Director of Code Compliance, xeported that .�nthony Dawson Puccio had petitioned to rezone a total of 17.67
acxes, six (6) paxcels of land, located on State Road 640/Sprin�r Gaxden Road and State Road 825/Chesmut
Level Lane, in the Dan River F,lection Distxict fxom R-1, Residenual SubuTban Subdivision District to A-1,
tlgricultuxal llistrict foc agricultuxal use - liaestock. Anthony Puccio was present to represent the pedtion. He
stated he had nothing to add. Mark Adams, Kathryn Watlington, Laxry Brumfield and Baxbaxa iarman spoke in
opposition ro the pericion. Their concerns included, but werc not limited to, the following: smell, noise, desire
to maintain the value of their pxopexties and a desire to keep their pxoperues zoned R-1 for xesidenrial puxposes
only. Mr. Puccio offexed a rebuttal and stated he only wanted a couple of cattle to help keep the paxcels clean
and maintain his properties. Mx. Stowe dosed the public heaxing at 7:13 p.m. A motion was made by Mx.
Welborn, seconded by Mr. Arthux, to recommend the Board of Supervisors deny this xezoning case. Motion
passed unanimously.
Case 2. William T. Willis,Jr., R-13-035 — b1T. Stowe opened the puUlic hearing at 7:14 p.m. �'�Ir. Shelton,
Directox of Code Compliance, repoxted that William Willis had perinoned to rezone OJ85 acre, located on
Highway 47 /I'ranklin Tuxnpike, in the Tunstall Elecrion Distxict from A-1, Agricultural District ro M-2,
Industrial District, Heavy Indusuy fox a distillery. Mr. Shelton also stated that a suroey plat showing the
pxoposed site and paxking was located in the Boaxd Packet fox xeview. William Willis was pTesent to represent
the petinon. He staced he had nothing to add. Nancy Lawson spokc in opposidon to thc petition. Hex
concerns included, but were not limited tq the following: Hca�y tTaffic, lights, noise, a change in the traffic
pattem and a xeducdon in the value of heT propexry. Mx. Willis offexed a rebuttal and stated thexe would be

Mr. Shanks stated he did not undexstand why the sign was placed at the site and the next day it had been
removed. He also stated a Stoxm Water Managcment Plan 2 would be used fox this site, the small structuxe
located behind the existing house would be demolished, and the eusdng house �vould be surveyed off as a
sepaxate parcel and would remain on the propexty. �irs. ;�larshall pxesented a color photogxaph and a site plan

built on a concrete slab and have no cxawl space, which climinates the need for steps. She also stated each

noise, concerns that property values will be reduced, conccrns regaxding laxge amounts of warex flowing into
their backyaxds and sinkholes in theu backyaxds. 1�4r. Stephen I3ass, Attoxney� at Law, stated he xepresented
Calcin and 7.ada Oakes, whose zequest to rezonc 5.33 acres from R-1 to S-2 was denied in 2012 and is waiting
for the case to be heard in Cixcuit Court He suggested this casc be tabled fox C�cuit Coust to handle. Mx.
Shanks offexed a rebuttal and stated the stoxm water does not dxain well and the new plan will dectease the
runoff more. He also stated the enteance could be moved to allow for a sIlent gxeen buffex to provide a shield
fox the neighboxs, and cegarding the setbacks, the driveway could be shiked more. In addition, he stated the
R1�1F zoning distxict would be less dense than a commercial zoning district. Mr. Stowe closed the public hearing
at 8:07 p.m. During the discussion, it was stated thexe axe many unanswexed quesrions regarding this site and

Shaneaka Dlintex Dodson was present to xepxesent the petidon. She stated she had nothing to add. Following
quesrions fxom a Board mcmber, the petiuonex stated she had obtained a building permit (inclucling electric

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the comprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the
board regarding zoning cases will be limited to (3) three minutes.
PUBLIC HEARING PROCEDURE
A. Prior to opening Hearing, Chairman reviews zoning law precepts for all present.
B. Open Hearing by Chairman.

all that certain tract or parcel of land, together with the improvement thereon and

Survey for Angela Kay Becker, dated August 12, 1997, by
Lawrence W. Cockram, C.L.S., which plat is recorded in the

BEING the same property conveyed unto Frank T. Heffmger and
Theresa J. Heffinger, husband and wife, from Angela Kay
Becker, unmarried, by deed dated June 1, 1999, and recorded in
the aforesaid Clerk's Office in Deed Book 1160 at Page 309.
There is also conveyed, assigned and set over ali right, title and
interest in and to a mobile home situated on said property, but
without warranty as to title or condition.
There is also conveyed herewith, without warranty, all rights of
the G?'anto: herein with reaard to the property and property
rights lying to the east of tl�e 795 contour line and the waters of
Smith Mountain Lake.
Subject to all easements, encroachments, restrictive covenants
and conditions, including, but not limited to, those shown on the
aforesaid plat and subject to all flowage easements by and
between previous owners, Appalachian Power Company and its
successors in title and interest as they affect the rise and fal] of
Smith Mountain Lake and the use of the waterfront and adjacent
properties.
There is also conveyed herewith insofar as it is wittun the power
of the Grantor to convey; a right in common with others for
ingress and egress along the existing access road from the
property herein conveyed to State Route 978 and in a northerly
direction to the northem terminus of the existing access road.
THIS CONVEYANCE is made together with and expressly subject to any
easements, restrictions, reservations, rights of ways, or conditions which may be of
record ar apparent upon an inspection of the premises.
