VIRGINIA: The Pittsylvania Counry Boazd of Zoning Appeals met on Tuesday, Decembex 11, 2012, in the General
District Courtsoom, Edwin R. Shields Couxthouse Addirion, Chatham, Virginia. Iv�. Talbott called the meeting to

Novak responded. There was no opposition to the petirion. Iv�. Talbott closed the public hearing at appxoximately
7:09 p.m. The Board discussed the peurion as [he Committee of the �G'hole and determined thexe wexe no adveTSe
effects. During the discussion it was stated this towex could only have a good effect for the area. Upon modon of
Mr. Reymolds, seconded by Mr. Easley, the following motion was adop[ed: Wheteas, Stanley E. and Vickie Murphy
have peririoned the Planning Commission and Boaxd of Zoning Appeals, on Octobex 25, 2012, for a Special Use
Permit for a 194 foot telecommunicadons towex plus ground rod and, Wheieas, we find no substanrial detriment to
adjacent property, that the charactex of the zoning districc will not be changed thexeby, and chat such use urill be in
harmonv wich the purpose and intent of the Ozclinance, I move the Special Use Permit be gxanted. Morion passed
unanunous.
Case S-2,Jack Morgan Mason, Life Tenant, and Others. 5-12-019 — Mr. Talbott opened the public hearing at
appro�mately 7:13 p.m. Ma Hayes, Deputy Zoning Admaiistxatox, reported Jack Morgan Mason, I.ife Tenant, and
Others had petidoned for a Special lise Pemut on 310 acres, located on State Road 764/Azalea Drive, in the
Staunton Rivex Elecuon District foc placement of a single-wide mobile home for the grandson's residence to assist
with the� caxe. Ms. Hayes further xeported the Planning Commission, with no opposirion, recommended granting
the petitionexs' request Carolyn Wyatt and Kevin Bennett were pxesent to xepresent the peddon. Ms. Wyatt stated
both N�. and Mrs. Mason were very eldexly. She stated hec son pxesendy lived in Gretna and came each day to help
urith theu caze. Her son now wanted to xelocate his home next dooc to the gxandparents. It was further stated this
home would be on a sepazate parcel fxom the grandpaxents' home. There was no opposirion to the perition. Mr.
Talbott closed the public hearing at appro�mately 7:15 p.m The Board discussed the pedcion as the Committee of
the Whole and determuied chere wexe no adverse effects. During the discussion it was stated this was a remote area
and thexe were other mobile homes in the area. It was further stated this family was very well thought of in the
community. Upon modon of Iv�. Estes, seconded by Mr. Easley, the following modon was adopted: Whereas, Jack
Morgan Mason, Life Tenant and Erleen Mason, I.ife Tenant have petitioned the Board of Zoning Appeals foz a
Special Use Permit for placement of a single-wide mobile home foc the grandson's residence and, Whereas, we find
no substantial detriment to adjacent property, that the character of the zoning distsict will not be changed thereby,
and tha[ such use will be in harmony with the purpose and intent of the Ordinance, I move the Special Use Permit be

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Boazd of Zoning Appeals have been empowered to heaz and decide specific applications
and appeals in support of said ordinance. In accomplishing this important task we aze
chazged with promoting the health, safety, and general welfare of the citizens of
Pittsylvania County. We must insure that all our decisions and recommendations be
directed to these goals and that each be consistent with the environment, the
comprehensive plan and in the best interest of Pittsylvania County, its citizens and its
posterity. Anyone here to speak to the board regarding zoning cases will be limited to (3)
three minutes.
PUBLIC HEARING PROCEDURE
A. Prior to opening Hearing, Chairman reviews zoning law precepts for all present.
B. Open Hearing by Chairman.

Dwayne L. Johnson and Angela T. Johnson petitioned the Planning Commission/Board of Zoning Appeals on
December 27, 2012, requesting a Special Use Permit on 6.87 acres, shown on the Pittsylvania Counry Tax Maps as
GPIN # 2451-94-9898/141-A-61C, located on State Road 713/Birch Creek Road, in the Dan River Election District.
The applicants would like a Special Use Permit for a recreational facility/public facility, namely a ha�nted trail. There
will be only one haunted trail, with no buildings involved, and this area will have lighting. Parking for this facility
will be provided, and one (1) depuTy will be on the premises during hours of operation. The facility will be covered
by liabi]ity insurance, and the Kentuck Volunteer Fire Department will be on standby during the hours of operation
and will also be providing concessions. An admission fee will be charged. The applicants are aware that the site must
be inspected prior to the opening of the facility.
The faciliry will be operating on Friday and Saturday nights during the month of October prior to Halloween and the
hours of operation will be from 730 p.m. — ll 30 p.m.

As we discussed, � met with Mr. Turner on site to evaluate the proposed haunted trail for a possible commercial entrance
location. His preferred location did not have adequate sight distance. The attached sketch shows a location that we came
up with where a commercial entrance would be possible. Some grading may be necessary in order to achieve the sight
distance necessary (610 ft), but I am confident that this location can be made to work.
This is only to show that an entrance could be located in this area. If Mr. Turner decides to actually build the entrance, he
will need to obtain a VDOT land use permit and abide by all of the associated regulations. Please feel free to contact me if
you have any questions or need any additional information.
