MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Thursday, August 9, 2012, in the General
District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00
p.m. Mr. Stowe called the roll.

APPROVAL OF THE MINUTES
A motion was made by Mr. Motley, seconded by Ms. Mease, and by unanimous vote the July 3, 2012, minutes
were approved as presented.

Case 1, Ronnie G. Warren & Anna W. Warren, R-12-031 – Mr. Stowe opened the public hearing at 7:02 p.m.
Mr. Shelton, Director of Code Compliance, reported that Ronnie and Anna Warren had petitioned to rezone
14.02 acres, located on State Road 854/Locust Drive, in the Tunstall Election District from R-1, Residential
Suburban Subdivision District to A-1, Agricultural District, to subdivide a lot for their son. Ronnie Warren was
present to represent the petition. He stated he had nothing to add. There was no opposition to the petition.
Mr. Stowe closed the public hearing at 7:03 p.m. A motion was made by Mr. Motley, seconded by Mr.
Weatherford, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District. Motion passed unanimously.
Case 2, Hattie Cabiness Wilson (Deceased), R-12-032 – Mr. Stowe opened the public hearing at 7:04 p.m.
Mr. Shelton, Director of Code Compliance, reported that the family of Hattie Cabiness Wilson (Deceased) had
petitioned to rezone 1.79 acre, located on State Road 612/Wyatt Farm Road, in the Tunstall Election District
from R-1, Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent
with the adjacent parcel of land and for future sale of the property. Glenda Ann Wilson was present to represent
the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the
public hearing at 7:05 p.m. During the discussion, it was stated that another parcel in the immediate area had
been rezoned from R-1 to A-1. A motion was made by Mr. Motley, seconded by Mr. Arthur, to recommend the
Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District to A-1,
Agricultural District. Motion passed unanimously.
Case 3, Michael John Sauer, R-12-033 – Mr. Stowe opened the public hearing at 7:06 p.m. Mr. Shelton,
Director of Code Compliance, reported that Michael John Sauer had petitioned to rezone 37.42 acres, located on
State Road 750/Whitmell School Road, in the Chatham-Blairs Election District from R-1, Residential Suburban
Subdivision District to RC-1, Residential Combined Subdivision District to allow for placement of a second
dwelling, a modular home, on the property. Michael Sauer was present to represent the petition. He stated he
had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:07 p.m.
During the discussion, it was stated there are parcels of land at the front and back of the petitioned parcel that
are zoned RC-1 and a mobile home park is located in the immediate area. A motion was made by Mr. Motley,
seconded by Ms. Mease, to recommend the Board of Supervisors rezone the property from R-1, Residential
Suburban Subdivision District to RC-1, Residential Combined Subdivision District. Motion passed unanimously.
Case 4, Willie Morgan Allen, Jr., & Joyce M. Allen, R-12-034 - Mr. Stowe opened the public hearing at 7:08
p.m. Mr. Shelton, Director of Code Compliance, reported that Willie Allen, Jr., and Joyce Allen had petitioned
to rezone 3.57 acres, located on State Road 628/Harmony Road, in the Staunton River Election District from
R-1, Residential Suburban Subdivision District to A-1, Agricultural District to make the zoning consistent with
the adjacent parcel of land zoned A-1. Attorney James Kent was present to represent the petition. He stated he
had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:09 p.m.
A motion was made by Mr. Arthur, seconded by Mr. Welborn, to recommend the Board of Supervisors rezone
the property from R-1, Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed
unanimously.
Case 5, Michael Allen Mayhew, R-12-035 - Mr. Stowe opened the public hearing at 7:10 p.m. Mr. Shelton,
Director of Code Compliance, reported that Michael Mayhew had petitioned to rezone 3.96 acres, located on
State Road 628/Harmony Road, in the Staunton River Election District from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District to make the zoning consistent with the adjacent parcel of land
zoned A-1. Attorney James Kent was present to represent the petition. He stated he had nothing to add.
There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:11 p.m. A motion was made

