Suburban Subdivision llistrict poxtion of 96.01 acres (appxoacimately 10.00 acxes), located off State Road
665/Rockford School Road, in the Staunton River Elecnon Distsict to .1-1, Agricultural District to make the
pazcel one zoning designation. Lynwood Dellis was pxesent to represent the perition. He stated the property
was in land use and he wanted to Tezone to make thc entire parcel A-1, Agxicultural District Ray Axcher spoke
in favor of the petition. He stated the pxoperty has lots of timberland and should be zoned A-1. Attomey
Ulenn Pulle}', �vho represented Doug Dalton of �1b1B Pxopertics, I,LC, spoke in opposition to thc petirion. He
stated the access issue is a disputed issue, especially access to the propexry fcom Music Stxeet He also stated
theTe is no legal access to the 19.50 acre parcel owned by Mx. llellis' �vife, Kisa, and that a 2005 deed eTeated a
50-foot right-of-way to the bordex of the 19.50 acTe tsact but not into the tract of land. Mr. Dellis offered a
rebuttal and stated that priar to closing on the two pxoperdes, l�fidland IR11, Inc., was gxanted a deeded access
from Rockford School Road across the Midland IRA, Inc., propexry to the 19.50 acre txact of land and a deeded
access was gxanted from Music Steeet to the 19.50 acre paxcel of land. He also stated he just wanted to rezone to
make both parcels A-1. Mx. Stowe closed the public hearing at 7:1 S p.m. � mouon was made by l�ir. ��xthur,
seconded by Mr. Welborn, to xecommend the case be continued until all the facts xegaxciing this case are

Case 2. Kisa H. Dellis, R-13-018 — Mx. Stowe opened the public hcaring at 7:17 p.m. 1�1r. Shelton, D�ector of
Code Compliance, xeparred that Kisa Dellis had petidoned to xezone 19.50 acres, located off State Road
6C5/Rockford School Road, in the Staunton Ricex Elecdon District from R-1, Residendal Suburban Subdivision
Disrrict to A-1, Agricultuxal District to make the zorung consistent with the adjacent parcels of land zoned A-1.
Lynwood Dellis was pxesent to xepxesent the petiuon. He stated that pxiar to closing on the puxchase of this
paxcel of land, he was deeded access to this pxopexty fxom Music Stteet. He also stated he had started
construcrion of a cabin on this paxccl and he wanted the zoning to be consistent with the adjacent parcels of
land. Ray Axchex spoke in favor of the peurion. He stated a deeded easement was gcanted to the previous
ownec of the pxoperty and thereby was conveyed to Mxs. Dellis upon puxchase of the pxopexty. Attorney Glenn
Pulley spoke in opposidon to the perition. He stated the pxevious owner of the pxopexty had no xight to convey
the easement to Mxs. Dellis. He then urged the Planning Commission to consider the same action taken with
the previous xezoning case (Casel, Midland IRA, Inc.). Mr. Stowe closed the public heanng at 7:29 p.m. A
modon was made by Mr. Arthur, seconded by b4x. Welbom, to recommend the case be continued unril all the
facts cegaxding this case axe straightened out. Motion passed unanunously.
Case 3, Boyd E. Motley & Carol B. Motley, R-13-019 —:�1x. Stowe opened the public hcaring at 732 p.m.
Mt. Shelton, Dixectox of Code Compliance, reparted that Boyd and Carol Motley had peririoned to rezone 79.81
acxes, located on State Road 802/Hodnetts Mill Road, in the Banistex Election Distcict from M-1, Industxial
District, Light Industry to A-1, Agxicultuxal District for agricultuxal use (farrrung�. Jeff Davis was pxesent to
xepxesent the petition. He stated he was �vorking on the peduoned paxcel for fixmre sale and the pxospective
buyec wanted the paxcel to be xezoned. He also stated the propexry is close to the Agriculmxal Centex and is in

41/Franklin Turnpike, in the Chatham-Blairs Election District from R-1, Residential Subutban Subdivision
District to A-1, Agcicultural Disteict to combine with the adjacent parcel of land zoned i1-1. Ramsey Yeatts was

rype of facming the pedrionexs wexe planrung to do, or if they were planning to caise livestock. Ms. Holmes
msponded to his concexn and stated the petitionexs axe a family with young children and they live on the land.
She also stated they plan to have a small livestock operation and she felt it would be well managed. There was

Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Board of Supervisors or

promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and
that each be consistent with the environment, the wmprehensive plan and in the best
interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the

accurate description, being the identical property conveyed H. V. Pickrel, Sr. and
Doris H. Pickrel (husband and wife) and H. V. Pickrel, Jr. and Ann T. Pickrel
(husband and wife) by deed of Owen B. Hankins and Sue R. Hankins (husband
and wife) March 12, 1973, recorded in the Clerk's Office in Deed Book 641, Page
105. H. V. Pickrel, Jr. and Ann T. Pickrel reconveyed their ownership interest in
the Lot by their deed dated September 29, 1977, recorded in the Clerk's Office
in Deed to Owen B. Hankins and Sue R. Hankins, Deed Book 644, Page 560.
Doris H Pickrel died intestate a resident of Pittsylvania County, Virginia on April
16, 1987, survived by her husband, H. V. Pickrel, Sr. and their children, the
Grantors, as her sole heirs at law and next of kin.
H. V. Pickrel, Sr. died intestate a resident of Pittsylvania County, Virginia
December 11, 1996, survived by the Grantors as his sole heirs at law and
next of kin.
This Deed may be executed in one or more counterparts, each of which will be
deemed an original and all of which together will constitute one and the same document.

such land abuts a puUlic xoad and shall be so placed as to be clearly visible fxom the xoad with the Uottom of the sign
not less than two and one-half (2 1/2) feet above the gxound if more than one (1) such xoad abuts the pxopexty,
then a sign shall be erected in the same manner as above for each such abutting xoad. If no public xoad abuts
thereon, then signs shall be erected in the same mannex as above on at least nuo (2) boundaries of the pxopexty

When a public hearing has been scheduled before the Board of Supervisoxs foc a Zoning Map amendment, there
shall be exected, at least fourreen (14) days preceding such hearing, a sign oc signs provided by the Zoning
Adininistratot indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same mannez as prescribed in Section 35-817 aboce.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this secdon shall be maintained at all tunes by the applicant up to the tune of the
hearing and it shall be the duty of the applicant at the heaxings to pxove by affidavit that he has fully complied with
the requuements of this section and has continuously maintained the sign or signs up to the rime of the heaTing. It
shall be unlawful for any pexson, except the applicant or the Zoning ��dministratox or an authorized agent of either,
to xemove or tamper with any sign furnished duting the period it is xequ�ed to be maintained undex this Secrion. All
signs exected under this Secuon shall be xemoved by the applicant with fouxteen (14) days following the public
hearing far which it was erected.

DISCUSSION:
Fairview Baptist Church is reqoesting a Variance to Section 35-182.Minimum Yard Dimensions.(B.) Side Setback, of the Pittsylvania
County Zoning Ordinance for a total of 26 feet to allow for construction of a new church sanctuary and drive-under canopy. The
petitioner has 454J5 feet of road frontage. Ten percent (] 0°/a) of the road frontage, 454J5 feet, would be 45.48 feet; however, the

We respectfully request a variance of the Side Setback Dimension for the construction of a new
sanctuary on our property identified as GPIN 2458-18-4550. The required and requested setback
dimensions are detailed on a previously submitted drawing. The reasons for this request are outlined
below:
1. The new building is sized to meet the future needs of our growing congregation and has been
sighted on the lot at the best location as determined by the architect. The location allows us to
connect to the existing building while limiting disturbance to our existing parking areas.
2. The building location is at the high point of the lot and works best for drainage considerations
away from the building and for visibility of the new building, which will be aesthetically
pieasing.
3. In determining the location of the building, we needed to account for the location of new and
future parking, a new well and new septic systems. These considerations also directed the
necessary location of the building.
4. The adjacent lot is a large (50 +/- acre), agriculturally zoned tract with the closest structure
being over 600' from our property. This tract does not contain any residential structures.
Considering this, we do not feel the variance would have any substantial impact to adjacent
properties.
