General District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at

Ms. Mease, and by a 6 to 0 vote (two members were absent), the revised minutes of the July 2, 2013, meeting
were approved as pYesented.

Case 1, Horace B. Dykes, R-13-048 — Mr. Stowe opened the public hearing at 7:03 p.m. Mr. Shelton, Director
of Code Compliance, reported that HoYace Dykes had petitioned to xezone 8.85 acres, located on Highway
40/W. Grema Road, in the Callands-Gretna Election District from R-1, Residenrial Suburban Subdivision
District to A-1, Agricultural District for agricultural use (hoYSes). Horace Dykes was present to Yepresent the
perition. He stated he had nothing to add except he felt that he had lost a sale for his propexty because the
prospecrive buyer could not have a horse. There was no opposition to the perition. Mr. Stowe closed the public
hearing at 7:05 p.m. During the discussion, it was stated the parcel of land is adjacent to agricultural properries
and there was no opposirion to the petition. A motion was made by Ms. Mease, seconded by Mx. Modey, to
recommend the Boaxd of Supervisors rezone the property from R-1, Residential SubuYban Subdivision District
to A-1, Agricultural District. Morion passed by a 6 to 0 vote (two members were absent).
Case 2, Spencer W. Walker & Angela W. Walker, R-13-049 — Mr. Stowe opened the public hearing at 7:07
p.m. Mr. Shelton, Director of Code Compliance, reported that Spencex and Angela Walker had peririoned to
rezone 8.510 acres (part of 13.09 acres), located on State Road 1800/Wyatt Drive, in the Westover Election
District from B-2, Business District, General to R-1, Residential Suburban Subdivision District to allow for
construcrion of a single family dwelling for their son. Spencer Walker was present to represent the petition. He
stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at
7:08 p.m. During the discussion, it was stated that Mr. Weatherford had called MY. Motley and said there was no
opposirion to the petition. A motion was made by Mx. Motley, seconded by Dr. Miller, to recommend the
Board of Supervisors zezone the property from B-2, Business District, General to R-1, Residenrial Suburban
Subdivision District. Motion passed by a 6 to 0 vote (two members were absent).
Case 3, Herman Eugene Crane, Life Tenant, Jean Crane Wilson, Remainderman, Herman Eugene
Crane, �, Remainderman, Kenneth Ray Crane, Remainderman, Claude David Crane, Remainderman,
R-13-050 — Mr. Stowe opened the public hearing at 7:09 p.m. Mr. Shelton, Director of Code Compliance,
reported that Herman Eugene Crane and Others had petitioned to rezone 11.20 acres, located off State Road
744/Crane Road, in the Chatham-Blairs Election District from R-1, Residenrial Suburban Subdivision District to
A-1, Agricultural District to allow for placement of a 1979 single-wide mobile home on the properry for Mr.
Crane's residence. Raymond Crane was present to represent the petition. He stated he had nothing to add.
James W. Hutcherson spoke in opposirion to the perition. His main concern was that this property would be
turned into a mobile home court since one single-wide mobile home was alYeady located on the property. Mx.
Stowe then stated the property would not be turned into a mobile home court. MY. Stowe closed the public
hearing at 7:12 p.m. During the discussion, it was stated the propexty is surrounded by A-1, Agricultural District
zoned properries and the mobile home will be located behind a storage building and cannot be seen from the
road. A morion was made by Mr. Motley, seconded by Mx. Arthur, to recommend the Board of Supervisors
rezone the property from R-1, Residential Subuxban Subdivision District to A-1, Agricultural District. Morion
passed by a 6 to 0 vote (two members were absent).
Case 4, Robert T. Marshall, Sr., Et Als, Robert T. Marshall, Jr., Et Als, Phvllis S. Marshall, Et Als, R-13-
051- Mr. Stowe called the public hearing at 7:14 p.m. Mr. Shelton, Director of Code Compliance, reported that
Robert T. Maxshall, Sr., and Others had petitioned to rezone 13.60 acxes, located on U.S. Highway 58
West/Martinsville Highway, in the Tunstall Election District fxom R-1, Residenrial Suburban Subdivision
District to RMF, Residential Multi-Family District fox a twelve (12) unit apartment building. Phyllis Marshall
was present to represent the perition. She stated she had nothing to add. Following questions from the Board
members, Ms. Marshall stated the Site Development Plan submitted with this rezoning application was the same
site plan submitted with a previous rezoning case (Case R-13-039) due to the high fee charged by the surveyor.
She also stated should the rezoning be approved, a new site plan would be provided. She stated no Highway

