09-18-2012 adjourned meetingAdjourned Meeting September 18, 2012 Pittsylvania County Board of Supervisors Tuesday, September 18, 2012 Adjourned Meeting VIRGINIA: The Adjourned Meeting of the Pittsylvania County Board of Supervisors was held on Tuesday, September 18, 2012 in the General District Courtroom of the Edwin R. Shields Addition in Chatham, Virginia. Tim R. Barber, Chairman, called the meeting to order at 7:03p.m. The following members were present: Tim Barber Tunstall District James Snead Dan River District Coy E. Harville Westover District Jessie L. Barksdale Banister District Jerry A. Hagerman Callands-Gretna District Brenda H. Bowman Chatham-Blairs District Marshall Ecker Staunton River District Mr. William D. Sleeper, County Administrator, Mr. J. Vaden Hunt, County Attorney, Mr. Greg L. Sides, Assistant County Administrator for Planning and Development, Mr. Odie Shelton, Jr., and Ms. Rebecca Flippen, Deputy Clerk to the Board, were also present. Mr. Barber led the Pledge of Allegiance. Approval of Agenda Motion was made by Mr. Ecker, seconded by Mr. Snead, to approve the agenda with the following additions/deletions: Additions: (a) Presentation Concerning Centra Health and a Resolution of Support (b) Resolution to Governor Robert McDonnell and State Legislators concerning Local funding for State mandated programs (c) Resolution of Support – Danville Regional Deletions: (a) Item 18 – Performance Agreements-Performance Agreements -(1) Wilkins Reality, Inc. and (2) Three Sisters Properties, Inc. Mr. Ecker’s motion was unanimously approved by the Board. Item 10; West Piedmont Workforce Investment: Update –Presentation to be made by Ms. Kim Adkins, Executive Director of the West Piedmont Workforce Investment Board, and Ms. Laurie Moran, President of the Danville Pittsylvania County Chamber of Commerce and National President for WorkForce Investment; was moved up to allow Ms. Adkins and Ms. Moran to make a brief presentation concerning the WorkForce Investment Program. Hearing of the Citizens Matthew Speck of the Staunton River District read a passage of scripture and offered a word of prayer. Adjourned Meeting September 18, 2012 Hunter Austin of the Staunton River District thanked the Board of Supervisors for all they do to protect the citizens of Pittsylvania County and encouraged the Board to approve a resolution with some guts in it against the mining/milling of uranium in Pittsylvania County. Gloria J. Giovanetti of the Banister District asked that the Board of Supervisors vote to approve a resolution against the mining/milling of uranium in Pittsylvania County. Ms. Giovanetti stated the citizens were very vocal at recent meetings in their opposition of uranium mining/milling here and anywhere else in the Commonwealth. Richard Shumate of the Westover District made comments opposing both the Solid Waste Fee and the mining/milling of uranium in Pittsylvania County. Karen Maute of the Westover District thanked Mr. Barksdale for his comments at the end of the Board’s September 4th meeting and thanked Mr. Hagerman on exposing Senator Stanley. Ms. Maute also encouraged the Board members to approve an updated resolution that supported the continuance of the moratorium banning the mining/milling of uranium. Eloise Nenon of the Chatham-Blairs District made comments: (1) strongly opposing the mining/milling of uranium; (2) unemployed miners who were already licensed that would migrate to the area as opposed to local residents being hired simply because it would take so long for an unlicensed person become licensed and eligible to work; and (3) encouraged the Board to amend and adopt a resolution that supports keeping the current moratorium in place. Valerie Welch of the Chatham-Blairs District, and faculty member at Chatham Hall Academy, made comments supporting uranium mining in the area, stated that after researching current studies, and the fact it is an industry that is strictly regulated by the federal government, that it appeared it could be safely mined. This concluded the Hearing of the Citizens. Consent Agenda Motion was made by Mr. Snead, seconded by Mr. Ecker, to approve the Consent Agenda, which was unanimously approved by the Board. a) Out of State Travel – Finance, Commissioner of Revenue, and