Board of Zoning Appeals have been empowered to hear and decide specific applications
and appeals in support of said ordinance. In accomplishing this important task we are
charged with promoting the health, safety, and general welfare of the citizens of
Pittsylvania County. We must insure that all our decisions and recommendations be
directed to these goals and that each be consistent with the environment, the
comprehensive plan and in the best interest of Pittsylvania County, iYs citizens and its
posterity. Anyone here to speak to the board regarding zoning cases will be limited to (3)
three minutes.

requesting a Special Use Permit on a total of 1.27 acre (per plat), three (3) paroels of land, shown on the Pittsylvania
County Tax Maps as GP1N #s 2580-03-6347, 2580-03-5247 and 2580-03-6505/63A-2-4, located on State Road 606/

this petition pursuant to Sections 35-713 of the Pittsylvania County Zoning Ordinance
and in accordance with the Code of Virginia,1950, as amended, and would respectfully

When a public hearing has been scheduled before the Board of Supervisors for a loning Map amendment, there
shall be exected, at leasY fourteen (14) days prececling such hearing, a sign or si�ms provided by tl�e Zoning
Administtator indicating the date, time and place of the public heaxing. Such sign or signs shall be erected in the
same manner as prescxibed in Secdon 35-517 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any si�n erected in compliance �vi[h this section shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the dut}' of the applicant at the heatings ro pxove by affidavit that he has fully� complied with
the xequ�ements of this section and has condnuously maintained the sign or signs up ro the dme of the hearing. It
shall be unlawful fox any person, except the applicant ar the Zoning Adnunistxator or an authorized agent of either,
to remove or tamper with any sign fumished during the pexiod it is required to be maintained under this Secrion. .1ll
signs erected under this Secrion shall be removed by the applicant �vith fourteen (] 4) days following the pnblic
hearing fot which it was exected.

WHEREAS, your Petitioners, David Ray Miller and Ruthanne Miller, respectlully
file this petition pursuant to Sections 35-713 of the Pittsylvania Counry Zoning Ordinance
and in accordance with the Code of Vireinia, 1950, as amended, and would respectPully
show the following:
(1) The Petitioners are the owners of the above-referenced parcel of land, or
are filing with the owmer's consent.

Sec. 35-817. POSTING OF PROPERTY - PI.ANNING COMMISSION HEARING-
At least fourteen (14) days pzeceding the Commission's public hearing on a zoning map amcndment, thexe shall be
exected on the properry pxoposed to be rezoned, a sign or signs provided by the Zoning Adminisrsator indicating t6e
date, rime, and place of the public heaxing. The sign shall be exected within ten (10) feet of whatever boundary line of
such land abuts a public road and shall be so placed as to be clearly visible fxom the road with the bottom of die sign
not ]ess than two and one-half (2 1/2) feet above the gxound. If more than one (1) such xoad abuts the propeTry,
then a sign shall Ue erected in the samc manner as above for each such abutdng road. If no public coad abuts
thexeon, then signs shall be exected in the same mannex as above on at least two (2) boundaries of the pTOperry
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a public heaTing has been scheduled before the Board of Supervisors far a Zoning Map amendmenc, thexe
shall be exected, at least fouxteen (14) days pxeceding such hearing, a sign or signs provided bp the 'Loning

Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign emcted in compliance with this secrion shall be maintained at all times by the applicant up to the time of the
heaxing and it shall be The duty of rhe applicant at the hearings to pxove by affidavit that he has fully complied with
the requicements of this section and has continuously maintained the sign or signs up to the time of the heaxing. It
shall be unlawful for any pexson, except the applicant or the Zoning Adminisuator or an authonzed agent of either,
to remoce or tampeT with anv sign fuxrushed dunng the period it is required to be maintained under this Secdon. All
signs erected under this Secnon shall Ue removed by the applicant with fourteen (14) days following the public
heaxing for which it was erected.

TO THE BOARD OFZONINGAPPEALS OFPITTSYLVANIA COUNTY
WHEREAS, your Petitioners, David Ray Miller and Ruthanne Miller, have filed with
the Secretary to the Zoning Administrator a petition to obtain a Special Use Permit for a general
store.
WHEREAS, the petition was referred to the Planning Commission which, considered
this petition in a public hearing on July 2, 2013; and
WHEREAS, at that public hearing all parties in interest were afforded an opportunity to
be heard; and
WHEREAS, the Planning Commission, afrer due consideration has recommended to the
Pittsylvania County Board of 7oning Appeals that the Special Use Permit be ranted.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission reeommends to
the Pittsylvania County Board of Zoning Appeals that the above-referenced parce] of land be
granted the Special Use Permit.