Entrance Permit had been submitted yet, and this was also pending appYOVal of the rezoning case by the Board
of Supervisors. She stated stoYm water management would be the same as pxesented with a previous rezoning
case for apartxnents located on Highway 41 (Case R-13-039). In addition, Ms. Maxshall stated a fence could be
erected, a playground could be built at the site, and an off-site easement on Whispering Pines Road could be
pYOVided. A letter in opposition to the petition written by an adjacent paYcel owner was presented to the Board
members. Mr. Stowe closed the public hearing at 7:22 p.m. During the discussion, it was stated the Board's
Yecommendation was due to a Site Development Plan and a Highway Entrance PeYmit from VDOT not being
submitted with the applicarion for rezoning. A morion was made by Mx. Motley (on behalf of Mr. Stowe),
seconded by Mr. Arthur, to recommend the Board of SupervisoYS deny this rezoning request. Motion passed by
a 6 to 0 vote (two members were absent).
This concludes the Rezoning cases.
OLD BUSINESS
There was no old business.
NEW BUSINESS
A site plan review for a proposed telecommunicarions tower to be located at 244 Oakland Road, Danville,
Virginia, was presented to the BoaYd members for their appYOVal. Mr. Shelton stated a cell tower is a permitted
use in propexty zoned M-1, Industtial District, Light Industry, and if the Board had no questions and the site
plan was approved as pYesented, then a building permit would be issued. A morion was made by Mr. Motley,
seconded by Ms. Mease, that the site plan be approved and accepted. Motion passed by a 6 to 0 vote (two
members were absent).
MY. Sides and Mr. Shelton then briefed the Planning Commission members on a special cominittee to be
appointed to look at agricultuYal setbacks. The coininittee will consist of Greg Sides, Odie Shelton, Vaden Hunt,
Fred Wydner, three (3) Planning Cominission members, three (3) Board of Zoning Appeals member, and two (2)
developers.

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the comprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the
board regarding zoning cases will be limited to (3) three minutes.

WHEREAS, your Petitioner, Timber Creek Properties, LLC, respectfully files
this petition pursuant to Sections 35-806 and 35-807 of the Pittsylvania County Zoning
Ordinance and in accordance with the Code of Vir�inia, 1950, as amended, and would
respectfully show the following:
(1) The Petitioner is the owner of the above-referenced parcels of land,
or is filing with the owner's consent.
(2) The properties are presently zoned under the provisions of the Pittsylvania
County Zoning Ordinance as R-1, Residential Suburban Subdivision District
and A-1, Agricultural District.
(3) Your petitioner now desires to have the R-1, Residential Suburban Subdivision
District portion of 44.09 acres (approximately 2.45 acres) rezoned to A-1,
Agricultural District and 0.75 acre rezoned from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District to make the zoning consistent
with the adjacent parcels of land zoned A-1 .
WHEREFORE, your Petitioner respectfully requests that the Zoning Ordinance of
Pittsylvania County be amended and that the above-referenced parcels of land be rezoned
as set out in Number 3.
FURTHER, your Petitioner respectfully requests that this petition be referred by the

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding.the Cominission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign or signs provided by the Zoning Administrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thexeon, then signs shall be erected in the same manner as above on at least two (2) boundaYies of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Administrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same mannex as prescribed in Secrion 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this secrion shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this section and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful foY any person, except the applicant or the Zoning Administrator or an authorized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Section. All
signs erected undex this Section shall be removed by the applicant with fourteen (14) days following the public
heaYing for which it was erected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Ordinance. I
understand it is my responsibility to post, maintain and remove this/these sign or signs, according to Secrion 35-817,
Section 35-818, and 35-819. If this sign is Yemoved or destroyed, I understand it is my responsibility to obtain
another sign from the Zoning office, post the property and maintain the sign(s), according to the above Secrions of
the Pittsylvania County Zoning Oxdinance.

Joyce B. Wilson petitioned the Planning Commission/Board of Supervisors on August 29, 2013, to xezone from

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Cominission's public hearing on a zoning map amendment, there shall be
erected on the property proposed to be rezoned, a sign oY signs pYOVided by the Zoning AdministratoY indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the pxoperty
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled befoxe the Boaxd of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Administrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this secrion shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to pxove by affidavit that he has fully complied with
the requirements of this section and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Adininistrator or an authorized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Secrion. All
signs erected under this Section shall be removed by the applicant with fourteen (14) days following the public
hearing fox which it was eYected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Ordinance. I
understand it is my responsibility to post, maintain and remove this/these sign or signs, according to Secrion 35-817,
Section 35-818, and 35-819. If this sign is removed or destroyed, I understand it is my responsibility to obtain

Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Coininission's public hearing on a zoning map amendment, theYe shall be
erected on the property proposed to be rezoned, a sign or signs provided by the Zoning Administrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the xoad with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If moxe than one (1) such road abuts the property,
then a sign shall be erected in the same mannex as above for each such abutting road. If no public road abuts
trhereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the propexty
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors fox a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs provided by the Zoning
Adininistrator indicating the date, time and place of the public hearing. Such sign ox signs shall be erected in the
same manner as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this secrion shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this section and has continuously maintained the sign ox signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant or the Zoning Adiniiust�ator or an authorized agent of either,
to remove or tamper with any sign furnished duYing the period it is required to be maintained under this Section. All
signs erected under this Section shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Ordinance. I
understand it is my Yesponsibility to post, maintain and remove this/these sign or signs, accoxding to Secrion 35-817,
Secrion 35-818, and 35-819. If this sign is removed or destroyed, I understand it is my responsibiliry to obtain

WHEREAS, your Petitioner, Larry Thomas Burnett, Jr., respectfully files this petition
pursuant to Sections 35-806 and 35-807 of the Pittsylvania County Zoning Ordinance and
in accordance with the Code of Virginia, 1950, as amended, and would respectfully show
the following:
(1) The Petitioner is the owner of the above-referenced parcel of land, or
is filing with the owner's consent.
(2) The property is presently zoned under the provisions of the Pittsylvania
County Zoning Ordinance as R-1, Residential Suburban Subdivision
District.
(3) Your petitioner now desires to have the property rezoned to A-1,
Agricultural District to make the zonin� consistent with the adjacent parcel
of land zoned A-1.
WHEREFORE, your Petitioner respectfully requests that the Zoning Ordinance of
Pittsylvania County be amended and that the above-referenced parcel of land be rezoned
as set out in Number 3.
FURTHER, your Petitioner respectfully requests that this petition be referred by the
Zoning Administrator to the Pittsylvania County Planning Commission for its
consideration and recommendation.

SIGN AFFIDAVIT
Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Commission's public hearing on a zoning map amendment, there shall be
erected on the property pYOposed to be rezoned, a sign or signs provided by the Zoning Adininistrator indicating the
date, time, and place of the public hearing. The sign shall be eYected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the road with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting road. If no public road abuts
thereon, then signs shall be erected in the same manner as above on at least two (2) boundaries of the pxoperty
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days prececling such hearing, a sign or signs provided by the Zoning
Administxator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Secrion 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this secrion shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied with
the requirements of this section and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any person, except the applicant ox the Zoning Administrator or an authorized agent of either,
to remove or tamper with any sign furnished during the period it is required to be maintained under this Section. All
signs erected under this Section shall be removed by the applicant with fourteen (14) days following the public
hearing for which it was erected.
I have read and understand Sections 35-817, 35-818, and 35-819 of the Pittsylvania County Zoning Ordinance. I
understand it is my responsibiliry to post, maintain and remove this/these sign or signs, according to Secrion 35-817,
Section 35-818, and 35-819. If this sign is removed or destroyed, I understand it is my responsibility to obtain
another sign from the Zoning office, post the propexty and maintain the sign(s), according to the above Sections of
the Pittsylvania County Zoning Ordinance.

SIGN AFFIDAVIT
Sec. 35-817. POSTING OF PROPERTY - PLANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Commission's public hearing on a zoning map amendment, there shall be
erected on the pYOperty proposed to be rezoned, a sign or signs provided by the Zoning Administrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible from the Yoad with the bottom of the sign
not less than two and one-half (2 1/2) feet above the ground. If more than one (1) such road abuts the property,
then a sign shall be erected in the same manner as above for each such abutting xoad. If no public road abuts
thereon, then signs shall be exected in the same manner as above on at least two (2) boundaries of the property
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Board of Supervisors for a Zoning Map amendment, thexe
shall be erected, at least fourteen (14) days preceding such hearing, a sign ox signs provided by the Zoning
Administratox indicating the date, time and place of the public hearing. Such sign or signs shall be eYected in the
same mannex as prescribed in Section 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign eYected in compliance with this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the duty of the applicant at the hearings to pxove by affidavit that he has fully complied with
the requirements of this section and has continuously maintained the sign or signs up to the time of the hearing. It
shall be unlawful for any pexson, except the applicant oY the Zoning Adnvnistrator or an authoxized agent of either,
to remove ox tamper with any sign furnished during the period it is required to be maintained under this Section. All
signs erected under this Section shall be removed by the applicant with fouYteen (14) days following the public
hearing for which it was erected.