Information Technology (b) Regional One – October (c) Resolution – Mount Hermon Volunteer Fire Department – 50th Anniversary (d) Resolution – Brosville Volunteer Fire Department – 50th Anniversary (e) Resolution – Intertape Polymer Group – 25th Anniversary (f) Resolution – Jack Miller (g) Resolution – Clyde Burnette (h) Resolution – Scenic River Designation – Dan River (i) Resolution – Scenic River Designation – Banister River (j) Proclamation – Fire Prevention Week; October 7-13, 2012 (k) Proclamation – County-wide Fall Clean Up Day – September 22, 2012 PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-05 WHEREAS, Mount Hermon Volunteer Fire Department began in the 1950s, as part of a unit that included Westover, Bachelors Hall, Brosville and Tunstall and WHEREAS, in 1962, the unit divided and the Mount Hermon Volunteer Fire Department acquired its own charter; and Adjourned Meeting September 18, 2012 WHEREAS, the Mount Hermon Volunteer Fire Department located in at 4268 Franklin Turnpike and the crew started by E. B. Cassada, Bob Brown, Raymond Haskins and Julian Simmons, where it continues to operate from; and WHEREAS, the 4268 Franklin Turnpike location was chosen as it allowed for four directions – north or south on Highway 41/ Franklin Turnpike, and east or west on State Route 719; and WHEREAS, in the latter part of 1968, the department’s first new pumper truck, in 1975 the department purchased a tanker; and in 1977, a brush truck was purchased and WHEREAS, the Ladies Auxiliary was a vital part in the establishment of fire protection to the Mount Hermon community by helping to raise funds for the department in many ways and their availability to assist with refreshments during lengthy alarms; and WHEREAS, in 1995, EMS service was added and the department then became known as Mount Hermon Volunteer Fire & Rescue; and WHEREAS, in the 50 years they have been a service to the community, the Mount Hermon Volunteer Fire & Rescue has gone from answering an average of 60 calls are year to 650 calls annually; and WHEREAS, the Mount Hermon Volunteer Fire & Rescue provides 24 hours-a-day fire, rescue and emergency medical services to their community and currently has a volunteer crew of 42 and has established an organized program for teen 16-18 that includes training; and WHEREAS, The former Chiefs who faithfully served Mount Hermon Volunteer & Rescue are: Eugene Richardson, Robert Adkerson, Jerome Cook, Lee Holly, Paul Eastridge and Dennis Beamon; and WHEREAS, Ernest Terry became the Chief for Mount Hermon Volunteer Fire & Rescue on August 6, 2012; then BE IT RESOLVED that the Board of Supervisors of Pittsylvania County, on the behalf all of the citizens of Pittsylvania County, congratulate and thank the Mount Hermon Volunteer Fire & Rescue and its members for its 50 years of service to the citizens of Pittsylvania County and the Board of Supervisors wishes the Mount Hermon Volunteer Fire & Rescue and its members a safe and successful future providing protection to the citizens of Pittsylvania County; and BE IT FURTHER RESOLVED that a copy of this Resolution be presented to Mount Hermon Volunteer Fire & Rescue. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-06 WHEREAS, the Brosville Community Volunteer Fire Department will celebrate their 50th anniversary on October 13, 2012; and WHEREAS, Brosville Community Volunteer Fire Department was originally chartered in April 1961 as the Bachelors Hall Volunteer Fire Department as part of a unit that included Westover, Bachelors Hall, Mount Herman, and Tunstall; and Adjourned Meeting September 18, 2012 WHEREAS, in August 1962, Brosville Community Volunteer Fire Department became Station #2 of the Tunstall District Volunteer Fire Department; and WHEREAS, Chartered in 1972, the Brosville Community Volunteer Fire Department continues to operate from its original building, located at 11912 Martinsville Highway, Danville, Virginia, serving their community with both fire and rescue services; and WHEREAS, because of its location, the Brosville Community Volunteer Fire Department has provided a response time of 4-8 minutes anywhere in their response area; and WHEREAS, members of the Brosville Community Volunteer Fire Department are trained in firefighting, rescue and