by Mr. Arthur, seconded by Mr. Harville, to recommend the Board of Supervisors rezone the property from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District. Motion passed unanimously.
This concludes the Rezoning cases.
Case S-1, Audrie Gale Meadows, S-12-012 – Mr. Stowe opened the public hearing at 7:12 p.m. Mr. Shelton,
Director of Code Compliance, reported that Audrie Gale Meadows had petitioned for a Special Use Permit on
1.00 acre, located on State Road 681/Mountain Road, in the Banister Election District for placement of a single-
wide mobile home for her personal residence. Audrie Meadows was present to represent the petition. She
stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the public hearing at
7:13 p.m. A motion was made by Ms. Mease, seconded by Mr. Harville, to recommend the Board of Zoning
Appeals grant this Special Use Permit. Motion passed unanimously.
Case S-2, Richard Allen Holland & Tondia Brafford Holland, S-12-013 – Mr. Stowe opened the public
hearing at 7:14 p.m. Mr. Shelton, Director of Code Compliance, reported that Richard and Tondia Holland had
petitioned for a Special Use Permit on 100 feet x 100 feet (10,000 square feet), part of 111.55 acres, located off
State Road 1098/Bowl Drive, in the Chatham-Blairs Election District for construction of a 195 foot
telecommunications tower, monopole design, with a four (4) foot lightning rod, within a fenced 75 feet x 75 feet
(5,625 square feet) compound for NTelos Wireless. Debbie Balser, Agent for NTelos Wireless, was present to
represent the petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe
closed the public hearing at 7:15 p.m. During the discussion, it was stated that family members live around the
area and the proposed site for the tower is in the middle of a soybean field. A motion was made by Mr. Motley,
seconded by Mr. Harville, to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion
passed unanimously.
This concludes the Special Use Permit cases.
Case Z-1, Rickey Lee Berkley, II, Z-12-001 – Mr. Stowe opened the public hearing at 7:16 p.m. Mr. Shelton,
Director of Code Compliance, reported that Rickey Lee Berkley, II, had petitioned for a Sign Permit on 2.51
acres, located on U.S. Highway 58 East/South Boston Highway, in the Dan River Election District for an
8 feet x 20 feet (160 square feet), double-sided (total of four (4) panels), off-site advertisement sign. Henry
Sasser with DI-MAC Outdoor, Inc., was present to represent the petition. He stated he had nothing to add. Mr.
Sasser was then questioned as to whether the sign would be non-illuminated and he stated that the sign would
not be lighted. He also stated the sign would be twelve (12) feet from ground level to the bottom of the sign, it
would not be inside a fenced-in area, and it would be on a unipole approximately 100 feet – 125 feet off the
highway right-of-way. There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:17 p.m.
During the discussion, it was stated the area has become extremely commercialized. A motion was made by Mr.
Welborn, seconded by Mr. Arthur, to recommend the Board of Zoning Appeals grant this Sign Permit. Motion
passed unanimously.
Case Z-2, W. David Lester & Robin L. Lester, Z-12-002 – Mr. Stowe opened the public hearing at 7:18 p.m.
Mr. Shelton, Director of Code Compliance, reported that David and Robin Lester had petitioned to request the
Board of Zoning Appeals remove Condition #2 attached to Case Z-11-001 for a Sign Permit, which reads as
follows: Sign location shall be moved as far north as VDOT regulations and sound engineering practices allow.
Al Harkins with Capital Outdoor Advertising was present to represent the petition. He stated he had nothing to
add. Mr. Harkins then explained an adjacent property owner no longer had issues concerning the location of the
sign on the south end of the petitioned parcel. He also stated the pole will be 51 feet from the side property line,
52 feet east of the edge of the highway right-of-way, and the sign will be inside a fenced area with barbed wire.

There was no opposition to the petition. Mr. Stowe closed the public hearing at 7:21 p.m. A motion was made
by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals grant the request to
remove Condition #2 attached to Case Z-11-001 for a Sign Permit. Motion passed unanimously.
Case Z-3, David Anderson Long, Jr., Z-12-003 – Mr. Stowe opened the public hearing at 7:22 p.m. Mr.
Shelton, Director of Code Compliance, reported that David Long had petitioned for a Sign Permit on 6.85 acres,
located on U.S. Highway 58 West/Martinsville Highway, in the Tunstall Election District for a 12 feet x 37 feet
(444 square feet), double-sided (total of four (4) panels), off-site advertisement sign. David Long was present to
represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe
closed the public hearing at 7:23 p.m. During the discussion, it was stated this is a rapidly growing intersection.
A motion was made by Mr. Motley, seconded by Mr. Weatherford, to recommend the Board of Zoning Appeals
grant this Sign Permit. Motion passed unanimously.
This concludes the Sign Permit cases.
OLD BUSINESS
There was no old business.
NEW BUSINESS
Mr. Harville made a recommendation to the Board that the Zoning Ordinance be reviewed regarding all signs in
order to keep Pittsylvania County clean. He cited an example of this on the bypass where there are more signs
but less business revenue for the County. He also recommended to the Board that a committee be organized
regarding the growing number of residential areas with excessive high grass growth. He stated the County needs
to take control of this problem, and he suggested that the committee draft guidelines to present to the Board of
Supervisors. Mr. Stowe stated these concerns will be addressed at the next meeting.
The meeting was adjourned at approximately 7:30 p.m.
