Mr. Motley, Chairman, called the meeting to order at approxirnately 7:00 p.m. Mr. Motley called the roll. Arthur, seconded by Mr. Welborn, and by unanimous vote the July 2, 2013, minutes were appYOVed as presented. CHAIRMAN'S REPORT There was no Chairman's Repoxt. THE ZONING PRECEPTS WERE READ by Mr. Motley TO OPEN THE PUBLIC HEARING at approxirriately 7:01 p.m. Planning Coininission August 8, 2013 Page 2 Case 1, Marion Baptist Church & Parsonage, R-13-044 — Mr. Motley opened the public hearing at 7:01 p.m. Mrs. Hayes, Code Compliance Officer/Deputy Zoning Adininistrator, xeported that Marion Baptist Church & Parsonage had petirioned to xezone a total of 2.874 acres, two (2) parcels of land, located on State Road 605/ Marion Road, in the Callands-Gretna Election District from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to combine with the adjacent parcels of land zoned A-1. Attorney Seth Elmore was present to represent the petition. He stated the petirioner had recendy acquired sevexal parcels of land and desired to rezone all the paxcels to A-1, Agricultural District, for construction of a new church sanctuary. There was no opposition to the perition. Mr. Motley closed the public hearing at 7:04 p.m. During the discussion, it was stated the parcels of land are surrounded by agricultural properries. A morion was made by Ms. Mease, seconded by Mx. WeatheYford, to xecommend the Board of Supervisors rezone the properties from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Morion passed unanimously. Case 2, TeresaJ. Burnette, R-13-045 — Mr. Modey opened the public hearing at 7:05 p.m. Mrs. Hayes, Code Compliance Officer/Deputy Zoning Administrator, Yeported that Teresa Burnette had petitioned to rezone 0.37 acre, located on State Road 1009/Bennett Street, in the Westover Elecrion District from B-2, Business District, General to R-1, Residential Suburban Subdivision DistYict for her personal residence. Teresa Burnette was present to represent the petition. She stated she had nothing to add. Following questions from a Board member, Ms. BuYnette stated she had resided in her home since 1982. She also stated the structuYe was occupied as a commercial business (store) before it was remodeled into a residence. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:07 p.m. A motion was made by MY. Weatherford, seconded by Mr. Arth�, to recommend the Board of Supervisors xezone the property from B-2, Business Disttict, GeneYal to R-1, Residential SubuYban Subdivision District. Morion passed unanunously. Case 3, Calvin E. Williams & Leonie Williams, R-13-046 — Mr. Modey opened the public heaYing at 7:07 p.m. Mrs. Hayes, Code Compliance Officer/Deputy Zoning Adinuiistrator, reported that Calvin and Leonie Williams had peririoned to rezone 5.83 acres, located on State Road 622/West Fork Road, in the Tunstall Elecrion District from RC-1, Residential Combined Subdivision District to A-1, Agricultural District to subdivide the paxcel for family members. Russell Nison with N�on Land Surveying was present to repxesent the petition. He stated the property is zoned RC-1, Residential Combined Subdivision District, and had been owned by the family since the 1800's. He also stated the family desired to rezone to allow for family subdivision. Following quesrions fxom a Boaxd member, Mr. Nixon stated there was one single-wide mobile home on the property that would be replaced with a modular home or a double-wide mobile home. He also stated there are other mobile homes on the property; howevex, he did not know if any of the mobile homes were abandoned. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:11 p.m. During the discussion, it was stated this would be an improvement to the pYOperty. A motion was made by Dr. MilleY, seconded by MY. Hagerman, to recommend the Board of Supervisors rezone the property fYOm RC-1, Residential Combined Subdivision District to A-1, AgricultuYal District. Motion passed unanimously. Case 4, Leonard A. Murray & Janet E Murphv, R-13-047 — Mr. Modey opened the public hearing at 7:12 p.m. Mrs. Hayes, Code Compliance Officer/Deputy Zoning Adtnuiistrator, reported that Leonard A. Murray and Janet E. Murphy had petitioned to rezone 0.49 acre, located on Munsons Road, in the Callands-Gretna Election District fYOm MHP, Residenrial Manufactured Housing Park District to A-1, Agricultural District to make the zoning consistent with the adjacent parcel of land zoned A-1. Leonard MurYay was present to Yepresent the peririon. He stated the properties on each side of his parcel aYe zoned A-1, Agricultural District. There was no opposition to the petition. Mr. Motley closed the public hearing at 7:13 p.m. DuYing the discussion, it was stated there are three (3) parcels of land in the area that have been rezoned from MHP, Residential Manufactured Housing Park District to A-1, Agricultural District. A motion was made by Ms. Planning Coinmission August 8, 2013 Page 3 Mease, seconded by Mr. Hagerman, to recommend the Board of Supervisors rezone the property from MHP, Residential Manufactured Housing Park District to A-1, Agricultural DistYict. Motion passed unanimously. This concludes the Rezoning cases. Case S-1, Charles B. Davis, Jr., & Sandra M. Davis, S-13-010 — Mr. Motley opened the public heaxing at 7:15 p.m. Mrs. Hayes, Code Compliance Officer/Deputy Zoning Administrator, reported that Charles and Sandxa Davis had peritioned for a Special Use Permit on 1.50 acre, located on State Road 878/Pine Lake Road, in the Westover Election District for a public garage. Charles Davis, Jr., was present to represent the petirion. He stated he wanted to add on to his e�sting 50 x 40 shop. Following questions from several Board members, Mr. Davis stated his business staxted as a hobby and is now an ongoing business. He also stated there are no wrecked automobiles on the property, he schedules five (5) to siY (6) cars weekly, and the automobiles that are a total loss are parked behind his shop and are not visible from the highway. Harold Harris spoke in opposirion to the petition. Mr. Harris stated he owns two (2) parcels of land across the highway that he wants to sell; however, he is concerned the property will not sell if there is a commercial garage located across the highway. He also stated there were restricrions on the properties when they were puYChased that only allow one (1) dwelling per parcel of land. Mx. Davis offered a rebuttal and stated the area is clean and neat; he takes pride in his properry; he has a retauzing wall; and he will have a paxking aYea behind the new shop. He also stated there will be no wrecked automobiles on the premises. Mr. Modey closed the public hearing at 7:22 p.m. DuYing the discussion, it was stated this is a well-kept aYea and is fine for a hobby, but not foY a commercial business. A motion was made by Mr. WeatherfoYd to recommend the Board of Zoning Appeals deny this Special Use Permit. The morion failed for lack of a second motion. A motion was then made by Mr. Welborn, seconded by Dr. Miller, to recommend the Board of Zoning Appeals grant this Special Use Permit. Mx. Motley, Ms. Mease, Dx. Miller, Mr. Arthur, Mr. Welborn and Mr. Hagerman voted in favor of the morion; Mr. Weatherford voted in opposirion to the morion. Morion was passed by a 6 to 1 vote. Case S-2, Cliserio Rojas & Brenda E. Rojas, S-13-011— Mr. Motley opened the public hearing at 7:25 p.m. Mrs. Hayes, Code Compliance Officer/Deputy Zoning Administratox, reported that Cliserio and Brenda Rojas had petirioned for a Special Use Permit on 0.58 acre, located on State Road 740/Iris Lane, in the Westover Elecrion District for placement of a single-wide mobile home for their personal residence. Bxenda Rojas was present to represent the perition. She stated she had nothing to add. There was no opposirion to the petirion. Mr. Modey closed the public hearing at 7:26 p.m. A morion was made by NIY. Weatherford, seconded by Mr. Arthur, to recommend the Board of Zoning Appeals grant this Special Use Pexmit. Motion passed unanimously. This concludes the Special Use Permit cases. OLD BUSINESS There was no old business. NEW BUSINESS There was no new business.
