less than two and one-half (2 1/2) feet above the gxound. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days pYeceding such hearing, a sign or signs provided by the Zoning
Adininistrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescxibed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the dury of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Administrator oY an authorized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Section. All
signs erected under this Section shall be xemoved by the applicant with fourteen (14) days following the public
hearing for which it was erected.

collection, whether all or any part of such indebtedness and obligations is direct or indirect, fixed or
contingent, matured or unmatured, liquidated or unliquidated, whether contracted by the Grantor alone,
jointly, or jointly and severally with anothe�, and whether originally contracted with the Beneficiary or
acquired by the Beneficiary by assignment, transfer or otherwise from another. The indebtedness and
obligations secured hereby may, but need not, be evidenced by the Grantor's endorsement or guaranry of the
indebtedness or obligations of another obligor to the Beneficiary.
ANYTH[NG contained herein or elsewhere to the contrary notwithstanding, this deed of trust secures
the indebtedness and the obligations described above, and the Grantor hereby acknowledges and agrees that
this deed of trust shall survive and shall not be merged into any other deed of trust, mortgage or security
agreement executed by the Grantor in favor of the Beneficiary (this deed of trust and such other documents
being hereinafter collectively called a"Security Instrument"), whether now existing or hereafter entered into,
even though the Beneficiary, one or both of the trustees, the property or the indebtedness secured shall be
the same as described in this deed of trust. Accordingly, the Grantor, Trustees and the Beneficiary intend, if
one or more Security Instruments are recorded against the property, that such Security Instruments shall not

paid. Beneficiary may require Grantor to obtain and maintain such flood insurance at the time the loan(s)
secured hereby are- made or at any time thereafter until the loans secured by such property are fully paid.
Grantor further agrees to pay Beneficiary all reasonable fees and costs incurred in determining whether any
of such property is located in an area having speciat flood hazards including determination fees (of initial
and subsequent determination as well as fees for monitoring the flood hazard status of the property during
the life of the loan), together with the cost of premiums and fees incurred with purchasing flood insurance
for Grantor, if Grantor fails to do so within the time period required by Beneficiary. Any such fees,
premiums or costs shall, in the Beneficiary's sole discretion, be due and payable on demand or as otherwise
provided for in the promissory note(s) secured hereby or this deed of trust. Any policy evidencing such
insurance shail be deposited with and loss thereunder to be payable to the Beneficiary as its interest may
appear. In the event of loss Grantor will give immediate notice by maii to the Beneficiary, who may make
proof of loss if not made promptly by Grantor, and each insurance company concerned is hereby authorized
and directed to make payment for such loss to the order of the Beneficiary only, instead of to the Grantor
and the Beneficiary jointly, and the insurance proceeds, or any part thereof, may be applied by the
Beneficiary to the restoration or repair of the damaged property or at the option of the Beneficiary may be
applied to the reduction of the indebtedness secured hereby. If Beneficiary elects to apply such proceeds to
said indebtedness, Beneficiary shall have sole discretion as to the manner in which the application of such
proceeds is distributed among principal, interest, charges, penalties, expenses and costs, etc. comprising the
indebtedness secured hereby. In the event of foreclosure of this deed of trust or the transfer of title to the
premises herein described in extinguishment of the indebtedness secured hereby, all right, title and interest
of the Grantor in and to any insurance policies then in force shall pass to the purchaser or grantee.
Seventh: That he will pay when due all taxes, liens, judgments or assessments heretofore or hereafter
levied, assessed or constituting liens upon the property herein described; and in the event Grantor fails to
pay the same when due or fails to maintain insurance as herein provided, the Beneficiary may make such
payment or provide such insurance and amounts paid therefor shall become a part of the indebtedness
secured hereby and bear interest at the billing rate then in effect from the date of payment.
Eighth: That, if required as a condition of any loan secured hereunder, Grantor shall pay to Beneficiary
on the day instaliments are due, until the note is paid in full or any escrow requirement is otherwise waived
in writing by Beneficiary, a sum to provide for payment of amounts due for. (a) taxes and assessments and
other items which can attain priority over this instrument as a lien or encumbrance on the property; and (b)
premiums for any and all insurance required by Beneficiary. Such amounts required hereunder shall be
determined in accordance with the Real Estate Settlement Procedures Act (12 U.S.C. §2601 et seq.) and its
implementing regulation, Regulation X("RESPA"). Upon payment in full of all sums secured by this
instrument, or if any such escrow requirement is no longer required as a condition of any loan secured
hereunder, Beneficiary shall promptly refund to Grantor any funds held by Beneficiary under this escrow
requirement.
Ninth: That he will keep all improvements now or hereafter located on the premises in good repair;
that he will maintain and work the premises herein described in a good and husbandlike manner; that he will
commit no waste and that he will not cut or remove or permit to be cut or removed any wood or timber from
said premises except for domestic use without the written consent of the Beneficiary and the Beneficiary
shall have the right by injunction or otherwise to prevent the cutting or removal of any wood or timber from
said premises irrespective of whether or not the balance of the security is ample to protect the Beneficiary.
Tenth: That he hereby represents and warrants to Beneficiary that there are no materials (hereinafter
collectively called "Speciai Materials") presenNy located on or near the premises which, under Federal, state,
or local law, statute, ordinance, regulation or standard, or administrative or court order or decree or private
agreement (hereinafter collectively called "Environmental Requirements"), require special handling in use,
generation, collection, storage, treatment, or disposal, or payment of costs associated with responding to the
lawful directives of any court or agency of competent jurisdiction or for similar economic loss. Such Special
Materials include those that violate any national or local contingency plan or the release or threatened
release of which may violate or create liabiliry under the Environmentai Requirements. Such Special
Materials also include (a) asbestos in any form, (b) urea formaldehyde foam insulation, (c) paint containing
lead, or (d) transformers or other equipment which contain dielectric fluid containing polychlorinated
biphenyls (commonly referred to as "PCBs"). Grantor further represents and warrants to Beneficiary that the
premises are not now being used nor have they ever been used in the past for the activities including the use,
generation, collection, storage, treatment, or disposal of any Special Materials, and in particular, without
limiting the generality of the foregoing, the premises are not now being used nor have they ever been used in
the past for a landfill, surface impoundment or other area for the treatment, storage or disposal of solid waste
(including solid waste such as siudge). Grantor will not place or permit to be placed any such

