Representative fox the Chatham-Blairs Distxict, who was in attendance at the meeung.
THE ZONING PRECEPTS WERE READ by� Mx. Stowe TO OPEN THE PUBLIC HEARING at
approximately 7:02 p.m.
Case 1 New Bethel Missionary Baptist Church, R-12-044 — b4r. Stowe opened the public heaxing at 7:02
p.m. :�iT. Shelton, Directox of Code Compliance, reported [hat New Bethel Missionary Baptist Chuxch had
peritioned to rezone 1.01 acxe, located off State Road 640/Wards Road, in the Staunton Rivex Elecuon Distcict
from A-1, Agricultuxal District to R-1, Residenrial Subuxban Subdi�dsion Disttict to combine with the adjacent
parcel of land zoned R-1. Robext Hunt, Jr., was present to represent the petition. He stated he had nothing to

add. There was no opposition to the petition. b4r. Stowe closed the public heaxing at 7:03 p.m. D�ing the
discussion, it was stated this is consistent with the axea. A morion was made by Mr. Axthux, seconded by Mx.
Welborn, to xecommend the Boaxd of Superoisors rezone the propexty from A-1,11gxicultuxal District to R-1,
Residential Suburban Subdivision District Motion passed unanunously.
Case 2,Jacqueline Kirb�, R-12-045 — Mr. Stowe opened the public hearing at 7:04 p.m. Mr. Shelton, Directox
of Code Compliance, repoxted rhat Jacqueline Kixby had petitioned to rezone 0.52 acxe, located on State Road
719/Mount Hexmon Circle, in the Chatham-Blairs Elecaon Distxict from R-1, Residential Suburban Subdivision
Distsict to B-1, Business District, l,imited fox a child day caxe centev Mx. Shelton also xeparted that Ms. Kirby
had submitted a proffex stating the 0.52 acre paTCel of land will not be used for any pernutted uses, listed by
xight, under Section 35-346 that axe not solely related to the child day care centex; that an}� other uses, othex than
stated, will xequ�e a new peuuon with a PuUlic Heaxing and appTOCal by the I3oaxd of Superoisocs; and should
the child da�� care centex ever be dissolved, she will pcution the Board of Superoisors to rezone the pxoperty
back to R-1, Residenual Subuxban Subdivision District. Jacqueline I�by was present to xepxesent the pedtion.
She stated she had nothing to add. Rick rowlex, Verlyn F_mswiler, i�lichael Osborne, Henry Cridex, Eugene
Jackson and Renae Nicholas spoke in opposition to the perition. Some of the� concexns included, but were not
limited to, the desire far the neighboxhood to xemain quiet, the dangex of thc extsa rsaffic on the stceet, the
desire foc the neighborhood to remain a residendal aTea and not have any businesses, a decline in the propexry
valUes, and the covenant which states the neighborhood is to be used exclusively fox single familp xesidences
with attached gaxages or carpoxts. Rick Powlex also presented a petition contauung a total of 74 signatures, all
opposed to the petition, to the Boaxd members fox the� review. A copy of the Covenant was also pxesented to
the Board membexs. Bobby Kirby, husband of Jacqueline I�by, stated he did not understand all the opposition
to this peution and why this would not benefit the children. Jacqueline Kixby offexed a xebuttal and stated thexe
would be a total of ti�ee (3) individuals at her home to supexvise the c6ildxen, it would be a teaching
env�onment, and she was not awaxe of any covenants or xestsictions on her pxopexry. Mx. Stowe closed the
public heazing at 7:52 p.m. Duxing the discussion, it was stated this is spot zoning and the Covenant states the
neighboxhood will be used fox single-family residences only. A motion was made by A4x. Motley, seconded by
Mx. Weathexfoxd, to xecommend the Boacd of Supexvisoxs deny this xezoning xequest. I�totion passed
unanunousl}�.

Case S-1 Kenneth G. Simpson, S-12-017 — Mr. Stowe opened the public hearing at 7:54 p.m. Mx. Shelton,
Dixectoc of Code Compliance, reported that Kenneth Simpson had petidoned for a Special Use Pexmit on 4.50
acxes, located on State Road 665/Rockfoxd School Road, in the Staunton River F.lecdon Distxict for placement
of a single-wide mobile home for his granddaughtex's xesidence. Kenneth Sitnpson was present ro xepxesent the
petition. He stated he had nothing to add, but he had talked to his neighboxs and Yhey had no objecuons. Theze
was no opposition to the pecition. Mr. Stowe dosed the public heaxing at 7:56 p.m. During the discussion, it
was stated thexe axe other single-wide mobile homes up the road &om the petidoned paxcel. .� motion was made
by Mr. Arthux, seconded by Mr. Harvillc, to tecommend the Board of Zoning 1�ppeals gxant this Special li se
Pernut. Morion passed unanimously.

NEW BUSINESS
Mx. Shelton presented a packet to each Board member far their xeview, which contained information regarding
litter contsol, grass ordinances to contsol high gxass, etc., in surrounding coundes. The Boaxd membexs agreed
to review the informarion and discuss at next month's meeting.