survival work; and WHEREAS, today the Brosville Community Volunteer Fire Department proudly provides fire, rescue and emergency medical services to 4,000 people living in an area of about 42 square miles; and WHEREAS, their department consists of 40 active devoted men and women from the Brosville community, helping serve their families, friends and neighbors, 24 hours a day, 7 days a week; and WHEREAS, the department is headed by Chief Chris Key, a 16-year veteran, who has served as chief for the past 7 years; and WHEREAS, the Brosville Community Volunteer Fire Department has 18 certified firefighters, 25 personnel certified at or above the EMT-B level, including 6 ALS personnel, and is governed by a 15 member Board of Directors; and WHEREAS, training for members of the Brosville Community Volunteer Fire Department include firefighter 1, firefighter 2, fire officer 1, fire officer 2, fire instructor 1, fire instructor 2, haz mat operations, haz mat specialists, EMT basic, EMT intermediate, EMT paramedic, and driver-operator; then BE IT RESOLVED that the Board of Supervisors of Pittsylvania County, on the behalf all of the citizens of Pittsylvania County, congratulate and thank the Brosville Community Volunteer Fire Department and its members for its 50 years of service to the citizens of Pittsylvania County and the Board of Supervisors wishes the Brosville Community Volunteer Fire Department and its members a safe and successful future providing protection to the citizens of Pittsylvania County; and BE IT FURTHER RESOLVED that a copy of this Resolution be presented to Brosville Community Volunteer Fire Department. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-07 VIRGINIA: At an adjourned meeting of the Pittsylvania County Board of Supervisors held in the General District Courtroom in Chatham, Virginia on Tuesday, September 18, 2012, the following resolution was presented and adopted. WHEREAS, Intertape Polymer Group Inc. (IPG) is an acknowledged leader in the packaging industry, assembling the broadest and deepest range of products in the industry; and Adjourned Meeting September 18, 2012 WHEREAS, on March 11, 1987, IPG selected Pittsylvania County as its site to expand their manufacturing operations; and WHEREAS, IPG first began operations in a shell building located in the Ringgold West Industrial Park, hiring approximately 50 workers their first year of operation and an additional 30 workers their second year of operation; and WHEREAS, since their startup in 1987, IPG has had 13 expansions to reach their present capacity, which includes a manufacturing building and warehouse space; and WHEREAS, currently IPG employees 290 people, who process 180 million pounds of raw material per year; and WHEREAS, IPG’s safety rating of 0.09 with OSHA, its ISO 9000 (Quality of Product rating), and 14000 Certification (Environmental rating) demonstrates the exemplary record the company has for the safety of its employees and IPG’s concern for its consumers; then BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors expresses their congratulations to Intertape Polymer Group (IPG) for their 25th anniversary of operation in Pittsylvania County; and BE IT FURTHER RESOLVED, that a copy of this Resolution be presented to IPG at their 25th anniversary celebration on September 19, 2012. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-08 VIRGINIA: At an adjourned meeting of the Pittsylvania County Board of Supervisors held in the General District Courtroom in Chatham, Virginia on Tuesday, September 18, 2012, the following resolution was presented and adopted. WHEREAS, Mr. Jack Miller has served on the Pittsylvania County Board of Assessors; and WHEREAS, Mr. Jack Miller was first appointed to serve on the Pittsylvania County Board of Assessors on September 8, 1992 by Pittsylvania County Board of Supervisors; and WHEREAS, Mr. Miller served as a County representative on the Board of Assessors from his 1992 appointment through his last appointment term that began September 2, 2008; totaling 20 years of service; then BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors expresses their sincere appreciation to Mr. Jack Miller for his outstanding leadership, counseling and expertise on the behalf of the citizens of Pittsylvania County for his service as a representative on the Board of Assessors; and Adjourned Meeting September 18, 2012 BE IT FURTHER RESOLVED, that a copy of this Resolution be presented to Mr. Jack Miller on the behalf of the Pittsylvania County Board of Supervisors. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-09 VIRGINIA: At an adjourned meeting of the Pittsylvania County Board of Supervisors held in the General District Courtroom in Chatham, Virginia on Tuesday, September 18, 2012, the following resolution was presented and adopted. WHEREAS, Mr. Clyde R. Burnette has served on the Pittsylvania County Board of Assessors; and WHEREAS, Mr. Clyde R. Burnette was first appointed to serve on the Pittsylvania County Board of Assessors on September 21, 2004 by Pittsylvania County Board of Supervisors; and WHEREAS, Mr. Burnette served as a County representative on the Board of Assessors from his 2004 appoint thru his last appointment term that began September 2, 2008; totaling 8years of service; then BE IT HEREBY RESOLVED, that the Pittsylvania County Board of Supervisors express their sincere appreciation to Mr. Clyde R. Burnette for his outstanding leadership, counseling and expertise on the behalf of the citizens of Pittsylvania County for his service as a representative on the Board of Assessors; and BE IT FURTHER RESOLVED, that a copy of this Resolution be presented to Mr. Clyde R. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS SCENIC RIVER DESIGNATION – DAN RIVER RESOLUTION 2012-09-10 VIRGINIA: At the adjourned meeting of the Pittsylvania County Board of Supervisors on Tuesday, September 18, 2012 in the General District Courtroom of the Edwin R. Shields Courthouse Addition, the following resolution was presented and adopted: WHEREAS, the Virginia Scenic Rivers Program was enacted by the Virginia General Assembly in 1970 for the purpose of identification, protection, and preservation of certain rivers, or sections of rivers, which possess high quality natural beauty; and WHEREAS, the Virginia Department of Conservation and Recreation has been charged with administering the Scenic Rivers Program and developing an objective evaluation process to judge the suitability of river segments; and Adjourned Meeting September 18, 2012 WHEREAS, elected officials and staff from Pittsylvania County and the City of Danville joined staff from the Virginia Department of Conservation and Recreation to visit the Dan River and evaluate its eligibility for Scenic River designation; and WHEREAS, the Virginia Department of Conservation and Recreation completed its evaluation and determined that the 15 mile segment of the Dan River under review was found to qualify as a Virginia Scenic River; and WHEREAS, the Virginia Board of Conservation and Recreation unanimously supported the endorsement for designation as a Scenic River of the 15 mile segment of the Dan River; then THEREFORE, BE IT RESOLVED, that the Pittsylvania County Board of Supervisors does hereby support the designation of the Dan River from the Berry Hill Bridge at Route 880 in Pittsylvania County to the downstream property boundary of Abreu/Grogan Park in the City of Danville as a Virginia Scenic River; and NOW, THEREFORE, BE IT FURTHER RESOLVED, that Pittsylvania County will contact our General Assembly representatives to request that they serve as patrons for the legislation that will codify the Scenic River designation. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS SCENIC RIVER DESIGNATION – BANISTER RIVER RESOLUTION 2012-09-11 VIRGINIA: At the adjourned meeting of the Pittsylvania County Board of Supervisors on Tuesday, September 18, 2012 in the General District Courtroom of the Edwin R. Shields Courthouse Addition, the following resolution was presented and adopted: WHEREAS, the Virginia Scenic Rivers Program was enacted by the Virginia General Assembly in 1970 for the purpose of identification, protection, and preservation of certain rivers, or sections of rivers, which possess high quality natural beauty; and WHEREAS, the Virginia Department of Conservation and Recreation has been charged with administering the Scenic Rivers Program and developing an objective evaluation process to judge the suitability of river segments; and WHEREAS, several