07/09/2013PITTSYLVANIA COUNTY BOARD OF ZONING APPEALS REGULAR MEETING July 9, 2013 MINUTES VIRGINIA: The Pittsylvania County Board of Zoning Appeals met on Tuesday, July 9, 2013, in the General District Couxtroom, Edwin R. Shields Courthouse Addition, Chatham, Virginia. Mr. Talbott called the meeting to order at appro�znately 7:00 p.m. The Board observed a few moments of silence. Mr. Shelton called the roll. PRESENT Kenneth Talbott Larry Estes Helen Glass H. Blair Reynolds R. Allan Easley Ronald Merricks Carroll Yeaman Odie H. Shelton, Jr. APPROVAL OF THE MINUTES By motion of Mr. Merricks, seconded by Mr. Yeaman, and by unanimous vote the Minutes of the May 14, 2013, meeting were approved as presented. Old Business There was no old business. New Business Mr. Shelton reported on the cases for the August 2013 rycle. CHAIRMAN'S REPORT There was no Chairman's report. The Board briefly discussed issues regarding an upcoming Appeal Case to be heard by the Board in September 2013. The Chairnzan recommended that the Board members review the Zoning Ordinance prior to the meeting. Mr. Talbott stated the Zoning Ordinance was on line. He further stated if the use under appeal was a permitted use in the Ordinance the decision of the Zoning Administtator would be overturned and if the use was not a permitted use in the Ordinance the decision of the Zoning Adininistrator would be upheld. THE ZONING PRECEPTS WERE READ By Mr. Talbott to OPEN THE PUBLIC HEARING at approscimately 7:02 p.m. Case S-1, Mecklenburg Electric Coo�erarive S-13 008 — Mr. Talbott opened the public hearing at approxunately 7:03 pm. Mr. Shelton, Director of Code Compliance/Zoning Adinirustrator, reported Mecklenburg Electric Cooperative had peririoned for a Special Use Permit on a tota] of 1.27 acres (per plat), three parcels of land, located on State Road 606/Edmunds Road and State Road 640/Renan Road, in the Staunton River Election District, for a new electrical power substation. Mr. Shelton further reported the Planning Comnussion, with no opposirion, recommended granting the peritioner's request. Brian Woods, with Mecklenburg Electric Cooperative, was present to represent the petition. Mr. Woods stated he was present to answer any questions. He further stated that the station L Board of Zoning Appeals Page 2 July 9, 2013 was being replaced due to the age of the station and for reliability of the system. There was no opposirion to the petirion. Mr. Talbott closed the public hearing at approximately 7:05 p.m. The Board discussed the peririon as the Committee of the Whole and determu�ed there were no adverse effects. Upon motion of Mr. Reynolds, seconded by Ms. Glass, the following motion was adopted: Whereas, Mecklenburg Electric Cooperative has petirioned the Board of Zoning Appeals for a Special Use Pemut for a new substation and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby and such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be gtanted. Motion passed unanimous. Case S-2. David and Ruthanne Millet, S-13-009 — Mr. Talbott opened the public hearing at approxirnately 7:06 p.m Mr. Shelton, Director of Code Compliance/Zoning Adininistrator, reported David and Ruthanne Miller had petitioned for a Special Use Permit on 20.56 acres (part of 42.45 acres), located on U. S. Highway 57/Callands Road, in the Banister Elecrion District, for a general store. Mr. Shelton further reported the Planning Commission, with no opposition, recommended granting the petirioners' request. Molly Holmes was present to represent the peurion. Ms. Holmes stated she would be glad to answer any questions. Ms. Holmes further stated the store would be located west of the Oak Grove Lodge and items that would sold in the store. She further stated this would be an Amish store. There was no opposition to the peririon. Mr. Talbott closed the public hearing at approxixnately 7:08 p.m. The Board discussed the petirion as the Committee of the Whole and deterinined there were no adverse effects. Upon morion of Mr. Easley, seconded by Mr. Estes, the following motion was adopted: Whereas, David Ray Miller and Ruthanne Miller have petitioned the Board of Zoning Appeals, for a Special Use Permit for a general store and, Whereas, we find no substantial detriment to adjacent property, that the character of the zoning district will not be changed thereby and such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be granted.