sold by publication in some newspaper of general circulation in the county where the property is located,
once a week for three successive weeks preceding the day of sale, and the Trustee may advertise in such
other manner as will, in his opinion, be best calculated to attract bidders, and such sale may be adjoumed
from time to time by oral proclamation at the time and place appointed for the sale, and if necessary in
making such sale, the Trustee may secure a survey of said property and the cost thereof shall become a part
of executing this trust; that immediately upon the first insertion of the advertisement in some newspaper, as
aforesaid, there shall be and become due by said Grantor to the Beneficiary all expenses incident to said
advertising and any other fees and costs incurred by reason of the default hereunder, which said expenses,
fees and costs said Grantor hereby covenants to pay as a part of the indebtedness secured hereby and neither
Beneficiary nor the Trustee hereunder shall be required to receive the principal and interest only of the
indebtedness secured hereby unless accompanied by a tender of said expenses, fees and costs, but said sale
may be proceeded with unless prior to the day appointed therefor legal tender be made of said indebtedness,
fees, expenses and costs. The Trustee shall pay out of the proceeds of sale: FIRST, all costs of executing
this trust, including a commission to the Trustee of five percent (5%) of the gross amount of proceeds of sale
and all reasonable attomeys' fees, as permitted by applicable state law, and all other expenses incurred in
execution of this trust, and all attorneys' fees and costs in substituting a trustee; SECOND, the indebtedness
secured hereby, and the residue, if any, shall be paid to the Grantor. The Trustee shall settle the accounts in
accordance with the statutes in such cases made and provided.
Seventeenth: That the Beneficiary, at its option, may require the Trustee to give a bond satisfactory to
the Beneficiary, conditioned upon the faithful performance of the duties hereunder, and any premium paid
on such bond shall become a part of the cost of executing this trust.
Eighteenth: That without affecting the liability of the Grantor or any other person (except any person
expressly released in writing) for payment of any indebtedness secured hereby or for performance of any
obligation contained herein and without affecting the rights ofthe Trustee or Beneficiary with respect to any
securiry not expressly released in writing, and without affecting the priority of the lien of this deed of trust,
the Trustee or Beneficiary may, at any time and from time to time, either before or after the maturity of said
indebtedness, and without notice to or the consent of any party hereto or any other party: (a) release any
person liable for payment of all or any part of the indebtedness or for performance of any obligation; (b)
make any agreement reamortizing, extending, renewing, refinancing, modifying or otherwise altering the
terms of payment of all or any part of the indebtedness, or modifying or waiving any obligation or
subordinating, modifying or otherwise dealing with the Iien or charge hereof; (c) exercise or refrain from
exercising or waive any right Trustee or Beneficiary may have; (d) accept additional security of any kind; (e)
release or otherwise deal with any property, real or personal, securing the indebtedness, including all or any
part of the property herein described without affecting the lien priority of this deed of trust on the remainder
of the property, for the full amount of any indebtedness unpaid.
Nineteenth: THE DEBT SECURED HEREBY IS SUBJECT TO CALL UPON DEFAULT AND/OR
SUBJECT TO THE TERMS THEREOF BEING MODIFIED IN THE EVENT OF SALE OR
CONVEYANCE OF THE PROPERTY.