Pittsylvania County residents joined staff from the Virginia Department of Conservation and Recreation to visit the Banister River and evaluate its eligibility for Scenic River designation; and WHEREAS, the Virginia Department of Conservation and Recreation completed its evaluation and determined that the portion of the Banister River under review in Pittsylvania County was found to qualify as a Virginia Scenic River; and WHEREAS, the Virginia Board of Conservation and Recreation supported the endorsement for designation as a Scenic River of a portion of the Banister River; then Adjourned Meeting September 18, 2012 THEREFORE, BE IT RESOLVED, that the Pittsylvania County Board of Supervisors does hereby support the designation of the Banister River, from the Anderson Bridge at Route 640 in Pittsylvania County to the point where the Banister River leaves the County at the Pittsylvania/Halifax County line, as a Virginia Scenic River; and NOW, THEREFORE, BE IT FURTHER RESOLVED, that Pittsylvania County will contact our General Assembly representatives to request that they serve as patrons for the legislation that will codify the Scenic River designation. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS PROCLAMATION NATIONAL FIRE PREVENTION WEEK October 7-13, 2012 “HAVE TWO WAYS OUT!” WHEREAS, the County of Pittsylvania is committed to ensuring the safety and security of all those living in and visiting our state; and WHEREAS, fire is a serious public safety concern both locally and nationally, and homes are the locations where people are at greatest risk from fire; and WHEREAS, home fires killed more than 2,600 people in the United States in 2010, according to the latest research from the nonprofit National Fire Protection Association (NFPA), and fire departments in the United States responded to more than 369,000 home fires; and WHEREAS, residents who have planned and practiced a home fire escape plan are more prepared and will therefore be more likely to survive a fire; and WHEREAS, only one-third of Americans have both developed and practiced a home fire escape plan, and WHEREAS, almost three-quarters of Americans do have an escape plan; however, less than half have actually practiced it, and WHEREAS, one-third of Americans households who made one and estimate they thought they would have at least 6 minutes before a fire in their home would become life threatening. The time available is often less, and WHEREAS, working smoke alarms cut the risk of dying in reported home fires in half; and WHEREAS, Pittsylvania County’s first responders are dedicated to reducing the occurrence of home fires and home fire injuries through prevention and protection education; and WHEREAS, Pittsylvania County residents are responsive to public education measures and are able to take personal steps to increase their safety from fire, especially in their homes; and WHEREAS, the 2012 Fire Prevention Week theme, “Have Two Ways Out!” effectively serves to remind us to develop and practice a home fire escape plans during Fire Prevention Week and year- round; then Adjourned Meeting September 18, 2012 THEREFORE, the Pittsylvania County Board of Supervisors do hereby proclaim October 7-13, 2012, as Fire Prevention Week throughout this County, and urge all the citizens of Pittsylvania County to practice their home fire escape plan during Fire Prevention Week 2012, and to support the many public safety activities and efforts of the County of Pittsylvania fire and emergency services. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS PROCLAMATION COUNTYWIDE FALL CLEANUP September 22, 2012 Whereas, the Beautification Committee of the Pittsylvania County Board of Supervisors has organized a countywide cleanup to ensure clean and beautiful roads in Pittsylvania County; and Whereas, the Fall Cleanup encourages communities, civic and professional groups, businesses, churches, schools, families and individual citizens to participate in the cleanup by sponsoring and organizing local roadside cleanup events; and Whereas, the great natural beauty of Pittsylvania County and a clean environment are sources of pride for all citizens of Pittsylvania County, attracting tourists and other entities to our locality; and Whereas, the cleanup will increase