(2) paxcels of land, located on State Road 360/Old Richmond Road and on Sta[e Road 713/Oak Grove Road in the Dan

zoning consistent with the adjacent pucels of land zoned A-1. Edwaxd Dalton was present to repxesent the peddon. He

Case 5, Michael W. Shelton R-13-005 — Mr. Stowe opened the public hearing at 7:12 p.m. Mrs. Hayes, Code
Compliance OfFicer/Deputy Zoning Administ�ator, xepoxted that Michael Shelton had peritioned to rezone 13.24 acres,
located on U.S. Highway 29 Noxth, in the Banister Election District from R-1, Residential Subuxban Subdivision District ro
B-2, Business District, Genexal for futuxe sale of the pxoperty. iVlichael Shel[on was present to xepresent the perition. He
stated he had notFung to add. Robext Jones spoke xegarcling the peddon. His concems included, but were not limited to,
the property being an eyesore with old junk cars, car parts and an old house on the property. He further stated he was not

p.m. During the discussion, Mr. Shelton was questioned as to whether he would be unlling to submit a proffex to upgxade
the pxopextv and clean it up prior to rezoning, and i�Ir. Shelton stated he would be willing to submit a pmffer. A motion
was made by Dr. ivlillex, seconded bv Mx. Harville, to xecommend the Boud of Supexvisors rezone the property fxom R-1,
Residenrial Suburban Subdivision Disaict to B-2, Business District, Genexal with proffer stating the old junk cats and
car parts on the pioperty will be removed and the old house on the property svill be demoGshed and cleaned up.
Morion passed unanunously.

Development Authoriry of Pittsylvania Counry, VA, had peririoned to xezone 2.99 acres, located on State Road 733/Bazker

Light Indusuy for industrial development. Greg Sides was present to represent the peririon. He stated he had nothing to

Mrs. Hayes reported that changes are being made to lighten the copies in the packets, and that tabs will be back on the
packets Eoz the February rycle. Several Boud membexs also had concerns relating to the correct dace for the Planning
Commission meeting to be held in August, 2013. Mrs. Hayes staced this will be checked on to verify the actual date for
the Nadonal Night Out.

Pursuant to Article V, Division 7 of the Pittsylvania County Zoning Ordinance, we the
Planning Commission have been empowered to hear and decide specific applications in
support of said ordinance and to make recommendations to the Boazd of Supervisors or
the Board of Zoning Appeals. In accomplishing this important task, we are charged with
promoting the health, safety, and general welfare of the citizens of Pittsylvania County.
We must insure that all our decisions and recommendations be directed to these goals and

interest of Pittsylvania County, its citizens and its posterity. Anyone here to speak to the

Sec. 35-817. POSTING OF PROPERII' - PI.ANNING COMMISSION HEARING-
At least fourteen (14) days preceding the Couirrrission's public hearing on a zoning map amendment, there shall
be erectcd on the property proposed to be rezoned, a sign or signs provided by the Zoning Adininisuator
indicating the date, time, and place of the public hearitig. The sign shall be erected within ten (10) feet of whatever
boundary line of such land abuts a public road and shall be so placed as to be cleazly visible from the road with
the bottom of the sign not less than two and one-half (2'/Z) feet above the ground. If mom than one (1) such
xoad abuts the property, then a sign shall be erected in the same manner as above for each such abutting road. If
no public toad abuts thereon, then sin�ns shall be etected in the same manner as above on at least two (2)
boundaries oE the property abutting land not owned by the applicant.
Sec. 35-818, POSTING OF PROPERTY - BOt1RD OF SUPERVISORS HEARING-
When a public hearing has been scheduled before the Boazd of Supervisors for a Zoning Map amendment, there
shall be erected, at least fourteen (14) days preceding such hearing, a sign or signs pxovided by the Zoning
Administrator indicating the date, time and place of the public hearing. Such sign or signs shall be erected in the
same manner as prescribed in Secdon 35-817 above.
Sec. 25-819. MAINTENANCE AND REMOVAL OF SIGNS.
Any sign erected in compliance with this section shall be maintained at all times• by the applicant up to the tune of
the hearing and it shall be the duty of the applicant at the hearings to prove by affidavit that he has fully complied
with the requirements of this secrion and has conrinuously maintained the sign ot signs up to the time of the
hearing. It shall be unlawful for any person, except the applicant ot the Zoning Adxninistrator or an authorized
agent of either, to remove ar tamper with any sign furnished during the period it is required to be maintained
under this Section. .�ll signs erected under this Section shall be removed by the applicant with fourteen (74) days
following the public hearing for which it was erected.

December 27, 2012, requesting a Special Use Permit on 6.87 acres, shown on the Pittsylvania County Tax Maps as
GPIN # 2451-94-9898/141-A-61 C, locafed on State Road 713/Birch Creek Road, in the Dan River Election District.
The applicants would like a Special Use Permit for a recreational facility/public facility, namely a haunted trail. There
will be only one haunted trail, with no buildings involved, and this area will have lighting. Parking for this facility
will be provided, and ane (1) deputy will be on the premises during hours of operation. The facility will be covered
by liability insurance, and the Kentuck Volunteer Fire Department will be on standby during the hours of operation
and will also be providing concessions. An admission fee will be charged. The applieants are aware that the site must
be inspected prior to the opening of the facility.
The facility will be operating on Friday and Saturday nights during the month of October prior to Halloween and the
hours of operation will be from 730 p,m. —] 1:30 p.m.

As we discussed, I met with Mr. Turner on site to evaluate the proposed haunted trail for a possible commercial entrence
location. His preferred location did not have adequate sight distance. The attached sketch shows a location that we came
up with where a commercial entrence would be possible. Some grading may be necessary in order to achieve the sight
distance necessary (610 ft), but I am confident that this location can be made to work.
This is only to show that an entrance could be located in this area. If Mr. Turner decides to actually build the entrence, he
will need to obtain a VDOT land use permit and abide by all of the associated regulations. Please feel free to contact me if
you have any questions or need any additional information.
