MINUTES
VIRGINIA: The Pittsylvania County Planning Commission met on Tuesday, July 3, 2012, in the General
District Courtroom, Chatham, Virginia. Mr. Stowe, Chairman, called the meeting to order at approximately 7:00
p.m. Mr. Stowe called the roll.

APPROVAL OF THE MINUTES
A motion was made by Mr. Motley, seconded by Mr. Harville, and by unanimous vote the June 5, 2012, minutes
were approved as presented.

Case 1, Dry Creek Properties, LLC, R-12-027 – Mr. Stowe opened the public hearing at 7:01 p.m. Mrs.
Hayes, Code Compliance Officer/Deputy Zoning Administrator, reported that Dry Creek Properties, LLC, had
petitioned to rezone 0.42 acre located on State Road 1031/Suburban Drive, in the Westover Election District
from R-1, Residential Suburban Subdivision District to B-2, Business District, General to make the zoning
consistent with the adjacent parcel zoned B-2 and for future sale of the property. Ramsey Yeatts was present to
represent the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe
closed the public hearing at 7:01 p.m. During the discussion, it was stated this is consistent with the surrounding
area. A motion was made by Mr. Weatherford, seconded by Mr. Harville, to recommend the Board of
Supervisors rezone the property from R-1, Residential Suburban Subdivision District to B-2, Business District,
General. Motion passed unanimously.
Case 2, Donna L. Byrd, R-12-028 – Mr. Stowe opened the public hearing at 7:02 p.m. Mrs. Hayes, Code
Compliance Officer/Deputy Zoning Administrator, reported that Donna Byrd had petitioned to rezone 40.85
acres located on State Road 668/Level Run Road, in the Staunton River Election District from R-1, Residential
Suburban Subdivision District to A-1, Agricultural District for agricultural use (horses and cattle) and to make
the zoning consistent with the adjacent parcels of land zoned A-1. Donna Byrd was present to represent the
petition. She stated she had nothing to add. There was no opposition to the petition. Mr. Stowe closed the
public hearing at 7:03 p.m. During the discussion, it was stated there is a lot of agricultural land in the area and
this is consistent with the surrounding area. A motion was made by Mr. Arthur, seconded by Dr. Miller, to
recommend the Board of Supervisors rezone the property from R-1, Residential Suburban Subdivision District
to A-1, Agricultural District. Motion passed unanimously.
Case 3, Randolph B. Chandler, R-12-029 – Mr. Stowe opened the public hearing at 7:04 p.m. Mrs. Hayes,
Code Compliance Officer/Deputy Zoning Administrator, reported that Randolph Chandler had petitioned to
rezone 7.64 acres located off State Road 924/Pocket Road, in the Staunton River Election District from R-1,
Residential Suburban Subdivision District to A-1, Agricultural District to combine with the adjacent parcel of
land zoned A-1. Mr. Chandler was present to represent the petition. He stated he had nothing to add. Mr.
Arthur questioned Mr. Chandler regarding the right-of-way as well as access to the property and location. Mr.
Chandler then presented Mr. Arthur with a plat showing the location of the petitioned parcel of land. There was
no opposition to the petition. Mr. Stowe closed the public hearing at 7:09 p.m. During the discussion, it was
stated this is consistent with the surrounding area. A motion was made by Mr. Arthur, seconded by Mr.
Welborn, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban
Subdivision District to A-1, Agricultural District. Motion passed unanimously.
Case 4, Russell A. Eades, R-12-030 – Mr. Stowe opened the public hearing at 7:10 p.m. Mrs. Hayes, Code
Compliance Officer/Deputy Zoning Administrator, reported that Russell Eades had petitioned to rezone 2.10
acres located off State Road 668/Grit Road, in the Staunton River Election District from R-1, Residential
Suburban Subdivision District to MHP, Residential Manufactured Housing Park District to combine with the
adjacent parcel of land zoned MHP. Russell Eades was present to represent the petition. He stated he needed
the two (2) acres rezoned in order to extend the drain field. Mr. Arthur then questioned Mr. Eades regarding the
necessity of rezoning the property in order to extend the drain field for the mobile home park. Mr. Eades then
stated if he should decide to sell the mobile home park in the future, he would like for the properties to have the
same zoning. Mr. Harville then questioned Mr. Eades as to whether he was adding to the plat, and Mr. Eades
responded that he was going to combine the petitioned parcel of land into one tract with the existing mobile
home park. There was no opposition to the petition. A motion was made by Mr. Arthur, seconded by Mr.
Motley, to recommend the Board of Supervisors rezone the property from R-1, Residential Suburban
Subdivision District to MHP, Residential Manufactured Housing Park District. Motion passed unanimously.