awareness of the need for cleaner roadsides, emphasize the importance of not littering and encourage recycling of solid wastes; and Whereas, the Fall Cleanup will be a part of educating the children of our great county regarding the importance of a clean environment to the quality of life in Pittsylvania County; then Now, Therefore, Be It Proclaimed, that the Pittsylvania County Board of Supervisors proclaims Saturday, September 22, 2012 to be Countywide Fall Cleanup Day in Pittsylvania County, Virginia, and encourages all communities, civic and professional groups, businesses, churches, schools, families and individual citizens to take an active role in making the communities in Pittsylvania County cleaner. Public Hearing Rezoning Cases: Case 1: D. L. Berry – Westover District; R-12-036 MHP, Residential Manufactured Housing Park District to B-2, Business District, General. Mr. Barber opened the public hearing at 7:42pm. Mr. Shelton explained that D. L. Berry had petitioned to rezone 1.149 acre, located on U.S.Highway 29 in the Westover Election District from MHP, Residential Manufactured Housing Park District to B-2, Business District, General (for future commercial development – Family Dollar Store). The Planning Commission, with no opposition, recommended granting the petitioner’s request. Adam Levitt, agent for The Hutton Company LLC was there to represent the petition. No one signed up to speak and Mr. Barber closed the public hearing at 7:43pm. Motion was made by Mr. Harville, seconded by Mr. Snead, to approve rezoning Case R-12-036 from MHP to B-1 and the following Roll Call Vote was Adjourned Meeting September 18, 2012 recorded: Mr. Ecker-Yes; Mr. Harville-Yes; Mr. Snead-Yes; Mr. Barksdale-Yes; Mr. Hagerman- Yes; Ms. Bowman-Yes; and Mr. Barber-Yes. The Board unanimously approved Mr. Harville’s motion to rezone Case R-12-036 from MHP to B-1. This concluded the Rezoning Cases and the Public Hearings. Item (a) under Items to be Added was heard at this time. Mr. E.W. Tibbs, of Centra Health, Lynchburg, Virginia, facilitated a presentation to the Board about a proposed health care facility Centra Health plans to build in Gretna, Virginia. Centra Health requested the Board to provide them with a Resolution of Support in Centra Health’s application for a Certificate of Public Need to the Virginia State Health Commission for CT services to be located at the facility they propose to build in Gretna, Virginia. After discussion, motion was made by Mr. Hagerman, seconded by Mr. Ecker, to approve Resolution 2012-09-12, which was unanimously approved by the Board. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-12 VIRGINIA: At their adjourned meeting of the Pittsylvania County Board of Supervisors held in the General District Courtroom of the Edwin R. Shields Courthouse Addition in Chatham, Virginia on Tuesday, September 18, 2012, the following resolution was presented and adopted: WHEREAS, the Pittsylvania County Board of Supervisors feels there is a significant need in their county for a medical service center; and WHEREAS, the Pittsylvania County Board of Supervisors, during the development of a comprehensive plan for the future of Pittsylvania County, realized a need for emergency and regular medical care facilities to be located in the urbanizing areas of Pittsylvania County, included but not limited to, the incorporated areas of the Towns of Chatham, Gretna, and Hurt; and WHEREAS, Centra Health of Lynchburg, Virginia has plans to expand their medical services facilities south to the area of Gretna, Virginia; and WHEREAS, Pittsylvania County, the largest county in Virginia in land area, lies between Lynchburg and Danville, and has no outpatient surgery or 24 hour emergency center within its boundaries; therefore BE IT HEREBY RESOLVED that the the Pittsylvania County Board of Supervisors supports efforts by Centra Health providers to establish facilities providing CT and associated diagnostic services for the citizens of Pittsylvania County, Franklin County, Halifax County, Henry County, Campbell County, and the Cities of Martinsville and Danville; and BE IT FURTHER RESOLVED that the Board of Supervisors supports Centra Health in their application for a Certificate of Public Need to the Virginia State Health Commission for CT services to be located at the facility proposed by Centra Health in Pittsylvania County. Adjourned Meeting September 18, 2012 Unfinished Business At the regular meeting of the Board of Supervisors on September 4, 2012, a motion was made by Mr. Harville, seconded by Mr. Hagerman, for the reappropriation of funds as follows: $197.50 to Sheriff-Travel (100-4-031200-5500), $60.00 to Sheriff-Parts (100-4-031200-6030), $1,860.93 to Jail-Extradition (100-4-033100-5550), $8.20 to Library-VRS (100-4-073100-2210), $12,982.14 to WIA-Rent (251-4-353160-5420) and $3,495.97 to Jail Inmate Management- Vehicles (311-4-033400-8105). This motion required a 10-Day Layover that had now been met. The following Roll Call Vote was recorded: Mr. Harville-Yes; Mr. Snead-Yes; Mr. Barksdale- Yes; Mr. Hagerman-Yes; Ms. Bowman-Yes; Mr. Ecker-Yes; and Mr. Barber-Yes. Mr. Harville’s motion was unanimously approved by the Board. At the regular meeting of the Board of Supervisors on September 4, 2012, a motion was made by the Property & Building Committee to appropriate up to $50,000 from unappropriated surplus for repair work in the Courthouse, Commissioner of Revenues’ Office, and Treasurer’s Office as a result from the Air Quality study. This motion required a 10-Day Layover that had now been met. This motion required a 10-Day Layover that had now been met. New Business Motion came from the Legislative Committee to set a public hearing date of October 16, 2012 to receive citizen input on a proposed amendment to Section 9-53 of the Pittsylvania County Code to increase Department of Motor Vehicle Stop Fees from $20 to $30, which was unanimously approved by the Board. Motion came from the Finance Committee to approve a Letter of Engagement with Davenport & Company for underwriter services related to the refinancing of the County’s General Obligation School Refunding Notes, Series 2010A, which was unanimously approved by the Board. Motion was made by Mr. Ecker, seconded by Mr. Hagerman, to authorize the County Administrator to amend or re-submit as needed, an application to the Tobacco Commission for the current grant funding the Klopman Mills Complex Sanitary Sewer Project, which was unanimously approved by the Board. Motion was made by Mr. Harville, seconded by Ms. Bowman, to authorize the County Administrator to issue Requests For Proposals to go to bid for the Orphanage Road/Jefferson Road Waterline Project, which was unanimously approved by the Board. Motion was made by Mr. Snead, seconded by Ms. Bowman, to set a public hearing date of October 16, 2012 to receive citizen input on the County’s intent to surplus property located at 485 Milton Highway, Ringgold, Virginia, which was unanimously approved by the Board. Added Items Motion was made by Mr. Ecker, seconded by Mr. Snead, to approve Resolution 2012-09- 13, concerning local funding for state mandated programs, and authorize the County Administrator to forward a copy of this resolution to the Honorable Robert F. McDonnell, Governor of the Commonwealth of Virginia, and to the Legislators of the Commonwealth, which was unanimously approved by the Board. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-13 VIRGINIA: At an adjourned meeting of the Pittsylvania County Board of Supervisors held in the General District Courtroom in Chatham, Virginia on Tuesday, September 18, 2012, the following resolution was presented and adopted. WHEREAS, state financial assistance for mandated and high priority programs, including public education, health and human services, public safety and constitutional officers, was $800 million less in FY 12 than in FY09 and almost $500 million less in FY13 than in FY09; and WHEREAS, cities and counties must balance their budgets during a time in which future state assistance in unreliable, federal stimulus dollars are depleted, and real estate assessments are either stagnant or in decline; and WHEREAS, the Appropriation Act contains $50 million in across-the-board cuts to cities and counties for FY13 and $45 million in FY14, under which localities are required to either elect to take reductions in particular state aid programs, or to send the State a check for the amounts determined by the Department of planning and Budget (“Local Aid to