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Commission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign or signs provided by the Zoning Administrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Boaxd of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Adininistrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the tune of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Adininistrator or an authorized agent of either,
to remove ox tamper with any sign furnished during the period it is required to be maintained under this Secrion. All
signs erected under this Section shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.

Kathy,
I looked at the existing entrance to Mr. Burdette's property and met with him this morning. This entrance would not qualify
for a regular commercial entrance because it does not meet the sight distance requirements. However, after talking with
Mr. Burdette and finding out more about his intentions, his proposed use will qualify as a low volume commercial entrance,
which has less stringent requirements.
As I discussed with Mr. Burdette, if in the future, the use changes so that the traffic volumes go beyond the limits of a low
volume commercial entrance (50 vehicles per day), then the entrance will have to be relocated to a location with better
sight distance.

such land abuts a public road and shall be so placed as to be clearly visible fxom the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be exected in the same manner as above for each such abutting road. If no public road abuts
theYeon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the pxoperty
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Boaxd of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Administrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the heaxings to prove by affidavit that he has fully complied with
the requirements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Adininistrator or an authorized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Secrion. All
signs erected under this Secrion shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was exected.

WHEREAS, your Petitioners, Ronnie M. Hollev and Linda C. Holley, respectfully file this petition
pursuant to Sections 35-806 and 35-807 of the Pittsylvania County Zoning Ordinance and in
accordance with the Code of Vir�inia, 1950, as amended, and would respectfully show the following:
(1) The Petitioners are the owners of the above-referenced parcel of land, or are filing with

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Coinmission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign or signs provided by the Zoning Adiniiustrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be cleaYly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same mannex as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be eYected, at least fourteen (14) days pYeceding such hearing, a sign or signs provided by the Zoning
Adininistrator indicating the date, time and place of the public hearing. Such sign or signs shall be eYected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the time of the
heaYing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Administxator or an authorized agent of either,
to remove or tamper with any sign fuznished during the pexiod it is required to be maintained undex this Secrion. All
signs eYected undex this Section shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Coinmission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign or signs provided by the Zoning Adininistrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Admiiiistratox indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requixements of this secrion and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Admuiistrator or an authorized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Secrion. All
signs erected under this Secrion shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Orclinance. I
understand it is my responsibility to post, maintain and remove this/these sign or signs, according to Secrion 35-817,
Section 35-818, and 35-819. If this sign is removed or destroyed, I understand it is my responsibility to obtain