Case S-1, Teresa Darlene Wiegand, S-12-008 – Mr. Stowe opened the public hearing at 7:14 p.m. Mrs. Hayes,
Code Compliance Officer/Deputy Zoning Administrator, reported that Teresa Wiegand had petitioned for a
Special Use Permit on 1.32 acres, located on State Road 665/Rockford School Road, in the Staunton River
Election District for non-emergency medical transport. Teresa Wiegand was present to represent the petition.
She stated she had nothing to add. Mr. Arthur questioned Ms. Wiegand regarding the number of vehicles and
the location of the vehicles used in the operation of her business. She then stated she has a total of fourteen (14)
vehicles used in her business, the business is located out of her home, and the drivers take turns driving the
vehicles to their respective homes. There was no opposition to the petition. Mr. Stowe closed the public
hearing at 7:15 p.m. A motion was made by Mr. Arthur, seconded by Mr. Harville, to recommend the Board of
Zoning Appeals grant this Special Use Permit. Motion passed unanimously.
Case S-2, Stephen Van Hanks, S-12-009 – Mr. Stowe opened the public hearing at 7:16 p.m. Mrs. Hayes,
Code Compliance Officer/Deputy Zoning Administrator, reported that Stephen Hanks had petitioned for a
Special Use Permit on 1.50 acre, located on Reese Loop Road, in the Callands-Gretna Election District for
placement of a single-wide mobile home for his daughter’s residence. Stephen Hanks was present to represent
the petition. He stated he had nothing to add. There was no opposition to the petition. Mr. Stowe closed the
public hearing at 7:17 p.m. During the discussion, it was stated there are other mobile homes in the area. A
motion was made by Ms. Mease, seconded by Mr. Motley, to recommend the Board of Zoning Appeals grant
this Special Use Permit. Motion passed unanimously.
Case S-3, William Elwood Wilmoth & Laverne Gayle Wilmoth, S-12-010 – Mr. Stowe opened the public
hearing at 7:17 p.m. Mrs. Hayes, Code Compliance Officer/Deputy Zoning Administrator, reported that
William and Laverne Wilmoth had petitioned for a Special Use Permit on 100 x 100 feet (10,000 square feet),
part of 46.39 acres, located on State Road 735/Cedar Road, in the Dan River Election District for construction
of a170 foot telecommunications tower, monopole design, with a three (3) foot lightning rod, within a fenced 59
x 59 feet (3,481 square feet) compound for NTelos Wireless. Debbie Balser, Agent for NTelos Wireless, was
present to represent the petition. She stated she had nothing to add. There was no opposition to the petition.
Mr. Stowe closed the public hearing at 7:18 p.m. A motion was made by Mr. Welborn, seconded by Mr. Arthur,
to recommend the Board of Zoning Appeals grant this Special Use Permit. Motion passed unanimously.
Case S-4, Florence Hudson Holley, S-12-011 – Mr. Stowe opened the public hearing at 7:19 p.m. Mrs. Hayes,
Code Compliance Officer/Deputy Zoning Administrator, reported that Florence Holley had petitioned for a
Special Use Permit on 100 x 100 feet (10,000 square feet), part of 97.34 acres, located off State Road 718/Dry
Fork Road, in the Tunstall Election District for construction of a 199 foot telecommunications tower, monopole
design, within a 75 x 75 feet (5,625 square feet) compound for Central States Tower, LLC. Tony Stewart, Agent
for Central States Tower, LLC, was present to represent the petition. He stated he had met with Mr. Johnson,
the school and the church concerning the proposed location for the tower, and everyone was satisfied. There
was no opposition to the petition. Mr. James Gauldin, an adjacent property owner, stated if Mr. Johnson and
everyone at the school is happy, then he is happy. Mr. Stowe closed the public hearing at 7:21 p.m. During the
discussion, it was stated that no calls had been received in opposition to the petition. A motion was made by Mr.
Harville, seconded by Mr. Arthur, to recommend the Board of Zoning Appeals grant this Special Use Permit.
Motion passed unanimously.
