VIRGINIA: The Pittsylvania County Planrung Commission met on Thuxsday, Septembex 6, 2012, in the
Geneial District Couxtxoom, Chatham, Vuginia. Mx. Stowe, Chaimian, called the meenng to oxdex at
appxoxixuately 7:00 pm. Mr. Stowe called the roll.

Case 1, D. L. Becry. R-12-036 — bix. Stowe opened the public hearing at 7:02 p.m. b1x. Shelton, DirectoT of
Code Compliance, xeparted that D. L. Berry had pedrioned to xezone 1.149 acxe, located on U.S. Highway 29, in
the Westovex Election District from MHP, Residendal Manufactuzed Housing Pask District to B-2, Business
District, General fox future commexcial development — a Family Dollar Store. Adam Levitt, agent foT The
Hutton Company, LLC, was present to repzesent the perition. He stated he had nothing ro add. There was no
opposition to the pednon; however, Mx. Gxegg bfason did voice his concerns which included, but wexe not
limited to, the watex runoff and standing watex. Mx. Levitt then offexed a xebuttal and stated that the State of
Vixginia is on top of this situadon. Mx. Stowe closed the public heaxing at 7:07 p.m. During the discussion, it
was stated this is in compliance with the Compxehensive Plan. A motion was made by Mr. Harville, seconded by
Mx. 1�Sodey, to xecommend the Boaxd of Superoisozs xezone the pxopexty fxom MHP, Residenrial Manufactured
Housing Park Distnct to B-2, Business Distnct, General. Morion passed unanunously.
This concludes the Rezoning case.
Case S-1, Atlene A. Carter, S-12-014 — Mx. Stowe opened the public hearing at 7:08 p.m. Mr. Shelton, Dixector
of Code Compliance, xeparted that Arlene Cartex had petirioned fox a Special Use Permit on 0.46 acre, located
on State Road 939/Bxookside Road, in the Tunstall Election District for a barber shop. Aclene Cartec was
pTesent to represent the petidon. She stated she had nothing to add. Thexe was no opposirion to the perition.
Mr. Stowe closed the public hearing at 7:0J p.m. During the discussion, it was stated the barbex shop would
have a low unpact on the area. A modon was made by Mr. blode��, seconded by 1�1T. Haroille, to cecommend the
Board of Zoning Appeals grant this Special Use Pernvt Motion passed unanimously.
Case S-2, William H. Rogers, Jr.. & Judith R. Rogets S-12-015 — b1T. Stowe opened the public hearing at
7:10 p.m. Mx. Shelton, Dicector of Code Compliance, xeported that William RogeTS, Jz., and Judith Rogers had
petidoned for a Special lise Pernut on 100 feet x 100 feet (10,000 square feet), 0.23 acxe, located ofE State Road
1032/'I'ower Lane, in the Chatham-Blairs Elecrion District fox construction of a 300 foot telecommunicarions
towes, self-suppoxting lattice design, with a thxee (3) foot lightning cod, within a fenced 100 feet x 100 feet
(10,000 squaxe feet) compound for Pittsylvania County Emexgency Management Mx. Rogexs was not pxesent to
repxesent the pedrion; ho�vever, iVls. Shelton stated he would try to answez any questions fxom the Board
membexs. Thexe was no opposirion to the petition. Mr. Stowe closed the public hearing at 7:12 p.m. During
the discussion, it was stated this towez is for the sole use of Pittsylvania County Emergency Management (911).
It was also stated the tower is needed and is impoxtant to the Counry. A modon was made by Mx. Modey,
seconded b5� Mi. Haroille, to iecommend the Boaxd of Zoning Appeals grant this Special Use Pernut Motion
passed unanunously.
This concludes the Special Use Permit cases.
Case V-1, C. Keith Walden, V-12-001- Mr. Stowe opened the public hearing at 7:13 p.m. Mr. Shelton,
D�ector of Code Compliance, repoxted that Keith Walden had petitioned fox a Variance on a rotal of 0.828 acre,
(per plat), two paxcels of land, located on State Road 729/Kentuck Road, in rhe Dan River Elecnon District to
Secrion 35-22G, Minimum Yacd Dunensions, (B.) Side Setback, and Section 35-224. Axea Regulations. (A.)
Minimum Lot Size, of the Pittsylvania Counry Zoning Oxdinance xequesting a variance of two (2) inches side
setback, and a variance of 1,661.24 square feet on GPIN # 2338-63-6835 and 2,271.08 squaxe Eeet on GPIN #
2338-63-6176 in ozder to add a single family dwelling to the e�sting gaxage and divide the pxoperty back into
two (2) sepaxate lots. Fred Shanks was pxesent to represent the pedtion. He stated the peririoned paTcels wexe
tcvo (2) small lots that were adopted before zoning went into effect. Jexry Walkez spoke in opposition to the
peririon. His concerns included, but wexe not limited to, the following: He stated if the vaxiance wexe to be
granted, he felt this would open the door fox future variances to be allowed on other lots in the axea. He also

stated if a small house were allowed to be built on such a small lot, this would h�t the pxoperty values. I�1x.
Stowe closed rhe public hearing at 7:41 p.m. A modon was made by Mx. Welborn, seconded bp Mr. Modey, to
xecommend the Board of Zoning Appeals deny this Vaxiance. b4otion ried by a 3 to 3 vote. A subsutute morion
was made by Mx. Harville, seconded by Ms. Mease, to recommend the Boaxd of Zoning Appeals gcant this
Variance. Motion tied by a 3 to 3 cote. Following discussion, and in order to bTeak the tie and forwaxd the case
to the Boaxd of Zoning ilppeals, one of the Boacd membexs changed his vore to suppart the subsritute modon,
to Tecommend the case be forcvaxded to the Boazd of Zoning Appeals provided that appxoval is given foz a well
and sepric tank by the Health Depaxtment Motion passed by a 4 to 2 vote.
This concludes the Variance case.
Case Z-1, Geo�e Lewis Staton, Z-12-004 — Mr. Stowe opened the public hearing at 7:54 p.m. MT. Shelton,
D'uectoT of Code Compliance, reparted that Geoxge Lewis Staton had peririoned for a Sign Permit on 1.05 acxe,
located on U.S. Highway 58 East/South Boston Highway, in the Dan River Election District foz a 10.9 feet x
23 feet (250.70 squaxe feet), double-sided (total of tcvo (2) panels), off-site adverdsement sign. Aaron Bxady with
The Lamar Company, L.L.C., was pxesent to represent the petition. He stated he had nothing to add. Thexe was

Welborn, seconded by Mx. Harville, ro Tecommend the Board of Zoning Appeals �ant this Sign Permit Morion
passed unanunously.
This concludes the Sign Permit case.

�Ix. Harville stated the coinuiittee had been oxganized to addxess the growing numbex of xesidential axeas with
escessive high gxass �owth. He also stated the couiinitree will try to move forwaxd to start drafting guidelines to
pzesent to the Board of Superoisors.