the Commonwealth”); and WHEREAS, the reductions are applied to essential services, including law enforcement, jail administration, foster care and child protective services, election administration and social services; and Adjourned Meeting September 18, 2012 WHEREAS, the state budget cuts are not accompanied by any reductions in state- imposed mandates, standards and service requirements, nor do they provide any administrative flexibility for local agencies; and WHEREAS, Virginia’s cities and counties will have provided the State with $270 million by the close of FY13 for this “Local Aid to the Commonwealth” program; and WHEREAS, these reductions shift state costs to local taxpayers and artificially increase the amount of State surplus revenue; and WHEREAS, state revenues have continued to recover and the State has experienced a budget surplus for the third consecutive year; and WHEREAS, revenue collections for the County of Pittsylvania continue to reflect the struggling housing market and consumer trepidation; and WHEREAS, the State should not shift its share of the costs for mandates and responsibilities to local governments; now THEREFORE, BE IT RESOLVED THAT the County of Pittsylvania Board of Supervisors asked Governor Robert McDonnell to submit a budget amendment to the 2013 session of the General Assembly to reverse the $50 million-a-year reduction for the current year, FY13, and to eliminate the aide to localities reduction in FY14; and further BE IT FURTHER RESOLVED THAT the members of the General Assembly are called upon to support a budget amendment for the 2013 session of the General Assembly to reverse the $50 million-a-year reduction for the current year, FY13, and to eliminate the aid to localities reduction in the budget for FY14. Motion was made by Mr. Barksdale, seconded by Mr. Snead, to approve Resolution 2012-09-14, supporting Danville Regional’s application to the Virginia State Health Department for a Certificate of Public Need to place a CT scanner at their Chatham location, which was unanimously approved by the Board. PITTSYLVANIA COUNTY BOARD OF SUPERVISORS RESOLUTION 2012-09-14 RESOLUTION SUPPORTING DANVILLE REGIONAL MEDICAL IN THE ESTABLISHMENT OF DIAGNOSTIC SERVICES INCLUDING COMPUTED TOMOGRAPHY (CT) SERVICES IN PITTSYLVANIA COUNTY. VIRGINIA: At their adjourned meeting of the Pittsylvania County Board of Supervisors held in the General District Courtroom of the Edwin R. Shields Courthouse Addition in Chatham, Virginia on Tuesday, September 18, 2012, the following resolution was presented and adopted: WHEREAS: Pittsylvania County is the most populous county in Planning District 12, and the largest county in the Commonwealth of Virginia; and Adjourned Meeting September 18, 2012 WHEREAS, the Pittsylvania County Board of Supervisors supports initiatives to improve the accessibility and scope of medical services for County citizens, and WHEREAS, CT is a diagnostic service that is frequently used by physicians to assess various significant medical conditions, and its availability in Pittsylvania County will permit County residents to remain in their communities for this basic medical service, and WHEREAS, the Pittsylvania County Board of Supervisors supports initiatives that will promote economic development in the County, then NOW, THEREFORE BE IT RESOLVED that the Pittsylvania County Board of Supervisors supports Danville Regional Medical Center in their application for a Certificate of Public Need to the Virginia State Health Commission for a CT scanner to be located at the facility in the Chatham area of Pittsylvania County; and FURTHER BE IT RESOLVED that the Board endorses and supports improvements that result in enhanced medical service to area residents and therefore urges approval of such actions by any and all agencies with jurisdiction over medical service delivery. Board Announcements Mr. Snead reminded everyone of the NAACP Annual Banquet that would be held on the upcoming Saturday evening. Ms. Bowman reminded everyone of the County Wide Fall Clean Up that would be held on the upcoming Saturday. Mr. Ecker stated there should be a public notice in the papers for the citizens to know the County’s current reassessment is going on and there would be appraisers out in their area.
