Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Board of Zoning Appeals have been empowered to hear and decide specific applications
and appeals in support of said ordinance. In accomplishing this important task we are
chazged with promoting the health, safety, and general welfare of the citizens of
Pittsylvania County. We must insure that all our decisions and recommendations be
directed to these goals and that each be consistent with the environment, the
comprehensive plan and in the best interest of Pittsylvania County, its citizens and its
posterity. Anyone here to speak to the board regazding zoning cases will be limited to (3)
three minutes.
PUBLIC HEARING PROCEDURE
A. Prior to opening Hearing, Chairman reviews zoning law precepts for all present.

Sec. 35-817. POSTING OF PROPERTY - PI.ANNING COMMISSION HEARING-
At least fourteen (14) days preceding the ComiTUSSion's public hearing on a zoning map amendment, there shall be
exected on the pxopexty pxoposed to be xezoned, a sign ox signs pxovided bj� the Zoning Admuustrator indicating the
date, time, and place of the public hearing. The sign shall be erected within ten (10) feet of whatever boundary line of
such land abuts a public xoad and shall be so placed as to Ue clearly visible from the soad with the bottom of the sign
not less than two and one-half (2 1/2) feet above the �ound if moxe than one (1) such road abuts the property,
then a sign shall be erected in the same manneT as above for each such abutting xoad. If no public road abuts
theseon, then signs shall be erected in the same mannex as above on at least two (2) boundaries of the pxoperty
abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOARD OF SUPERVISORS HEARING-
When a puUlic hearing has been scheduled before the Boaxd of Supenisors fox a Zoning �1ap amendment, thexe
shall be erecrsd, at least fourteen (74) days pxececling such hearing, a sign ox signs pxovided by the Zoning
Administratox indicating the date, time and place of the public hearing. Such sign ox signs shall be eTected in the
same manner as prescribed in Secrion 35-817 abo� e.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance wirh this secdon shall be maintained at all times by the applicant up to the time of the
hearing and it shall be the dury of the applicant at the hearings to pxoce by affidavit that he has fully complied with
the xequirements of this secrion and has continuously maintained the sign ox signs up to the time of the hearing. It
shall be unlawful fox any peTSOn, escept the applicant or the Zoning Adininistxatox ox an authorized agent of eithex,
to xemove ox tampei with any sign furnished during the period it is xequixed to be maintained undex this Secuon. All
signs erected under this Section shall be xemoced by the applicant with fourteen (14) days following the public
hearing fox which it was erected.

Whereas, Marcie A. Cobble has petitioned the Board of Zoning Appeals for a Variance to
Section 35-226. Minimum Yard Dimensions, (B.) Side Setback, of the Pittsylvania County
Zoning Ordinance and,
Whereas, the application does fulfill the minimum requirements for a variance from the
provisions of the ordinance and,
Whereas, the board finds that the strict application of the ordinance would produce undue
hardship, that the hardship is not shared generally by other properties in the same zoning
district and the same vicinity, that the authorization of the variance will not be of substantial
detriment to adjacent property and that the character of the district will not be changed by the
granting of the variance and,
Whereas, the condition or situation of the property concerned is not of so general or
recurring a nature as to make reasonably practicable the formulation of a general regulation
to be adopted as an amendment to the ordinance,

Dear Mr. Shelton:
I am requesting a variance for the above-referenced property in order to add a garage (attached
via a breezeway/pergola) to my residence at Smith Mountain Lake. I purchased the home in the
late 1980's (it was built in the mid-1970's). Since I am now retired, a garage will provide
protection for my vehicles/outdoor equipment and, most importantly, alleviate the problem of
adverse weather conditions.
The lot is considerably sloped from front (roadside) to back (lakeside). Enclosed is a plat
showing the proposed location of the structure along with some photos of the existing well house.
Although a variance is needed, the distance from the sideline of the lot would still exceed 10 feet.
The garage needs to be sited at the proposed spot for the following reasons:
1. Inability to locate the garage on the other side of the house. This is precluded by the
location of the septic system, the existing deck and the slope of the lot.
2. Allows for demolishing and incorporating the existing well house (which is an
eyesore) into the garage. Mr. Ken Vipperman from the Environmental Health
Department confirmed that this was allowed.
3. Conforms to the existing driveway and parking area.
4. Convenience of access to the home's entry.
5. Provides space for a retaining wall and steps down the slope for access to the back
of the house and dock.
6. Maintains enough distance from the windows in the side of the house so as to
maintain some of the views. Placing the garage any closer to the house would
eliminate all views except for the side of the garage.
Thank you for your kind consideration. I believe the addition of a garage will not only enhance
the usability and curb appeal of the home, it will add to neighboring property values.

TO THE BOARD OF ZONING APPEALS OF PITTSYL VANIA COUNTY
WHEREAS, your petitioner, Marcie A. Cobble, has filed with the Secretary to the
Board of Zoning Appeals a petition to obtain a Variance to Section 35-226. Minimum
Yard Dimensions, (B.) Side Setback, of the Pittsylvania County Zoning Ordinance, to
allow for construction of an attached garage.
YYHEREAS, the petition was referred to the Planning Commission which
considered this petition in a public hearing on March 5, 2013; and
WHEREAS, at that public hearing all parties in interest were afforded an
opportunity to be heard: and
WHEREAS, the Planning Commission, afrer due consideration has recommended
to the Pittsylvania County Board of Zoning Appeals that the Variance be r� anted.
NOW, THEREFORE BE IT RESOLVED that the Planning Commission
recommends to the PitYsylvania County Board of Zoning Appeals that the above-
referenced parcel of land be granted a Variance to Section 35-226. Minimum Yard
Dimensions, (B.) Side Setback, of the Pittsylvania County Zoning Ordinance, to allow for
construction of an attached garage.
The above action was adopted on motion of Ms. Mease and upon the following
recorded vote:
